(i) The particulars of its organization, functions andduties.
Particulars:
Name of the organization:
The office of the “ District and Sessions Court, Nagpur.”
The organization is subordinate institution of the HighCourt of Judicature at Bombay.
Functions of the organization:
The organization has its two functions.
(i) Judicial function and
(ii) Administrative function
Duties of the organization :
(i) To exercise the control over all it's subordinate courtsfunctioning in it’s territorial jurisdiction i.e. Nagpurdistrict.
(ii) To distribute the various grants amongst it’s subordinate authorities received from the government from time to time.
(iii) To deal with all correspondence relating to theSupreme Court of India, the High court of Bombay,Department of law and judiciary and Government ofMaharashtra.
(iv) To administer justice as per the various laws.
(v) To recruit Class-III and Class IV Government servantsas per rules.
(vi) To promote the officials to the higher responsibleposts as per service rules.
(vii) To handle the administration in view of the procedurallaws, the Maharashtra Civil Services Rules, theGovernment resolutions and the notifications issued bythe high court from time to time.
(viii) In exercise the duties of administrative nature, theorganization deals with the duties of its employeestransfer of its employees, holding departmentalexaminations, and departmental inquiries of theemployees etc
The Head of the organization:
The Principal District and Sessions Judge is the headof the organization and also the Chairman of the Districtlegal Services Authority, Nagpur under which the Lok-Adalats, Seminars legal awareness programmes,Conferences on various legal subjects are being heldunder his supervision.
In order to improve the work of the Judicial Officersand employees, the workshops are being held, under thedirections of the Hon'ble High Court.
The Principal District and Sessions Judge isdesignated as Special court under the provisions ofPrevention of Money Lending Act, 2002.
The Principal District and Sessions Judge is also theChairman of the Motor Accident Claims Tribunal.
The Principal District and Sessions Judge isempowered under Wakf Act for determination of disputes,questions and other matters relating to a Wakf or Wakfproperty under the said Act.
(ii) The power and duties of its officers andemployees.
There are following cadres of the judicial officers:
(i) District Judges and Additional Sessions Judges.
(ii) Ad-hoc District Judges and Additional Sessions Judges.
The above judicial officers deal with both civil andcriminal matters pertaining to the original side andappellate side and criminal cases triable by the court ofsessions only and also the matter under special acts.
The Appeals in which the suits are valued upto Rs.10 Lacs are heard & decided by the District Court.
Some District Judges are also designated courts underMCOC and TADA Act.
iii) Motor Accident Claims Tribunal
Motor Accident Claims Tribunal deals with MotorAccident Claims petitions.
(iv) The Civil Judges Senior Division:
The above Judicial officers deal with the matters ofCivil nature having unlimited pecuniary jurisdiction abovefive lacs.
The suits against the Government, MarriagePetitions, Land Acquisition Cases and also heard anddecided by these Judicial officers.
(v) Judges, Small Causes Court,
The above Judicial officers deal with the mattersunder the provincial Small Cause Courts Act, 1887 andthe provisions of Maharashtra Rent Control Act, 1999.
(vi) The Chief Judicial Magistrates:
To deal with all types of Criminal matters excludingthe cases triable by the Court of Sessions.
(vii) The Civil Judges (Junior Division)
To deal with the matters of Civil nature havingpecuniary jurisdiction up to Rs. Five lacs.
Two Special Corporation Courts are appointed todeal with the matter pertaining to Corporation Disputes.
(viii) Judicial Magistrate, First Class
To deal with the matters of criminal nature excludingthose triable by the Court of Sessions and the caseshaving exclusive jurisdiction by the Chief JudicialMagistrate and the Special Courts.
Motor Vehicle Court for offenses under Motor Vehicles Actis constituted for Nagpur. Railway Court are constitutedfor offenses under the jurisdiction of Railway Police,Nagpur.
(ix) Juvenile Justice Board
It is constituted for Nagpur Judicial district at HeadQuarter Nagpur for the trial of cases of the Juvenile inconflict with law under Sec. 4 of the Juvenile Justice(Care and Protection of Children) Act, 2000 Smt. N. N.Bedarkar, 6th Jt. Civil Judge, Jr. Dn. & J.M.F.C.,Nagpur isappointed as I/C Principal Magistrate to preside over theJuvenile Justice Board on each Thursday & Friday. Thereis a Railway Court having jurisdiction from Nagpur toBadnera, Nagpur to Ballarshah, Nagpur to Gondia.

Superintendent:
To supervise the work of the employees of theirrespective branch i.e. Judicial Branch, Cash and Financebranch, Inspection branch and administration andestablishment branch, and assistant superintendents. Anyother work which is assigned by the presiding officer ofthe court..
ASSISTANT SUPERINTENDENTS:
They are allotted the work of supervision overthe employees working under him at Nagpur Headquarteras well as Taluka places and they have to deal thematters presented before the Court. They have to assistthe Principal Judicial Officer at the place in Administrativework.
To deal with the matters of cash transaction,copying etc., where the post of superintendent is not inexistence.
Any other work which is assigned by thePresiding Officer of the Court.
SENIOR CLERKS:
They do the work of Bench, of Property, Statistics,Correspondence, Accounts, Establishment in DistrictCourt as well as in subordinate Courts. Any other workwhich is assigned by the Presiding Officer of the Court.
INTERPRETER:
They do the work of taking deposition in Marathi andtranslation of English into Marathi and Marathi intoEnglish.
Junior Clerks:
They have the custody of cases instituted in therespective courts. They look after the maintenance ofthose cases and to do the work as per procedural lawsand the duties assigned by the head of the organizationand by the presiding Officer of the Court.

Head Bailiff:
To supervise the work of Bailiffs and to do the officialcash transaction. Any other work which is assigned by thePresiding Officer of the Court.

To watch the Court buildings and premises. Any otherwork which is assigned by the Presiding Officer of theCourt.
Sweeper:
To clean the court building and premises, lavatories etc.any other work which is assigned by the presiding officerof the court.
WATERMAN:
To fetch the water to the Judicial Officer and employees.Any other work which is assigned by the Presiding Officerof the Court.
(iii) The procedure followed in the decision makingprocess including channels of supervision andaccountability.
The Officers follow the procedure as laid down in thelaws, Manuals and directions received from the Hon'bleHigh Court, Law and Judiciary Department ofGovernment.
The employees working in the various Courts andsections follow the procedures laid down in the prescribedManuals and under the directions of Head of organizationand the Presiding Officer.
The Principal District and Sessions Judge, Nagpursupervises the work of the organization and exercisescontrol over it. Likewise, he distributes the grantsreceived from the Government amongst the subordinateauthorities for its appropriate expenditure.
The subordinate authorities submit various types ofreturns and information to the Head of Organization foronward transmission to the Hon'ble High Courtperiodically and whenever called for by the superiorauthorities.
The Civil Suits are initially presented in the Court ofthe Civil Judge at Nagpur and at other stations in theCourt of Civil Judge (Junior Division) and after itsregistration the same are being assigned amongst theother Civil Judges by rotation except in case of specialjurisdiction.
The criminal cases are initially presented by theconcerned Police Authorities and the private parties in theCourt of Chief Judicial Magistrate, at Nagpur and at otherstations in the Court of Judicial Magistrate, First Classand after its registration the same are made over to theother Judicial Magistrate in accordance with thejurisdiction allotted to them, for disposal according to law,except the cases triable under section 409 of the IndianPenal Code, which are heard and decided by the Court of
Chief Judicial Magistrate in case of Government money.
The cases exclusively triable by the Court ofSessions are being committed to the Court of Sessionsby the concerned Judicial Magistrates for being triedaccording to law.
The Special Judicial Magistrates are appointed bythe Hon’ble High Court for recording confession & dyingdeclaration.

Initially the organization receives the grants undervarious heads from the Government and thereafter itdistributes the same amongst its subordinatecourts/authorities as per their requirements and theremaining funds are used to keep for expenditure of theorganization for pay and allowances, over-timeallowance, wages, Traveling Allowances, office expenses,rent, rate and taxes, publications,grant-in-aid etc.

Licenses/permits are issued to the clerks of theadvocates. license to the persons who work as typist inthe bar room in consultation with the presiding officer ofthe court and bar association. Licenses are also issued tothe persons who work as petition writers in civil court inconsultation with the presiding officer of the court andthey are authorized to receive the charges to reduce intowriting the description of the documents and for typingcharges, as per norms prescribed in civil and criminalmanuals.
