This was agreed. 1. Temporary flood protection at KP- response from Council to list of questions about Watergate barrier with Gavin Penman and Lee Watson from Aberdeenshire Council with input from representatives from Scottish Water. Lee Watson spoke for the council, he described the history and the position of Kemnay in relation to the flooding in January. He indicated that Kemnay is not a PVA at present but SEPA are likely to designate Kemnay as a PVA in 2019 before the Council’s next planning cycle which starts in 2022. In the meantime he said that the Watergate temporary barrier can be deployed without planning permission so it a potential solution until such time as a

KenLedinghamwelcomedalltothemeetingandsuggestedthatweshoulddealwiththebusinessinvolvingmembersofAberdeenCouncilandScottishWaterinthefirstplace.Thiswasagreed.

TemporaryfloodprotectionatKP-responsefromCounciltolistofquestionsaboutWatergatebarrierwithGavinPenmanandLeeWatsonfromAberdeenshireCouncilwithinputfromrepresentativesfromScottishWater.LeeWatsonspokeforthecouncil,hedescribedthehistoryandthepositionofKemnayinrelationtothefloodinginJanuary.HeindicatedthatKemnayisnotaPVAatpresentbutSEPAarelikelytodesignateKemnayasaPVAin2019beforetheCouncil’snextplanningcyclewhichstartsin2022.InthemeantimehesaidthattheWatergatetemporarybarriercanbedeployedwithoutplanningpermissionsoitapotentialsolutionuntilsuchtimeasa

permanentbarriercanbelookedat.Leeusedslidestoshowtheproposedbarrierroutewhichwillconnectthetwoexistingbunds.Thisrouteinvolvedachangeindirectionmidrouteasshowninsomeofhisslidesbelow.

JimBuchanaskedifthecouncilhastakenadvicefromthesupplierofWatergateaboutintroducingabend.Councilrepresentativesrespondedthattheyhavetakenadviceandthatadditionalballastatthepointwherethebarrierbendswoulddealwiththisissue.JudeGalasasked“Whatabouttheimpactoffloatingdebrissuchastreesetc?”.KevinMuir(ScottishWater)indicatedthattherewouldbelessforceofflowintheareawherethebarrierwouldbedeployedsodebriswillnotfloatintothisareawithmuchvelocity.KenLedinghamsuggestedatthispointthatweshouldmoveontothewrittenanswerstothecommitteequestionswhichhadbeensenttotheCouncilpreviously.Question:Kenaskedifthesystemwillbepurchased?Answer:GavinPenmanstatedastheprojectcostisover£50kitwillbenecessarytoobtainafullydetailedquoteandobtainpermissiontoproceedwiththepurchasefromtheGariochAreaCommittee.Hestatedthathedoesnotforeseeanyobstaclestoapprovalbeinggranted.Question:Kenaskedwhatarrangementsapplytotheprovisionofpumps?Answer:Gavinthinksthatratherthanpurchasepumpsitwouldbepreferabletohaveacompanycontractedtoprovidethemwhenneeded.Whenafloodthreathasbeendeclared,thepumpswillbebroughtonsiteinreadinessforuse.Thesepumpswouldalsobeservicedtoensurethattheyareingoodworkingorderwhenneeded.KenstatedthattheRotaryclubhasofferedtodonateapumptobothKembhillParkFloodGroupandMiltonMeadowsResidentsAssociation.Question:Kenasked“Whatsortofstoragecontainerwillbeprovided?Willitbevandalproof?”Answer:Assurancewasgivethatitwouldbeametalcontainerwhichwouldbeverysecure.Question:Kenaskedifelectricalgeneratorswillbeprovidedtopowerfloodlights.Inviewofthefactthattherearenostreetlightsintheareawherethesystemneedstothedeployedthiswouldbeuseful.Lightswouldbeneededduringdeploymentandlaterontovisuallymonitorthesysteminuse.Comment:KevinMuirsuggestedthattherewouldbeaneedtoprovidesecuritymonitoringwhenthesystemisdeployed.Thepoliceshouldalsobeinformedtoseewhattheycandotoprovideaddedsecuritysuchasadditionalpatrols.PaulHendysuggestedthatawebCamsurveillancesystemwouldbegoodtoallowremotemonitoring.Answer:GavinstatedthattheCouncilintendtogive12hoursnoticeofafloodalertsothatwecanhavethebarrierdeployedingoodtimeandingoodlight.Noexplicitcommitmenttoprovidepowergeneratorswasmade.

Comment:KevinMuirthoughtweshouldplanto“overreact”inthefirstplacetogetthedeploymentexercisewellrehearsed.Thiscouldbedonebyhavingvolunteersexecutethesetupprocedurebeforearealemergencyoccurs.Question:KenaskedwhentheGariochAreaCommitteewillcometoafinaldecisionandthefullproposalwouldbeready.Answer:GavinstatedthatthenextcommitteemeetinghewouldbeabletopresenthisproposalstoisinJanuarysothedetailedproposalwouldbedesignedandavailableforthecommunitytoseeatthattime.Question:Kenaskediflifejacketswouldbeprovidedforvolunteers?Discussion:Thisgaverisetosomediscussion,KevinMuirstatedthatifalifejacketisneededpeopleareinanareawheretheymightbeindangerwhichwouldbebetteravoided.PaulHendycommentedthatitmaybebettertoprepareforapotentialaccidentwhereavolunteermightfindthemselvesinthewater.Somecommentsweremadeaboutthepowerofflowingwaterwiththebestadvicebeingtokeepwellclearofmovingwater.Requestfromamemberofthepublictojointhemeeting:AtthispointDianeBurgess,whohadbeencalledoutofthemeetingearlierbytheperson,returnedtothemeetingandaskedifthepersoncouldattendthemeetingtoobserve.CommitteemembersagreedunanimouslythatthiswouldnotbeappropriateasthepersonisneitheramemberofKPFGorthiscommittee.Dianeagainleftthemeetingtoinformthepersonofthisdecisionandreturned.Question:Kenaskedaboutvolunteer’sinsurancecoveriftheyweredeployingtheWatergatebarrier?CantheCouncilclarifywhatactivitieswouldbecovered?Answer:ItwasagreedbyGavinthathewillprovideinformationonwhatactivitieswouldbecovered.Question:IreneaskedifthereisanyupdateonInsuranceforGeneralVillageVolunteers.GavinstatedthatthereiscoverforKemnayCommunityCounciltowhichIreneagreed,however,addedthatitwasrecentlystatedbyColinGrayofACthatthematterofinsuranceforGeneralVillageVolunteersiswiththeinsurersandtheScottishGovernment.Gavintogetthisfurtherclarified.Action–Gavinsaidhewouldgetthisclarifiedandreportbacktothecommitteeinwriting.ConditionsofinsuranceProvision:

• Gavinwillhavetokeeparegisterofnamedpeoplewhowillbetrainedandcoveredbytheinsurancepolicy.

• Onlythoseonanauthorisedvolunteerlistwillbecovered.• Adhocvolunteerswouldnotbecovered.

Comment:Kevincommentedthatifatemporaryfloodbundwasbuiltitwouldimpactonsitesbothupanddownstream.Discussion:SomediscussionfollowedaboutthePortElphinstonebund.Gavinstatedthatthiswasareconstructiontorestorethatbundtoitsoriginalstate.Therewasalotofrabbitburrowdamagewhichledtoitscollapseduringtheflooding.Therewasalsoafloodstudydonewhenitwasoriginallybuilt.Comment:PaulsaidthatputtingtheWatergatesysteminplacewouldhavethesameeffectonwaterbeingdiverteddownstreameverytimeitisdeployed.TheimpactofhavingabarrierarethesamewhetheritisadeployabletemporarysolutionsuchasWatergateora“temporary”earthbunddesign.Answer:Gavinstated“Ifweneedtobuilda“temporary”earthbundsolution,thiswouldraisetheissueofplanningpermissionbeingrequiredanddelaymattersfurther.Question:JuderaisedtheissueofAbergeldycastleandtheconstructionworkwhichwasdonebyputtingstonesintherivertosupportthebuildingaftertheflooddamagethereandaskedwhatplanningpermissionwasgiventodothis?Answer:GavinconfirmedthattheCouncilwasnotinvolvedinthatprojectinanywayanddidnotelaborate.Question:Jimasked”whatifanearthbundsimilartoPortElphinstonewasbuiltonthebasisthatitcanberemovedormodifiedifafuturestudywastoindicatethatanalternativesolutionshouldbeinstalledwithadifferentconstructionorroute?”.Kenraisedtheissueofgettingasectionoftheexistingbundrepairedasthereisquiteadipnearthehousesatnumbers43to45whichmightleadtothebundbeingbreachedinhighwaterconditions.Answer:Gavinstatedthathewouldbereluctanttodothisworkuntilafloodriskstudyhasbeenconducted.Comment:JimstatedthatbasedonthePEbundcostings(whichGavinhasconfirmedtoJim),asimilarsolutionatKembhillParkcouldcostlessthantheindicativecostoftheWatergatesystem.JimemphasisedhoweverthatwestillwanttheWatergatebarrierbutthatweneedtokeepaconversationgoingaboutdoingsomethingdifferentofatemporarynaturewhichmaybelesscostlytotheCouncilinthelongrunandcompletelyremoveanyrisktopeoplewhootherwisewouldhavetodeploytheWatergatebarriereverytimetherewasathreatofflooding.Discussion:TherefolloweddiscussionconcerningthePortElphinstonebundwhereGavinstatedthatitisnotformalbundanditsconstructionisnotwhatwouldberequiredforaformalfloodprotectiondeviceresultingfromafullfloodriskstudy.

JimassertedthatthismeansthatitmustbeatemporarybundandthatitmightbeappropriatetoconsidersuchaconstructionatKembhillPark.Ireneaskedifatemporaryearthenworksbundwouldrequireafloodstudy.Gavinsaidthatitwouldnot.Alistairalsocommentedthataconstructionofthistypecouldbesubjecttoremoval/upgradeasaconsequenceofafullfloodriskstudyinthefuture.Answer:Gavinstatedthathewouldneedtoconsulthisplanningdepartmentcolleaguesbutagreedtogoawayandlookatthispossibility.Hestatedthatthismightdelaymatterssomewhat.Comments:LeestatedthatatPEtherewasfundingthatthecouncilwasabletoapplyforwhichisnotavailablehere.GavinstatedthatthelandatKembhillParkisprivatelyowned.JimcounteredthisbystatingthathehastheofficialdocumentationfromtheLandRegistrywhichstatesthatownershipiswiththeCouncil(thisisavailableforviewing).Itwasthenarguedthatinthiscasetheprotectionwasforprivateproperty.KenstatedthatPortElphinstoneisthesameasthehousesthereareprivateproperties.PaulHendyraisedaconcernthattheKembhillParkbundmaynotberobustenoughtowithstandwaterpressurefromoneside.InJanuarywaterflowedaroundbothsidesandpressurewouldhavebeenequalised.Gavinstatedthatthebundiswellstabilisedbutthattheconstructiondetailsareunknown.Answer:GavinsaidthatSEPAneedtogivetheirblessingtoanearthbundandseemedtoagreethathemightgiveanearthbundconsideration.

ReportfromScottishWater–DianeBurgess,KevinMuirandBenBickleQuestion:KenaskedScottishwateriftheyhaveconsideredbuildingaflooddefencealongtheriversideperimeteroftheSewageWorks.Answer:BenBicklerespondedthatthishasnotbeenconsideredasitnotbethemosteffectiveplacetobuildabarrierandothersagreed.Thisideawasthereforediscounted.Question:KenaskedifthereisalegalresponsibilityonScottishWatertoprotectprivateproperties.Answer:Benstatedthattheirlegalpeoplesaythattheyhavenolegalresponsibilitytobuildabarriertoprotecthousingfromoutflowfromtheirplantduringflooding.Theironlyresponsibilitywasforthesafeoperationofthesewersystemandpipeworktoandfromtheplant.
