1 INTRODUCTION This Community Relations Plan (CRP) documents how La Plata County (the County) will provide opportunities for public involvement and public comment concerning the results of the investigations and the selection of remedial actions for the former Redfield Rifle Scope facility (current La Plata County Detention Center [LPCDC]) in Durango, Colorado. The community relations activities described in this plan follow U.S. Environmental Protection Agency (EPA) guidance on public participation (EPA, 2005) and comply with the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) public participation requirements, as amended by the Superfund Amendments and Reauthorization Act of 1986 (SARA). La Plata County has been performing community relations activities including holding public meetings and briefings and has contacted adjacent property owners. This CRP builds on and formalizes the community relations activities that will be performed to convey the results of the site investigations and evaluations and describe the remedial/corrective actions that are proposed for the site.

2 SITE DESCRIPTION AND BACKGROUND The Site is located at the former Redfield Rifle Scope Facility in the Bodo Industrial Park in the southern portion of Durango, Colorado (Figure 1). The Site is approximately 8 acres in size and currently contains several structures associated with the LPCDC including the main jail building, the dormitory complex, and the recently constructed northern “pod” complex (Figure 2).

From the mid 1970s through the early 1980s, Brown Group Recreation Industries (Brown), Plummer Precision Optics, and Plummer Precision Optics, Western Division, Inc. (Plummer) operated a Redfield Rifle Scope (Redfield) manufacturing plant in the building that now serves as the main jail building for the LPCDC. During these operations, chlorinated solvents such as trichloroethene (TCE) and 1,1,1-trichlorethane (1,1,1-TCA), as well as acetone, pine tar, a polishing solution, and a mixture of antifreeze were used at the facility to polish and clean optical glass and machined parts (LPC, 2007). Waste solvents, some of which were classified as hazardous waste pursuant to the Resource Conservation and Recovery Act (RCRA) and the Colorado Hazardous Waste Management Regulations (CHWMR), were stored on the loading dock. Based on the results of the environmental investigations and information provided by former employees, it has been determined that the Redfield operations discharged spent solvent and wastewater containing solvent onto the floor of the building and into the floor drains and the sewer system which leaked into the underlying ground and that waste materials were also directly discharged to the ground in and near the area of the former loading

dock. The results of the environmental sampling indicate that releases to the ground also occurred in other portions of the site. Optical lens manufacturing operations at the facility reportedly ceased in 1982.

In 1983, the County purchased the property and building and in 1985 conducted renovations to allow the building and property to be used as a jail. The Site is currently the location of the La Plata County Detention Center (LPCDC) and is used to house male and female prisoners for durations of two years or less. Environmental sampling performed prior to and during performance of the RI/RFI site investigations have determined that chlorinated solvents trichloroethene (TCE) and 1,1,1-trichloroethane (1,1,1-TCA) were released to the ground at the site. As a result of these releases, these chemicals along with their related degradation products such as 1,1-dichloroethene (1,1-DCE) and cis-1,2-dichlroethene (cis-1,2-DCE) as well as the solvent stabilizer 1,4-dioxane, have been found in soil, soil gas (air that is present between the soil particles) and groundwater beneath the site and in indoor air within the facility. Occurrences of these chemicals in groundwater extend from around and beneath the former Redfield building offsite beneath adjacent properties to near the area of Suttle Street.

3 REGULATORY FRAMEWORK La Plata County is performing a Remedial Investigation/RCRA Facility Investigation (RI/RFI) to investigate and characterize the subsurface conditions and nature and extent of contamination at the site. The RI/RFI is being conducted by La Plata County on a voluntary basis under CDPHE oversight pursuant to the Colorado Hazardous Waste Act (CHWA) and RCRA. La Plata County is also preparing a Feasibility Study/Corrective Measures Study (FS/CMS) to identify and evaluate potential remedial actions/corrective measures for the site. The site investigations are intended to characterize the site conditions as required by the CDPHE Corrective Action Guidance (CDPHE, 2002). The RI/RFI is also being prepared and the associated site investigations were conducted in general accordance with the requirements set forth in the National Contingency Plan (NCP) for site investigations performed pursuant to the Comprehensive Environmental Compensation, Liability and Recovery Act (CERCLA) as identified in the U.S. Environmental Protection Agency’s (EPA) Guidance for Conducting Remedial Investigations/Feasibility Studies Under CERCLA (EPA, 1988). For investigations and response actions taken pursuant to or in a manner consistent with CERCLA, the National Oil and Hazardous Substances Contingency Plan (NCP) requires that the following community relations activities be conducted to the extent practicable in conjunction with performance of the RI/FS and selection of a remedy:

• Conduct interviews with local officials, community residents, public interest groups or other interested or affected parties, as appropriate, prior to the start of field work;

• Prepare a formal community relations plan; • Establish at least one local information repository at or near the location of the

response action; • Publish a notice of availability and a brief analysis of the proposed plan in a

major local newspaper of general circulation; • Make the proposed plan and supporting analysis and information available in

the administrative record; • Provide a reasonable opportunity, not less than 30 calendar days, for

submission of written and oral comments on the proposed plan and the supporting analysis and information located in the information repository, including the RI/FS;

• Provide the opportunity for a public meeting to be held during the public comment period at or near the site at issue;

• Keep a written transcript of the public meeting and make the transcript available to the public;

• Prepare a written summary of significant comments, criticisms, and new relevant information submitted during the public comment period and the responses to each issue.

• Publish a notice of the availability of the record of decision (ROD) in a major local newspaper of general circulation; and

• Make the ROD available for public inspection and copying. For corrective actions that are voluntarily taken pursuant to the CHWMR, there are no formal requirements to notify the public or involve the public in the corrective action process (CDPHE, 2002); however, CDPHE does encourage parties involved in corrective actions to notify the public of its activities through newsletters, public meeting or information repositories. Performance of the activities described above for CERCLA actions will also address the public notification activities suggested by CDPHE for corrective action sites.

4 COMMUNITY PROFILE The site is located in the Bodo Industrial Park which is the location of numerous business entities and government agencies. The general types of business that are currently located in the Bodo Industrial Park include contractors, equipment and material suppliers and equipment rental companies, automobile repair facilities, and shipping companies, for example. Government agencies with offices located in the Bodo Industrial Park include the La Plata County Detention Center, the State of Colorado – Youth Correctional Facilities, Robert E. Denier Youth Services Center (the Denier Center), and

the La Plata County Procurement Department offices for example. Motels, resturaunts, and retail stores are located to the east of the Bodo Industrial Park along the U.S. Highway 550 frontage roads. The area to the west of the Site is undeveloped and is part of the Bodo State Wildlife Area which is owned by the Colorado Division of Wildlife.

5 INTERESTED COMMUNITY MEMBERS AND ELECTED OFFICIALS Various stakeholders and organizations may play an integral role in activities and decisions related to the former Redfield Rifle Scope facility or otherwise be interested in being kept informed regarding the results of the investigations and decision making process. The potential stakeholders are listed below. 6 ROLES AND RESPONSIBILITIES La Plata County has voluntarily assumed responsibility for the site investigations, and evaluation of remedial actions for the former Redfield Rifle Scope facility. La Plata County’s goals are to:

• Ensure that any contamination at the site does not impose undue risk to citizens, staff, inmates, general public, and environment;

• Protect the environment and the health, safety and welfare of staff, guest and

inmates that occupy the facility, and neighbors;

• Mitigate current and future risk associated with public ownership of the property;

• Restore the market value of the real estate to a viable asset to the citizens of La Plata County for current and future uses in a growing diverse, multi use district of the City of Durango,

• Determine the nature and extent of contamination; and

• Cleanup up the soil and groundwater on, at, under or near the site and to protect

against future contamination of indoor air, ground water and soil. Decisions regarding the need for, objectives and general scope of any remedial actions that may be taken by the site will be made by La Plata County in consultation with and subject to approval from CDPHE.

7 PUBLIC PARTICIPATION ACTIVITIES La Plata County has been performing community relations activities including holding public meetings and briefings and has contacted adjacent property owners. La Plata County will continue to conduct public participation activities to provide information to the public and encourage ongoing communication between La Plata County and the public about the investigations and remedy selection process for former Redfield Rifle Scope site. Contact information for the Former Redfield Rifle Scope facility is given in Appendix A – Former Redfield Rifle Scope Site Contact List. Providing access to site documents and meeting with stakeholders and the public are the primary public participation activities anticipated to be performed in conjunction with the site characterization and remedy selection phases of the response actions at the site.

8 MEETINGS La Plata County will provide briefings and presentations on site activities in a variety of public forums.

8.1 Public Meetings La Plata County will hold a public meeting to describe the results of the site investigations and risk assessment, present a summary of the remedial actions/corrective measures that are potentially applicable to the site, and to present the remedial actions/corrective measures that are proposed to be undertaken at the site. La Plata County will seek stakeholder and community input on these issues prior to making final recommendations to CDPHE regarding remedial actions/corrective measures for the site.

As they cannot attend the public meeting, a separate meeting will be held at the La Plata County Detention Center with the Detention Center inmates.

8.2 Briefings for Local Officials La Plata County may hold briefings with elected officials or department personnel as needed to discuss the scope and results of the site investigations and the potential remedial actions at the site. Briefings will be conducted as needed with the Board of County Commissioners for La Plata County and the La Plata County Sheriff’s Office.

8.3 Meetings with Local Business and Property Owners La Plata County has previously contacted the adjacent property owners and informed them of the nature and scope of the site investigations. La Plata County will continue to work with stakeholder entities to address property owner and community concerns or questions related to the site conditions or remedial actions/corrective measures. Meetings or telephone calls may be held with owners of the Durango Party Rental and the Durango Electric properties to discuss the results of the environmental sampling performed at these properties and the proposed remedial actions.

9 ADMINISTRATIVE RECORD AND DOCUMENT REPOSITORY La Plata County has established a document repository as required under Section 117(d) of SARA. The document repository is located at the La Plata County Court House –Information Desk. Copies of site documents that make up the Administrative Record for the site are kept in and are made available at the document repository. La Plata County has also established an internet site with links to key site documents. Copies of site documents can be obtained for review or copying from the document repository at the La Plata County Court House – Information Desk or from the La Plata County internet website. As additional documents are created they will be added to the document repository and additional links will be included on the website. 10 SITE TOURS As the site is the location of the La Plata County Detention Center, access to the site is highly restricted. Consequently, site tours will not be available to the general public.

11 DOCUMENTS FOR PUBLIC REVIEW AND COMMENT As required by CERCLA regulations, La Plata will provide opportunities for stakeholders to review and comment on the site characterization documents and the potential remedial actions/corrective measures that may be considered for the site. An Administrative Record of site documents, including a list of the various site documents as well as electronic files of the documents has been prepared by La Plata County. The Administrative Record includes not only site related documents and correspondence but also key technical references used to guide the performance of the site investigations and evaluations.

11.1 News Releases and Editorials La Plata County will issue news releases and/or community advisories to announce public meetings regarding site documents or significant activities.

11.2 Neighborhood and Tenant Notices La Plata County will place announcements in local newspapers regarding document availability and public meetings as prescribed by CERCLA.

11.3 Fact Sheet La Plata County will prepare a fact sheet as needed to describe the results of the site investigations and the evaluation of potential remedial alternatives/corrective measures. Fact sheet will be available to stakeholders and posted on the La Plata County website.

12 EMERGENCY CONTACTS The La Plata County Sheriff’s office is responsible for operation of the La Plata County Detention Center. During periods when site investigations or other activities related to the contamination or remedial actions at the site are being performed by County personnel or contractors, these individuals will be responsible for identification and initial

response to any possible environmental emergency that may occur at the site. In the event that an emergency or other condition arises relative to environmental conditions at the site during periods when County personnel or contractors involved with the site investigations and remediation are not present, Sheriff’s office personnel will notify County personnel in the La Plata County Public Works Department and/or local emergency responders as necessary to respond to any environmental emergency that may occur at the site. La Plata County will make prompt notifications as necessary and appropriate to regulators, and other affected parties if such a situation arises.

13 MAILING LISTS La Plata County has developed an initial list of contacts of all potential stakeholders associated with the former Redfield Rifle Scope facility site (Appendix A). La Plata County will update and maintain site-specific stakeholders’ list as necessary through completion of implementation of remedial actions at the site. .
