CURRENT CONSIDERATIONS: K.S.A. 2015 Supp. 25-2023 was amended so that the term of office of each school board member shall commence on the second Monday in January following the election in November. The KASB legal department recommends that each Board of Education take action to extend the terms of current board members to meet this new timeline. FINANCIAL CONSIDERATIONS: There are no financial considerations for the approval of this resolution. STAFF RECOMMENDATION: The Board of Education is respectfully requested to approve Resolution 20160222, extending the terms of the current Board of Education members in order to comply with recently enacted legislation (K.S.A. 2015 Supp. 25-2023). RESOLUTION TO EXTEND TERMS OF OFFICE

RESOLUTION 20160222

WHEREAS, recent state legislation requires municipal elections, including those for boards of education, occur in November, rather than April, of odd-numbered years; and

WHEREAS, K.S.A. 2015 Supp. 25-2023 was amended so that the term of office of each school board member shall now commence on the second Monday in January following the election of said board member; and

WHEREAS, due to this legislative amendment, the term of office for any elected board member whose term would have expired at any time in 2017 will be extended until the second Monday in January of 2018; and

WHEREAS, due to this legislative amendment, the term of office for any elected board member whose term would have expired at any time in 2019 will be extended until the second Monday in January of 2020.

NOW THEREFORE, BE IT RESOLVED THAT, the Board of Education of Unified School District No. 443, Ford County, Kansas hereby extends the term of office for any elected board member whose term would have expired at any time in 2017 until the second Monday in January of 2018, when board members elected in the November 2017 general election take office pursuant to K.S.A. 2015 Supp. 25-21a01;

AND BE IT FURTHER RESOLVED THAT, the Board of Education of Unified School District No. 443, Ford County, Kansas, hereby extends the term of office for any elected board member whose term would have expired at any time in 2019 until the second Monday in January of 2020, when board members elected in the November 2019 general election take office pursuant to K.S.A. 2015 Supp. 25-21a01.

Reviewed By: Administrative Cabinet BACKGROUND INFORMATION: A vacancy exists on the USD 443 Board of Education for the term that expires on the second Monday in January 2018. The required Public Notice of the vacancy was published in the Dodge City Daily Globe on Thursday, January 15, 2016. Applications for the vacant position were made available online, as well as through the Public Information Office from Monday, January 19 through Friday, February 12, 2016. CURRENT CONSIDERATIONS: According to K.S.A. 25-2022, a qualified elector may be appointed by the remaining board members to fill the unexpired term. Kansas statute does not specify a process for the appointment of a new board member. The Kansas Open Meetings Act indicates that the selection process must be done in a public session, and may not occur within fifteen (15) days of the publication of the vacancy. FINANCIAL CONSIDERATIONS: There are no financial considerations for the appointment of an elector to fill the unexpired term on the USD 443 Board of Education. STAFF RECOMMENDATION: The Board of Education is respectfully requested to discuss the process to be used to fill the unexpired term on the USD 443 Board of Education. RECOMMENDED ACTION:

Reviewed By: Administrative Cabinet BACKGROUND INFORMATION: With the successful school facilities bond referendum in June 2015, the Board of Education approved the scope of facilities improvements at the February 8, 2016 board meeting. USD 443 currently partners with the Dodge City Family YMCA by providing afterschool programs at the following school locations: Sunnyside, Northwest, Central, Miller, Ross, Linn, Beeson and Wilroads Gardens. CURRENT CONSIDERATIONS: Administration has been approached by DeWayne Donaldson, Branch Executive Director of the Dodge City Family YMCA about their desire to partner with other entities to enable the YMCA to bring more robust programming to the citizens of Dodge City. FINANCIAL CONSIDERATIONS: There are no financial considerations at this time. STAFF RECOMMENDATION: The Board of Education is respectfully requested to direct administration to discuss with the Dodge City Family YMCA and other entities opportunities for partnerships that could involve the use of school district facilities to benefit students and community at large. Any agreement resulting from these discussions would be presented to the board for consideration and action. RECOMMENDED ACTION:

Reviewed By: Administrative Cabinet BACKGROUND INFORMATION: The 2015 Kansas Legislature eliminated the previous school funding formula and implemented “block grants” for Kansas’ public schools, which in essence froze school funding for the 2015-2016 and 2016-2017 school years. In doing so, the legislature also eliminated equalization aid for both the Capital Outlay and Supplemental General Fund (LOB) budgets. This equalization funding was originally implemented in response to the Montoy Case, in which the Supreme Court ruled that the State had an obligation to supplement the funding of less property-wealthy school districts, in order to provide similar educational opportunities to all Kansas school children. On February 12, 2016 the Kansas Supreme Court ruled on the “equity” portion of the Gannon school funding case. The Court affirmed what previous Kansas courts had ruled over the past two or more decades; that the Kansas constitution requires that all school children of our state must have reasonably equal access to substantially similar educational opportunity through a similar tax effort. In doing so, the Court said that the Legislature’s action to eliminate this equalization aid was unconstitutional. The funding “adequacy” portion of the Gannon Case will be argued before the Court this spring, with a decision sometime following. CURRENT CONSIDERATIONS: How the State now decides to meet this fundamental right of all Kansas school children is up to the Kansas Legislature and the Governor. The Supreme Court has ordered that this be accomplished during the current legislative session, and a legally-acceptable resolution be presented by June 30, 2016. FINANCIAL CONSIDERATIONS: For the 2016 fiscal year, Dodge City USD 443 experienced a loss of approximately $250,000.00 in Capital Outlay equalization aid, as well as another $350,000.00 in equalization aid for the Supplemental General Fund (LOB). This does not account for an estimated $927,500.00 additional funding that would have come to the school district as a result of increased enrollment and/or enrollment weightings under the previous school funding formula. STAFF RECOMMENDATION: The Board of Education is respectfully requested to receive the information regarding the impact for Dodge City USD 443 of the Kansas Supreme Court’s decision in the Gannon Case.
