The chestnut, who had not raced since 2007, had been retired to stud, but sired just 19 foals from three crops and had returned to training at owner Bruno Schickedanz=s farm. He shipped to Woodbine Tuesday to breeze. Woodbine Entertainment=s Executive Vice President of racingJamie Martin told the To- ronto Star that there would be an investigation. AWe=re looking into it,@ Martin said. AI have the same concerns as everyone else. We will make some decisions as soon as we talk to all of the parties.@ Wake At Noon was not eligible to race at Woodbine, which does not take entries on horses over 10 that have not won in the past year. Schickedanz told the Toronto daily that the catastrophic injury was the result of tragic accident. AIt was a freak thing I am told,@ Schickedanz said in a telephone interview with the Star. AHe spooked from another horse and took a bad step. I feel terrible about it.@ Explaining why the champion was back in training, he added, AHe was not getting many mares in foal. This spring he was shooting blanks, so he has been training at my farm for a few months. I wanted to send him to Woodbine and see what he would do in a workout. He=s been acting like a three-year-old at the farm. I had plans to send him to race at Mountaineer Park.@ Wake At Noon=s body was sent to Guelph University, and the results of the necropsy will be sent to the Ontario Racing Commis- sion. Bred and raced by Schickedanz, he was retired to stud in 2004. Back at the track in 2005, 2006 and 2007, he made 16 starts over the three seasons and winning twice, but failing to hit the board in five stakes appearances. Overall, he compiled a record of 67-21-8- 7, with four Grade III victories, and earned $1,681,386. As Tim Capps wrote in his recent Op/Ed (Finding aWay Forward for Horse Racing, TDN, June 25, 2010)"people who love racing in America Y are more con-cerned about its health, well-being and, above all fu-ture, than at any time in the writer's increasinglylengthy memory." Concern, however, is not enough.We need active love. This is clearly a time for people who love racing tospeak up, to find a way to make their voice heard, andto get involved. In this time of current crisis, it is notOK for those who love the sport to go about businessas usual, while passively watching (or convenientlyignoring) our steady qualitative and quantitative decline.It is not OK to do nothing, any more than it is OK tostand by on the sidewalk and look on while someone isbeing mugged or beaten. (In this instance, hands-onhorsemen, racehorse owners, bettors, and our equineathletes are the ones being mugged and beaten).

And, as members of an intertwined Thoroughbredcommunity, it is also not OK to mind our own businesswhile the business of others goes down the drain alongwith the sport as we know it or wish it to be. Although much damage has already been done, westill have a tiny window of opportunity to create thekinds of changes that can make a difference, but weneed people across all strata to join hands and workactively togetherYor get out of the way. Dylan's greatAmerican ballad still has sway after nearly 50 years,"get out of the way if you can't lend a hand, the timesthey are a'changin." A few recent events reflect a growing awareness thatchange must occur: several racing commissioners con-tinue to talk about a partial compact; a large number ofinternet blogs have been spawned that target importantissues; Bobby Kulina and his team at Monmouth de-signed a risky but innovative new paradigm for theirrace meet; an unusually large number of individuals (28)ran for the Breeders' Cup board, presumably to help itbecome more than a two-day event that is largely un-known to the general public, etc. But we need manymore initiatives that target the lack of cohesion andinnovation that defines our industry. In particular, we need our younger, technology-drivengeneration of horsemen (those who will inherit thissorry complex of fractionated interests and generaldysfunction), to mobilize their IT acumen and socialnetworking platforms in order to shake up the "statusquo," create virtual horseracing games and experiences,laser the moss off the Trustees Room at Belmont Parkand other rooms like it, breathe down the necks ofracing commissioners, and sculpt afuture for themselves and the sportthey love. The bar has been set low bytheir elders, and they can do muchbetter if they organize effectively anddevelop imaginative strategies. Towardthat end, a recently formed organiza-tion called Vision 20/20 (a group ofyoung horse professionals under theage of 40) gives a glimmer of hope fora better tomorrow. Unless our young people can figure away out through the maze of fiefdomsand disparate rules and regulations, wewill soon have status similar to boxing.Tim Capps, on the other hand, takesan historian's perspective and believesthat "a turn-around WILL come andperhaps is already underway." I don'tsee it and I don't believe it. Our funda-mentals were in serious decline before the recessionand financial crisis hit the general economy, and thenotion that our horse business will "come back" withthe overall economy (when and if that happens) ap-pears to be nothing more than wishful thinking.

In my opinion, an historical view does not apply toour current circumstance. We have never been herebefore. Our problems in combination are severe and

For sure, historical or academic perspectives havetheir uses. Analyzing what has gone on before mayyield useful insights that can inspire or guide new orreformulated strategies. And the timeless observationthat "those who do not learn from history are doomedto repeat it," is a truism that applies to any era. How-ever, thinking that things will somehow get betterbecause we have had other downturns and have al-ways "come back" is a highly speculative use of his-tory, especially given today's kaleidoscopic set of vex-ing variables within a fast-paced and rapidly changingworld. Squinting through an historical lens reveals the harsh-est reality of all: we humans have squandered the mostexquisite advantage in all of sport, the equine athleteand the intrinsic fascination that many humans have forhorses. We have been given a magical gift; but we havebrought no magic of our own. Of course, there will always be horse racing. As TimCapps wrote, "people are not going to stop likinghorses, or enjoying seeing them run, or wanting to beton the outcome." However, the landscape for the nextTim Capps to write about 20 years from now will begreatly changed, and many hands-on horsemen (whogenerally love horses more profoundly and intimatelythan those who watch them or write about them) willbe gone from the scene, unnecessarily. Inevitable contraction will recast the sport to resem-ble earlier eras when it became known as the Sport ofKings and was almost exclusively a playground for thepowerful and privileged. The only thing different will bethe size of the crowds. We will have a few boutiquemeets like that of Keeneland, Del Mar, Saratoga andMonmouth, and a few big events. Our once thrivingindustry that employed tens of thousands of individualsand accounted for billions of dollars in GDP will be littlemore than a club sport for the wealthy, and a nationalafterthought that will occasionally catch the public'seye around a big event or special horse. Thus, if you are an industry participant who loveshorses and wants more than this scenario (whether youare a vet, bloodstock agent, owner, trainer, van driver,breeder, stallion manager, sales company executive,farrier, feed man, fence builder, groom, hotwalker, oralphabet Board member, etc.), you have a responsibilityto yourself and a shared responsibility to others. There-fore, please ask yourself what you have done today(and each day) to help make things better for the indus-try as a whole, and find a way to make your voiceheard. COURT APPROVES ZAYAT STABLES SETTLEMENT The U.S. Bankruptcy Court for theDistrict of New Jersey has approved a reorganizationplan submitted last week by Zayat Stables, which willsettle its financial responsibilities to Fifth Third Bank. Ina statement, Zayat Stables= owner Ahmed Zayat said, AIam thrilled that the judge has approved the global set-tlement that was proposed to the court between us andFifth Third. This is a huge step forward, not only forZayat Stables, but for the entire equine industry. Withall outstanding matters finally resolved, we can keepour focus where it needs to be--on breeding and racingsome of the top horses in America.@ A confirmationhearing in front of the Bankruptcy Court is set for July15, and Fifth Third has indicated it will vote in favor ofthe settlement at that time.

TRIO OF BIDS SUBMITTED FOR AQUEDUCTCASINO Three entities--Penn National Gaming, theMalaysian-based Genting New York and the partnershipof SL Green, Hard Rock Entertainment and the ClairvestGroup--Tuesday submitted bids to become the licensedoperator of the Aqueduct casino. Six groups took partin the early stages of the process, but two, DelawareNorth Gaming and Yonkers Raceway=s Empire StateCasino, opted out. Clairvest, a publicly traded merchantbank that invests in mid-market companies, had initiallybeen listed as a sixth potential operator, but changedgears and joined forces with Penn National and SLGreen prior to Tuesday=s 4 p.m. deadline for submis-sions. The New York State Lottery, which was put incharge of finding an operator in May, is scheduled tomake its recommendation to Gov. David Paterson Aug. 3. If the Governor, State Assembly Speaker Shel-don Silver and temporary State Senate PresidentMalcolm Smith grant approval, the casino is expectedto open some time next year. It will offer 4,500 videolottery terminals, and is predicted to generate as muchas $600 million in net revenue annually, with sevenpercent going to the New York Racing Association and6 1/2 percent to purses.

TRF ANNOUNCES RESTRUCTURING The boardof the Thoroughbred Retirement Foundation, the oldestand largest non-profit association devoted to the after-care of racehorses, has announced a restructuring of itsinternal operations. The new structure comes in re-sponse to the growth of the organization and the in-creasing demand from the racing industry and fans forhumane treatment of ex-racehorses. Two new positionshave been created, and the organization will now main-tain offices in Saratoga, New York, and Lexington,Kentucky. Diana Pikulski,who has served as TRF Ex-ecutive Director for 15 yearsand was named one of theindustry's A25 Most Influen-tial Women,@ will fill the newposition of Executive Direc-tor for External Affairs, andwill continue to work fromthe foundation's office inSaratoga Springs. Discount For Breeders= Cup Early Foal Nominators: The Breeders= Cup will once again offer a $100 dis-count off the $500 fee for breeders who nominate theirfoals of 2010 to the Breeders= Cup program electroni-cally by the end of the business day Aug. 1. The dis-count program, unveiled in 2009, saved breedersaround the world more than $1 million last year, whena record 10,241 foals were nominated. That marked anincrease in Breeders= Cup foal nominations of nearly200 percent. TCA Awards $860,672 in Grants: Thoroughbred Charities of America has distributed$860,672 in grants to 81 non-profit organizations con-nected to the Thoroughbred industry. ASaid Erin Crady,executive director of TCA, AThe grant money distributedby TCA would not be possible without the generoussupport of our many donors and, in particular, ourstallion season donors.@ Grants were given out to orga-nizations involved with rescue, rehabilitation and adop-tion of Thoroughbreds, as well as education and back-stretch programs, therapeutic riding programs andresearch organizations. Grant applications for 2011 willbe available next January at www.tca.org. The TCA,which has distributed over $17 million to more than200 charities over the past 20 years, became the chari-table arm of the Thoroughbred Owners and BreedersAssociation in 2008.
