Distracted driving is a dangerous
epidemic on America's roadways.
In 2010, over 3,500 people were
killed in distracted driving crashes.
The U.S. Department of Trans-
portation is leading the effort to
stop texting and cell phone use be-
hind the wheel. Many states have
enacted laws controlling how cell
phones and texting can be used.
Distracted Driving and Business
Legal Liability
Business owners can, and are,
being held liable for the actions of
their fleet drivers. For example,
one of your employees runs a red
light and slams into another car se-
verely injuring the driver. When
the driver sues, they may sue your
driver and your company because
at the time of the accident he was
on company business. When
phone records show he was send-
ing a text message at the time of
the vehicle’s impact, he is judged
negligent and that negligence con-
tributed to the accident. The
lawyer has the smoking gun he
needs to sue your company.
At Fault and Not Behind the
Wheel
If you're texting while driving and
you have an accident - it's your
fault. But what about the person
who was texting with you? That
question is being asked in recent
lawsuits.
Sue and Bill Packer’s lives were
shattered in seconds. On August
10, 2010, Sue and Bill were driving
about a mile from their home. A car
swerved across the center line and
hit them head-on. "What I saw was
a gentleman in the car steering with
his elbows, with his head down. I
could tell he was text messaging,"
Bill said. "I looked down after the

My wife told me the bones of her
leg were through her pants." Both
lost a leg in the crash. The 20 year
old driver of the car pleaded guilty
to three motor vehicle violations.
The Packers are now suing him as
a distracted driver for civil dam-
ages and they are also suing his
girlfriend for sending text messages
to him while he was driving, and
distracting him. Records show
they exchanged 71 texts that day.
The Packer’s lawyer argues the dri-
ver’s girlfriend was "electronically
present" in the crash. During her
testimony, and at depositions, she
answered by saying, “This is how
people communicate now.”
Punitive damages
Statutes may allow for punitive
damages because of aggravating
circumstances in order to penalize,
punish, or deter the defendant.
Many statutes make it clear that
punitive damages shall not be
awarded as compensation to a
plaintiff, but solely to punish, pe-
nalize, or deter a defendant. Puni-
tive damages may be awarded
when it is proven by clear and con-
vincing evidence that the defen-
dant's conduct showed willful
misconduct or conscious indiffer-
ence to consequences, such as tex-
ting while driving.

It was mid 1960 when Joe Farago
left the paper mill to help a
plumber in Plainfield. At that time
he started putting well points in
around the area with trailer driver
set up. In 1976, he bought a 6T
Smeal hoist and in 1978 he ob-
tained a cable tool 22W.
In 1981, Joe bought a 20W cable
tool. His son Terry, who was at the
time working as a big game hunt-
ing and fishing guide in Wyoming,
moved back to Wisconsin with his
new bride Tina (1984), to work in
the family business.
There were some tough years, but
they remained determined to keep
this a family business and their per-
sistence paid off. In 1991 they
hired John Zouski as the com-
pany’s main driller and in 1996
they bought a new 450 with a cas-
ing driver.
In 201, Terry and Tina’s son Clancy
joined Farago Drilled Wells and
this became a 3 generation busi-
ness.
In 2012, Joe was awarded the
WWWA LifeTime Achievement
Award. Joe accepted the award sur-
rounded by his family.
Terry has been actively involved in
the Wisconsin Water Well Associa-
tion, including being President of
the Association. He also served on
the National Ground Water Associ-
ation Board of Directors.
Joe and Terry are proud to be mem-
bers of the Wisconsin Water Well
Association; the shop is closed for
them to go to the conventions.
Tina and Terry have helped with
the Convention Display area since
we had it in Oshkosh, Wisconsin,
when Wally Govert asked Tina to
help move some tables, the kids
have helped out through the years
also, making it a family thing while
helping the Wisconsin Water Well
Association.
