AlberasFreedom of Information and Protection of Privacy Actsrives o creae a balance beween he availabiliy oinormaion and making sure Alberans can be confiden heir righ o privacy is mainained.
Te pas year marks one decade since he legislaion was expanded o include all public secor bodies, suchas school boards and municipaliies. Over he course o hose 10 years, weve seen a significan increase inrequess o local public bodies, rom 620 requess a decade ago o 2,020 requess in 2008-09. Service Albera
works closely wih hose public bodies, giving advice and assisance o help hem mee heir responsibiliiesin providing access o inormaion while proecing personal privacy. en years ago, 90 per cen o requess
were processed in 60 days or less. oday, he sandard is 95 per cen.
Te provincial governmen has also improved is response ime during he las 10 years despie an increaseo 3,350 requess or inormaion compared o 2,150 a decade ago. en years ago, 93 per cen o requess
were processed in 60 days or less. oday, ha number is 96 per cen.
Significan accomplishmens or he 2008-09 fiscal year include:
Te enactment of a new Freedom of Information and Protection of Privacy Regulation to ensurecurrency, including he scope o he Ac.
A major project to revise and redesign many of Service Albertas FOIP print and electronic resourcesor adminisraors province-wide; hese resources now incorporae all recen amendmens andguidance offered in recen Inormaion and Privacy Commissioner decisions.
Providing opportunities for FOIP sta to expand their knowledge and expertise by organizing specialpresenaions on new and emerging privacy issues.
Collaborating with other ministries through advisory services to promote a consistent approach toaccess and privacy adminisraion across governmen.
As new echnology and processes emerge o collec and sore inormaion, we mus coninue o developexperise and experience boh in he provincial governmen and in local public bodies. Albertas FOIP Program
Service Albera provides leadership, sraegicdirection and support to public bodies subjecto he Freedom of Information and Protection ofPrivacy Act(he FOIP Ac). Tese bodies includeprovincial governmen deparmens, agencies,
boards and commissions, as well as a diverserange o local public bodies operaing across
Albera. Te role o Service Albera is o ensureha Alberans are able o exercise heir righunder he FOIP Ac o reques access o recordsand ha hey can rely on public bodies o proecheir personal inormaion.
Te deparmen provides raining, inormaionresources and proessional developmen orsaff in public bodies who are responsible or
he day-o-day adminisraion o he Ac. Tisensures hey have he suppor hey need o runan effecive FOIP program. Service Alberaalso keeps ahead o new issues and rends, andensures ha he legislaion keeps pace wih hechanging world.
Effective Legislative Framework
A new FOIP Regulaion came ino orce onNovember 5, 2008. Te Regulaion updaedthe list of public bodies that are subject to
he Ac. I also updaed reerences o oherlegislaion and clarified cerain seps inprocessing access requess. Laer in he yeara Miniserial Regulaion was used o bringhree new governmen bodies under he
Ac wihou requiring an amendmen ohe general regulaion.
A process was esablished a ew years ago o reviewand commen on any access or privacy implicaionsin new legislaive iniiaives. Tis process promoesa consisen approach o access and privacy inlegislaion across he governmen. Te deparmenconsuled wih minisries on 32 pieces o legislaion
in 2008-09.
Learning Opportunities
As echnology and approaches o deliveringgovernmen services change, new access and privacyissues mus be considered. FOIP saff are encouragedo paricipae in aciviies ha expose hem o helaes developmens in he field.
Regular inormaion sessions were held wihgovernmen, school board, pos-secondary and
municipal FOIP saff. Tese meeings providean opporuniy or he deparmen o conveyinormaion abou aciviies and or public bodies oshare inormaion and sraegies o address commonissues. Training Program
Service Albera offers sandard raining courses
on a regular schedule so ha public bodies cansend new saff or FOIP raining. Te insrucor-led raining program includes hree one-daycourses or employees who are responsible orFOIP and a hal-day course or employees whorequire an overview o he basic conceps inhe field o proecion o privacy and access oinormaion. raining courses are scheduled
or delivery in Edmonon and Calgary, andaddiional courses are held around he provinceas requesed. In 2008-09, 964 employees rom
governmen and local public bodies successullycompleed raining. raining was provided in52 courses, including 30 delivered a public
body workplaces.
A new course,Managing Contracts under the FOIPAct,was developed and piloed his spring. Tenew course will be offered nex year.
National Initiatives
