    Whereas, its unique location provides critical access to and from major

    transportation links for commerce and local delivery of flowers from throughout the

    Bay Area and northern California;

    Whereas, reasonable zoning standards have preserved the San Francisco

    Flower Mart at this site currently zoned SALI (Service/Arts/Light Industrial), 40-55-

    X Height and Bulk in the Western SoMa Special Use District;

    Whereas, Kilroy Realty Corporation is under contract to purchase a 1.9-acre

    portion of the Flower Mart site for $26.6 million;

    Whereas, the Flower Mart is threatened by a proposal on file with the San

    Francisco Planning Department, submitted by a representative of Kilroy RealtyCorporation, to demolish the Flower Mart, replace it with over a half million square

    feet of office space and increase the height limit to 160 feet;

    Whereas, it is the policy of the City and County of San Francisco to create and

    retain local jobs and the closure of the Flower Mart would cost thousands of jobs

    contrary to City policy;

    Therefore, the people of San Francisco declare that it is the policy of the City

    and County of San Francisco that:

    The existing height and bulk limits and zoning classification for the San

    Francisco Flower Mart shall be preserved and shall not be increased unless approved

    by San Francisco voters.

    SECTION 3. San Francisco Flower Mart Protection Act

    The existing San Francisco Planning Code height and bulk district and zoning

    classifications for the San Francisco Flower Mart shall be as follows:

    (a) The height and bulk district classification of the property located at

    Assessor's Block No. 3778, Lot No. 005 (575 Sixth Street), shall be

    preserved as 40-55-X Height and Bulk District as set forth on the City

    and County of San Francisco Zoning Map Sheet HT08 .

    (b) The zoning classification of the property located at Assessor's Block No.

    3778, Lot No. 005 (575 Sixth Street), shall be preserved as SALI

    (Service/Arts/Light Industrial) Zoning District as set forth on the City

    and County of San Francisco Zoning Map Sheet ZN08.

    (c) Pursuant to Sections 106 and 302(c) of the Planning Code, the following

    height and bulk district classification, is hereby affirmed by the City and

    County of San Francisco:

    Assessors Block 3778 40-55-X SALILot 005

    SECTION 4. Effective Date

    In accordance with the provisions of California Elections Code section 9217, if

    a majority of the voters vote in favor of the Initiative, the Initiative shall go into effect

    10 days after the vote is declared by the Board of Supervisors.
