Introduction The Polk Transportation Planning Organization (TPO) maintains a comprehensive, cooperative, and continuing (“3C”) planning process. The TPO’s plans and programs are designed to meet the current and future transportation needs of Polk County. Pursuant to Titles 23 and 49, Code of Federal Regulations (CFR), and Chapter 339.175, Florida Statutes (F.S.), the fiscal year 2012/13 – 2013/14 Unified Planning Work Program (UPWP) is the basis for allocating federal, state and local funds for transportation planning purposes in Polk County. The UPWP documents all planning tasks and related activities for the period of July 1, 2012 through June 30, 2014 developed by the Polk TPO and other transportation planning agencies.

Developed every two years, the UPWP serves as the basis of the planning program for the TPO. Planning tasks address transportation issues that concern citizens, elected officials, and transportation professionals. The TPO’s public involvement process is used to identify and define these issues. The UPWP substantiates the level of effort for each task and the associated requirements for federal, state, and local funding.

The UPWP is developed by TPO staff in cooperation with the Florida Department of Transportation (FDOT), members of the Technical Advisory Committee (TAC), and members of the Citizens Advisory Committee (CAC). The document is divided into the following sections:

In terms of public participation opportunities used in the development of the UPWP, the UPWP was presented six (6) times at meetings which are publically noticed. This includes four (4) presentations at the TPO’s Citizens and Technical Advisory Committees (CAC/TAC) and twice at TPO Board meetings. In addition, the Draft UPWP was posted on the TPO’s website for public review and comment thirty days prior to the final adoption by the TPO Board in April.

In an effort to ensure the TPO planning program is compatible with other state and local planning programs, coordination with adjacent counties is maintained. The TPO is a member of the West Central Florida Metropolitan Planning Organization Chairs’


Coordinating Committee (CCC). Citrus, Hernando, Hillsborough, Manatee, Pasco, Pinellas, Polk, and Sarasota counties are included on this committee. Pursuant to Florida Statutes Section (F.S.S.) 339.175, the CCC is charged with the following:

Coordinate transportation projects deemed to be regionally significant by the committee.

Review the impact of regionally significant land use decisions on the region. Review all proposed regionally significant transportation projects in the respective

transportation improvement programs, which affect more than one of the MPOs represented on the committee.

Institute a conflict resolution process to address any conflict that may arise in the planning and programming of such regionally significant projects.

In the spring of 2003, the TPO also became a member of the Central Florida MPO Alliance. The Alliance members include METROPLAN ORLANDO (Osceola, Orange and Seminole), Brevard, Volusia, Lake, Sumter, Polk and Marion counties.

The TPO operates in compliance with Title VI of the Civil Rights Act of 1964. This includes any and all applications of work by the TPO such as, the administration of business, decision making, purchasing and consultant services.


Planning Priorities for the Metropolitan Area For the FY 2012/13 and FY 2013/14 UPWP, the Polk TPO will focus on the following planning activities. These priorities are based on SAFETEA-LU, and other planning requirements pursuant to state and federal regulations, as well as the direction of the TPO Board and member local governments. Additional details regarding these projects can be found under the respective planning task descriptions beginning on page 10.

Task 2.1 Travel Data and Strategies o Congestion Management Process – Preparation of an annual Trends and

Conditions Report.

o Annual Traffic Count Program

o Major Road Network LOS Monitoring (Roadway Network Database).

Continue to monitor major developments and developments of regional impact (DRI) and there affect on the transportation system.

Task 3.1 Long Range Transportation Planning

o Adoption of the 2035 Mobility Vision Plan by the TPO Board in December 2010 (FY 2010/11).

o Ensure that the 2035 Mobility Vision Plan is an integral part of local government comprehensive plans.

o Development of a 2040 Population and Employment Forecast.

o Development of 2040 Transportation Model Networks.

Task 3.2 Short Range Transportation Planning

o The TPO, in coordination with our TAC, local governments, transit agencies, FDOT and other modal partners, will develop annual multi-modal transportation priorities.

o Adoption of a multimodal Transportation Improvement Plan (TIP) annually.

o Update the TPO’s Congestion Management Process.

o Annual update of the Consolidated Transit Development Plan (TDP) for the Lakeland and Winter Haven Transit Systems.

o TPO Support of the Polk Transit Authority (PTA).

o Development of a Complete Streets Policy and Manual for the TPO and local governments.

Task 3.5 Public Participation Process

o Update the TPO’s Public Participation Plan (PPP).

o Implement new and innovative methods for communicating the TPO’s plans and programs, e.g., Facebook, Twitter, Webcasts and short videos that describe a plan or project.


o TPO staff will ensure that the goals and recommendations of the PPP are being implemented.

Task 3.6 Regional Transportation Planning

o Continued Coordination with CCC and CFMPOA.

Development of regional transportation facilities and candidate TRIP and Regional Multi-Use Trail priority projects.

o Updated Regional Transportation Plans and Priorities

The TPO will ensure that the regional projects contained in the Adopted 2035 Mobility Vision Plan are included in the regional LRTPs of the CCC and CFMPOA.

o Continued participation in ongoing Regional Visioning Efforts in Central Florida.

Each work task is detailed according to proposed methodology, cost estimate, funding sources, and the agencies responsible for completing the work.

There are eight (8) planning factors under the Safe, Accountable, Flexible, Efficient Transportation Equity Act – Legacy for Users (SAFETEA-LU), which must be considered in the TPO planning process. Accordingly, the TPO makes a deliberate effort to incorporate these factors, or planning emphasis areas, into its planning program. The matrix in Appendix C identifies how these factors are addressed through the UPWP planning tasks.

Polk County and all of the seventeen municipalities have adopted local government comprehensive plans pursuant to Chapter 163, Florida Statutes. The transportation projects and programs developed by the TPO are reviewed to ensure their consistency with these adopted local government comprehensive plans.

TPO Agreements The TPO executes and maintains various agreements with its funding agencies and planning partners. On January 16, 2004, the Governor approved a reapportionment plan for the TPO Board to maximize the participation of municipal governments. The plan provides two (2) alternate voting memberships for smaller municipalities that comprise an East County Bloc and a South County Bloc. The Interlocal Agreement creating the newly formed TPO was executed on August 11, 2004.

The Polk TPO’s Staff Services agreement between the Polk TPO and Polk County Board of County Commissioners was revised and approved by the TPO Board on April 10, 2008 and by Polk County on August 6, 2008. The TPO and Polk County are currently in the process of approving a Renewal Agreement to continue the current arrangement for TPO staff services. This agreement is expected to be executed in early 2012.

The current Transportation Planning Funds Joint Participation Agreement (JPA) between the Polk TPO and FDOT was approved on December 8, 2011.

The TPO conducts transit planning under a continuing Federal Transit Administration (FTA) Section 5303 JPA executed on January 25, 2008. In October of 2008 the TPO and FDOT signed Exhibit 2 of the current JPA based on changes from a one to two year UPWP cycle. Exhibit 2 will supersede the previous agreement until a new one can be signed by both the FDOT and TPO. A new multi-year JPA will be executed between TPO and FDOT for funding year 2012/2013.

On September 30, 2011, The TPO executed a Memorandum of Understanding (MOU) between TPO and the Polk Transit Authority (PTA), the Polk County Board of County Commissioners (BoCC) and the Lakeland Area Mass Transit District (LAMTD) for cooperation with planning and programming public transportation projects.

In June 2011 the TPO executed a JPA with the FDOT for a park and ride study in the I-4 corridor. This study will be incorporated into the 2012 major update to the Transit Development Plan (TDP).


The TPO receives technical assistance from CUTR on a periodic basis and in 2012 the TPO executed an Interlocal Agreement between the Polk TPO and the University of South Florida to Provide Technical Assistance through the Center for Urban Transportation Research (CUTR).

In 2011, the Polk TPO executed a revised Interlocal Agreement for coordinated regional transportation planning activities for the West Central Florida Chairs Coordinating Committee (CCC) which includes the Hernando, Hillsborough, Pasco, Pinellas, Polk and Sarasota/Manatee MPO/TPOs.

In 2012, the Polk TPO Amended the Interlocal Agreement with the Central Florida Metropolitan Planning Organization (MPO) Alliance in regards to administrative procedures for the Alliance.

Organization and Management The TPO develops transportation plans and programs for Polk County as mandated by federal and state legislation. It serves a lead role in transportation planning, and it provides a forum for cooperative decision-making regarding countywide transportation issues. The TPO was established through the execution of an interlocal agreement by member governments pursuant to Section 163.01, F.S. The agency is comprised of a policy board (local elected officials), advisory committees, and staff members. The TPO Board and its advisory committees operate under bylaws approved by the TPO Board.

The TPO Board has nineteen voting members with representatives from the following local governments:

The Technical Advisory Committee (TAC) provides technical review, supervision, and assistance to the TPO on transportation planning matters for Polk County. This committee


is comprised of planners, engineers, managers from the member governments, and non-voting representatives from state and federal agencies.

The Citizens Advisory Committee (CAC) provides a forum for public participation in the planning process of the TPO. Its membership consists of a broad range of participants representing various sectors of Polk County to include, local commerce, private non-profit organizations, and community organizations. Committee members are appointed by the local governments for the jurisdiction that they reside in and are then confirmed by the TPO Board. The CAC has a Bicycle/Pedestrian Subcommittee which is comprised of CAC members with an interest in bike/ped issues and multi-modal transportation. The TPO also has several ad hoc committees that meet on an as needed basis to address special projects such as the Transportation and Land Use Forum, and LRTP Update Steering Committee.

The Polk TPO also serves as the official planning agency for the Polk County Transportation Disadvantaged Program and provides staff support to the Transportation Disadvantaged Coordinating Board.

The TPO is part of Polk County’s Office of Planning and Development and is the primary agency responsible for transportation planning. The FDOT is a partner in the “3C” planning process.

Planning activities or tasks are funded through federal, state, and local sources. Federal funding is provided through the FHWA and FTA. The FDOT provides funding in the form of both hard cash and soft cash matches, and toll revenue expenditures are used as a credit, or soft cash match, toward FHWA funds. The Polk County BoCC provides a local cash

match to various tasks.


Multi-Year Business Plan FY 2012/13 through 2014/15 In an effort to ensure that adequate funding is available for short and long terms projects contained in the FY 2012/13 – 2013/14 Unified Planning Work Program (UPWP), the TPO has prepared a multi-year business plan as part of the UPWP. The multi-year business plan outlines ongoing projects and new projects that are anticipated within the next three (3) years (FY 2012/13 through FY 2014/15). In Table B1. (FY 2012/13 – 2013/14 UPWP Funding), it is shown that there is a combined $1,550,827 available in FHWA planning funds to program for FY 2012/13 and FY 2013/14. The various tasks and projects outlined in the UPWP require $1,562,993. Table B2. (Consultant Projects) illustrates the major consultant projects that are needed in support of the FY 2012/13 – 2013/14 UPWP. In FY 2012/13 the TPO has budgeted funds to finish the Complete Streets Project which began in FY 2011/12. Also, the TPO has allocated funds for its traffic count program in FY 2012/13 and FY 2013/14. This information is used by the TPO to monitor major county and city roads. In FY 2013/14 and in anticipation of the Polk TPO receiving Transportation Management Area (TMA) status, the TPO is allocating funding in FY 2013/14 for consultant services to assist staff in updating our Congestion Management Process. Also in FY 2013/14, the TPO will allocate funding for consultant services in support of the 2040 Long-Range Transportation (LRTP) Update which must be adopted by December 2015. In FY 2013/14 these activities will focus on the development of a 2040 Population and Employment Forecast and Transportation Modeling in support of the 2040 LRTP. Table B3. (Projected FHWA PL Funding) identifies the use of projected PL funding through Fiscal Year 2014/15. It should be noted that the funding amounts shown in FY 2014/15 are based on estimates and are subject to change.

1.0 Administration Task 1.1 Program Administration and Management

OBJECTIVE: To administer and manage a 3-C (Comprehensive, Cooperative and Continuing) transportation planning process for Polk County pursuant to federal and state requirements.

PREVIOUS WORK:

Continued assurance of a successful and 3-C planning process from FY 1975/76 to FY 2011/12 by receiving annual federal and state certification;

Continued staff support to the TPO Board and advisory committees; Adoption of the FY 2010/11 – 2011/12 UPWP; and Executed an updated Staff Services Agreement in FY 2011/12.

METHODOLOGY: TPO staff will undertake administrative and managerial work in support of FY 2012/13 through 2013/14 planning tasks. This work will include grants management per required procedures, preparation for and documentation of meetings, publication of planning and administrative documents, and expenditure of direct and indirect costs in support of the planning process. Staff will ensure compliance with federal and state TPO certification requirements and Title VI of the Civil Rights Act of 1964 and Environmental Justice Orders. Staff will prepare meeting agenda and packets to be distributed in paper and electronic format. Meeting minutes will be prepared to document Board and committee actions, and staff will prepare quarterly progress reports to monitor the completion of outlined planning tasks. The Polk County Clerk of Courts will prepare a comprehensive financial audit that meets federal and state requirements in compliance with 23 C.F.R. 420.211(c) and 49 CFR 18.26, 49 CFR part 90, OMB circular A133, and F.S.S. 215.97. This audit and indirect cost allocation plan will be prepared on an annual basis following the close of the Polk County Government’s fiscal year on September 30.

Task 1.1A Multi-Media Presentations

2.0 Surveillance Activities

Task 2.1 Travel Data and Strategies OBJECTIVE: To implement a systematic process to collect and analyze travel data including safety related items, develop strategies to preserve and increase the safety and mobility of the transportation system, and collect data that will aid in transportation decision making related to the allocation of resources. PREVIOUS WORK:

Established the TPO Traffic Count Program and continued maintenance of the Roadway Network Database (RND) for state and non-state roads;

Traffic count data has been collected nearly every year since 1993; Continuous surveillance of existing and proposed land developments including active

Developments of Regional Impact (DRI) for transportation related impacts; Continued assistance to local governments in the review of traffic studies to identify

impacts to the major road network; Continued assistance to local governments in the review of Comprehensive Plan

amendments; Publication of annual Trends and Conditions Report (2002 – 2010); In conjunction with FDOT completed a Transit Stop Inventory in 2010 which

documented the location of bus stops, passenger amenities, and the presence of sidewalks and bicycle facilities;

Completed an inventory of bicycle facilities and sidewalks on the major road network. Data used to identify Strategic Bicycle and Pedestrian Needs as part of 2035 Mobility Vision Plan (MVP); and

Staff identified “High Crash Corridors” for motor vehicle, bicycle and pedestrian crashes.

METHODOLOGY: This task will include the continued implementation of the congestion management process (CMP) to monitor travel conditions on the major road network and consultant services will be used to collect traffic counts on non-state roads in support of this effort. Staff will coordinate with the FDOT in regards to the collection of travel data, particularly data for the Highway Performance Monitoring System (HPMS). Staff will continue to monitor transportation impacts associated with land development, including DRIs. The TPO prepares an annual Trends and Conditions Report in support of the Congestion Management Process. This report includes a comprehensive assessment of the current state of Polk County’s transportation system and a comparison to peer and neighboring counties. The report now includes a spatial database with the location of pedestrian and bicycle crashes. The Roadway Network Database (RND) will be updated at least annually to include the following information by Congestion Management System (CMS) Link: functional classification, traffic volume, peak-hour level-of-service, and projected five year level-of-service (LOS). The TPO will provide assistance to local governments in reviewing development-related traffic impacts and implementing a coordinated approach to identifying and funding

3.0 Systems Planning Task 3.1 Long Range Transportation Planning OBJECTIVE: Implement and maintain a Mobility Vision Plan (MVP), e.g., long-range transportation plan, to meet the travel needs of Polk County. PREVIOUS WORK:

On December 7, 2010, the TPO Board adopted the 2035 Mobility Vision Plan (MVP). The 2035 MVP, a financially-constrained plan, includes road, transit, bicycle, pedestrian, multi-use trail, intelligent transportation system (ITS) and safety improvements;

In FY 2008/09, the TPO developed 2035 and 2060 Population and Employment Forecasts in five year increments that are consistent with current development trends and future land use plans;

In FY 2008/09 the TPO Board adopted the 2060 Transportation Vision Plan (TVP) which identifies multimodal corridors intended to serve Polk’s future travel needs.

METHODOLOGY: In FY 2012/13 and 2013/14 the TPO will prepare amendments to the 2035 Mobility Vision Plan (MVP), as needed, to ensure consistency with Federal transportation legislation, the TPO’s TIP, FDOT’s Adopted Work Program and local government capital improvement plans (CIP). Pursuant to Federal requirements, the Polk TPO must adopt an updated 2040 Long-Range Transportation Plan (LRTP) by December 2015. The new plan will be an update to the 2035 MVP that was adopted in 2010. The development of a long-range transportation plan can take several years. Therefore, the TPO has allocated funding for consultant services in FY 2013/14 for the preparation of 2040 population and employment forecast that will be used to forecast future travel demand in the updated Plan. Additionally the TPO has allocated funding for transportation model development in support of the 2040 Plan Update. These funds will be used to prepare model networks that identify unfunded needed highway projects and cost-feasible highway projects that will be contained in the 2040 LRTP. TPO staff will coordinate with the West Central Florida Chairs Coordinating Committee (CCC) and Central Florida MPO Alliance (CFMPOA) to ensure the TPO’s 2035 MVP, and any amendments to the MVP, are integrated into the regional long-range transportation plans. TPO staff will assist Polk County’s local governments to ensure that their Comprehensive Plans are consistent with the 2035 MVP.

Task 3.2 Short Range Transportation Planning OBJECTIVE: To address Polk County’s travel needs through short range multi-modal planning. Adopt and maintain a Transportation Improvement Program. PREVIOUS WORK:

Annual development and adoption of the Consolidated Transit Development Plan for the Lakeland Area Mass Transit District and Winter Haven Area Transit (2001 – 2010);

Continuous development of TPO priorities for road, transit, aviation, congestion management, and transportation enhancement projects;

Annual adoption of the Transportation Improvement Program; Preparation and adoption of Congestion Management Process/Plan (CMP) in 2009; Analysis of Congested Corridors identified in the CMP in 2009; Ongoing development and implementation of the process known as Early and

Continuing Coordination on Road Projects; Coordinated efforts with stakeholders to introduce legislation in the 2007 session to

form the Polk Transit Authority (PTA), which was signed by Governor Crist into law on June 29, 2007.

TPO staff provided support in the formation of a Corridor Advocacy Group for the SR 17 Scenic Highway. Staff participated in the development and review/adoption of the Corridor Management Plan (CMP) and the update of the CMP in 2009/10. SR 17 was designated as a Florida Scenic Highway in 2005.

TPO provided support and financial assistance (FTA 5303 funds) to the PTA’s Comprehensive Operations Analysis (COA) in 2009.

METHODOLOGY: Most of the short range planning will culminate in the adoption of the Transportation Improvement Program (TIP) as follows:

Evaluation of existing transit services and consideration of service improvement alternatives in response to identified needs;

Review surface access and inter-modal needs related to airport master plans and staff support to the Joint Airport Zoning Board (JAZB);

Review of proposed and programmed transportation projects in relation to mobility (transit access and bicycle and pedestrian facilities), and safety considerations such as lighting;

Participate in commuter and high-speed rail studies; and Development of a TPO Priority Projects list and Transportation Improvement

Program (TIP) in 2013 and 2014. The TPO will prepare and publish an annual list of projects for which federal funds have been obligated in the preceding year. TPO staff will continue to provide support to the Polk Transit Authority (PTA).


The TPO will continue to identify and prioritize Candidate Transportation Enhancement, Congestion Management and Safety Projects as part of the annual priority transportation projects. The TPO will continue to provide staff support to local efforts in updating and implementing the Corridor Management Plan for the Ridge Scenic Highway (SR 17). The TPO will participate in the FDOT District-wide Commuter Services Program, to include local and regional meetings, document reviews, and coordination on local and regional issues. In updating the Transportation Disadvantaged Service Plan (TDSP), the TPO will coordinate with its Local Coordinating Board (LCB), and the Polk Transit Authority (PTA), as well as representatives of public, private and non-profit transportation providers to ensure that this plan meets the SAFETEA-LU provisions for a Coordinated Human Services Transportation Plan. Task 3.5 Public Involvement Process OBJECTIVE: Educate and inform the public regarding transportation projects, plans, and issues. Maintain a public involvement process to meet federal and state requirements. PREVIOUS WORK:

Developed and adopted the TPO Public Involvement Process in FY 1994/95. The plan was amended in FY 2001/02 and in FY 2008/09;

Distributed transportation information through newsletters, brochures, newspaper articles, and radio;

FY 2007/08 Developed a Countywide Trails Brochure and Trail Map; Developed and used a more customer friendly and marketable name and logo for

the long range transportation plan – Mobility Vision Plan (MVP);

Sponsored public involvement activities related to the 2035 MVP; Published “Polk Transportation Timeline – A History of Transportation in Polk

County.”; Sponsored an annual poster contest (2004 – 2010) in conjunction with public and

private educational institutions, using the theme “Transportation in the year 2030/2035.”;

Developed MVP brochures and presentations; Provided direct support to project consultants on public involvement efforts for the

2035 MVP; Developed a project website for the 2035 MVP

METHODOLOGY: The TPO’s Communications Specialist will prepare and maintain information and fact sheets on transportation projects and process requests and develop a contact list for neighborhood and community groups to conduct outreach programs. The overall performance and effectiveness of public involvement and engagement strategies will be evaluated, including attempts to incorporate groups that are traditionally under served by the transportation system. In FY 2012/13 the TPO will update the Public Participation Plan (PPP) that was last adopted in 2008. In updating the PPP, the TPO will attempt to pursue innovative, cost-


effective public involvement techniques such as integrating the use of Twitter and Facebook social media as part of our public involvement efforts. On an annual basis the TPO will evaluate the effectiveness of its public participation process by using the evaluation methods and performance standards outlined in Appendix A of the adopted Public Participation Plan (PPP). Recommendations will be developed using community impact assessment techniques in the TPO planning, and an assessment of the distribution of benefits and adverse environmental impacts will be given on plan and project levels. Staff will institute a guest speaker series to schedule speakers at various community and business groups and clubs to speak on transportation related topics of local interest. The target audience may include elected officials, professional staff, or citizens. TPO staff and advisory committee members (whenever possible) will participate in a Speaker’s Bureau. Presentations on transportation plans and programs will be made to civic or neighborhood groups as part of community outreach efforts. Through our website, www.PolkTPO.com, the TPO will make available for viewing and download a compilation of existing transportation data and adopted plans including the 2035 MVP. The Polk County Communications Office broadcasts the TPO Board Meetings (live and tape-delayed) on PGTV. The Communications Office provides approximatly $1,000 in in-kind services for this and other related services. Task 3.6 Regional Planning and Coordination OBJECTIVE: To maintain and improve regional coordination and transportation planning in central Florida and to support the identification, prioritization and implementation of improvements to the regional transportation system including the Strategic Intermodal System (SIS). PREVIOUS WORK: The Polk TPO became a member of the West Central Florida Metropolitan Planning Organization Chairs Coordinating Committee (CCC) in 2000 and a member of the Central Florida MPO Alliance in 2003.

The TPO participated in the development of Regional Transportation Plans for both the CCC and Central Florida MPO Alliance (CFMPOA).

The TPO coordinated with its regional partners to identify a regional multi-use trail system. In 2007, the TPO participated in the update of the CCC’s Regional Multi-Use Trail Element and the preparation of a Regional Multi-Use Trails brochure.

In 2005, the Polk TPO identified the “Regional Road Network” in Polk County as a source of candidate Transportation Regional Incentive Program Projects. This Regional Road Network was endorsed by both the CCC and CFMPOA and has been updated several times since. The TPO participated in the development of Regional Priority Projects for the referenced grant program.

The CCC recently adopted a Public Participation Plan (PPP) in 2008 and continues to implement new strategies for engaging the public in accordance with the regional PPP. The CCC continues to maintain and update a website and also developed Title VI and Limited English Proficiency (LEP) processes and discrimination complaint procedures.

As part of its 2030 and 2035 Long-Range Transportation Plans (LRTP), the Polk TPO prepared a “Regional Transportation System” element. This regional element (regional system and proposed improvements in Polk County) was subsequently incorporated in the respective regional plans.

The TPO participates in quarterly CCC and Central Florida MPO Alliance Board meetings, Regional GIS meetings, Joint CAC public meetings (CCC), Regional Multi-Use Trails Committee meetings (CCC), staff director meetings, and TRT biweekly meetings (CCC). Annually, the Polk TPO hosts a joint coordination meeting between the CCC and MPO Alliance (these two regional MPO committees in Central Florida consist of 11 MPOs).

METHODOLOGY: The TPO will participate in the following regional planning efforts:

Continued update and maintenance of regional transportation plans; Identification of congested corridors and areas with strategies for congestion relief

as part of regional congestion management efforts;


Identification of Regional Transportation System to include highway, transit and multi-use trail network;

Preparation of Regional Transportation Priorities including candidate projects for the Transportation Regional Incentive Program;

Develop and update a regional Congestion Management Process (CMP) performance report (CCC);

Conduct regional air quality conformity modeling and analysis and produce determinations for LRTPs and TIPs in the region and update the Regional LRTP as needed (CCC);

Participation in regional highway and transit studies; and Participation in regional public involvement process and safety initiatives.

The Polk TPO will continue to participate in the Central Florida Smart Growth Alliance and regional visioning efforts including: MyRegion.org; OneBay; and Heartland 2060. The TPO will participate in the CCC and CFMPOA update to its Regional Long Range Transportation Plan to ensure that the regional components (highway, transit and multi-use trails) of the TPO’s 2035 Long-Range Transportation Plan are reflected in these regional plans. The TPO will work with the CCC and CFMPOA to develop a prioritized list of regional projects that are eligible for Transportation Regional Incentive Program (TRIP) and Regional Multi-Use Trail funding. The TPO staff will attend meetings of the Tampa Bay Regional Transportation Authority (TBARTA) and provide input to the development of TBARTA’s master planning efforts, as appropriate. The TPO will continue to participate and coordinate with FDOT District One’s Coordinated Urban Transportation Studies (CUTS) Committee which is comprised of all the MPOs in District One. Consistent with regional visioning efforts that the TPO has supported, the Polk County Board of County Commissioners (BoCC) in partnership with Polk Vision and the Polk TPO will develop and implement a coordinated land use and transportation strategy. This effort is referred to as the Livable Polk Initiative and will help link neighborhoods to transit, jobs and educational opportunities. TPO staff will assist the Polk BoCC and Polk Vision in developing this strategy. The TPO will provide financial assistance ($5,000) to METROPLAN ORLANDO for administrative and planning support for the Central Florida MPO Alliance (CFMPOA). METROPLAN ORLANDO will provide professional staff support to the Alliance in the form of a staff person who will spend a portion of their time on strategies, programs and projects of importance to the CFMPOA. These tasks will consist of meeting agenda preparation, printing, meeting minutes, mailings, making meeting location arrangements including


coordinating the annual meeting of the CFMPOA and CCC. The TPO will also provide administrative and staff support for quarterly meetings of the West Central Florida Chairs’ Coordinating Committee including the Joint CAC and the CCC Board. This support will consist of the preparation of meeting agendas and meeting packets, maintain up-to-date distribution lists, arrange meeting equipment and venues rotating among the member MPOs, prepare minutes and follow-up correspondence, and post all materials on-line. Provide staff support for biweekly, staff directors meetings. Arrange for venues and conference calls, prepare and distribute agendas and attachments, follow up on agenda items as needed/directed including coordination with partner agencies, monitor update schedule for regional documents and coordinate the drafting, review, and final distribution of updated documents (CCC). The TPO and other member MPOs of the CCC may use consultant services to help complete these tasks. One member or partner agency of the CCC may take the lead on a portion of this work and be reimbursed by other members or partner agencies of the CCC. In support of these services the Polk TPO will provide financial assistance in the amount of $5,000 to the Hillsborough MPO for CCC staff services in FY 2012/13 and 2013/14.

RESPONSIBLE AGENCY: Polk County. In FY 2012/13 and 2013/14, the TPO will allocate funding for administrative and staff support for the Central Florida MPO Alliance ($5,000 will be provided to METROPLAN ORLANDO) and West Central Florida Chairs’ Coordinating Committee ($5,000 will be provided to the Hillsborough MPO). The undersigned certifies, to the best of her or his knowledge and belief, that:

employee of any agency, a Member of Congress in connection with the awarding of any

Federal Contract, the making of any Federal grant, the making of any Federal loan, the

entering into of any cooperative agreement, and the extension, continuation, renewal,

amendment, or modification of any Federal contract, grant, loan, or cooperative

agreement.

(2) If any funds other than Federal appropriated funds have been paid or will be paid to any

prerequisite for making or entering into this transaction imposed by Section 1352, Title 31,

U.S. Code. Any person who fails to file the required certification shall be subject to a civil

DISADVANTAGED BUSINESS ENTERPRISE UTILIZATION

It is the policy of the Polk Transportation Planning Organization (TPO) that disadvantaged businesses, as defined by 49 Code of Federal Regulations, Part 26, shall have an opportunity to participate in the performance of TPO contracts in a nondiscriminatory environment. The objectives of the Disadvantaged Business Enterprise Program are to ensure non-discrimination in the award and administration of contracts, ensure firms fully meet eligibility standards, help remove barriers to participation, create a level playing field, assist in development of a firm so it can compete successfully outside of the program, provide flexibility, and ensure narrow tailoring of the program. The Polk TPO, and its consultants shall take all necessary and reasonable steps to ensure that disadvantaged businesses have an opportunity to compete for and perform the contract work of the Polk TPO in a non-discriminatory environment. The Polk TPO shall require its consultants to not discriminate on the basis of race, color, national origin, sex, age, handicap/disability, or income status in the award and performance of its contracts. TITLE VI/ NONDISCRIMINATION POLICY STATEMENT

The Polk Transportation Planning Organization (TPO) assures the Florida Department of Transportation that no person shall on the basis of race, color, national origin, sex, age, disability, family or religious status, as provided by Title VI of the Civil Rights Act of 1964, the Civil Rights Restoration Act of 1987 and the Florida Civil Rights Act of 1992 be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination or retaliation under any program or activity. The Polk TPO further agrees to the following responsibilities with respect to its programs and activities:

1. Designate a Title VI Liaison that has a responsible position within the organization and access to the Recipient’s Chief Executive Officer.

2. Issue a policy statement signed by the Chief Executive Officer, which expresses its commitment to the nondiscrimination provisions of Title VI. The policy statement shall be circulated throughout the Recipient’s organization and to the general public. Such information shall be published where appropriate in languages other than English.

3. Insert the clauses of Appendix A of this agreement in every contract subject to the Acts and the Regulations

4. Develop a complaint process and attempt to resolve complaints of discrimination against sub-recipients. Complaints against the Recipient shall immediately be forwarded to the FDOT District Title VI Coordinator.

5. Participate in training offered on Title VI and other nondiscrimination requirements. 6. If reviewed by FDOT or USDOT, take affirmative action to correct any deficiencies

found within a reasonable time period, not to exceed ninety (90) calendar days. 7. Have a process to collect racial and ethnic data on persons impacted by your

agency’s programs. THIS ASSURANCE is given in consideration of and for the purpose of obtaining any and all federal funds, grants, loans, contracts, properties, discounts or other federal financial assistance under all programs and activities and is binding. APPENDIX A During the performance of this contract, the contractor, for itself, its assignees and successors in interest (hereinafter referred to as the “Contractor”) agrees as follows: (1.) Compliance with Regulations: The Contractor shall comply with the Regulations

relative to nondiscrimination in Federally-assisted programs of the U.S. Department of Transportation (hereinafter, “USDOT”) Title 49, Code of Federal Regulations, Part 21, as they may be amended from time to time, (hereinafter referred to as the Regulations), which are herein incorporated by reference and made a part of this Agreement.

(2.) Nondiscrimination: The Contractor, with regard to the work performed during the

contract, shall not discriminate on the basis of race, color, national origin, sex, age, disability, religion or family status in the selection and retention of subcontractors, including procurements of materials and leases of equipment. The Contractor shall not participate either directly or indirectly in the discrimination prohibited by section 21.5 of the Regulations, including employment practices when the contract covers a program set forth in Appendix B of the Regulations.

(3.) Solicitations for Subcontractors, including Procurements of Materials and

Equipment: In all solicitations made by the Contractor, either by competitive bidding or negotiation for work to be performed under a subcontract, including procurements of materials or leases of equipment; each potential subcontractor or supplier shall be notified by the Contractor of the Contractor’s obligations under this contract and the Regulations relative to nondiscrimination on the basis of race, color, national origin, sex, age, disability, religion or family status.

(4.) Information and Reports: The Contractor shall provide all information and reports

required by the Regulations or directives issued pursuant thereto, and shall permit access to its books, records, accounts, other sources of information, and its facilities as may be determined by the Florida Department of Transportation, the Federal Highway Administration, Federal Transit Administration, Federal Aviation Administration, and/or the Federal Motor Carrier Safety Administration to be pertinent to ascertain compliance with such Regulations, orders and instructions. Where any information required of a Contractor is in the exclusive possession of another who fails or refuses to furnish this information the Contractor shall so certify to the Florida Department of Transportation, the Federal Highway Administration, Federal Transit Administration, Federal Aviation Administration, and/or the Federal Motor Carrier Safety Administration as appropriate, and shall set forth what efforts it has made to obtain the information.

(5.) Sanctions for Noncompliance: In the event of the Contractor’s noncompliance

with the nondiscrimination provisions of this contract, the Florida Department of Transportation shall impose such contract sanctions as it or the Federal Highway Administration, Federal Transit Administration, Federal Aviation Administration, and/or


the Federal Motor Carrier Safety Administration may determine to be appropriate, including, but not limited to:

a. withholding of payments to the Contractor under the contract until the Contractor

complies, and/or b. cancellation, termination or suspension of the contract, in whole or in part.

Incorporation of Provisions: The Contractor shall include the provisions of paragraphs (1) through (6) in every subcontract, including procurements of materials and leases of equipment, unless exempt by the Regulations, or directives issued pursuant thereto. The Contractor shall take such action with respect to any subcontract or procurement as the Florida Department of Transportation, the Federal Highway Administration, Federal Transit Administration, Federal Aviation Administration, and/or the Federal Motor Carrier Safety Administration may direct as a means of enforcing such provisions including sanctions for noncompliance. In the event a Contractor becomes involved in, or is threatened with, litigation with a sub-contractor or supplier as a result of such direction, the Contractor may request the Florida Department of Transportation to enter into such litigation to protect the interests of the Florida Department of Transportation, and, in addition, the Contractor may request the United States to enter into such litigation to protect the interests of the United States.

APPENDIX F CERTIFICATION OF TPO PLANNING PROCESS


Certification of TPO Planning Process Annually, the Florida Department of Transportation (FDOT) and the Polk Transportation Planning Organization (TPO) conduct a joint review of the TPO planning process. The purpose of this review is to evaluate the effectiveness of the planning process and to determine its compliance with applicable federal and state requirements. This joint review was conducted as part of the development of the FY 2012/13 – 2013/14 UPWP. The referenced parties jointly certify, pursuant to Code of Federal Regulations (CFR) Section 450.334, “Metropolitan Transportation Planning Process: Certification,” that the metropolitan transportation planning process in the Lakeland and Winter Haven Urbanized Areas is addressing the major issues facing the area and is being conducted in accordance with all applicable requirements.

The TPO was not required to take any corrective actions during the review period.

The following section includes a review of noteworthy achievements highlighted as part of the TPO Certification.

Noteworthy Achievements Public Outreach and Involvement

• The TPO has started the process of updating its Public Participation Plan (PPP) which was last adopted in 2008. As part of this update the TPO will attempt to create a more user-friendly document that increases the effectiveness of our community outreach efforts. Several techniques that are being considered include: Broadcasting Citizens’ Advisory Committees (CAC) via interactive webcasts so members and interested citizens that are unable to attend meetings can still participate and comment; Expanding the membership of the CAC to include members with interests in transit services and bicycle/pedestrian facilities; Expanding our outreach efforts by attending the community meetings of other civic groups and organizations that are interested in hearing about our plans and programs; and Sponsoring a Citizens Planning Program that will educate citizens about the TPO’s transportation planning process.

• The Polk Transit Authority (PTA) adopted a Public Involvement Strategy for the update of the Transit Development Plan (TDP). The TPO, in conjunction with the PTA is updating the TDP which will be adopted in the summer of 2012. The primary goals of the Public Involvement of Strategy are identifying and understanding Community Needs; Community Education on the need for and value of public transportation; and Developing and implementing a Consolidated Service Plan that provides countywide public transportation services and access to the regional transportation system.

Multi-Modal Transportation Plans


• On December 7, 2010, the Polk TPO Board adopted the 2035 Mobility Vision Plan (MVP). The 2035 MVP identifies numerous highway, transit, bicycle, pedestrian, and trail projects that help support a multi-modal transportation system. At the conclusion of a public hearing held on February 23, 2012, the TPO adopted several amendments to the 2035 MVP. It was necessary to amend the 2035 MVP in order to accurately reflect the correct funding years and phasing of projects that have been advanced in the FDOT 5-year Draft Tentative Work Program and maintain consistency between the plans. • Since 2003, TPO staff has provided support to the Ridge Scenic Highway Corridor Management Entity (CME). This support consists of developing and distributing meeting agenda materials and compiling annual reports on the status of the CME and the efforts to protect and enhance the corridor. In 2009, TPO staff worked with the CME to help develop the five year update to its Corridor Management Plan (CMP) which was approved in 2005 when State Road 17 was officially designated by FDOT as a State Scenic Highway. TPO staff assists the CME in updated the CMP annually. http://www.ridgescenichighway.com/home.php

Congestion Management System

• In support of the TPO’s adopted Congestion Management Plan (CMP) and 2035 Mobility Vision Plan, the TPO Board adopted a list of Congestion Management Projects as part of the TPO’s 2011 Priority Transportation Projects. These projects included safety, bicycle and pedestrian projects, transit service improvements, and intersection projects that will help supplement FDOT’s resurfacing program. As a matter of policy, the TPO annually sets aside $4 Million for Congestion Management Projects. The TPO has defined these projects to include traffic operations and low-cost construction projects intended to ease traffic congestion, as well as projects intended to enhance safety and multi-modal travel. The aim of these projects is to maximize the safety and efficiency of the existing transportation system. Noteworthy examples of projects that have been prioritized by the TPO and funded by FDOT in recent years include the following:

• Transit Shelter Construction in Lakeland and Winter Haven on Citrus Connection and Winter Haven Area Transit routes;

• US 98 at SR 540 Intersection widening in Lakeland; • Complete Streets Project on CR 540 (Clubhouse Rd) to include sidewalk,

bicycle Lanes and turn lane improvements; • Intersection improvements and signalization at SR 17 and Mountain

Lake Cutoff Road in Lake Wales; • Safety Analysis and funding for improvements on US 92 (Memorial

Boulevard), SR 37 (Florida Ave), and US 92 (Wabash Ave) in Lakeland;


• Chain of Lakes Trail - Trail Bridges over SR 544 in Winter Haven and US 17/92 in Lake Alfred;

• Countywide Transit Stop Inventory for all of the stops in Polk County; and • Sidewalk construction along SR 17 (Ridge Scenic Highway) in Frostproof,

Lake Wales, Lake-of-the-Hills and Haines City in support of the Ridge Scenic Highway Bike/Ped Plan that was prepared by FDOT District One.

• In October 2011 the TPO adopted a Policy on Transportation Projects in support of the TPO’s Congestion Management Process. In developing the TPO’s priority transportation projects each year the TPO accepts applications and project proposals from local governments for candidate congestion management, transportation enhancement, multi-use trail, regional multi-use trail and safe routes to school projects. The Policy on Transportation Projects is intended to assist applicants interested in submitting a candidate project under one of these categories. Transportation Improvement Program (TIP)

• The TPO implemented a process for “Early and Continuing Coordination on Road Projects.” Under this process, the TPO identifies the need to include appropriate pedestrian, bicycle, and safety features as part of major capacity and resurfacing projects. Since 2002, the TPO has reviewed and commented on the FDOT maintenance projects to identify the need for additional safety and multi-modal features. As part of its priority transportation projects, the TPO has set-aside funds (FDOT work program box) to address these needs when they fall outside the scope of the programmed maintenance project. As a result, many candidate projects have been funded with the TPO’s congestion management set-aside.

• In 2010 the TPO created an Interactive TIP Web Application for the Polk TIP which can be accessed from this link http://polktip.edats.com/. This program integrates FDOT’s Work Program and local CIP project information for the development of the TIP. The program includes a Web Mapping Tool that enables users to locate the various TIP projects as well as run queries to search for specific project information. The TPO’s Draft FY 2012/13 – 2013/14 UPWP allocates funding that continues to promote and enhance this application.

Regionally Significant Projects and Regional Coordination Efforts

• The TPO is a member of the West Central Florida Metropolitan Planning Organization Chairs Coordinating Committee (CCC) and the Central Florida MPO Alliance (CFMPOA). Regionally significant transportation projects are


addressed as part of the regional coordination process and there have been joint efforts to increase and accelerate funding for such regional projects.

• On March, 11, 2011, the CCC amended its 2035 Regional Long-Range Transportation Plan to include the regional projects from the 2035 MVP.

• The CCC in the process of updating the Regional Congestion Management Process (CMP). The CMP is expected to be adopted by the CCC later this year.

• Annually, the Polk TPO has hosted a Joint Meeting of the CCC and the CFMPOA to discuss regional transportation issues common to both groups. These meetings include 11 MPO/TPO’s in Central Florida and are well attended by the general public. Attendance at these meetings is typically exceeds a hundred.

• Annually, the TPO prioritizes candidate Transportation Regional Incentive Program (TRIP) projects that are reviewed and approved by the CCC. Since the TRIP program was established, Polk County has received funding for five (5) regional transportation projects.

• Annually since 2009, the Polk TPO develops a prioritized list of candidate Regional Multi-Use Trail Projects for consideration for funding by FDOT District One. These projects are endorsed by the CCC. Three (3) projects in Polk County have been awarded funding since 2009.

Regional Visioning Efforts

• The Polk TPO has participated in several long range visioning efforts in Central Florida such as the myRegion.org plan which includes east Central Florida and the Orlando metropolitan area, Reality Check Tampa Bay that includes west Central Florida and the Tampa Bay region, and Heartland 2060 which includes seven interior counties in south Central Florida.

Public Transportation System

• As the Official Designated Planning Agency, TPO staff has provided support to the Polk County Local Coordination Board for the Florida Commission for the Transportation Disadvantaged. This support consists of developing and distributing meeting agenda materials and development of the Transportation Disadvantaged Service Plan (TDSP) and the Human Services Coordination Plan as required by law. The Polk County Local Coordinating Board received the “2011 Outstanding Local Coordinating Board of the Year” statewide award


from the Florida Commission for the Transportation Disadvantaged at their annual conference.

• With a service development grant provided by the FDOT, the TPO, FDOT, City of Lakeland and the Lakeland Area Mass transit District (LAMTD) continue to evaluate enhanced transit service in the South Florida Avenue (State Road 37) corridor. This is an example of one method of relieving congestion on a constrained roadway. By improving transit service in the corridor, traffic flows will be improved and congestion would be alleviated. The South Florida Avenue Transit Advisory Group (TAG) has successfully branded the corridor with its own distinct logo and color scheme on bus stop signs and shelters. Several shelters have been installed along the corridor and operational service enhancements have been made as a result of the work of the TAG.

• In January, 2012, the Polk TPO kicked off the 2012 major update to the Polk Consolidated Transit Development Plan (TDP). This planning document includes service improvements and transit needs for Polk County, and will serve as a visioning tool for Polk Transit and has been branded “My Ride.” FDOT requires a major update to this document every five years with annual progress reports in the interim years. This major plan update is expected to be completed and adopted by September 1, 2012.


2012 Joint Certification Review

During February of 2012, the Polk Transportation Planning Organization (TPO) and the Florida Department of Transportation (FDOT) District One conducted a modified certification review based upon the process outlined in the FDOT Metropolitan Planning Organization Program Management Handbook. This review addressed all of the planning requirements mandated by law referenced in the Joint Certification Statement and the questions outlined in Section 7.11 of the MPO Handbook.

The TPO and FDOT District One staff reviewed the Unified Planning Work Program (UPWP) development process for the upcoming Fiscal Years 2012/2013 and 2013/2014. Other discussion topics included:

During the 2010 Certification Review, among the topics discussed is the need for Polk TPO staff to begin efforts for the development and execution of a stand-alone consultant services contract. In the past, the TPO was granted approval to acquire consultant services under Polk County’s master consultant agreements (revised to include required language) in order to implement planning activities. Both District One and TPO staff were in agreement that having a stand-alone TPO consultant contract will eliminate many issues that may otherwise be encountered.

Update: During 2011, TPO and FDOT District One coordinated and developed the new agreement in cooperation with the District One Procurement office and The Polk County Purchasing Office.

During the 2011 Certification Review, the need to update the Transportation Planning Funds Joint Participation Agreement was recommended by District Staff.

Update: This has been completed. The updated agreement was executed on December 8, 2011.

Planning Emphasis Areas (PEAs)

The only State PEA, Transit Quality of Service was removed in 2010 per the Transit Section of Central Office. The eight Federal factors listed in U.S.C. 134(h) (1) should continue to be followed until such time that a Federal Reauthorization occurs. It is expected there will be changes or revisions at that time.

Proposed Revisions of Air Quality Standards for Ozone

Update: During the 2011 review, this was discussed and the TPO included a task in the UPWP for LRTP/TIP compliance. This has been postponed indefinitely. As a result, the Polk TPO will amend its current year UPWP, creating a new task and transferring funding previously anticipated to be needed to the new task. The new task will also be included in the FY 2012/13-2013/14 UPWP

Additional items discussed:

• Staff Services Agreement – Last year, one of the recommendations was for the Polk TPOs staff services agreement with Polk County be reviewed prior to August 6,


2011 for any revisions that may be needed - Update: This item has been completed and at the December 8, 2011 meeting, TPO staff requested the board’s approval to execute a renewal agreement with Polk County for continuation of services. The TPO staff should provide a copy of this agreement once finalized.

• Intergovernmental Coordination and Review and Public Transportation Coordination Joint Participation Agreement (ICAR)

The most recent ICAR was executed in 2006. The TPO should review the agreement to determine if there is a need to update.

• Interlocal Agreement for the Creation of the Polk Transportation Planning Organization

The most recent Interlocal Agreement was executed in 2004. Upon the release and result of the 2010 Census, the TPO may need to update and execute a new agreement.

• Public Participation Plan – The TPO will update their Public Participation Plan (PPP) over the next year. District staff recommended a review and possible revision to clarify the time frame for public notices to allow for minor revisions to the TPO’s TIP, UPWP, and LRTP. In addition, the Measures of Effectiveness contained in Appendix A, Public Involvement Evaluation Handbook should be reviewed. The TPO and District will review other MPO PPPs during the update process.

• Invoice Submittals - The TPO should make every effort to submit the final PL invoice in as timely a manner as possible to avoid any delay in obtaining updated allocation information for the next UPWP cycle. There should be a table included with each invoice reflecting each UPWP task’s approved amount, as well as running totals and remaining balances for each task. In addition, the progress reports accompanying invoice submittals should include more detail regarding the TPO staff activities during the period being reported.

• PL Closeout - Chapter 3, page 29; of the MPO Program Management Handbook, Unified Planning Work Program states the final invoice for Year Two of the Two Year UPWP should be submitted prior to September 30th of the second year. This is to allow the Closeout Confirmation process to be completed by September 30th. The TPO is under the umbrella of Polk County Government. Since the County’s Fiscal Year ends on September 30th, TPO staff must wait to obtain expenditure confirmations subsequent to this date. District staff requested the TPO strive to meet this date if at all possible.

• Title VI/DBE Reporting - Ensure that an updated Title VI agreement, as well as all required statements and assurances are signed as part of the UPWP development/amendment process. The TPO’s Title VI Coordinator reported there have not been any complaints during the past year. The TPO’s DBE utilization is reported in BizWeb by Polk County’s Purchasing Division.


• Audits - Discussion during the 2011 Certification review included FDOT staff informing TPO staff they are required to provide a copy of the Polk County Comprehensive Annual Financial Report, or CAFR to each TPO Board Member, either by hard copy or electronic format. The audit should be listed as a separate line item in the Unified Planning Work Program (UPWP) – This item was complied with.

• Congestion Management Process (CMP)

The Polk TPO is expected to become a Transportation Management Area (TMA) TPO as a result of the 2010 Census and is required to have a CMP. While the Polk TPO already has a CMP, it should be reviewed for the need to update the document over the coming year. District staff recommended the TPO consider including a policy governing right-of-way acquisition in the CMP.

In conclusion, both the TPO and FDOT staff agree the Polk Transportation Planning Organization’s metropolitan planning process is conducted in a consistent, comprehensive, and cooperative manner and should be certified.


JOINT CERTIFICATION STATEMENT ON THE METROPOLITAN TRANSPORTATION PLANNING PROCESS

Pursuant to the requirements of 23 U.S.C. 134 (k)(5), 23 CFR 450.334(a), the Department and the TPO have performed a review of the certification status of the metropolitan transportation planning process for the Polk Transportation Planning Organization (TPO) with respect to the requirements of: 1. 23 U.S.C. 134 and 49 U.S.C. 5303 et seq.; 2. Title VI of the Civil Rights Act of 1964 and the Title VI assurance executed by each state under 23 U.S.C. 324 and 29 U.S.C. 794; 3. Section 1101(b) of SAFETEA-LU (Public Law 109-59) regarding the involvement of disadvantaged business enterprises in FHWA and FTA funded planning projects and; 4. The provisions of the Americans with Disabilities Act (ADA) of 1990, (Public Law 101-336, 104 Stat. 327, as amended) and USDOT regulations under “Transportation for Individuals with Disabilities” (49 CFR Parts 27, 37, and 38). Included in this certification package is a summary of noteworthy achievements by the MPO, attachments associated with these achievements, and (if applicable) a list of any recommendations and/or corrective actions. The contents of this Joint Certification Package have been reviewed by the TPO and accurately reflect the results of the joint certification review meeting held on February 15, 2012. Based on a joint review and evaluation, the Florida Department of Transportation and the Polk Transportation Planning Organization (TPO) recommend that the Metropolitan Planning Process for the Polk Transportation Planning Organization (TPO) be certified.
