INTRODUCTION

The Coronavirus Aid, Relief, and Economic Security (CARES) Act, signed March 27,

2020, is the third of four federal relief packages enacted in response to the COVID-

19 pandemic. The CARES Act establishes two funds that are authorized for

expenditure for education-related purposes:

• $30.8 billion Education Stabilization Fund (Michigan: $866.9 million, all of

which is allocated for education-related purposes), allocated in four categories:

o $14.0 billion Higher Education Emergency Relief Fund (Michigan: $369.8

million).

o $13.2 billion Elementary and Secondary School Emergency Relief Fund

(Michigan: $389.8 million).

o $3.0 billion Governor’s Emergency Education Relief Fund (Michigan: $89.4

million).

o $307.5 million for grants to states with the highest coronavirus burden

(Michigan: $17.8 million).

o $307.5 million reserved for allocations to territories and programs operated

by the Bureau of Indian Education.

• $150.0 billion Coronavirus Relief Fund (Michigan: $3.9 billion, $730.0 million of

which is allocated for education-related purposes).

This fiscal brief describes the education-related allocations for Michigan from funds

established under the CARES Act.

FUND AUTHORIZATIONS

CARES Act funds related to education are allocated in Michigan through the

following means:1

• 2020 PA 67 authorized the expenditure of any federal funds received for the

COVID-19 crisis within 90 days of March 25, 2020 (i.e., by June 23, 2020). Under

this authorization, the State Budget Office (SBO) appropriated $479.2 million

Education Stabilization Fund.

• $369.8 million Education Stabilization Fund is appropriated directly to institutions of higher education (IHEs).

• The remaining $17.8 million Education Stabilization Fund is allocated as a high coronavirus burden grant

directly to the Michigan Department of Labor and Economic Opportunity (LEO).

• 2020 PA 123 authorized $18.0 million Coronavirus Relief Fund (CRF) to districts for instructional recovery

programming, benchmark assessments, or health and safety expenditures necessary to provide instruction

safely.

• 2020 PA 146 authorized $512.0 million CRF to districts in an amount equal to $350 per pupil and $200.0

million CRF to public universities and community colleges2 in an amount equal to each entity’s School Aid

Fund (SAF) reduction under the same public act.

FUND DISTRIBUTIONS

The education-related funds described above are allocated to K-12 districts, IHEs, and other entities. Table 1 groups each allocation by recipient type. Allocations are described in further detail in the following sections.

HIGHER EDUCATION EMERGENCY RELIEF FUND: $14.0 BILLION (MICHIGAN: $369.8 MILLION)

The Higher Education Emergency Relief (HEER) Fund is allocated in the following three categories.

Emergency Student Aid and Institutional Coronavirus Related Costs

90% ($12.6 billion; Michigan: $354.8 million) is allocated to each IHE using the following formula:

• 75% is distributed according to the calculated measure of full-time equivalent (FTE) enrollment of federal Pell

Grant recipients who are not exclusively enrolled in distance education courses.

• 25% is distributed according to the calculated measure of FTE enrollment of students who are not federal

Pell Grant recipients and who are not exclusively enrolled in distance education courses.

The institutions may use funds to cover costs associated with significant changes to the delivery of instruction due

to the coronavirus. However, at least 50% of the funds must be used to provide emergency financial aid grants

directly to students for expenses related to the disruption of campus operations due to the coronavirus, such as food,

housing, technology, or health care expenses.

Institutions are prohibited from using HEER Fund appropriations for the following costs:

• Payment to contractors for the provision of pre-enrollment recruitment activities.

• Endowments.

• Capital outlays associated with facilities related to athletics, sectarian instruction, or religious worship.

The U.S. Department of Education (U.S. ED) has issued a ruling that funds may go only to students who are eligible

to participate in programs under Title IV of the Higher Education Act (i.e., U.S. citizens and permanent residents).3

Out of the $354.8 million allocation for Michigan IHEs, public community colleges received $93.9 million and public

universities received $189.9 million. See Appendix A for allocations to Michigan IHEs.

Awards to Historically Black Colleges and Universities (HBCUs) and Minority-Serving Institutions

7.5% ($1.1 billion; Michigan: $9.1 million) is allocated for additional awards to IHEs under Parts A (Strengthening

Institutions Program) and B (Strengthening Historically Black Colleges and Universities Program) of Title III, Parts A

(Developing Hispanic-Serving Institutions Program) and B (Promoting Postbaccalaureate Opportunities for Hispanic

Americans) of Title V, and Subpart 4 of Part A of Title VII (Master’s Programs at HBCUs and Predominantly Black

Institutions) of the Higher Education Act. These funds are allocated in proportion to the funding of such programs in

the 2020 Further Consolidated Appropriations Act.

Awards may be used for:

• Defraying expenses, including lost revenue, reimbursement for expenses already incurred, technology costs

associated with a transition to distance education, faculty and staff trainings, and payroll.

• Grants to students for any component of the student’s cost of attendance, including food, housing, course

materials, technology, health care, and child care.

Michigan public community colleges received $3.2 million, and public universities received $2.1 million. See

Appendix A for allocations to eligible Michigan IHEs.

Supplemental Emergency Funding

2.5% ($348.8 million; Michigan: $5.9 million) is allocated to IHEs that the U.S. ED determines have the greatest unmet

needs related to the coronavirus. Funds may be used for the same purposes described under the HBCU 7.5%

allocation. Priority must be given to any institution that is not otherwise eligible for at least $500,000 under the 90%

formula-based allocation and that demonstrates significant unmet needs related to expenses associated with the

coronavirus.

In Michigan, the supplemental funding effectively increased 19 IHEs’ total HEER Fund allocations to $500,000,

although no Michigan public community colleges or universities received funding from this category. See Appendix

A for allocations to eligible Michigan IHEs.

ELEMENTARY AND SECONDARY SCHOOL EMERGENCY RELIEF (ESSER) FUND: $13.2 BILLION (MICHIGAN: $389.8

MILLION)

ESSER funds are allocated to each state in the same proportion as the state’s FY 2019-20 Title I, Part A allocation

under the Elementary and Secondary Education Act (ESEA).

Subgrants to Local Educational Agencies (LEAs)

90% (Michigan: $350.8 million) of a state’s grant is allocated for formula subgrants to LEAs in proportion to Title I,

Part A allocations. Appendix B details the subgrant amount available for each eligible district in Michigan. The

application process for subgrants in Michigan began on May 8, 2020, and ended September 30, 2020.

An LEA may use funds for any of the following allowable expenses incurred on or after March 13, 2020:

1. Any activity authorized by the ESEA, including the Native Hawaiian Education Act and the Alaska Native

Educational Equity, Support, and Assistance Act; the Individuals with Disabilities Education Act (IDEA); the

Adult Education and Family Literacy Act; the Carl D. Perkins Career and Technical Education Act; or Title VII-

B of the McKinney-Vento Homeless Assistance Act.

2. Coordination of preparedness and response efforts of LEAs with state, local, tribal, and territorial public

health departments, and other relevant agencies, to improve coordinated responses among such entities to

prevent, prepare for, and respond to coronavirus.

3. Providing principals and other school leaders with the resources necessary to address the needs of their

individual schools.

4. Activities to address the unique needs of low-income children or students, children with disabilities, English

learners, racial and ethnic minorities, students experiencing homelessness, and foster care youth, including

how outreach and service delivery will meet the needs of each population.

5. Developing and implementing procedures and systems to improve the preparedness and response efforts of

LEAs.

6. Training and professional development for staff of LEAs on sanitation and minimizing the spread of infectious

diseases.

7. Purchasing supplies to sanitize and clean the facilities of an LEA, including buildings operated by such agency.

8. Planning for and coordinating during long-term closures, including for how to provide meals to eligible

students, how to provide technology for online learning to all students, how to provide guidance for carrying

out requirements under IDEA, and how to ensure other educational services can continue to be provided

consistent with all federal, state, and local requirements.

9. Purchasing educational technology (including hardware, software, and connectivity) for students that aids in

regular and substantive educational interaction between students and their classroom instructors, including

low-income students and students with disabilities, which may include assistive technology or adaptive

equipment.

10. Providing mental health services and supports.

11. Planning and implementing activities related to summer learning and supplemental afterschool programs,

including providing classroom instruction or online learning during the summer months and addressing the

needs of low-income students, students with disabilities, English learners, migrant students, students

experiencing homelessness, and children in foster care.

12. Other activities that are necessary to maintain the operation of and continuity of services and continuing to

employ existing staff.

State Education Agency (SEA) Reserve

Up to 10% (Michigan: $39.0 million) of a state’s grant may be reserved for the SEA to address emergency needs. Out

of this allocation, an amount not to exceed 0.5% (Michigan: $1.9 million; MDE only reserved $1.6 million) of the total

state grant may be reserved for administrative costs; the remainder (Michigan: $37.4 million) is allocated as

determined by the SEA to respond to the coronavirus.

MDE designated $37.4 million remaining SEA reserve for a new education equity fund to provide competitive grants

to districts for items 9 and 10 of the ESSER allowable expenses, above. $29.8 million is awarded for purchasing

educational technology, and $7.6 million is awarded for providing mental health services and supports.4 Appendix C

details the grants awarded to districts from this fund.

Districts were able to apply for an amount equal to 20% of their ESSER formula subgrant or, for districts that did not

receive a formula subgrant, an allocation up to $87.34 per FY 2019-20 pupil. Of 569 applications, 328 were approved.

Not all approved grants are fully funded.

Priority was given to districts identified by MDE as satisfying at least one of the following criteria:

• Over 85% of students in the district are economically disadvantaged.

• Over 85% of students in at least one of the district’s schools are economically disadvantaged.

• Over 20% of students in the district have a disability.

• Over 10% of students in the district are English language learners.

GOVERNOR’S EMERGENCY EDUCATION RELIEF (GEER) FUND: $3.0 BILLION (MICHIGAN: $89.4 MILLION)

The governor of each state with an approved application receives an allocation from the Governor’s Emergency

Education Relief Fund based on the following formula:

• 60% based on the state’s relative population of individuals aged 5 through 24.

• 40% based on the state’s relative number of children counted under Sec. 1124(c) of ESEA.

Governors may use funds to do any of the following:

• Provide emergency support through grants to LEAs that the SEA deems have been most significantly

impacted by coronavirus to support the ability of such LEAs to continue to provide educational services and

to support the ongoing functionality of the LEA.

• Provide emergency support through grants to IHEs serving students within the state that the governor

determines have been most significantly impacted by coronavirus to support the ability of such institutions

to continue to provide educational services and to support the ongoing functionality of the institution.

• Provide support to any other IHE, LEA, or education-related entity within the state that the governor deems

essential for authorized activities, the provision of child care and early childhood education, social and

emotional support, and the protection of education-related jobs.

On August 19, 2020, Governor Whitmer announced that out of Michigan’s $89.4 million allocation, $60.0 million

would be allocated for reimbursements to districts, including public school academies (PSAs), for which over 50% of

students are economically disadvantaged, have disabilities, and/or are English language learners in an amount equal

to $86.62 per eligible category per student. If a student is eligible under more than one category, the district may

receive more than one reimbursement for that student. Intermediate school districts (ISDs) are also eligible to receive

funding based on their special education student count.

Eligible districts and ISDs must submit an application by December 30, 2020 documenting expenses for any of the

following policy goals:

• Connectivity.

• Student mental health.

• Addressing learning loss.

• Out-of-school-time learning.

• Remote learning materials and training (digital and non-digital).

• Teacher training and curriculum.

• Other health, safety, and wellness needs in the MI Return to School Roadmap.

See Appendix D for GEER allocations to eligible districts and ISDs.

An additional $24.0 million is allocated to launch Futures for Frontliners,5 a scholarship program to provide tuition-

free community college access to Michiganders who provided essential services between April 1, 2020, and June 30,

2020. Applications are due by December 31, 2020.

The remaining $5.4 million is dedicated for distribution to other education-related entities “for statewide mental

health and social-emotional learning supports, teacher professional learning, educational programming on public

television, and supports for remote early intervention services for infants and toddlers.”

GRANTS TO STATES WITH THE HIGHEST CORONAVIRUS BURDEN: $307.5 MILLION (MICHIGAN: $17.8 MILLION)

$307.5 million is allocated for grants to states with the highest coronavirus burden as determined by the U.S. ED.

According to a U.S. ED Coronavirus Burden Table6 by state, Michigan ranks in the “41st to 60th percentile” based on

four factors (lack of broadband access, poverty, COVID-19 cases per capita, and rural LEAs).

The U.S. ED has developed two grant competitions to allocate these funds.

Rethink K-12 Education Models Grant

The U.S. ED awarded a total of $180.7 million in grants to 11 states to address the needs of students, parents, and

teachers in public and nonpublic schools. Michigan did not receive a grant.

Reimagining Workforce Preparation Grants

The U.S. ED awarded a total of $126.7 million in grants to eight states for creating new short-term educational

opportunities and career pathways programs to provide students the opportunity to develop new skills in high-

demand areas.

LEO received a $17.8 million grant to launch the Michigan Learning and Education Advancement Program (MiLEAP)

to assist subgrantees in transitioning to high-skill, high-wage career pathways. Customized education and training

will be delivered through distance and hybrid modes of learning and will be employer-led, competency-based, and

coupled with work-based learning opportunities.

OTHER MAJOR PROVISIONS RELATED TO THE EDUCATION STABILIZATION FUND

The following provisions apply to entities receiving HEER, ESSER, and/or GEER funds (as applicable).

Maintenance of Effort

A state receiving ESSER or GEER funds must assure that the state will maintain support for elementary, secondary,

and higher education in FY 2019-20 and FY 2020-21 at least at the average level of such support in the preceding

three fiscal years. For this calculation, state support includes funding to IHEs and need-based financial aid, but does

not include support for capital projects, support for research and development, or tuition and fees paid by students.

The U.S. ED may waive this requirement for states that have experienced a precipitous decline in financial resources.

Providing Equitable Services to Nonpublic Schools

An LEA receiving ESSER or GEER funds must provide equitable services in the same manner as under Sec. 1117 of the

ESEA to students and teachers in nonpublic schools, as determined in consultation with representatives of nonpublic

schools.

Under Sec. 1117 of the ESEA, an LEA must provide services “to the extent consistent with the number of eligible

children” served by the LEA who are enrolled in nonpublic schools. “Eligible children” refers to children at risk of

failing academically, including children who are economically disadvantaged, children with disabilities, migrant

children, or English language learners.

According to the U.S. ED’s April 30, 2020 guidance on providing equitable services,7 due to the “significantly broader

eligibility and uses of funds authorized under the CARES Act as compared to Title I, Part A,” services under the CARES

Act are “clearly available to all public school students and teachers, not only low-achieving students and their

teachers as under Title I, Part A.” Rather than providing services based on the number of at-risk children, therefore,

the U.S. ED advised providing services based on the total number of children served by the LEA who are enrolled in

nonpublic schools. On June 25, 2020, U.S. Secretary of Education Betsy DeVos issued an interim final rule8 to codify

this interpretation and require that services be provided based on total number of students.

On August 26, 2020, federal judge James Donato granted a temporary injunction, pausing the rule from being

implemented in Michigan and in other states and school districts that partnered in filing a lawsuit against the rule.

On September 4, federal judge Dabney L. Friedrich issued a final ruling blocking the U.S. ED’s interpretation, which

applies nationwide. Districts are now required to provide services to nonpublic at-risk students only as described

under Sec. 1117 of ESEA. Secretary DeVos wrote that the U.S. ED will not appeal the ruling in a September 28, 2020

letter to chief state school officers.9

When providing services to nonpublic schools, the control of funds for the services, and title to materials, equipment,

and property purchased with funds, must be in a public agency, and a public agency must administer funds, materials,

equipment, and property and provide services (or contract for services with a public or private entity). Only nonprofit

nonpublic schools are eligible for funds.

Employee Pay

Any entity that receives Education Stabilization Fund must, to the greatest extent practicable, continue to pay its

employees and contractors during the period of any disruptions or closures related to coronavirus.

CORONAVIRUS RELIEF FUND: $150.0 BILLION (MICHIGAN: $3.9 BILLION ($730.0 MILLION FOR EDUCATION))

The CARES Act established the CRF for specified use by states, territories, tribal governments, and certain local

governments to respond to the COVID-19 pandemic.

Of Michigan’s $3.9 billion CRF allocation ($730.0 million for education purposes), $1.4 billion ($0 for education

purposes) is approved by SBO under the authorization of 2020 PA 67 and another $1.6 billion ($730.0 million for

education purposes) is appropriated under 2020 PAs 123 and 146.

• Under 2020 PA 123, $18.0 million CRF is allocated to districts for instructional recovery programming,

benchmark assessments, or health and safety expenditures necessary to provide instruction safely.

• 2020 PA 146 allocates $512.0 million CRF to districts in an amount equal to $350 per pupil. The act also

included a $175 per pupil reduction in state school aid to districts, resulting in a net increase of $175 per

pupil for each district.

• 2020 PA 146 also allocates $163.7 million CRF to community colleges for base operations and performance

funding, an amount equal to their reduction of SAF in the same act. Public universities are allocated $36.3

million CRF for base operations and performance funding, also in an amount equal to their reduction of SAF.

The CARES Act requires CRF to be spent only on costs that meet all of the following:

• Are necessary expenditures incurred due to the COVID-19 pandemic.

• Were not accounted for in the budget most recently approved as of March 27, 2020.

• Were incurred during March 1, 2020, to December 30, 2020.

For instance, according to the U.S. Department of Treasury,10 an allowable expense includes broadening a teacher’s

responsibilities to include developing online instruction capabilities, but does not include a teacher providing

instruction that has simply switched from in-person to online.

Due to the above restrictions, districts may not be able to use CRF as direct “backfill” for their state aid per pupil

reduction without documenting expenses that are “substantially different” than previously expected. Likewise,

community colleges and public universities may not be able to use CRF as direct “backfill” for their base operations

and performance funding.
