Purpose
To establish Councillor membership to Boards, Special Purpose Advisory Committees and External Committees in support of the governance arrangements for Mackay Regional Council.
Background/Discussion
The appointment of Councillors to Boards, Special Purpose Advisory Committees and External Committees will ensure good governance and/or enable community or special interest group inputs into significant ongoing activities of Council. The Advisory Committees do not have decision making powers but make recommendations, as required, to Council or to the Chief Executive Officer. The level of membership of Councillors will provide opportunities for Councillors to participate in the development of recommendations on matters on which they have a particular interest. All Councillors will have access to Minutes of Advisory Committee Meetings as part of the agenda of Council.

9.2 COUNCILLOR PORTFOLIO APPOINTMENTS

Purpose
To allocate Councillor Portfolio Areas to differing aspects of Council services, and also appoint Councillors to different Rural Portfolio Areas.
Background/Discussion
The appointment of Portfolio Areas for Councillors enables specific concentrated interest to be given to different aspects of services delivered by Council. As a large Regional Council, it is very difficult for all Councillors to be across every aspect of each operation of Council. By the

allocation of a Portfolio Area, it enables Councillors to focus interest in certain aspects and in doing so be able to provide a better standard of information and service to residents. Under such an arrangement, residents are still able to contact any Councillor with any issue, however those Councillors holding the particular Portfolio related to the matter will be better positioned to provide an immediate and informed response. The Portfolio system, which mirrors in some respects the system in the State and Federal Government areas, was operated successfully by Council during the 2008-2012 term. As such, and with some revision of applicable Portfolios, it is expected that this system could again provide a very good service delivery to residents. Following review the proposed Portfolio Areas, and the recommended Councillor for each are:-

As well as Portfolio Areas, with an Undivided Council area regarding Councillor representatives, the recommendation is that Councillors(with the exception of the Mayor who will hold overall interest) be appointed to a Rural geographical area within the Council area. Previously there was a single Rural Portfolio held by a single Councillor. Suggestion being that such a large Rural area as covered by Council cannot be covered by a single Councillor. Also, it is believed that the general Urban area already has easy access to all Councillors, therefore does not need any specific Councillor allocation. Under such a system, as with the Portfolio Area system, Councillors will be able to better concentrate on specific Rural geographical areas and build up an experience and knowledge base of these areas. Like the Portfolio Area system, residents from any Rural area are still able to contact any Councillor with any issue, however those Councillors appointed to their geographical area will be better positioned to provide an immediate and informed response. 9.4 INKIND ASSISTANCE REQUEST - MACKAY SHOW ASSOCIATION

Purpose
An inkind assistance request has been received from the Mackay Show Association.
Background/Discussion
Mackay Regional Council's Inkind Assistance Policy provides a mechanism for relevant community groups and organizations to access Council resources free of charge. The policy provides that the Director of Community Services has delegated authority to approve applications up to a value of $2,000 and to refuse requests of any value. Where approval is recommended and the cost to Council exceeds $2,000, Council must decide whether to approve the application or not. Council has traditionally supported the Show Society through this program and the request for this year is virtually identical to that approved in previous years. For this year the organisation has requested Council provide the following assistance prior to the annual show being held from 19-21 June 2012.

Consultation and Communication
The current request has been costed by the Central Area Maintenance Coordinator Civil Operations, Warehouse Supervisor and Horticulture Supervisor and discussions have been held between the Directors of Engineering and Community Services regarding the feasibility of competing this work..
Resource Implications
The cost to Council for this request is $5,875.00. The Central Area Maintenance Coordinator Civil Operations advises that due to their current workload from the latest declared natural disaster event their resources will be limited to complete the grading of the roadway in the timeframe required, however it will be made a priority should Council approve this application. .

The Warehouse Supervisor advises that the traffic cones can be provided for pickup from the Council Depot and will be free of charge. However, if items are not returned they will be charged to the Inkind Assistance Budget. The Horticulture Supervisor advises that the potted plants and palms will be delivered as per previous years. $36,000.00 is the budget for the 11/12 financial year to cover inkind assistance requests. The current balance of the inkind vote is $16,591.09.
Risk Management Implications
Nil.
Conclusion
In the past Council has supported this event through the inkind assistance program and the event continues to attract crowds exceeding 20,000 per year. The Mackay Regional Show is one of the premier events in regional Central Queensland, attracting significant urban and rural patronage, as well as generating an enormous economic benefit to the local community.

9.5 PROPOSED HARBOUR BEACH HORSE RIDING CLASSIC

Purpose
To approve the holding of The Harbour Beach Horse Racing Classic, at Harbour Beach on Sunday, 26 August 2012.
Background/Discussion
Council was contacted in November 2011 by representatives from the Mackay Harbour Beach Race Association in regards to gaining approval for the holding of the Harbour Beach Horse Racing Classic. The event was promoted as a family friendly event “Picnic Race” program with six horse fields cantering over a 600m track along the beach, with the Association hoping to emulate the famous Barramedia Beach racing in Spain and the Laytown Beach Racing Festival in Ireland to create a national tourist attraction to be hosted annually in Mackay. The association is planning to utilise the skills and resources of local groups and clubs to assist with running the event and anticipate a crowd of 5,000 to 10,000 people attending the initial event. The event will be run on a commercial basis with profits if achieved from the initial event to be used for branding and improving the event. Approval for the event will be subject to the following conditions that have been compiled through discussions with relevant Council officers:
1. Area needs to be cleaned both prior to and after event, with remediation work to the site after the event to be undertaken by the event organisers to Council’s satisfaction.
2. Horses to be restricted to specific areas only so as not to damage dunes, park or
access tracks. (Areas to be approved by Council)
3. Approved Temporary Entertainment Permit and Temporary Food Permit to be obtained with such permits to include but not be limited to the following:
Timeframe for full event including set up time prior to the event and clean
up after the event. Traffic Management Plan. Areas that will be restricted from general public access during the event. Police and security involvement. Toilet and waste management arrangements. Fencing/barrier description and location.
4. Public liability and indemnity to Council clauses to be prepared for event.

5. Payment of Council charge for the use of the area and facilities for the event.
6. Council will require a bond to be paid for the event.
7. Confirmation that Liquor Licensing of the entire area with the exception of the Kids Kingdom area has been approved by the Office of Liquor, Gaming and Racing.
8. Coastal sand dune and vegetation systems in and around the event area to be
protected from damage.
9. All relevant stakeholders provide approval for the event to proceed.
Consultation and Communication
The proposal has been reviewed by the Director Community Services and relevant Program Managers with Mr Mick Pope a representative from the Mackay Harbour Beach Race Association presenting information to Council on the 15 February 2012.
Resource Implications
Council has been asked to provide assistance with the preparation of the Traffic Management Plan and Council officers will be required to inspect the area to be utilised by the event both prior to and after the event to ascertain the associated impact and rehabilitation requirements if needed.
Risk Management Implications
Council’s main risks are the safety of the general public utilising Harbour Beach outside of the event area and damage that may be caused to the coastal sand dune and vegetation systems.
Conclusion
That approving the Harbour Beach Horse Racing Classic subject to mentioned conditions will assist in the development of a new event that will encourage local resident’s participation and attract tourists to the Mackay Region.

To present to Council the Draft Natural Environment Advisory Committee Meeting Minutes dated 3 April 2012, for information purposes.
Background/Discussion
The Committee is recommending that Council acquit funding to the SLCMA on 1 July 2012 of $4,000 to fund two water tanks for the nursery and $656 to purchase tools and equipment for the nursery and volunteers. The Committee supports the inclusion of a representative from MRPMG into the Natural Environment Advisory Committee. A review of the Terms of Reference will need to be undertaken to allow this to take place. Director's Comment The recommendations of the Committee are endorsed.

Officer's Comments At its meeting on 19 April 2012 the City Focus Advisory Committee considered a draft budget which was presented by the Director of Community Services in advance of Council considering its 2012/13 budget. The committee provided some very valuable feedback regarding proposed expenditure of city centre levy funds which will be considered in the development of Council's 2012/13 budget.

11. RECEIPT OF PETITIONS:
11.1 PETITION REGARDING THE CEDARS BORAL QUARRY

Purpose
A petition was delivered to Council on the 21 May 2012
Background/Discussion
In terms of Council’s Standing Orders Council has three options with regard to Petitions that are tabled and these are;
the petition be received and consideration stand as an order of the day for the meeting; or for a future meeting; or
the petition be received and referred to a committee or officer for consideration and a report to the local government; or
the petition not be received. This petition relates to a request that the Cedars Boral Quarry be refused its request to increase its operating hours or double its capacity of production.

The petitioners have concerns relating to health issues (dust, toxic gases in blasting operation), excessive noise, potential damage to houses from blasting ground vibrations, and the devaluation of surrounding properties. They are also concerned with the increase of heavy vehicular traffic within a residential area. There is also apprehension regarding buffer zones and possible non-compliance. The petition meets the requirements as per the Standing Orders, in that it is legible and has more than 10 signatures in that it has 157 signatures. As the petition was received in the time frame during which submissions may be made, it has been accepted as a formal submission.
Consultation and Communication
That the petitioners, through their representative, be informed that Council acknowledges receipt of the Petition and that it has been accepted as a formal submission on the Development Application and the issues raised will be addressed in the report that is tabled before Council.

Purpose
To present a report to Council demonstrating the benefit of calling Expressions of Interest for the creation of a Register of Prequalified Suppliers for the provision of Planning and Project Development Services, as per Section 181 of the Local Government (Finance, Plans and Reporting) Regulation 2010.
Background/Discussion
In accordance with the Long Term Financial Plan, it is estimated that approximately $600 million dollars (present value) will be spent on new water and wastewater infrastructure over the next 10 years. The first stage of the delivery of these projects is to undertake planning and project development activities. To ensure the timely and successful delivery of these projects Council is required to outsource specialist planning and project development skills. Due to the current and projected work load, it has been identified that the formation of a panel of appropriately qualified and experienced providers would enable Council to most effectively source expert resources as well as abiding by all legislative requirements. Respondents to the Request for Tender will be assessed based upon their technical, financial and managerial ability to perform the services under the various planning and project development disciplines. It is proposed that panel members be awarded projects based upon their expertise, availability, pricing and previous experience in similar projects.

Director Water and Waste Services, Executive Manager Water Services, Manager Procurement and Plant, Manager Infrastructure Delivery, Manager Planning and Sustainability and Manager Operations collectively considered the formation of the register of prequalified suppliers. Briefings to SLT and Councillors have also occurred.
Resource Implications
The budget for the project management expenditure is included in the annual operating budget and the capital budget for each project.

Purpose
To seek Council approval to install a gas collection and flare system at Hogan’s Pocket Landfill.
Background/Discussion
Council’s Waste Management Strategy 2010 -2019 identified the requirement of landfill gas management at operating and some specific closed waste facilities. The strategy outlined in the 10 Year Capital Works Programme, the installation of landfill gas systems and this was subsequently adopted into Council’s Long Term Financial Strategy. Following the adoption of the strategies, Council called for tenders for Landfill Gas Management and Energy Utilisation Services. At its Ordinary meeting held on 16 February

2011, Council resolved to award contract MRC 2010-064 Landfill Gas Management and Energy Utilisation Services to Landfill Gas and Power Pty Ltd. The minute from the Council meeting was: “Officer Recommendation 1. THAT The tender as submitted by Landfill Gas and Power for Stage 1 and Stage 2 be accepted for the provision of MRC 2010-064 Landfill Gas Management and Energy Utilisation Services at the price and for the term outlined in the Resource Implications Section above. 2. The Economic Analysis Report be presented to Council for its consideration and approval prior to commencement of Stage 2. 3. The tender as submitted by Landfill Gas and Power for Stage 2 and Stage 3 be accepted subject to the findings of the Stage 1 Economic Analysis Report. 4. Landfill Gas and Power Pty Ltd completed the Economic Analysis Report on July 2011 (please see attachment). Following the submission of the Report, Council was briefed on the Economic Report on Wednesday, 3 August 2011 by Landfill Gas and Power Pty Ltd. At the Briefing Session, Council supported the Report recommendations for each site. Subsequently at the end of 2011, the Australian Government passed the Clean Energy Act 2011 and regulations that has introduced the Carbon Pricing Scheme. Hogan’s Pocket landfill will trigger the 25,000 CO2–e tonnes/year threshold and the operator will be liable for the legislated gases emitted at the facility from 1 July 2012. The Clean Energy Legislation also introduced the Carbon Farming Initiative (C.F.I.). As part of the C.F.I., landfill gases produced by legacy wastes (i.e. gas from waste landfilled prior to 1 July 2012) which is flared could earn carbon credits. In addition to the tender, Landfill Gas and Power Pty Ltd submitted pricing for supplementary works. In summary, Landfill Gas and Power Pty Ltd state that Hogan’s Pocket, being an active landfill site, has a very high gas percentage and will require treatment initially by flaring and ultimately by electricity generation, depending on costs to upgrade the grid connection to the site. They suggested the installation of a well-field and flare on the current operational Cell 1 as soon as practical to reduce Council’s potential carbon price liabilities and participation in C.F.I. A permanent gas flaring system will need to be installed once the final capping of Cell 1 has been completed. The capping of Cell 1 is due to commence in the 2012/2013 financial year. The majority of the initial supplementary gas flaring system infrastructure can be used in the final arrangement, however, further costs will be required to complete the permanent gas flaring system. In recognition of the impact of the new Legislation, on 22 February 2012 Council adopted the December 2011 second quarter budget review and as part of this review Council brought forward an allocation towards the proposed landfill gas works. This action is to urgently reduce Council’s potential Carbon Price Liability and participate in the C.F.I. for landfill gases. To enable this to occur, Council needs to formally endorse the Economic Analysis Report provided by Landfill Gas and Power Pty Ltd and approve proceeding with the next stage of gas flaring.

Resource Implications
In the 10 year Waste Services Capital Works Plan, allocation for funding Hogan’s Pocket has been identified in the Long Term Financial Strategy for 2012/2013 budget. As outlined above approval was given to bring forward the expenditure to 2011/2012. A budget of $520,000 now exists for this project. The proposal by Landfill Gas and Power Pty Ltd for Stage 1 is the installation of a sacrificial well field, manifold and flare which has a total cost of $409,530. This is within the available budget. The final gas flaring works, Stage 2, are conditional on the final capping works of Cell 1 being completed. Total capping is not projected to be completed for at least 2 to 3 years as an uncapped section of Cell 1 will be used as part of the airspace for Cell 2 operations. The majority of the infrastructure installed as part of Stage 1, will be used as part of the final gas flaring system. The forecast expenditure for this final phase of the project is $142,860 (plus applicable contract price escalation since the tender bid). The 10 Year Waste Services Capital Works Plan also identifies funding being available for a gas flaring system at Bayersville Landfill as part of the 2012/2013 budget. The decision on whether to proceed with these works is conditional on some additional monitoring being undertaken. The current proposal is for this monitoring to be completed once the current Bayersville Landfill remediation contract has been completed. This remediation project is currently forecast for completion in July 2012. Once the additional monitoring has been completed a separate Report on the findings along with recommendations will be presented to Council for further consideration.
Risk Management Implications
As a requirement of the Clean Energy Act 2011, Hogan’s Pocket Landfill will trigger the 25,000 CO2-e tonne/year threshold and Council will be liable for carbon price liabilities from 1 July 2012. To reduce this financial risk, Council should introduce actions that reduce the emission of landfill gases to the atmosphere. This proposal would meet this goal. There is the added benefit with the project in that landfill gases at Hogan’s Pocket will be controlled on site and reduce risks to employees and contractors working on the site.
Conclusion
The proposal by LGP to install sacrificial landfill gas wells and flare at Hogan’s Pocket will reduce Council’s potential Carbon Price Liability and could enable Council to participate in the C.F.I.

12.3 MRC 2012-041 NEBO ROAD TRUNK WATER MAIN

Purpose
To present to Council for approval of tenders submitted for the MRC 2012-041 Nebo Road Trunk Water Main.
Background/Discussion
Tenders were invited on 7 January 2012, via Council’s website, and advertised locally in The Daily Mercury. Council is seeking submissions to construct a new 200mm trunk water main on the south-eastern side of Nebo Road. The new pipe is to run from Thorning Street north to Shakespeare Street. The scope of works also includes the construction of cross connections at many of the side streets to link the new 200mm pipe with the existing network. In total this project requires the installation of approximately 2.26km of 200mm DICL trunk water main as well as a combination of 200mm, 150mm and 100mm cross connections and provisions for residential, commercial and Council service connections. The following submissions were received by the closing date of 7 February 2012:

Shamrock Civil Engineering Pty Ltd The following late submission was received at 4.00pm on Tuesday, 7 February 2012.
NQ Excavations Pty Ltd An initial compliance check was conducted by the Evaluation Panel on 10 February 2012 to identify submissions that were non-conforming with the immediate requirements of the RFT. This included compliance with contractual requirements and provision of requested information. Tender Information Requests were issued to Davbridge Constructions Pty Ltd, Shamrock Civil Engineering Pty Ltd, Christopher Contracting Pty Ltd and G & MA Lemura Pty Ltd seeking clarification on various aspects of their submissions. Upon receipt of Shamrock Civil Engineering Pty Ltd’s response, a further Tender Information Request was issued to seek additional clarification of their understanding of Council’s requirements. During the evaluation, Tenderers were assessed against the nominated qualitative criteria. The weighting attributed to each qualitative criteria was:

After the initial evaluation, further Tender Information Requests (TIR’s) were issued as detailed below:
All Tenderers were issued with a request to extend the validity of their submissions to 15 June 2012 due to the Local Government Caretaker Period.
Shamrock Civil Engineering was also requested to address further queries in regard to their submission identified throughout the evaluation process.
All responses were received within the specified timeframes, however, Shamrock Civil Engineering failed to address the additional requested information on Qualitative Criteria. The failure to fully address Council’s numerous requests for further information pertaining to relevant experience of works of a similar nature resulted in the Evaluation Panel being unable

to fully assess Shamrock Civil Engineering’s capabilities to perform the scope of works identified. After the Evaluation Panel conducted a Risk Analysis of the Shamrock Civil Engineering submission regarding their construction program together with the pricing structure, the tendered price was deemed variable due to the inclusion of provisional items. These items were included within the fixed price of all other Tenderers' submissions and, therefore, an accurate price comparison was unable to be determined and any price variance may be negated through these provisional items. The Evaluation Panel reviewed all previous experience as noted by Davbridge Constructions Pty Ltd in their tender response and although they have extensive experience in bridge construction and nominated minimal projects involving civil works, the Tenderer demonstrated no experience in managing a complex pipeline project as detailed in the Tender documents. Based on this, the utilisation of this contractor for these high profile works may have the potential to expose Council to significant risks. While evaluating the details provided in Christopher Contracting Pty Ltd's submission, the Evaluation Panel noted that the contractor demonstrated a comprehensive understanding of Council’s requirements. This coupled with their extensive previous experience on projects of a similar nature and of a much larger scale in high volume traffic areas, led the Evaluation Panel to a decision that awarding the contract to Christopher Contracting Pty Ltd would provide Council with the most advantageous outcome in terms of proven quality of works and reducing Council's potential level of risk.

Resource Implications
The funding for this Project is in the Waste Water Services (WWS) Capital Budget, Nebo Road Trunk Main Replacement. The works have been planned to be spread over two financial years 2011/2012 ($1,390,000) and 2012/2013 ($3,415,000). The pipe procurement of $318,836.10 was awarded in March 2012 and procurement has occurred with delivery to site dependent on the preferred contractor's timetable. The recommended tender price aligns with the budget provision for this component of the Project. Commencement of the works is unlikely within the current financial year due to timing of Local Government Elections and the majority of the cash flow will extend into FY 2012/2013. No amendment is required to the FY 2011/2012 budget but there will be a need to carry over unspent funds.

Risk Management Implications
The Water Main Replacement Project is required to address concerns with regard to impact of proposed roadworks on the reliability of the existing 300mm cast iron trunk water main situated under the eastern traffic lane of Nebo Road that was installed in 1929. The need to replace the main arises as it is nearing the end of its useable life and it is in poor physical condition affecting customer serviceability levels. In addition, proposed roadworks will impact the pipe increasing the existing high risk of failure that will cause damage to a major arterial highway which carries a high traffic load including a high number of heavy vehicles and result in extensive repairs costs. The removal of this water main from the traffic lane of Nebo Road also removes an ongoing issue of noise complaints associated with the hydrants and valves located along the length of the trunk main.
Conclusion
That awarding the contract to Christopher Contracting Pty Ltd represents the most advantageous outcome to Mackay Regional Council based on their demonstration of a comprehensive understanding of Council’s requirements and their previous experience outlined indicates that they have extensive experience working on projects similar in nature, which are located in high volume traffic areas, and they demonstrate value for money.
