Terms and Conditions Terms: Unless satisfactory credit arrangements have been made by the buyer with the seller prior to the sale, the terms of this sale are cash or check, payable during or immediately upon conclusion of the sale and before cattle will be released to buyer. Seller will reserve the right to require a certified check or money wire as settlement of sale purchase(s) including any prior unpaid balance if applicable, before releasing any cattle. At the conclusion of the sale, cattle are required to be loaded out by the buyer/agent receiving an authorized release, unless other arrangements have been made with the seller. Risk: All animals are the seller’s risk prior to their sale and become the property of the buyer as soon as declared “sold” by the auctioneer. Bidding: All animals sell to the highest bidder. Any disputes or challenges regarding bids will be settled by the auctioneer and his decision will be final. Health: A vet will be available at the sale to generate health papers at buyer’s request. Please check with your local/state authorities to determine if your area/state has special requirements. Announcements: Announcements from the auction block will take precedence over statements in the sale catalog. We reserve the right to withdraw or add any sale lot(s). Registry Certificates: Registration papers will be generated on eligible cattle at seller’s expense, only if buyer, 1) makes written request, and 2) upon satisfaction of full payment. Seller will provide a registration paper request form in load-out paperwork for buyer to complete and return to seller within two weeks after the sale. Any rush fees and associated overnight delivery service fees will be buyer’s expense. Breeding Guarantee: Any female that appears to be a non-breeder within six months after date of sale, if in healthy condition and of breeding age, may be returned to seller at buyer’s expense. Seller will then reserve the right to prove the female a breeder within a six-month period using the natural service of a bull, and if successful will return bred female to buyer, again at buyer’s expense. Should the female fail to prove a breeder, the seller, at his option, may either return purchase price to buyer or replace the animal with another of equal value in full settlement and satisfaction of all claims. In no event shall seller be responsible for more than the purchase price. In case the animal in question should develop to be a problem breeder due to negligence or improper management by the buyer, the seller’s guarantee does not apply. In cases where the female is subjected to any hormonal or surgical reproduction techniques after this sale, this guarantee shall be null and void. Any complaints regarding breeding difficulties must be reported in writing by the buyer to seller within the time limit specified above, and females returned must be free from disease and in good condition. Any deceased female renders breeding guarantee null and void. Flush Option: Sellers reserves the right to two, successful flushes at seller’s expense and buyer’s convenience on any heifer lot. A successful flush will be defined as producing a minimum of six, transferrable embryos per flush. Genetic Defects: Buyer assumes all risk associated with possible genetic defects and genetic factors in females (TH, PHA, NH, CA, for example). Lots are sold as is, where is, and with all faults. Brand Papers: Brand papers are not required, as the county of origin and county of sale site in Nebraska are not mandatory brand areas. Accidents: All persons who attend the sale and/or preview the cattle in advance of the sale date do so at their own risk. Liabilities: Seller and sale facility, assumes no liability for loss of, or injury to livestock due to theft, mysterious disappearance, sickness, improper handling or Act of God. Contract: The above terms and guarantees shall constitute a contract between buyer and seller of each animal and shall be equally binding on both. Animals that are resold following purchase in this sale shall constitute a separate transaction and the rights and obligations of the two parties connected thereto are not covered by these sale terms and conditions.
