CONDITIONAL ADMINISTRATIVE ORDER AND NOTICE OF RIGHT TO BE HEARD

COMES NOW the State of Oklahoma, ex rei. John D. Doak, Insurance Commissioner, by and

through counsel and alleges and states as follows:

JURISDICTION

1. John D. Doak is the Insurance Commissioner of the State of Oklahoma and as such is

charged with the duty of administering and enforcing all provisions of the Oklahoma Insurance Code,

36 O.S. §§ 101-7301 , and the Oklahoma Bail Bond Act, 59 0. S. §§ 1301-1340.

2. Respondent Stacy French ("Respondent") is a licensed bail bondsman in the State of

Oklahoma holding license number 40087375.

FINDINGS OF FACT

1. On March 13, 2013 , Respondent executed an appearance bond in the amount ofTwenty

Nine Thousand Dollars ($29,000.00) using Allegheny Casualty Company power of attorney number

AS30K-68016 for Defendant, Rayvon Lee, in Oklahoma County District Court Case No. CF-2013-

1692. See Appearance Bond dated March 13, 2013 , attached hereto as Exhibit "A".

2. On January 6, 2014, the Oklahoma Insurance Department ("Department") received a

Cancellation of Surety Bail Bondsmen Appointments from Allegheny Casualty Company dated

December 30,2013 with attached Cancellation of Appointment Bail Bond Form-BCAA notifying the

Department that it had cancelled Respondent's appointment. See Cancellation of Surety Bail Bondsmen

Appointments and Cancellation of Appointment Bail Bond Form-BCAA dated December 30, 2013,

attached hereto as Exhibit "B".

3. On February 11 , 2014, the Department received a complaint from the Oklahoma County

Comt Clerk advising the Depa1tment that Respondent agreed to remain on an appearance bond for

Defendant, Rayvon Lee after being cancelled as an agent for the insurer. See Agreement to Remain on

Bond After Bail Bondsman is Cancelled as an Agent dated February 6, 2014 and attached Bondsman

Agreement and Acknowledgment to Remain on Defendant's Bond After Plea(s) and Until Defendant is

Sentenced by the Comt dated February 5, 2014 attached hereto as Exhibit "C".

CONCLUSIONS OF LAW

1. Respondent has violated 59 O.S. § 1310(A)(2) by violating a law of this state relating to

bail.

2. Respondent has violated 59 O.S. § 131 0(9), by conducting the affairs under her license,

in the judgment of the Commissioner, demonstrating incompetency, or untrustworthiness, or conduct or

practices rendering her unfit to cany on the bail bond business or making continuance in the business

detrimental to the public interests.

3. Pursuant to 59 O.S. § 1310(B), "any person violating any provision of Sections 1301

through 1340 ofthis title may be subject to a civil penalty of not less than Two Hundred Fifty Dollars

($250.00) nor more than Two Thousand Five Hundred Dollars ($2,500.00) for each occurrence."

ORDER

IT IS THEREFORE ORDERED that Stacy Fr·ench is CENSURED and FINED Two

Hundred Fifty Dollars ($250.00). Respondent is fmther notified that she may request a hearing within

30 days of the receipt of this Order concerning this action, and upon such request, the Oklahoma

Insurance Depmtment shall conduct a hearing before an independent hearing examiner. A request for

hearing shall be made in writing to Dan R. Byrd, Oklahoma Insurance Department, Legal Division,

3625 NW 56111 St., Suite 100, Oklahoma City, Oklahoma 73112, and state the basis for requesting the

hearing.

If Respondent does not request a hearing within the 30 days allotted, this Order shall

become a FINAL ORDER on the 3151 day following the receipt of the Order.
