Dear Mr. Hager:
Attached for your review and processing is a variance package for the above referencedproject. The total site area consists of 28,500 square feet. The site is zoned SB and is improved witha wood frame house and driveway and is connected to public water and sewer utilities. The site islocated at the comer of Ferndale Road to the north and Aviation Boulevard MD 162 to the west inAnne Arundel County. The applicant is proposing the development of a new Dunkin Donuts coffeeshop.The applicant is requesting a variance to Article 18-3-312:
(a) "Freestanding or identification signs" An establishment or use m a small business districtmay have one sign, freestanding or identification, that does not exceed 10 square feet in area.The height of a freestanding sign may not exceed six feet.
The applicant is seeking a variance to the number of signs, square footage size andmethod of iUiunination of signs permitted to be placed on the site. The proposed signinformation is presented in the following table:

directional signs. The clearance bar sign will also be placed at the entry point to the drivethrough and will limit vehicles to a height of 9'-0". The clearance bar sign will be the onlysign taller than 6'-0". One pylon sign will be placed on the property close to the intersectionofFerndale Road and Aviation Boulevard. The smallest pylon sign square footage availablewill be used which is 12. 75 square feet in size, which makes it only 27. 5% larger than the 10square feet maximum allowed in 18-3-312 (a). Two of the building mounted signs wiU be 2'-0" taU and the third wiU be 3'-0" tail.
Article 18-3-312:
(b) "Illumination of signs" A sign in a small business disteict may be illuminated only by lightingexterior to the sign.The placement of low ground niounted exterior lighting fixtures for each sign will
create multiple tripping hazards spread throughout the site. Internal sign lighting wiUeliminate any tripping hazard in regards to the proposed signage. Small ground mountedlighting fixtures are also susceptible to theft and vandalism. Exterior illumination would beperformed with ground mounted light fixtures which tend to raise concerns with offsiteglare. Glare along the trafficways of Aviation Boulevard would be a hazard. Internally litsigns would prevent glare.
Article 18-3-312:(c) "Signs prohibited on accessory structures"
There are no accessory structures proposed with the development of this project.
Based on the approval criteria in Article 18-16-305, we believe this request meets the coimtyrequirements for approval of a variance in accordance with the following:
Article 18-16-305ra):
(1) "Because of certain unique physical conditions, such as irregularity, narrowness orshallowness of lot size and shape or exceptional topographical condidons peculiar to andinherent in the particular lot, there is no reasonable possibility of developing the lot in strictconformance with this article,"
This site fronts on Aviation Boulevard, a main entranceway to the BWIAirport, one of the Counties top employers serving over 26 million passengers peryear. Aviation Boulevard is a Collector Road which is primarily zoned commercialalong its length. The predominant commercial zoning along the corridor is Cl, C4and Wl with less restrictive sign regulation than SB zoning. This disparity creates anexceptional circumstance and a unique physical condition.

Based on the requirement to provide clear commimication with customers,directional signage and building mounted signs are essential to the safe operation oftraffic within the site and to alert motorists of the store location. The clearance barsign will prevent vehicles taller than 9' from damaging their own vehicle as well asthe drive through service window canopy. The grant of the variance is necessary inorder to avoid the previously mentioned practical difficulties and to preventunnecessary hardship to enable the applicant to develop the lot to the maximum levelof public safety.
Atdcle 18-16-201^:(1) "The variance is the minimum necessary to afford relief.
The proposed variance is the minimum necessary to afford relief. The signsproposed are smaller and more residential in style than a standard Dunkin Donutssite to minimize the request.
(2) "The granting of the variance wiU not alter the essential character of the neighborhood,substantially impair the appropriate use or development of adjacent property, nor bedetrimental to the public welfare".(i) The proposed variance will not alter the essential character of the
neighborhood or district in which the lot is located. Providing signage asdescribed above is in character with the Aviation Boulevard corridor wherenine (9) existing business type signs are located. Photographs of the existingsigns are attached.
(ii) Providing signage as described above will not substantially impair theappropriate use or development of any adjacent property. This is the only areaof Small Business zoning within the Aviation Boulevard corridor. Theremaining areas are commercial zoning.
(iii) The site is not located within the Chesapeake Bay Critical Area, Buffer orBog.
(iv) The site is not located within the Chesapeake Bay Critical Atea, Buffer orBog.
