A PROCLAMATION TO AMEND THE PROCLAMATION ON HE DEFINITION OF POWERS AND DUTIE OF THE EXECUTIVE ORG NS OF THE FEDERAL DEMOCRATIC

REPUBUt OF ETHIOPIA

WHEREAS, it has became ecessary to amend the Proclamation on the Defini ion of Powers and Duties of the Executive Organs of the Federal Democratic Republic of Ethiopia;

NOW, THEREFORE, in accordance witli Article 55( l) of the Co,nstitution of the Federal Democratic Republic of Ethiopia, it is hereby proclaimed as follows:

I. Short Title

This Proclamation may be cited as the"Definition of Powers and Duties of theExecutive Organs of the Federal DemocraticRepublic of Ethiopia (Amendment)Proclama ion No.803/2013".

The Definition of Powers and Duties of theExecutive Organs of the Federal DemocraticRepublic of Ethiopia Proclamation No.69112010 is hereby amended as follows:

2/ the designations "Ministry of Urban Development and Construction" and "Ministry of Water and Energy" appearing anywhere in the Proclamation and in other laws, currently in force, are deleted and replaced by the designations "Ministry of Urban Development, Housing and Construction" and "Min'stry of Water, Irrigation and Energy", respectively;

3/ paragraph (f) of sub-article ( 1) of Article 25 of the Proclamation is deleted and replaced by the following new paragraph (f):

"t) undertake stu ies for setting general directions for citizens to acqu·re residential houses compatible with their own means; provide capacity building support to regions for the implementation of same;"

4/ Arti les 33 34, 35, 36, 3 7 and 38 of the Proclamation are renumbered as Articles 34, 35 36, 37, 38 and 3 , respecti ely, and the following new Article 33 is added:

"33. The Mi istry of Environment and

Forest

I/ The Ministry of Environment and Forest shal I have the powers and duties to:

a) coordinate measure to ensurethat the environmentalobjectives provided under theConstitution and the basicprinciples set out in the environmentaJ policy of Ethiopia are realized;

b) establish a system for environmental impact assessment of public and private proje ts, as well as social and economic development policies, strategies, laws and programmes;

c) prepare a mechanism thatpromotes social, economic andenvironmental justice and channel the major part of any benefit derived thereof to the affected communities to reduce emissions of greenhouse gases that would otherwise have resulted from deforestation and forest degradation;

d) coordinate actions onsoliciting the resourcesrequired for building a climateresilient green economy in allsectors and all governancelevels as well as providecapacity building support andadvisory services;

e) establish a system for thevaluation of the environmentalimpact asse sment ofinvestmenl projects submittedby their respective proponentsby the concerned sector Ilicensing organ or _ _thec ncerned regional organ prior to ranting a pennission for their implementation m accordance · w · th the Environmental Impact Assessment Pr clamation·

f) prepare programmes anddire tives for the synergisticimplementation and follow upof environmental agreements

o) prepare and disseminate aperiodic report on the state ofthe country's environment andforest as wel as climateresilient green economy;

· p) promote and provide nonfonnal environmental education programs, and cooperate with the competent organs with a vi w to integrating environmental concerns in the regular educationaJ curricula.

2/ The powers and duties given to the Ministry of Agriculture, with respect to matters relating to forest, by the provisions of other laws currently · n force, are hereby given to the Ministry of Environment and Forest."

s/ the following new paragraph (f) is added under sub-article (I) of Article 3.6 of the Proclamation (as re-numbered pursuant to sub-article (4) of this Article):

"f) from Article 3 to Article 13 of the Environmental Protection Organs Establishment Proclamation No. 295/2002."

6/ th following new sub-article (11) is added under Article 37 of the Proclamation (as re­numbered pursuant to sub-article (4) of this Article):

"11/The rights and obligations of the Environmental Protection Authority re­established under Proclamation No. 295/2002 are hereby transferred to the Ministry of Environment and Forest."

3. Effective Date

This Proclamation hall enter into force on thedate of publication in he Federal NegaritGazette.
