fourth year in a row. Chef Hiro Sone and Lissa Doumani, as chefs and co-

owners of Terra Restaurant in St. Helena, have brought their sense of taste and

style to Ame Restaurant. The menu showcases seasonal New American cuisine,

with a blending of flavors from southern France, northern Italy, and Japan.

Please join us for a wonderful winter auction day full of great food and wine. Complementary, wine-friendly appetizers will be served continuously to all tables throughout the auction. In life, timing is everything. In wine

too. There is also truth in it. Truth

be told, I could not have joined the

fantastic team here at WineGavel at

a better time.

If I had to choose a name for this

offering it could be called the

Acronyms Auction. The very first one that comes to mind is OMG

as in Oh My God! …or Bacchus or Dyonysus shall we say. Whatever

our belief, we know that wine is a part of it. There are many lots here

that remind us of the divine. A picture is worth a thousand words and

the cover brings the next acronym, DRC. Yes, The Domaine. A scene

from Hugh Johnson’s indispensible documentary “Vintage: A History

of Wine” visits Lalou Bize-Leroy in the vineyard and when asked a

question about Pinot Noir, she is taken aback. Her response is along

the lines of; “we don’t make Pinot Noir here, we make Romanée-

Conti, La Tâche….” Inspiring words of wisdom.

The largest DRC bottle comes with the next acronym of utmost

presence in this catalog, OWC. Original Wood Cases have enticed

us fine wine captives since fine wine began. They are a guarantee

of provenance, pristine wines waiting to see the daylight. They are

like the dream car with no mileage waiting to be driven off of the

showroom carpet. A breathtaking experience, an opportunity in time

travel quietly awaiting the lucky few.

Among the vintages here almost spanning across a whole century, over

a case of DRC, including stunning bottles of 1934, 1966 and 1990

Romanée-Conti are at the top of my highlights list. A close contender

to the throne, Vogüé’s Musigny Vieilles Vignes is also queenly with the

1949, 1959 and 1966 vintages.

As for Bordeaux, the king of the wine world, from half-bottles of

Latour to a nebuchadnezzar (twenty bottles in one!) of Ormez de

Pez, the choices seem endless. There are more than a dozen cases of

First Growths. Lafite, the global favorite, ranges from 1961 to 2000.

Celebrating their first Chinese artist label release this year, a homage

to the Asian market, there are more than five cases of Mouton, some

in complete verticals, and vintages going back to 1928. A treasure

trove of rare Yquems, TBAs, Ports, even Banyuls, some dating back to

the 1920s, appeal to the sweet tooth.

California blue chips, from properties of distinction with strong track

records are another major theme. In their stunningly immaculate

conditions, they offer comparable drinking to the greatest of Bordeaux

at a fraction of the relative value. These classics are ideal candidates to

surprise with their charisma and American heritage at blind tastings.

Two Judgments of Paris held three decades apart can’t be wrong.

My fervent career in fine wine has taught me not to make critics’

scores a guide in my choices, rather a numerical snapshot of how

that wine was doing at that particular moment. That said, it is hard

not to be impressed with over twenty 100-pointers, monuments to

perfection, in one catalogue.

And the eclectic too, from Quintarelli to Unico, from Run Rig to

Flying Pig, there is something for everyone! We hope you take pleasure

in these beauties as much as we do in presenting them to you.

Showing incredibly well at two tastings of 2000s, the wine has a dense bluish/purple color and a beautiful nose of incense, melted asphalt, and creme de cassis as well as hints of new saddle leather and licorice. It is superbly concentrated and very pure, with excellent texture and opulence. The acidity seems low, the tannin high but well-integrated. This is a compelling 2000 that is just closing in on its window of maturity and should stay there for at least 20 or more years. Bravo! 97 Pts.” WA (RP) 2010

This work of art is worth every cent it will fetch. A virtually perfect effort is the 1997 Sperss (30,000 bottles), which represents the essence of truffles, earth, and black cherries in its striking aromatics and multidimensional, opulent, full-bodied palate. The acidity seems low because of the huge glycerin levels and prodigious concentration of fruit, but I suspect it is normal in the scheme of oenological measurement. This profound wine requires 3-4 years of cellaring, and should age well for 30-35 years. 99 Pts.” WA (RP) 2001

In the mouth, there is much more concentration and extract (it was a drought year of tiny yields), gobs of tannin, and a spectacularly long finish. 96 Pts.” WA (RP) 1992

After the passing of the original owner in 1984, these bottles remained untouched in a locked cellar for 20 years. We were able to borrow and photograph the original catalogs and brochures dating back to 1938 showing provenance for where these wines originated. Upon request, photocopies of these documents can be provided to interested bidders. Some of the highlights from this cellar include sparse vintages of Yquem and a highly unique and rare bottle of 1934 DRC Romanee Conti. These wines were removed from a subterranean wine cellar two levels below ground.

Neck Levels for Bordeaux and Bordeaux Shaped Bottlesneck level – The level is into the neck of the bottle. This is a normal level for wines less than 10 years old. In wines 10-30 years old, a neck level usually indicates pristine storage history.

bn – Bottom Neck level: acceptable for wines 10-20 years old. In bottles 20-30 years old, a base neck level is an excellent level and usually indicates excellent storage history.

VtS – Very Top Shoulder level: acceptable level for wines 20 to 30 years old. Considered excellent for bottles older than 30 years.

Generally indicates that a wine has been properly cellared.

tS – Top Shoulder level: acceptable for wines 30-40 years old. In bottles older than 40 years, a top shoulder level usually indicates proper storage.

uS – Upper Shoulder level: acceptable for wines 40-60 years old. In bottles older than 60 years, an upper shoulder level usually indicates excellent storage history. For mid 20th century or older wines that have not been reconditioned, this is considered an

generAL sHiPPing PoLicies,

terms AnD conDitions

Cellar29 provides all purchasers with multiple options

for air and ground transport. WineGavel and Cellar29

do not in any way represent the shipment of wines

across state lines as legal nor does WineGavel take

responsibility for the legality of shipment of alcoholic

beverages into any state. Generally states regulate the

shipment of wines into and across their borders. Some

states require that the purchaser, consignor or shipper

possess certain licenses or permits, while other states

have a strict prohibition on such shipments, and may

not allow them in any form. WineGavel and Cellar29

advise all buyers to investigate and understand, on

their own examination, the wine shipping laws and

regulations of the state to which they intend the

wine to be shipped prior to the purchase of wines at

auction. Cellar29 can assist in making arrangements

to have wine purchased at auction shipped through

the appropriate channels. All domestic shipments will

be subject to a 1% insurance charge, International

shipments will be charged 2% for coverage. Insurance

covers only breakage or loss. WineGavel & Cellar29

cannot be held responsible for any other changes to

the wines during shipment. It may be required for

the wines to be repacked in heavy duty Styrofoam

shipping boxes. The wooden or cardboard cases will

normally be shipped separately at an additional charge.

Insurance coverage does not cover confiscation by any

government or law enforcement agency as a result

of any violations of any shipping laws by any buyer.

Loss or breakage resulting from transportation shall

be reported to Cellar29 in writing within three days

of incident. Weather-related issues are not covered by

any shipper and therefore Cellar29 is not responsible.

Cellar29 has a weather hold policy in place and will

not ship outside that temperature allowance. Wines

held longer than 15 days are subject to a storage fee

except where noted. . Any lots that are split into two

or more parts for multiple deliveries or pickups will be

subject to a $10 service charge per split, per lot. Visit

the Cellar29 terms and conditions page for complete

details, terms and conditions.

PersonAL DeLivery in tHe BAy AreA

Cellar29 will deliver wines within the Bay Area for $12

per case or part thereof, with a minimum charge of 2

cases. The Bay Area is roughly the following counties:

Alameda, Contra Costa, Marin, Napa, San Francisco,

San Mateo, Santa Clara, Solano, and Sonoma.

PersonAL DeLivery in cALiForniA outsiDe

Cellar29 will deliver wines within the state of

California at a charge of $25 per case or part thereof,

with a minimum charge of 5 cases. In some instances,

additional charges may apply. We have periodic temp-

controlled, palletized freight transports on a few

regular routes that will result in reduced rates, typically

$15 per box. Minimums apply.

sHiPPing outsiDe oF cALiForniA

Cellar29 will help you coordinate all necessary shipping

and packing arrangements through the appropriate

freight forwarders. and common carriers. There will be

at least three levels of service available to the purchaser:

Common carrier ground service ranging from $18 to

$48 per 12x 750ml case, not including materials; 1-,

2-, and 3-Day Air shipment from $30 per case; fully

licensed and insured temperature-controlled trucking.

I. All estimates are per lot as numbered in the catalog. We reserve the right to withdraw, divide or group lots prior to sale. WineGavel™ and/or the auctioneer may have a direct or indirect ownership interest in any or all lots in the sale resulting from ownership or purchase by WineGavel™ of the lots (or an agreement to purchase), or from an advance of monies or property to the seller, or a guarantee of minimum proceeds made by WineGavel™ to the seller.

II. The highest bidder shall prevail. Should any dispute arise between bidders, the decision of the auctioneer as to the successful bidder and the re-offering or resale of the lot under dispute shall be final. The auctioneer shall regulate the bidding and reserves the right to refuse any bid believed by him not to be made in good faith. Any bid which is merely, or which is merely a nominal or fractional advance over the previous bid, may be rejected by the auctioneer, at his discretion. Neither we nor the auctioneer shall be liable for errors and omissions in executing instructions to bid, whether caused by our negligence, the auctioneer’s negligence, or otherwise.

III. Any lot in this sale may be subject to a reserve. The auctioneer or its agent shall have the right to bid on behalf of the seller for any lot subject to a reserve. The auctioneer may open bidding on any lot by placing a bid on behalf of the seller or the auctioneer and may further bid on behalf of the seller or the auctioneer by placing successive or consecutive bids for a lot or by placing bids in response to other bidders. Any “hammer” price listed is the price for which a lot closed on the floor at the sale (or a reserve price), and such prices do not indicate whether or not any lot met its reserve price if such a price had been established. Bid only as much as you are prepared to pay as in most cases, bidders will pay their top bid.

IV. E-Mail, Fax, or Telephone Bidder. A successful e-mail, fax or telephone bidder will be notified of lots purchased and must remit payment before the lots are shipped. Payment must be received by us within fifteen (15) days of notification. Delivery to a successful bidder will be based on the instructions given by the customer in the “Collection and Delivery Form” which will be included with payment.

V. Title shall not pass to the buyer until full payment is received by WineGavel™.

VI. If a bidder shall fail to comply with these Conditions of Sale, then, as to any lot with respect to which such failure to comply occurs, we shall be entitled (but not obligated), at our sole discretion, to resell the lot or cause it to be resold by public or private sale, without notice to the bidder and in any manner of sale (whether or not commercially reasonable), and to hold the non-complying bidder liable for any deficiency in the purchase price attending such resale, as well as for all charges, costs and expenses incurred in both sales, and all incidental damages. In no event shall any surplus arising from such resale be payable to the non-complying bidder.

VII. If WineGavel™ takes any action to enforce these Conditions of Sale, or to secure payment of any amount due to us from a bidder or purchaser, the defaulting bidder or purchaser shall be liable for all legal and other costs and expenses incurred by us, including but not limited to reasonable attorneys’ fees.

VIII. Successful bidders agree to pay for lots as specified above and no credit will be extended. A late payment charge of 1 1/2% per month shall be imposed on overdue payments. A minimum monthly surcharge of $10 shall apply. All lots purchased in California are subject to sales tax, unless the purchaser is a licensed entity, in which case any and all documentation regarding that entity’s license(s) must be submitted to WineGavel™ prior to each sale. A 19% Buyer’s Commission will be added to all purchases. Lots will be considered as paid when all fees, including but not limited to, shipping, handling, late charges, purchase price, commissions, and any and all sales or use taxes are paid in full.

IX. All agents will be personally liable and responsible for the purchases of those persons they represent, and for other costs and expenses which would be the responsibility of the buyer under these terms and conditions.

X. Under no circumstances, including, but not limited to negligence, will WineGavel™, its officers, directors, employees, agents, or affiliates be liable to any bidder or any third party for any indirect, incidental, special, consequential, punitive or exemplary damages (including, without limitation, damages for loss of business, loss of profits, loss of opportunity, or business interruption) arising out of participation in any auction, or the placing or acceptance or rejection of any bid, or the sale (or failure to consummate a sale) for any lot or lots, or resulting from failure or breach of security, mistakes, omissions, interruptions, deletions, or loss of files or data, errors, defects, delays in operation or performance, regardless of the cause including, but not limited to, acts of God, communication failure, theft, destruction or unauthorized access to WineGavel™ Fine and Rare Wine Auction’s computer network, programs or services, or for any claim by any other party. Not withstanding anything to the contrary in this agreement, the exclusive remedy for all damages, losses and causes of action which a bidder or other person or entity participating or involved in any auction may incur or suffer, whether in contract, tort (including negligence), equity, at law or otherwise, shall be to recover damages in an amount that is not in excess of the wholesale value of any lot that may be the subject of any such dispute.

XI. In the event of any dispute under these Conditions of Sale, or any dispute between the auctioneer and bidders, or between any parties requesting inspection of any of the lots of the auctioneer, or between persons offering their lots to be auctioned and the auctioneer, the exclusive jurisdiction and venue over any such dispute shall be in the Federal and state courts having jurisdiction and located in San Francisco, California, the parties waiving any other jurisdiction or venue to which they may be entitled.

XII. The auction is being conducted by WineGavel™ and no individual auctioneer, employee, office or director of WineGavel™, shall be held to any personal liability hereunder for negligence or otherwise.

XIII.The placing of a bid shall constitute acceptance and agreement of these Conditions of Sale.

XIV. Warranty Information, Buyer’s Remedies: (i) All property is sold “as is”, and neither WineGavel™ nor the consignor make any guarantees, warranties or representations, expressed or implied, with respect to the property, except as to warranty of title.
