D & L STRAUS DISTINGUISHED VISITING PROFESSOR

AKHIL REED AMAR (Advanced Constitutional Law: Reading The Constitution): Akhil Reed Amar, Southmayd Professor of Law at Yale Law School, is considered by many to be the most outstanding constitutional law scholar of his generation. He was the second youngest person to be tenured and given a chair in the Yale Law School's history. As an undergraduate he attended Yale College, where he majored in history and economics, won many prizes, earned a perfect grade point average, and was a star debater. Later, as a student at Yale Law School, he served as editor of the Yale Law Journal. Professor Amar is the author of several distinguished scholarly books and law review articles, has been cited by the Supreme Court often and is one of the most frequently quoted academics in America. He was also a consultant to the popular television show “The West Wing," and serves on the Board of Directors for the National Constitution Center.

NEW FACULTY MEMBERS

KHRISTA MCCARDEN (Federal Income Tax (Fall), Federal Income Taxation of Business Entities (Spring) and International Tax (Spring)): Before joining Pepperdine, Professor McCarden practiced with Morgan Lewis in London where she focused on all aspects of international taxation, including corporate, individual, estate, and trust planning for U.S. persons conducting business or residing abroad. She also advised individuals and charities on U.S. and cross-border charitable giving and structuring and served as Pro Bono Vice Chair for the office. Professor McCarden has published articles in the United States and in the United Kingdom and regularly presented lectures on US/UK dual-qualified charitable structures. While living in London, Professor McCarden was actively involved with her local church and with several charitable organizations. In addition, she was appointed to the Board of the Harvard Law School Alumni Association of the UK.

Professor McCarden began her legal career with Latham & Watkins LLP in Los Angeles. During her first two years of practice, she was selected as a Washington, D.C. delegate by the State Bar of California and the Los Angeles County Bar Association Taxation sections to present a policy paper on charitable giving and planning before the Internal Revenue Service and the Treasury Department, which was later published. She has practiced international tax law in Paris and completed a clerkship in New York with Judge Barrington D. Parker of the U.S. Court of Appeals for the Second Circuit. Professor McCarden has published articles in the United States and in the United Kingdom and regularly presented lectures on US/UK dual-qualified structures.

DEREK MULLER (Civil Procedure I (Fall), Civil Procedure II (Spring), and Complex Litigation (Spring)): Professor Muller focuses his research on procedure, election law and constitutional law issues. He teaches Civil Procedure and Complex Civil Litigation. Professor Muller is a graduate of Notre Dame Law School, where he was notes editor of the Notre Dame Law Review. Following his graduation, he served as a law clerk to Judge Raymond W. Gruender of the U.S. Court of Appeals for the Eighth Circuit. He then worked as a litigation associate in the Chicago, Illinois office of Kirkland & Ellis LLP, where he focused his practice on commercial and appellate litigation. Professor Muller is a member of the Illinois state bar and is admitted to practice in the U.S. Court of Appeals for the Seventh and Eighth Circuits as well as the U.S. District Court for the Northern District of Illinois.

DISTINGUISHED VISITING PRACTITIONER IN RESIDENCE

CHARLES ESKRIDGE (Constitutional Law Seminar: Origins of the Federal Constitution): Charles Eskridge is the Distinguished Visiting Practitioner of Law for Fall 2011. He graduated summa cum laude from the Law School in 1990, and now serves on its Board of Visitors. Upon graduation, he served as a law clerk to Byron R. White, Associate Justice of the U.S. Supreme Court; Charles Clark, Chief Judge of the U.S. Court of Appeals for the Fifth Circuit; and Howard M. Holtzmann, U.S. Arbitrator of the Iran-U.S. Claims Tribunal in The Hague. Eskridge has been a partner with the commercial litigation law firm of Susman Godfrey L.L.P. since 1996, where he has focused his practice on complex, high-stakes litigation in federal and state courts across the country. He also serves as an Adjunct Professor of Law at the University of Houston Law Center, where he has taught courses on Federal Courts and Origins of the Federal Constitution.

NEW ADJUNCT FACULTY MEMBERS RABBI YITZCHOK ADLERSTEIN (Jewish Law): LEE S. ARIAN (White Collar Crimes):

AMY JANE LONGO (Electronic Discovery Practice): Amy Jane Longo is a litigation partner with O'Melveny & Myers, LLP in Los Angeles, and a co-founder and leader of its Electronic Discovery Practice. She graduated as a Harlan Fiske Stone Scholar from Columbia University School of Law in 1996. She is a Council Member of the American Bar Association Section of Litigation, and has served as Co-Chair of its Class Actions and Derivative Suits Committee and a member of its Task Force on Electronic Discovery. She co-authors a practice guide titled Electronic Discovery Practice Under the Federal Rules (BNA 3d ed. 2010), and is an editorial board member of BNA's Digital Evidence and E-Evidence Report and an advisory board member of the Thomson Reuters Electronic Discovery and Document Retention Conference. She has been recognized in The Legal 500 United States for Securities Litigation, and as a Southern California Super Lawyers Rising Star.

CONSTITUTIONAL LAW SEMINAR: ORIGINS OF THE FEDERAL CONSTITUTION: Origins of the Federal Constitution presents an intensive introduction to the historical sources of the Constitution. By reference to original source documents, the class considers the common law and other influences on early American government and justice, including Blackstone’s Commentaries; the colonial experience leading to and immediately following the American Revolution; documents and debate directly relevant to formation of individual constitutional provisions and amendments; and the initial experience and understanding of the Constitution, through to Story's Commentaries, in addition to later amendments. The class will also consider the influence and use of this material on modern interpretation of the Constitution. ELECTRONIC DISCOVERY PRACTICE: In recent years, there has been explosive growth in court decisions and rulemaking regarding discovery of electronically stored information. Much of the caselaw pertains to the propriety of sanctions for the failure to preserve or produce information in discovery -- motions for which have increased dramatically. This class provides an overview of the major concepts in this relatively new discipline, which is grounded in civil procedure and borrows from established doctrines in the areas of preservation, ethics, and spoliation. In addition, the class considers the role of evolving technologies associated with creating, modifying and retaining electronic information, and how these tools intersect with clients’ discovery obligations and evidentiary presentations. TOLERANCE MULTICULTURALISM AND THE LAW: In an age of ever-growing religious and cultural diversity, the modern-nation state is confronting a host of complex questions regarding national identity, individual conscience, and group politics. This course focuses on the two core concepts and the center of such debates: tolerance and multiculturalism. In so doing, the course explores the philosophical, political and legal perspectives that frame contemporary issues at the nexus of individual, community and state. In turn, the course will examine the extent to which these concepts play a role in shaping U.S. law and the extent to which the law addresses the needs of and accommodates the practices of various minority groups.

If you have a pending or secured externship, you must also attend one of the mandatory orientation meetings as well as a weekly clinical seminar, unless you have previously attended the orientation and seminar. The mandatory orientation meetings are August 24th and 25th, 2011. Please also note:

hours of class time weekly (scheduled) and approximately 8 hours of fieldwork per week. Students are advised to leave two time blocks (2 mornings, 2 afternoons or 1 of each) in their schedule to accommodate mediations at various courthouses throughout Los Angeles County.
