FAIR’s Congressional Voting Report is designed to help you understand the positions each U.S. Representative has taken on immigration measures in the First Session of the 110 th Congress in furtherance of a rational immigration system. We have chosen thirteen immigration-related votes on a various immigration-related topics — including border enforcement, interior enforcement, and legal immigration policies — in order to present a broad picture of each Representative’s position. Where a Representative voted on a motion, amendment or bill that FAIR supports, you will see a green plus sign (+). H.R. 1427 Federal Housing Finance Reform Act of 2007 House Vote 387, Housing Assistance Benefits May 22, 2007 — Price (R-GA) amendment H.A. 216 to H.R. 1427, the Federal Housing Finance Reform Act of 2007, requiring an applicant for housing assistance to present proof of identity and legal status. The forms of identification acceptable were limited to (1) a social security card with photo identification, (2) a driver’s license or other identification in compliance with REAL ID, (3) a U.S. or foreign passport or (4) a USCIS photo identification card. The amendment was adopted 235-188. FAIR supported this amendment. H.R. 2638 Department of Homeland Security Appropriations, 2008 House Vote 476, Border Fencing June 15, 2007 — Carter (R-TX) amendment H.A. 273 to remove language in the Appropriations bill that barred the funding of fencing (1) through federal lands without the approval of the environmental or other agency involved in management of the lands or (2) without consultation with the state and local communities. The amendment would restore the authority of the Secretary of Homeland Security to determine the most strategic locations for building the fence without being required in every instance to consult other agencies. The amendment was rejected 190-233. FAIR supported this amendment. House Vote 478, Employment Authorization Verification June 15, 2007 — King (R-IA) amendment H.A. 278 to reduce ICE salaries and expenses by $5 million and redirected it toward operation of the E-Verify program (formerly the Basic Pilot Program). The amendment was adopted, 228-195. FAIR supported this amendment. House Vote 479, REAL ID June 15, 2007 — Bilbray (R-CA) amendment H.A. 280 to reduce the Coast Guard integrated deepwater system program by $150 million and use the money to help states comply with the REAL ID Act of 2005. House Vote 485, Sanctuary CitiesJune 15, 2007 — Tancredo (R-CO) amendment H.A. 294 to prevent the distribution ofHomeland Security funds under the bill to cities that bar communication between their agenciesand Homeland Security regarding the immigration status of individuals in custody. Theamendment was adopted 234-189. FAIR supported this amendment.

House Vote 486, Border FencingJune 15, 2007 — Royce (R-CA) amendment H.A. 295 to prohibit the use of funds to buildfencing on the U.S.-Mexico border with fewer than two layers. The amendment was rejected,149-272. FAIR supported this amendment.

House Vote 487, Temporary Protected StatusJune 15, 2007 — Forbes (R-VA) amendment H.A. 296 to prevent Homeland Security fundsbeing used to extend temporary protected status for nationals of a country beyond the originalperiod of not more than 18 months. The amendment was rejected, 123-298. Fair supportedthis amendment.

House Vote 673, Social Security Totalization AgreementsJuly 19, 2007 — Gingrey (R-GA) amendment H.A. 673 to prohibit the use of any fundsappropriated in the act pursuant to any totalization agreement with Mexico. A totalizationagreement with Mexico would permit illegal Mexican workers, whose employers paid SocialSecurity taxes in the U.S., to obtain credit for funds paid into the system under fraudulentlyobtained Social Security numbers (SSN) once the alien obtains any form of legal status andobtains a valid SSN. The amendment was agreed to, 254-168. FAIR supported thisamendment.

H.R. 3074 Transportation, Housing and Urban Development, and Related AgenciesAppropriations Act, 2008

House Vote 707, Security and Prosperity PartnershipJuly 24, 2007 — Hunter (R-CA) amendment H.A. 630 to prohibit the use of DOT funds for U.S.participation in a working group pursuant to the Security and Prosperity Partnership. TheSecurity and Prosperity Partnership (SPP) was launched in March of 2005 as joint effortbetween the United States, Mexico and Canada to “increase security and enhance prosperity”through greater cooperation and information sharing. The SPP, however, has been criticized fordeveloping certain initiatives, such as the Mexican Trucking Pilot Program. The amendment

would stop funding for U.S. participation in this partnership. It was agreed to, 388-39. FAIRsupported this amendment.

H.R. 3093 Commerce, Justice and Science Appropriations Act, 2008

House Vote 734, English LanguageJuly 26, 2007 — Stearns (R-FL) amendment H.A. 678 to prohibit the Equal EmploymentOpportunity Commission from using funds to prosecute actions against employers who requireemployees to speak English. The amendment was proposed in reaction to a recent EEOCaction against the Salvation Army, which had required workers to speak English on the job. Theamendment was rejected, 202-212. FAIR supported this amendment.

H.R. 3161 Agriculture, Rural Development, Food and Drug Administration and RelatedAgencies Appropriations Act, 2008

House Vote 814, Employment of and Housing Assistance for Illegal AliensAugust 2, 2007 — Lewis (R-CA) motion to recommit the Act to the committee with instructionsto report back the bill with an amendment prohibiting the use of Agriculture funds to employillegal aliens and to provide rental housing to aliens not authorized to receive assistance undersection 213A of the Immigration and Nationality Act. Note: This controversial vote had anoriginal tally in support of recommitment of 215-213, which after time expired was changed to214-214 because of vote changes, and ultimately failed on a 212-216 vote. This vote was thesubject of an internal House of Representatives inquiry. The motion failed, 212-216. FAIRsupported this amendment.
