Dear Citizens of Mother India,Before, we go to celebrate our Independence Anniversary,

we need to know some facts.ARE WE REALLY AN INDEPENDENT NATION?

Have you heard of TOP (Transfer of Power) Treaty?



A British Labour Party Minister by name Stafford Cripps visited India, on May 1942 with a proposal to Gandhi, with a mission better known in Indian political History as the CRIPPS OFFER, promising DOMINION STATUS to India, after the 2nd World War, which was rejected by him. But, the deliberations on this proposal went on till 1947, until it took the final shape as a Bill introduced in House of Commons in London on June 1947, on the basis of Mountbatten's reports from India since April 1947, when he became Viceroy. This Bill known as the ‘Indian Independence Act 1947’ was passed in June 1947 for enactment, giving DOMINION STATUS to India.

POINT NO: 1



The Indian Independence Act 1947, passed by the Parliament of Britain was in short an EXECUTIVE NAME of the earlier suggested TOP, which lies highly classified in British custody even today, with only 12 EDITED and highly censored volumes from among numerous volumes, being made public in the year 1975. These volumes are available across Public Libraries in India, in the name of ‘TOP SERIES 1942-’47’. (THE 6TH VOLUME GIVES MINUTES OF THE BRITISH CABINET MEETING DISCUSSING ARREST OF SUBASH CHANDRA BOSE AS WAR CRIMINAL between page 142 to 150).

POINT NO: 2



The Indian Independence Act 1947 has some restricted subjects reserved by the British Govt under the earlier followed diarchy, which were NOT TRANSFERRED TO INDIANS IN THOSE MATTERS ON WHICH AGREEMENTS HAVE BEEN REACHED, PRIOR TO THE INDIAN INDEPENDENCE ACT OF 1947.

POINT NO: 3



The restricted subjects included matters on Taxation, Revenue, Foreign Relations/Policies, Justice Department, Police etc, attached to prior agreements executed before 1947. It also tied the Indian Union to the British Commonwealth of Nations, which recognized the British sovereign as head of the Commonwealth, to whom all dominions had to swear allegiance. This allegiance into which India entered to, is supposed to last for a period of not less than 99 years from the date of enactment of the Act.

POINT NO: 4



Note: There is absolutely no public document, to support the claim of lease of India for a period 99 years, as such a sensitive document can set aflame the hearts of every patriotic Indian, at the thought that he had been deceived for years. But, that such documents are signed by every Prime Minister, after taking his oath in office at the Rashtrapathi Bhawan, is an ever recurring fact.

Any attempt to bring out the facts of this document, through the RTI clause is also not possible, as the office of the President is out of purview of RTI. Hence, to lay ones hold on the text of this documents signed by the Prime Minister, is impossible as they form part of documents in secrecy at the Office of the President of India. It would require some former Prime Minister, coming out openly against these documents, in which case, he is likely to be brought to justice and wide international implications to follow.



The British left India through a declaration on the midnight of August 15th 1947, under the Indian Independence Act 1947, through a Transfer of Power. India was given DOMINION STATUS, with White Officers as Administrative Head of the Dominion of India. The Viceroy of India till 1947 and thereafter the Governor General of India till June 1948, Louis Francis Albert Victor Nicholas Mountbatten, was one such officer stationed in India.



What is to be a DOMINION? Dominion is a self-governing division of the British Empire, with allegiance to the British Common Wealth.

Although, the dominion status ended with the day when India became a Republic with an Independent Constitution, we are still tied up in the provisions of the Dominion, through Article 147 of the Indian Constitution, even today.Look at what the Balfour declaration of 1926 defines, what a ‘Dominion’ is:

Dominions are autonomous communities within the British Empire but united by a common allegiance to the British Monarchy. India, with its ‘Dominion’ status, thus became an autonomous community “within the British Empire”. The period, 99 years from the date of grant of ‘Dominion’ status. And let me add, that all such ‘Dominions’ will have to pledge itself to remain within the British Common Wealth.

OUR INDEPENDENCE BECOMES A FAKE ONE.



Please note that this Article is a widely discussed and debated one among constitutional experts in India. The Article 147 of the Indian Constitution states that although the Supreme Court of India is the final interpreter of the Constitution of India, Article 147 also makes it mandatory that the interpretation of Article 147, shall be made, standing withing the the interpretation of Government of India Act 1935 and Indian Independence act 1947; which is to say, that some of the requirements in these act two Acts, shall stay valid even today. The Article also says that, whatever amendments that the British Privy Council (Supreme Court of Britain) shall make, with regard to the clauses in the two acts of 1935 and 1947, they shall remain applicable at whatever time, they may be amended in Britain. Hence, Article 147 of the Indian Constitution is a controversial one for ever inquisitive and Patriotic citizen of India.

AND THAT IS NOT THE FREEDOM YOU AND ME WANTS

THE CONTROVERSIAL ARTICLE 147, IN INDIAN CONSTITUTION



The present Federal structure of India with its Constitution included is as per the Govt of India Act 1935, which has concurrency of the British Govt. It has many clauses that were later on taken into the TOP treaty. The Reserve Bank of India, which is a creation of the British Govt, is also tied down to many of the clauses in the said Act of 1935.



Look above, at the underlined words of the Declaration of American Independence of July 4, 1776.“that those United colonies are, and of the Right ought to be Free and Independent States; that they are absolved from all allegiance to the British Crown, and that all political connection between them and the State of Great Britain is, and ought to be, totally dissolved”

Look on the right, the lines written in the Indian Independence Act 1947, according to which, we were subject to Dominion Status



It is also to be noted that (letter of Nehru shown ) C Rajagopalachari, our first Indian Governor General, was appointed by Nehru after getting the concurrence from the British Monarchy. Although India became a Republic, we had a Constitution that was forced upon us under the supervision of the British Monarchy on January 26, 1950 and this Constitution was an amalgamation of various other constitutions, as suggested by Britain, according to which, our Constitution was formulated.

IF INDIAN INDEPENDENCE WAS A COMPLETE ONE, THEN WHAT WAS THE PURPOSE OF SUCH A LETTER FROM NEHRU? TAKE CARE OF THE VERY SUBMISSIVE LANGUAGE USED.



Although, no public records are available, it is still to be known by the people of India, that:

The form of Affirmation of Allegiance to the Emperor of Britain was made by Nehru on the 15th of August 1947 as:

• I, Jawaharlal Nehru, do solemnly affirm that I will be faithful and bear true allegiance to His Majesty, KING GEORGE THE SIXTH, Emperor of India, His Heirs, and Successors, according to law.

AND

The form of Affirmation of Office by the Prime Minister of India by Nehru was made as:• I, Jawaharlal Nehru, do solemnly affirm that I will well and truly serve our Sovereign, KING GEORGE THE

SIXTH, Emperor of India, in the Office of Member of the Governor General’s Executive Council, and that I will do right to all manner of people after the laws and usages of India without fear or favor of affection or ill-will.

(It is told that Nehru had initially refused to recite these words, but had to do so, not having another alternative)

THAT WAS THE SORT OF FAKE INDEPENDENCE WE WERE MADE TO SWARE INTO



LOOK AT THE NAMES OF THE NAVAL CHIEF’s AFTER INDIA BECAME A REPUBLIC. THEY WERE BRITISH OFFICERS TILL 1955. Ronald Ivelaw-Chapman and Gerald Gibbs headed our Air Force until 1951 and 1954 respectively. It was only in 1954 that we could have our own citizens, Subroto Mukherjee, at the helm of the air force affairs.

IS THAT THE INDEPENDENCE WE SO PROUDLY TALK ABOUT?



On 2nd September 1953, Dr. Ambedkar clarified in his speech in the Rajya Sabha (Parliament) that, and I quote

“People always keep saying to me: ‘Oh, you are the maker of the Constitution.’ My answer is I was a hack. What I was asked to do, I did much against my will.

“My friends tell me that I have made the Constitution. But I am quite prepared to say that I shall be the first person to burn it out. I do not want it. It does not suit anybody….”

AMBEDKAR STATED OPENLY THAT HE WAS NOT HAPPY WITH THE WAY HE WAS ASKED TO FORMULATE THE INDIAN CONSTITUTION



COMMENTARY: This is an article that sets definite parameters in the jurisdictional areas of the Supreme Court of India. Please not the underlined portions. Here, it may be understood that, any dispute raised by any individual, organization, state or states; that challenges the authority of any treaty, agreement, covenant or such other instruments, entered into before India became a Republic on 26th of Jan 1950, will

not be subject to the jurisdictional power of the Supreme Court of India. Here, British agreements, deeds or treaties made before the said date, that exercises British power and rights on organizations or properties inside India, by which the operational benefits of such organizations/property in India, is either protected or siphoned out of the country, stands unquestionable. IS THIS THE FREE INDIA IN WHICH YOU AND ME LIVE?

WHAT ARTICLE 131 OF THE INDIAN CONSTITUTION MEANS?



Commentary: It says about the authority of Britain on properties ;I. received by someone in regular or by increasing quantity over a period of time, orII. by the reversion of property to a state or to a Lord on the owners dying without

legal heirs orIII. those without any apparent owner,

to which the Crown may have right within the territory of India, BEFORE the period of enactment of The Constitution of India. By this, all property which are in some way or other, linked with Britain, will not be under the legal purview of the highest court of India.



First, look at the above press release of the Government Of India.History: The High Courts of Calcutta, Madras and Bombay, were established by the Indian High Court Act of 1861, passed by the Parliament of UK, under the concurrence of the British queen. Thus the Sadar Courts (Supreme Court of Revenue in British India) was amalgamated with the Supreme Courts of the three presidencies. The Charter of the High Court of Calcutta, was issued on the 14th of May 1862, while those of Madras and Bombay were issued on the 26th of June, 1862.

As per Transfer of Power treaty, these royal charters cannot be negated and any change in the constitution of these courts, by way of it’s name or content of judicial members, procedures or authority, will require the direct approval of the Parliament and the queen of Britain.

The above attempted bill, by the Modi Government was hence shelved.



Commentary: This was a very inquisitive news that came on the 26th of August 2016 at 1:30 PM on the Mathrubhumi TV News channel in Kerala, saying that the estates of Harrison Malayalam Plantations at Munnar in Kerala are claimed to be owned by a British Company.



Commentary: A search of the company details on the above British website, returned the details of the company as being a British entity incorporated in the year 1977, much after the declaration of Independence and also attainment of Republic status. That is the effect of Article 131 of the Constitution, and is this the sort of independence, you and me are to be proud about?



The news further goes on to say that a search through the website, revealed that the assets of the said British company are in the Indian Companies.

HOW COULD A FOREIGN COMPANY OWN LAND ASSETS IN INDIA?



CASE STUDY WHICH SHOWS THE EFFECTS OF ARTICLE 147.

There was a strike of labourers of the Kannan Devan Hill Plantations Pvt Ltd, in Kerala, on Sept 2015 for increase of rise in wages from Rs.213 per day to Rs.500 per day, in the name of PEMBLAI ORUMAI, at Munnar, Kerala. But inspite of local support and backing from the Govt of Kerala, the strike failed to achieve its objective. The existing wage of Rs.213 (equivalent to an unchanged amount as introduced by the Scotts way back in 1920s, but re-evaluated in Rupees, as per current inflation and devaluation of Indian currency), was besides humane conditions of shelter given to these workers. (Many of them are still accommodated in these British made small holdings called LAITH, that leak in monsoon).



The Kannan Devan Hill Plantations Pvt Ltd sought to prohibit the state Government from taking any action against the Company in relation to lands held by it. This claim was raised, with the support of a deed executed at the Devikulam Sub Registrar Office on December 31st 1976 between a Scotland based Company with Office at Calcutta, named 'KANNAN DEVAN HILLS PRODUCE COMPANY LIMITED' and Bombay based ' TATA FINLAY LIMITED' for transfer of lands for Rs.1.58 crores. The second deed was registered between a foreign Company named ' ANGLO-AMERICAN DIRECT TEA TRADING COMPANY LTD' and 'TATA FINLAY LTD' for transferring 5,250 acres. The Govt of Kerala contested the validity of these deeds saying that KDHP Co. Ltd and ANGLO-AMERICAN DIRECT TEA TRADING Co. Ltd, which is an amalgamated Company, that are parties in the deed are both foreign Companies, and that they have no right to buy or sell land inside the Republic of India, as per the Foreign Exchange Regulations act, of the Reserve Bank of India. The petition also claimed that the LAND BOARD had also ordered the restoration of 57,359 acres of land to KDHP Co. Ltd, which again was also invalid. The matter was thus contested, may be due to the ignorance on the part of those who handled the case, or deliberately, to make a fool of the public.

POINTS CONSIDERED DURING LITIGATION:



The above claim of the State Govt was successfully disputed by KDHP Co. Ltd by furnishing proofs that THE RESERVE BANK HAD ACCORDED IT'S APPROVAL BY AN ORDER DATED 09/02/1977, FOR TRANSFER OF UNDERTAKINGS OF KANNAN DEVAN HILLS PRODUCE COMPANY LTD ON AN APPLICATION DATED NOVEMBER 19TH 1975 by the company.

RBI allowed the transfer to happen because it is duty bound under provisions of the TOP Treaty to honour all deeds and agreements, executed before the Indian Independence Act of 1947, during which period onwards, these foreign companies own the land inside India. Moreover, RBI is the product of the British enacted GOVERNMENT OF INDIA ACT of 1935 which incorporates many clauses in the TOP treaty and hence, is powerless to take any stance against the business interests of KDHP company.

CONCLUSION

This case which is one of the latest to happen, clearly shows that, besides having been told that we all live in a free India, we are still bound by some highly classified clauses of the Govt of India Act 1935, that places restrictions on our integrity & freedom, by favoring the deceitful British, even after so many years. It was an open invitation for committing an act of suicide, thrown upon us by some so called cunning leaders of our nation.



SOMETHING, EVERY INDIAN SHOULD KNOW:

Clement Attlee had visited India in 1956 as a Private citizen of Britain and the Commonwealth. He was well received by the people and the Govt ( thanks to the official History taught to generations) and as he was staying in the Raj Bhawan of Kolkata, his host, the then Acting Governor of West Bengal , who was also the ex Chief Justice of Calcutta High Court , Justice; Phani Bhushan Chakraborty asked Attlee a remarkable question that. WHY, INSPITE OF THE VICTORY IN WORLD WAR II, DID THE BRITISH LEAVE INDIA, ALL ON A SUDDEN ?

Attlee replied that there were many reasons, but the most important is the ACTIVITIES OF SUBHAS CHANDRA BOSE WHICH CAUSED A PSYCHOSIS OF WIDESPREAD MUTINY BY INDIAN SOLDIERS IN BRITSH ARMED FORCES IN 1945-46 PERIOD.
