1. On behalf of the Executive Director, KSHMA, Lalbagh Bangalore, Project Officer, CoE for protected cultivation, Somanahallikaval Horticulture Farm, Hassan Taluk., & District., Karnataka State, India, invites tenders from eligible tenderers, for the construction of works detailed in the Table below.
2. The tenderer/s may submit tenders- for the works given in the Table. The tenderers are advised to note the minimum qualification criteria specified in the clause 3 of the instructions to tenderers to qualify for the award of the contract.
3. Tender documents may be downloaded from Government of Karnataka e-procurement website https://eproc.karnataka.gov.in
4. Tenders must be accompanied by Earnest Money Deposit which will have to be paid through online e-procurement portal along with the prescribed e-bid processing fee.
5. Tenderers must submit all documents with self attestation, originals if required for verification have to be produced at short notice. Validity of tender will be 90 days from the date of submission of tender.
6. Bidders are required to obtain level III digital signature from designated firms (available on e-procurement portal and then register with the Government of Karnataka e-procurement platform and submit bids by using their User_ID and Digital Signature).

A. General1. Scope of Tender
On behalf of the Executive Director, KSHMA, Lalbagh Bangalore, Project Officer, Centre of
Excellence for Protected Cultivation, Somanahallikaval, Horticulture farm, Kudurugundi Post, Hassan

Taluk & District Pin-573214, Karnataka State, India invites tender following Two Cover e-tender
procedure, from eligible Tenderers, for the construction of works (as defined in these documents and
referred to as "the works") detailed in the Table given in the Invitation for Tenders (IFT). The
Tenderers may submit tenders for the works detailed in the table given in IFT.
2. Eligible Tenderers
2.1 Tenderers shall not be under a declaration of ineligibility for corrupt and fraudulent practices issued
by the Department of Horticulture, Government of Karnataka.
2.2 Tenders from Joint ventures are not acceptable.
3. Qualification of the Tenderer:
3.1 All Tenderers shall provide the requested information accurately and in detail in Section-3
qualification information.
3.2 To qualify for award of this contract, each Tenderer in his name should have in the last five years
period (2010-11, 2011-12, 2012-13, 2013-14 & 2014-15).
a. Achieved in at least three financial years an average annual financial turnover (In all classes of
hi-tech/ automatic / fully automatic greenhouse construction and management) of not less than
Rs.15 Crores.
b. Should have satisfactorily completed as globally reputed registered contractor / firm for at least
two similar works to an extent of 80% of the cost of the work, for all works costing more than
Rs. 800 Lakhs.
c. Executed in any one year (for a continuous period of 12 months), the following minimum
quantities of work.

d. The tenderer should have obtained globally reputed registration certificate in the field of hi-
tech greenhouses developmentfrom competent authority.
e. The tenderer should have completed atleast one similar project with Double Ridge Ventilation
(DRV) system installed in India or outside India.

3.3 To qualify for this contract, the tenderer must demonstrate having experience and resources
to meet the aggregate of the qualifying criteria for the contract.
3.4 Each tenderer should further demonstrate

b) Liquid assets and / or availability of credit facilities of no less than Rs. 200.00 lakhs
(credit lines / letter of credit / certificates from Nationalized banks for meeting the fund
requirement etc).
3.5 Sub-contractors experience and resources shall not be taken into account in determining the
Tenderers compliance with the qualifying criteria.
3.6 Tenderers who meet the above specified minimum qualifying criteria, will only be qualified, if
their available tender capacity is more than the total tender value. The available tender capacity will
be calculated as under:
Assessed availability tender capacity = (A*N*1.5 - B)
Where
A = Maximum value of hitech polyhouse construction works executed in any one year during the
last five years taking into account the completed as well as works in progress.
N = Number of years prescribed for completion of the works for which tenders are invited.
B = Value, at 2014 price level, of existing commitments and ongoing works to be completed during
the next one year.
3.7 Even though the tenderers meet the above criteria, they are subject to be disqualified if they have:
Made misleading or false representations in the forms, statements and attachments
submitted in proof of the qualification requirements; and / all.
Record of poor performance such as abandoning the works, not properly completing the
contract, inordinate delays in completion, litigation history, or financial failures etc.; / or

3.8 Consortium of companies involved in similar projects with expertise in various components in the
tender shall participate with authorized expertise certification of the individual consortia from the
competent authority: and shall provide the details accordingly for the clauses stated above (3.2, 3.4
and 3.6).
3.9 Tenderers should have ISO certification for construction of hitech green house and accessories.
3.10 The company, or leading company in case a consortium of companies is responsible for the
coordination of all deliveries, the construction (The works specified in the clause 3.2 and 3.4 above;
individual components or whole of them) and training of officers of CoE and Department of
Horticulture.
4 One Tender per Tenderer:
4.1 Each tenderer shall submit only one tender.
5 Cost of Tendering:
5.1 The tenderer shall bear all costs for submission of his tender.
6 Site visit:
6.1 The tenderers are encouraged to submit their respective bids after visiting the project site and
asserting themselves the site condition, traffic, location surroundings, climate, availability of
power and water, and other utilities for the construction, storages etc., the cost of visiting the
Site shall be at the Tenderer's own expense.

7 Instruction to tenderers (Based on Indian law and rules)
General instructions
7.1 The tenderers are advised in their own interest, to carefully read the instructions and understand
their purpose and unless the tenderers specifically states to the contrary in respect of any
particular clause, It shall be presumed that all tender conditions have been accepted as laid down
in this tender document.
7.2 In case, the specifications of any offered items / machineries/ software/ any other related items
deviates from the specifications laid down in the tender form, the tenderers should describe as to
in what respect and to what extent the equipment offered by them deviates from the
specifications, even though the deviations may be minor. It should be explained how these would
be useful for our purpose.
7.3 The tenderers should enclose with their offers descriptive catalogues, leaflets and engineering
drawings supplementing the description and point out any special features/advantages of their
equipment quoted and users list of the equipments/machineries supplied by them. All the
literature, leaflets, engineering drawings etc. should be in English or accompanied by English
translation in case the language is other than English. This should be adhered to strictly to enable
objective evaluation of offers.
7.4 The tenderer must have established similar structures and should take necessary steps to arrange
field visit for the technical committee members to organization where it had erected similar

structured to get first hand information on functioning of the units erected; soon after the issuing
of the work order and the tenderer shall bear all the expenses for the purpose; failing may attract
termination of the contract.
7.5 The tenderer shall deposit a bid security deposit Rs. 50.00 lakhs either as demand draft or as bank
guarantee. The scanned copy of the bank guarantee should be attached with the technical bid and
the original should be posted to Project Officer, CoE for Protected Cultivation, Somanahallikaval
Horticulture farm, Kudrugundi post, Hassan District– 573214 within 25 days from the date of
award of the tender.
7.6 The validity of the bank guarantee should be till the completion of the project and shall be
extended as per the orders of the empoyer.
7.7 All the documents and communications in connection with the bidding shall be made in English.
7.8 Apart from the erecting and commissioning of the unit as per the specifications laid down, the
tenderer shall provide handholding support and maintenance of the unit for three years from the
date of commencement of production and ensure production of good quality seedlings of high
yielding varieties during that period. Shut down and/ or preventive maintenance during that
period shall be the responsibility of the tenderer.
7.9 Quotation of Prices
Tenderer shall give a final and net price free from all escalations. Request for change in price will
under no circumstances be considered after opening of the tender.
7.10 All direct and indirect taxes arising in connection with the execution of work shall exclusively
be borne by the successful tenderer and the price quoted will be deemed to be inclusive of all
such taxes.
7.11 Tenderer should establish an office/service center in Bangalore once the work order is issued
for the work within 7 days from the issue of the same.
7.12 Printed terms & conditions of the bids shall not be considered and the same shall not be binding
or become part of the contract unless any of such terms is specifically laid down by the tenderer
and accepted by the KSHMA in writing. Except to the extent stated above, it will be deemed that
the printed terms & conditions of the tendering contractors have been rejected by Karnataka State
Horticulture Mission Agency (KSHMA).
7.13 This tender is not transferable
7.14 The tenderer shall not sublet, transfer, assign or otherwise part with the contract to any person,
contractor or Company directly or indirectly, in full or any part thereof.
7.15 Appointing a committee for evaluation, monitoring and certification of the construction
work: Mission Director, KSHMA will appoint a committee for the evaluation, monitoring and
certification of the work done by the selected tenderer; the same shall issue the work satisfactory
report from time to time before making any payments to the tenderer. The detail will be given to
the selected contractor in due course.
7.16 Warranty

The successful tenderer shall warrant that goods to be installed under this contract shall be free
from all defects and faults in material, workmanship and manufacture and shall be of the highest
grade and consistent with the established and ISO standards for materials and in full conformity
with the contract specifications and drawings or samples, if any, and shall operate properly and
satisfactorily for a period of three years from the date of commissioning. The successful tenderer
shall, replace or repair the goods or such portion in case of defects or poor workmanship or any
malfunction of the unit or any portion thereof.
7.17 Contractor shall at his expense obtain all necessary permits and licenses required for execution
of the work.
7.18 The Contractor shall arrange and pay for all personnel, materials, transportation and all other
facilities required for the satisfactory execution and completion of the work. The price quoted
will be deemed to be inclusive of all such expenses.
7.19 Contractor shall indemnify the KSHMA against all claims, proceedings, damages, costs,
charges and expenses arising in connection with damage to property of any person or injury to
person or loss of life occurring in the course of execution of the work.
7.20 All bidders shall enclose a certificate stating that they have no dues with regard to the EPF, ESI
Or any other statutory payment with regards to their employees and should also furnish the details
of last remittance of EPF and ESI of their employees
7.21 It is the obligation of the selected firm to provide required training and capacity building
programmers to Mission staff on the operation of the unit.
7.22 Liquidated Damages (LD) clause — The successful bidders should complete the work as per
the schedule above. Any delay will attract LD of 0.1% per day of the contract value subject to
maximum of 7.5% of the contract value.
7.23 General terms and conditions of E- tendering
7.23.1 The bid should be submitted online at website https://eproc.karnatakta.gov.in by the due date
and time, as specified in the 'Critical Dates' view of the 'Work Item details' of the tender. Late /
delayed tenders submitted on line after the due date and time, for whatsoever reasons will not
be considered. The Server Date & Time as appearing on the website
http://eproc.karnataka.gov.in shall only be considered for the critical date and time of tenders.
Offers sent through post, telegram, fax, telex, e-mail, courier will not be considered.
7.23.2 All communication regarding the tender including queries if any and submission of offers shall
be done online within the e-Procurement system at website https://eproc.karnataka.gov.in
7.23.3 Bidders shall be required to arrange all resources, including Digital Signature Certificates and
Internet Connections at their own cost, for participating in online tenders at
https://eproc.karnataka.gov.in
7.23.4 KSHMA shall not be responsible for any delays, reasons whatsoever, in receiving as well as
submitting offers, including connectivity issues. KSHMA shall not be responsible for any
postal or other delays in submitting EMD/Tender cost wherever applicable.

7.23.5 Please note that queries related to tender specifications, terms & conditions etc. should be
submitted online only by logging in at https:// eproc.karnataka.gov.in before the clarification
end date/time specified in the 'Critical Dates' view of 'Work item Details'. KSHMA, at its sole
discretion, may not entertain the queries sent by post / fax/ e-mail or through any other mode of
communication
7.23.6 Tender opening (Cover I) will be done online at the time and dates specified in the tender
'Critical Dates View' of 'Work Item Details' and Cover II (Financial) will be opened on a
subsequent date after evaluation of Cover I.
7.23.7 The bidders are requested to go through the instruction to the bidders in the website
https://erpoc.karnataka.gov.in . The bidders who submit their bids for this tender after digitally
signing using their Digital Signature Certificate (DSC), accept that they have clearly
understood and agreed the terms and conditions in the website including the terms and
conditions of this tender.
7.23.8 Single transaction for remitting Tender processing fee and Bid security. Bidder should ensure
that tender processing fees and Bid security are remitted as one single transaction and not
separate. Separate or split remittance for tender processing fee and Bid security shall be treated
as invalid transactions. Bid security can be paid as bank guarantee in the prescribed format and
the scanned copy should be attached with the technical bid and the original posted to Project
Officer, CoE, Hassan.
7.23.9 Account number as per Remittance Form only: Bidder should ensure that account no entered
during NEFT remittance at any bank counter or during adding beneficiary account in Internet
banking site is the same as it appears in the remittance form generated for that particular bid by
the e-Procurement system. Bidder should ensure that tender document fees and Bid security are
remitted only to the account number given in the Remittance form provided by e-Procurement
system for that particular tender.
7.23.10 Bidder should ensure the correctness of details submitted while remittance through NEFT.
Please also ensure that your banker inputs the Account Number (which is case sensitive) as
displayed or appears in the Remittance form. Bidder should not truncate or add any other detail
to the above account number. No additional information like bidder name, company name, etc.
should be entered in the account no. column along with account no. for NEFT remittance.
7.23.11 Only NEFT remittance allowed: RTGS payments, Account to Account transfers or Cash
payments are not allowed and are invalid mode of payments. Hence, the remittance form
provided by e-Procurement system is to be used only for NEFT payment.
7.23.12 UTR number: Bidders should ensure that the remittance confirmation (UTR number) received
after NEFT transfer should be updated as it is, without any truncation or addition, in the e-
Procurement system for tracking the payment
7.25.13 One Remittance form per bidder and per bid: The remittance form provided by e-Procurement
system shall be valid for that particular bidder and bid and should not be re-used for any other

tender or bid or by any other bidder. The bids will not be considered for further processing if
bidder fails to comply on points above and tender fees and EMD will be reversed to the account
from which it was received The Earnest Money Deposit of the unsuccessful tenderer shall be
refunded immediately after the acceptance of Work Order by the successful bidders through
online.
B. Tender documents8. Content of Tender documents
8.1 The set of tender documents shall have all the Sections given in Page 3.
9. Clarification of Tender Documents
9.1 A prospective tenderer requiring any clarification of the tender documents may notify the tender
inviting authority in writing or by cable (herein after "cable" includes telex and facsimile) at the tender
inviting authority address indicated in the invitation to tender.
9.2 Pre-tender meeting:
9.2.1 The tenderer or his authorized representative is invited to attend a pre-tender meeting which will
take place at the Office of Mission Director, KSHMA, lalbagh, Bangalore-04.
On 16-11-2015,11:00 Am.
9.2.2 The purpose of the meeting will be to clarify issues and to answer questions on any matter that
may arise at that stage.
9.2.3 The tenderer is requested to submit any questions in writing or by cable to reach the tender
inviting authority not later than one week before the pretender meeting.
9.2.4 Minutes of the meeting, including the text of the questions raised (without identifying the source
of enquiry) and the responses given will be transmitted through e-proc portal. Any modification of the
tender documents listed in Sub-Clause 8.1 which may become necessary as a result of the pre-tender
meeting shall be made by the tender inviting authority exclusively through the issue of an Addendum
pursuant to Clause 10 and not through the minutes of the pre-tender meeting through e-proc portal only.
9.2.5 Non-attendance at the pre-tender meeting will not be a cause for disqualification of a tenderer.
10. Amendment of Tender documents
10.1 Before the deadline for submission of tenders, the Employer may modify the tender documents
by issuing addenda.
10.2 Any addendum thus issued shall be part of the tender documents and shall be published in
e-procurement portal and no communication would be sent to the purchasers of tender.
10.3 To give prospective Tenderers reasonable time in which to take an addendum into account in
preparing their tenders, the Employer shall extend as necessary the deadline for submission of tenders,
in accordance with Sub-Clause 17.2 below.
C. Preparation of Tenders
11. Documents comprising the Tender
11.1 The tender submitted by the Tenderer shall be in two covers through e-procurement only

11.1.1 All the documents required to be completed and submitted to the tenderer in accordance with
these instructions. The documents listed under Sections 3, 4, 6 and 9 shall be filled in without
exception.
12. Tender prices
12.1 The contract shall be for the whole works as described in Sub Clause 1.1, based on the priced
Bill of Quantifies submitted by the Tenderer.
12.2 The Tenderer shall fill in rates and prices and line item total (both in figures and words) for all
items of the Works described in the Bill of Quantities along with total tender price (both in figures and
words).
Items for which no rate or price is entered by the Tenderer will not be paid for by the Employer when
executed and shall be deemed covered by the other rates and prices in the Bill of Quantities.
Corrections, if any, shall be made by crossing out, initialing, dating and rewriting.
12.3 All duties, taxes, and other levies payable by the contractor under the contract, or for any other
cause, shall be included in the rates, prices and total Tender Price submitted by the Tenderer.
13. Tender validity
13.1 Tenders shall remain valid for a period not less than ninety days after the deadline date for tender
submission specified in Clause 17. A tender valid for a shorter period shall be rejected by the Employer
as non-responsive.
13.2 In exceptional circumstances, prior to expiry of the original time limit, the tender inviting
authority may request that the Tenderers may extend the period of validity for a specified additional
period. The request and the Tenderers responses shall be made in writing or by cable. A Tenderer may
refuse the request without forfeiting his earnest money deposit. A tenderer agreeing to the request will
not be required or permitted to modify his tender, but will be required to extend the validity of his
earnest money deposit for a period of the extension and in compliance with Clause 14 in all respects.
14. Earnest Money Deposit
14.1 The tenderer / contractor can pay the Earnest Money Deposit (EMD) in the e-Procurement portal
using any of the following payment modes as per the prescription of column 3 of table of IFT for the
particular work
Credit Card Direct Debit National Electronic Fund Transfer (NEFT) Over the Counter (OTC)
OTC payment procedure
If a contractor / tenderer chooses to make payment of EMD / tender processing fees Over The Counter
(OTC) in any of the designated Axis Bank branches listed in the e-Procurement web-site
(https://eproc.karnataka.gov.in), the contractor / supplier will need to log into e-Procurement system,
access the tender for which bid is being created and then select the OTC option under the payment
section and print the Challan shown in that section. The printed challan will have the unique bid

reference number and the amount to be remitted. Along with the challan, contractor can choose to make
the payment either in the form of cash or in the form of Demand Draft Cheque payments will not be
accepted. The contractor is requested to specifically inform the bank officer to input the unique bid
reference number printed in the challan in the banking software. Upon successful receipt of the
payment, the bank will provide a 16-digit reference number acknowledging the receipt of payment. This
16-digit reference number has to be inputted by contractor in the payment section of its bid as payment
confirmation before the bid is submitted (i.e.) as a pre-requisite for bid submission.
NEFT payment procedure
If a contractor / tenderer chooses to make payment of EMD / tender processing fees using Reserve
Bank of India's (RBI) National Electronic Fund Transfer (NEFT) system, the contractor/ supplier will
need to log into e-Procurement system, access the tender for which bid is being created and then select
the NEFT option under the payment section and print the Challan shown in that section. The printed
challan will have the unique bid reference number, account details of Government of Karnataka and the
amount to be remitted. The contractor has to submit the printed challan to its bank-branch (NEFT-
enabled) and request for an account-to-account transfer, wherein the money will get transferred from
the contractors' bank account to Government of Karnataka bank account. The contractor should ensure
that NEFT transfer instructions are executed and the funds are wired to the Government of Karnataka's
principal account before the last date for bid submission and preferably 24 hours before the last date for
bid submission. If the contractor's bank transfers/wires the money after the last date for bid submission,
the contractor's bid will be liable for rejection. Upon executing the transfer, the contractor's bank will
provide a reference number generated by NEFT software as confirmation of transfer, which has to be
inputted by contractor in the payment section of its bid as payment confirmation before the bid is
submitted •(i.e.) as a pre-requisite for bid submission. Also, the account number from which the funds
were transferred have to be inputted in the e-Procurement system as part of its bid.
The supplier / contractor's bid will be evaluated only on confirmation of receipt of the payment (EMD)
in the Government of Karnataka central pooling a/c held at Axis Bank.
EMD amount will have to be submitted by the supplier / contractor taking into account the following
conditions.
a. EMD will be accepted only in the form of electronic cash (and not through Demand Draft or Bank
Guarantee) and will be maintained in the Govt.'s central pooling account at Axis Bank until the contract
is closed.
b. The entire EMD amount for a particular tender has to be paid in a single transaction. For details on e-
Payment services refer to e-procurement portal for more details.
14.2 Any tender not accompanied by an acceptable Earnest Money Deposit and not secured as indicated
in Sub-Clause 14.1 above shall be rejected by the Employer as nonresponsive.
14.3 a. The earnest money deposit of unsuccessful Tenderers will be returned within 30 days of the end
of the tender validity period specified in Sub-Clause 13.1.
b. Based on the instructions of Tender Accepting Authority (TAA) the EMD amount of the

unsuccessful bidders will be refunded to the respective Bank accounts of the supplier/contractor
registered in the e-Procurement system.
14.4 The Earnest Money Deposit of the successful Tenderer will be discharged when the Tenderer has
signed the Agreement and furnished the required Performance Security.
14.5 The Earnest Money Deposit will be forfeited:
a. if the Tenderer withdraws the Tender after tender opening during the period of tender validity;
b. if the Tenderer does not accept the correction of the Tender Price, pursuant to Clause 25; or
c. in the case of a successful Tenderer, if the Tenderer fails within the specified time limit to
I. Sign the Agreement; or
II. Furnish the required Security deposit
15. Format and signing of Tender15.1 The original and a copy of the Tender shall be signed by a person or persons duly authorized to
sign on behalf of the Tenderer. All pages of the tender where entries or amendments have been made
shall be initialed by the person signing the tender
15.2 The Tender shall contain no alterations or additions, except those to comply with instructions
issued by the tender inviting authority, or as necessary to correct errors made by the Tenderer, in which
case such corrections shall be initialed by the person signing the Tender.
15.3 Tenderer shall submit the Bid electronically before the submission date and time published in
e-Procurement portal.
D. Submission of Tenders
16. Method of submission16.1 Entirely done through e-procurement portal (https://eproc.karnataka.gov.in) only.
17. Deadline for submission of the Tenders17.1 Tenderers shall submit the bid electronically before the published date and time.
18. Late Tenders18.1 Tenderer shall not be able to submit the bid after the bid submission time and date as the icon or
the task in the e-Procurement portal will not be available.
19. Withdrawal of Tenders19.1 In e - Procurement Portal Contractor has the option of withdrawing the Bid by digitally signing to
withdraw/cancel bid before the bid submission time /Date.
E. Tender opening and evaluation
20. Opening of technical bid:20.1 Tender inviting authority will open the technical bids of all the tenders received as per the
schedule.

20.2 The Tender evaluation authority shall prepare minutes of the Tender opening.
20.3 The evaluation authority will evaluate and determine whether each tender (a) meets the eligibility
criteria defined in ITT Clause 2; (b) is accompanied by the required Earnest Money Deposit as per
stipulations in ITT Clause and (c) meets the minimum qualification criteria stipulated in ITT Clause 3.
The evaluation authority will draw out a list of qualified Tenderers.
21. Opening of financial bid:21.1 The evaluation authority will open as scheduled in the calendar of events fixed for the
opening of the financial bid containing the priced Tenders.
21.2 The evaluation authority shall prepare minutes of the financial bid opening.
22. Process to be confidential22.1 Information relating to the examination, clarification, evaluation, and comparison of Tenders and
recommendations for the award of a contract shall not be disclosed to Tenderers or any other persons
not officially concerned with such process until the award to the successful Tenderer has been
announced. Any effort by a Tenderer to influence the Employer's / processing of Tenders or
award decisions may result in the rejection of his Tender.
23. Clarification of Tenders23.1 To assist in the examination, evaluation, and comparison of Tenders, the tender inviting authority
may, at his discretion, ask any Tenderer for clarification of his Tender, including breakdowns of unit
rates. The request for clarification and the response shall be in writing or by cable, but no change in the
price or substance of the Tender shall be sought, offered, or permitted except as required to confirm the
correction of arithmetic errors discovered by the Employer in the evaluation of the Tenders in
accordance with Clause 25.
23.2 Subject to sub-clause 23.1, no Tenderer shall contact the Employer on any matter relating to its
Tender from the time of the Tender opening to the time the contract is awarded. If the Tenderer wishes
to bring additional information to the notice of the Employer, it should do so in writing.
23.3 Any effort by the Tenderer to influence the Employer in the Employer's Tender evaluation, Tender
comparison or contract award decisions may result in the rejection of the Tenderers' Tender.
24. Examination of Tenders and determination of responsiveness24.1 Prior to the detailed evaluation of Tenders, the tender evaluating authority will determine whether
each Tender; (a) has been properly signed; and; (b) is substantially responsive to the requirements of the
Tender documents.
24.2 A substantially responsive Tender is one which conforms to all the terms, conditions, and
specifications of the Tender documents, without material deviation or reservation.
24.3 If a Tender is not substantially responsive, it will be rejected by the tender evaluating authority,
and may not subsequently be made responsive by correction or withdrawal of the nonconforming
deviation or reservation.
25. Correction of errors

25.1 Tenders determined to be substantially responsive will be checked by the tender evaluating
authority for any arithmetic errors. Errors will be corrected by the Employer as follows:
a. Where there is a discrepancy between the rates in figures and in words, the lower of the two will
govern; and
b. Where there is a discrepancy between the unit rate and the line item total resulting from multiplying
the unit rate by the quantity, the unit rate as quoted will govern.
25.2 The amount stated in the Tender will be adjusted by the tender accepting authority in accordance
with the above procedure for the correction of errors and, with the concurrence of the Tenderer, shall be
considered as binding upon the Tenderer. If the Tenderer does not accept the corrected amount the
Tender will be rejected, and the earnest money deposit may be forfeited in accordance with Sub- Clause
14.5(b).
26. Evaluation and comparison of Tenders26.1 The tender evaluation authority will evaluate and compare only the Tenders determined to be
substantially responsive in accordance with Clause 24.
26.2 The tender accepting authority reserves the right to accept or reject any variation, deviation, or
alternative offer. Variations, deviations, and alternative offers and other factors which are in excess of
the requirements of the Tender documents or otherwise result in unsolicited benefits for the Employer
shall not be taken into account in Tender evaluation.
26.3 The estimated effect of the price adjustment conditions under Clause 41 of the Conditions of
Contract, during the implementation of the Contract, will not be taken into account in tender Evaluation
26.4 If the tender of the successful tenderer is seriously imbalanced in relation to the Employer's
estimate of the cost of the work to be performed under the contract, the Employer may require the
Tenderer to produce detailed price analyses for any or all items of the Bill of Quantities, to demonstrate
the internal consistency of those prices with the construction methods and schedule proposed. After
evaluation of the price analyses, the tender accepting authority may require that the amount of the
performance security set forth in Clause 29 be increased at the expense of the successful Tenderer to a
level sufficient to protect the Employer against financial loss in the event of default of the successful
under the contract.
F. Award of Contract
27. Award criteria
27.1 Subject to Clause 28, the tender accepting authority will award the Contract to the Tenderer
whose Tender has been determined to be substantially responsive to the Tender documents. and
who has offered the lowest evaluated Tender Price, provided that such Tenderer has been
determined to be (a) eligible in accordance with the provisions of Clause 2, and (b) qualified in

accordance with the provisions of Clause 3.
28. Tender accepting authority (Director of Horticulture) have right to accept or reject any or all Tenders.
28.1 Notwithstanding Clause 27, the tender accepting authority reserves the right to accept or reject
any Tender, and to cancel the Tender process and reject all Tenders, at any time prior to the
award of Contract, without thereby incurring any liability to the affected Tenderer or Tenderers
or any obligation to inform the affected Tenderer or Tenderers of the grounds for the Employer's
action.
29. Notification of award and signing of Agreement29.1 The Tenderer whose Tender has been accepted will be notified of the award by the tender
accepting authority prior to expiration of the Tender validity period by cable, telex, e-mail or
facsimile confirmed by registered letter. This letter (hereinafter and in the Conditions of
Contract called the "Letter of Acceptance") will state the sum that the Employer will pay the
Contractor in consideration of the execution, completion, and maintenance of the works by the
Contractor as prescribed by the Contract (hereinafter and in the Contract called the "Contract
Price").
29.2 The notification of award will constitute the formation of the Contract, subject only to the
furnishing of Security deposit in accordance with the provisions of Clause 30.
29.3 The Agreement will incorporate all agreements between the Employer and the successful
Tenderer. It will be kept ready for signature of the successful Tenderer in the office of tender
inviting authority within 10 days following the notification of award along with the Letter of
Acceptance. Within 10 days of receipt, the successful Tenderer will sign the Agreement and
deliver it to the tender inviting authority.
29.4 Upon the furnishing by the successful Tenderer of the Performance Security, the tender inviting
authority will promptly notify the other Tenderers that their Tenders have been unsuccessful.
30. Security deposit30.1 Within 10 days of receipt of the Letter of Acceptance, the successful Tenderer shall deliver to
the Employer a Security deposit in any of the forms given below for Rs. 50.00 lakhs plus
additional security for unbalanced tenders in accordance with clause 26.5 of ITT and Clause 44
of the conditions of contract for all works.

30.2 If the security deposit is provided by the successful Tenderer in the form of a Bank Guarantee,

30.3 Failure of the successful Tenderer to comply with the requirements of Sub-Clause 30.1 shall
constitute sufficient grounds for cancellation of the award and forfeiture of the Earnest Money
Deposit.
31. Advance Payment and Security:31.1 Within 21 days of the receipt of notification of award from the Purchaser, the successful
tenderer shall furnish the performance security in accordance with the conditions of contract, in
the performance security form provided in the tender document or in another form acceptable by
the purchaser.
32. Corrupt or Fraudulent practices32.1 The Department of Horticulture requires that the Tenderers/Suppliers/Contractors, observe the
highest standard of ethics during the procurement and execution of such contracts. In pursuance
of this policy, The Department of Horticulture
(a) will reject a proposal for award if it determines that the Tenderer recommended for award has
engaged in corrupt or fraudulent practices in competing for the contract in question;
(b) will declare a firm ineligible, either indefinitely or for a stated period of time, to be awarded a
The Department of Horticulture contract if it at any time determines that the firm has engaged
in corrupt or fraudulent practices in competing for, or in executing, a Department of
Horticulture contract.
32.2 Furthermore, Tenderers shall be aware of the provision stated in sub-clause 51.2 of the Conditions
of Contract.
33. Death of Contractor In the case of the death of a contractor after executing the agreement / commencement of the
work, his legal heir, if an eligible registered contractor and willing, can execute and complete the
work at the accepted tender rates irrespective of the cost of the work.

the terms and conditions of the agreement. If Project Officer, COE, Hassan notice that the
work is not progressing as per the schedule and there are violations of the terms and
conditions of the agreement, he has every right to give stop memo and terminate the
contract without prior notice. This is not prejudice to his any right as per the agreement.
5. Shut down and / or preventive maintenance during that period shall be the responsibility of
the tenderer.
6. Advance payments, if any as requested by the successful tenderer can be considered subject
to approval of the Mission Director on the recommendations of the Tender Evaluation
committee.
7. Final bill shall be settled after successful completion of the work as per the tender contract
with approval of the tender accepting authority on the recommendations of the Executive
Director, Karnataka State Horticulture Mission Agency (KSHMA).
8. Valid security deposit of 5% shall be retained by KSHMA till the end of three years after
completion of the work including holding/training and technical support and management.
9. All direct and indirect taxes arising in connection with the execution of work shall be borne

Conditions of ContractA. General
1. Definitions
1.1 Terms which are defined in the Contract Data are not also defined in the Conditions of Contract but
keep their defined meanings. Bold letters are used to identify defined terms.
Bill of Quantities means the priced and completed Bill of Quantities forming part of the Tender.
Compensation events are those defined in Clause 38 hereunder.
The Completion Date is the date of completion of the Works as certified by the Employer in
accordance with Sub Clause 46.1.
The Contract is the contract between the Employer and the Contractor to execute, complete and
maintain the Works. It consists of the documents listed in Clause 2.2 below.
The Contract Data defines the documents and other information which comprise the Contract.
The Contractor is a person or corporate body who’s Tender to carry out the Works has been accepted
by the Employer.
The Contractors Tender is the completed Tender document submitted by the Contractor to the
Employer.
The Contract price is the price stated in the Letter of Acceptance and thereafter as adjusted in
accordance with the provisions of the Contract.
Days are calendar days; months are calendar months.
A Defect is any part of the Works not completed in accordance with the Contract.
The Defects liability period is the period named in the Contract Data and calculated from the
Completion Date.
The Employer is the party who will employ the Contractor to carryout the Works.
Equipment is the Contractor's machinery and vehicles brought temporarily to the Site to construct the
Works.
The Initial Contract price is the Contract Price listed in the Employer's Letter of Acceptance.
The Intended Completion Date is the date on which it is intended that the Contractor shall complete
the Works. The Intended Completion Date is specified in the Contract Data. The Intended Completion
Date may be revised only by the Employer by issuing an extension of time.
Materials are all supplies, including consumables, used by the contractor for incorporation in the
Works.
Plant is any integral part of the Works which is to have a mechanical, electrical, electronic or chemical
or biological function.
The Site is the area defined as such in the Contract Data.
Specification means the Specification of the Works included in the Contract and any modification or
addition made or approved by the Employer.
The Start Date is given in the Contract Data. It is the date when the Contractor shall commence
execution of the works. It does not necessarily coincide with any of the Site Possession Dates.
A Variation is an instruction given by the Employer which varies the Works.
The Works are what the Contract requires the Contractor to construct, install, and turn over to the
Employer, as defined in the Contract Data.
2. Interpretation
2.1 In interpreting these Conditions of Contract, singular also means plural, Male also means female or
neuter, and the other way around. Headings have no significance. Words have their normal meaning
under the language of the Contract unless specifically defined. The Employer will provide instructions
clarifying queries about the Conditions of Contract.
2.2 The documents forming the Contract shall be interpreted in the following order of priority:
1. Agreement
2. Letter of Acceptance, notice to proceed with the works
3. Contractor's Tender
4. Contract Data
5. Conditions of Contract
6. Specifications
7. Drawings
8. Bill of quantities and
9. Any other document listed in the Contract Data as forming part of the Contract.
3. Law governing contract
3.1 The law governing the Contract is the Laws of India supplanted by the Karnataka Local Acts.
4. Employer's decisions
4.1 Except where otherwise specifically stated, the Employer will decide contractual matters between
the Employer and the Contractor.
5. Delegation
5.1 The Employer may delegate any of his duties and responsibilities to other people after notifying the
Contractor and may cancel any delegation after notifying the Contractor.
6. Communications
6.1 Communications between parties which are referred to in the conditions are effective only when in
writing .A notice shall be effective only when it is delivered (in terms of Indian Contract Act).
7. Subcontracting - Deleted
8. Other Contractors - deleted
9. Personnel
9.1 The Contractor shall employ the technical personnel (of number and qualifications) as may be
stipulated by Department of Horticulture from time to time during the execution of the work. The
technical staff so employed shall be available at site as may be stipulated by the Employer.
9.2 If the Employer asks the Contractor to remove a person who is a member of the Contractor's staff or
his work force stating the reasons; the Contractor shall ensure that the person leaves the Site within
seven days and has no further connection with the work in the Contract.
10. Employer's and Contractor's risks
10.1 The Employer carries the risks which this Contract states are Employer's risks, and the Contractor
carries the risks which this Contract states are Contractor's risks.
11. Employer's risks
11.1 The Employer is responsible for the excepted risks which are:
a. Rebellion, riot commotion or disorder unless solely restricted to employees of the Contractor
arising from the conduct of the Works; or
b. A cause due solely to the design of the Works, other than the Contractor's design; or
c. Any operation of the forces of nature (in so far as it occurs on the Site) which an experienced
contractor:
i. Could not have reasonably foreseen; or
ii. Could reasonably have foreseen, but against which he could not reasonably have taken at least
one of the following measures;
A. prevent loss or damage to physical property from occurring by taking appropriate measures or
B. Insure against such loss or damage
12. Contractor's risks
12.1 All risks of loss of or damage to physical property and of personal injury and death which arise
during and in consequence of the performance of the Contract other than the excepted risks are the
responsibility of the Contractor.
13. Insurance:
13.1 The Contractor shall prior to commencing the works, effect and thereafter maintain insurances, in
the joint names of the Employer and the Contractor, (cover from the first working day after the Start
Date to the end of Defects Liability Period), in the amounts stated in the Contract Data:
A. For loss of or damage to the Works, Plants and Materials and the Contractor's equipment;
B. For liability of both Parties for loss, damage, death and injury to third parties or their property arising
out of the Contractor's performance of the Contract including the Contractor's liability for damage to the
Employer's property other than the Works and
C. For liability of both Parties and of any Employer's representative for death and injury to the
Contractor's personnel except to the extent that liability arises from the negligence of the Employer, any
Employer's representative or their Employees.
13.2 Policies and certificates for insurance shall be delivered by the Contractor to the Employer for his
approval before the Start Date. All such insurance shall provide for compensation to be payable to
rectify the loss or damage incurred. All payments received from insurers relating to loss or damage
shall be held jointly by the Parties and used for the repair of the loss or damage or as compensation for
loss or damage that is not to be repaired.
13.3 If the Contractor fails to effect or keep in force any of the insurances referred to in the previous
sub-clauses or fails to provide satisfactory evidence, policies or receipts, the Employer may without
prejudice to any other right or remedy, effect insurance for the cover relevant to such default and pay
the premiums due and recover the same as a deduction from any other monies due to the Contractor. If
no payments is due, the payment of the premiums shall be a debt due.
13.4 Alterations to the terms of insurance shall not be made without the approval of the Employer.
13.5 Both Parties shall comply with any conditions of the insurance policies.
14. Site Investigation Reports
14.1 The Contractor, in preparing the tender, shall rely on any site investigation reports referred to in
the Contract data, supplemented by any information available to the Tenderer.
15. Queries about the Contract Data
15.1 The Employer will clarify queries on the Contract Data.
16. Contractor to construct the Works
16.1 The Contractor shall construct the Works in accordance with the Specification and Drawings.
17. The Works to be completed by the Intended Completion Date
17.1 The Contractor may commence execution of the Works on the Start Date and shall carry out the
Works in accordance with the program submitted by the Contractor, as updated with the approval of the
Employer, and complete them by the Intended Completion Date.
18. Approval by the Employer
18.1 The Contractor shall submit Specification and drawings showing the proposed Temporary Works
to the Employer, who is to approve them if they comply with the Specifications and Drawings.
18.2 The Contractor shall be responsible for the design of Temporary Works
18.3 The Employers approval shall not alter the Contractor's responsibility for design of the Temporary
Works.
18.4 The Contractor shall obtain approval of third parties to the design of third parties to the design of
the temporary Works where required.
18.5 All Drawings prepared by the Contractor for the execution of the temporary or permanent Works,
are subject to prior approval by the Employer before their use.
19. Safety
19.1 The Contractor shall be responsible for the safety of all activities on the Site.
20. Discoveries
20.1 Anything of historical or other interest or of significant value unexpectedly discovered on the Site
is the property of the Employer. The Contractor is to notify the Employer of such discoveries and carry
out the Employer's instructions for dealing with them.
21. Possession of the Site
21.1 The Employer shall give possession of all parts of the Site to the Contractor. If possession of a part
is not given by the date stated in the Contract Data the Employer is deemed to have delayed the start of
the relevant activities and this will be Compensation Event.
22. Access to the Site
22.1 The Contractor shall allow the Employer and any person authorized by the Employer access to the
Site, to any place where work in connection with the Contract is being carried out or is intended to be
carried out and to any place where materials or plant are being manufactured / fabricated / assembled
for the works.
23. Instructions
23.1 The Contractor shall carry out all instructions of the Employer which comply with the applicable
laws where the Site is located.
24. Disputes
24.1 Arbitration Clause will not be applicable wherever the value of the work is less than Rs. 100 lakh.
24.2 If the Contractor is not satisfied with the decision taken by the Employer, the dispute shall be
referred by either party to Arbitration within 30 days of the notification of the Employer's decision.
24.3 If neither party refers the dispute to Arbitration within the above 30 days, the Employer's decision
will be final and binding.
24.4 The Arbitration shall be conducted in accordance with the arbitration procedure stated in the
Special Conditions of Contract.
B. Time Control
25. Program
25.1 Within 15 days after issue of work order, the Contractor shall submit to the Employer for approval
a Program showing the general methods, arrangements, order, and timing for all the activities in the
Works.
25.2 The Employer's approval of the Program shall not alter the Contractor's obligations. The
Contractor may revise the Program and submit it to the Employer again at any time. A revised Program
is to show the effect of Variations and Compensation Events.
26. Extension of the Intended Completion Date
26.1 The Employer shall extend the Intended Completion Date if a Compensation Event occurs or a
Variation is issued which makes it impossible for Completion to be achieved by the Intended
Completion Date.
26.2 The Employer shall decide whether and by how much to extend the Intended Completion Date
within 21 days of the Contractor asking the Employer for a decision upon the effect of a Compensation
Event or Variation and submitting full supporting information.
27. Delays ordered by the Employer
27.1 The Employer may instruct the Contractor to delay the start or progress of any activity within the
Works.
28. Management meetings
28.1 The Employer may require the Contractor to attend a management meeting. The business of a
management meeting shall be to review the progress achieved and the plans for remaining work.
28.2 The responsibility of the parties for actions to be taken is to be decided by the Employer either at
the management meeting or after the management meeting and stated in writing to be distributed to all
who attended the meeting.
C. Quality Control
29. Identifying defects
29.1 The Employer shall check the Contractors work and notify the Contractor of any Defects that are
found. Such checking shall not affect the Contractors responsibilities. The Employer may instruct the
Contractor to search for a Defect and to uncover and test any work that the Employer considers may
have a Defect
30. Tests
30.1 If the Employer instructs the Contractor to carry out a test not specified in the Specification to
check whether any work has a Defect and the test shows that it does, the Contractor shall pay for the
test and any samples. If there is no Defect the test shall be a Compensation Event.
31. Correction of defects
31.1 The Employer shall give notice to the Contractor of any Defects before the end of the Defects
Liability Period, which begins at Completion and is defined in the Contract Data. The Defects Liability
Period shall be extended for as long as Defects remain to be corrected.
31.2 Every time notice of a Defect is given, the Contractor shall correct the notified Defect within the
length of time specified by the Employer's notice.
32. Uncorrected defects
If the Contractor has not corrected a Defect within the time specified in the Employers notice, the
Employer will assess the cost of having the Defect corrected, and the Contractor will pay this amount.
D. Cost Control
33. Bill of Quantities (BOQ)
33.1 The BOQ shall contain items for the construction, installation, testing, and commissioning work to
be done by the Contractor.
33.2 The BOQ is used to calculate the Contract Price. The Contractor is paid for the quantity of the
work done at the rate in the BOQ for each item
34. Variations
34.1 The Employer shall have power to order the Contractor to do any or all of the following as
considered necessary or advisable during the progress of the work by him
Increase or decrease of any item of work included in the Bill of Quantities (B0Q);
Omit any item of work;
Change the character or quality or kind of any item of work;
Change the levels, lines, positions and dimensions of any part of the work;
Execute additional items of work of any kind necessary for the completion of the works; and
Change in any specified sequence, methods or timing of construction of any part of the work.
34.2 The Contractor shall be bound to carry out the work in accordance with any instructions in this
connection, which may be given to him in writing by the Employer and such alteration shall not vitiate
or invalidate the contract.
34.3 Variations shall not be made by the Contractor without an order in writing by the Employer,
provided that no order in writing shall be required for increase or decrease in the quantity of an item
appearing in the BOQ so long as the work executed conforms to the approved drawings.
34.4 The Contractor shall promptly request in writing to the Employer to confirm verbal orders and the
officer issuing oral instructions shall confirm it in writing within 30 days, failing which the work shall
be carried out as though there is no variation. In case variation is approved it shall be accompanied by
BOQ, failing which the contractor shall be responsible for deviation if any. Further, approval of
Government has to be obtained for the variation exceeding 5%.
35. Payments for Variations
35.1 Payment for increase in the quantities of an item in the BOQ up to 25% of that provided in the Bill
of Quantities shall be made at the rates quoted by the Contractor.
35.2 For quantities in excess of 125% of the tendered quantity of an item as given in the BOQ, the
Contractor shall be paid at the rate entered in or derived from in the Schedule of Rates (applicable for
the area of the work and current at the time of award of contract) plus or minus the overall percentage
of the original tendered rates over the current Schedule of Rates prevalent at the time of award of
contract.
35.3 If there is no rate for the additional, substituted or altered item of the work in the BOQ, efforts
would be made to derive the rates from those given in the BOQ or the Schedule of Rates (applicable for
the area Of the work and current at the time of award of contract) and if found feasible the payment
would be made at the derived rate for the item plus or minus the overall percentage of the original
tendered rates over the current Schedule of Rates prevalent at the time of award of contract
35.4 If the rates for additional, substituted or altered item of work cannot be determined either as at 35.1
or 35.2 or 35.3 above, the Contractor shall be requested to submit his quotation for the items supported
by analysis of the rate or rates claimed, within 7 days.
35.5 If the Contractor's quotation is determined unreasonable, the Employer may order the Variation
and make a change to the Contract Price which shall be based on Employer's own forecast of the effects
of the Variation on the Contractor's costs.
35.6 If the Employer decides that the urgency of varying the work would prevent a quotation being
given and considered without delaying the work, no quotation shall be given and the Variation shall be
treated as a Compensation Event.
35.7 Under no circumstances the Contractor shall suspend the work on the plea of non-settlement of
rates for items falling under this Clause.
36. Submission of bills for payment
36.1 The Contractor shall submit to the Employer monthly bills of the value of the work completed less
the cumulative amount paid previously.
36.2 The Employer shall check the Contractor's bill and determine the value of the work executed
which shall comprise of (i) value of the quantities of the items in the BOQ completed and (ii) valuation
of Variations and Compensation Events.
36.3 The Employer may exclude any item paid in a previous bill or reduce the proportion of any item
previously paid in the light of later information.
37. Payments
37.1 Payments shall be adjusted for deductions for advance payments, other than recoveries in terms of
contract and taxes, at source, as applicable under the law. The Employer shall pay the Contractor within
60 days of submission of bill. The contractor shall be liable to pay liquidated damages for shortfall in
progress. For progress beyond the agreed programme payment is subject to availability of the grants.
37.2 Items of the Works for which no rate or price has been entered in will not be paid for by the
Employer and shall be deemed covered by other rates and prices in the Contract.
38. Compensation events
38.1 The following are Compensation events unless they are caused by the Contractor:
A. The Employer does not give access to a part of the Site by the Site Possession Date stated in the
Contract Data.
B. The Employer orders a delay or does not issue drawings, specifications or instructions required for
execution of works on time.
C. The Employer instructs the Contractor to uncover or to carry out additional tests upon work which is
then found to have no Defects.
D. The Employer gives an instruction for dealing with an unforeseen condition, caused by the
Employer, or additional work required for safety or other reasons.
E. The effect on the Contractor of any of the Employer's Risks.
F. The Employer unreasonably delays issuing a Certificate of Completion.
G. Other Compensation Events listed in the Contract Data or mentioned in the Contract.
38.2 If a Compensation Event would cause additional cost or would prevent the work being completed
before the Intended Completion Date, the Contract Price shall be increased and/or the Intended
Completion Date is extended. The Employer shall decide whether and by how much the Contract Price
shall be increased and whether and by how much the Intended Completion Date shall be extended.
38.3 As soon as information demonstrating the effect of each Compensation event upon the Contractor's
forecast cost has been provided by the Contractor, it is to be assessed by the Employer and the Contract
Price shall be adjusted accordingly. If the Contractor's forecast is deemed unreasonable, the Employer
shall adjust the Contract Price based on Employer's own forecast. The Employer will assume that the
Contractor will react competently and promptly to the event.
38.4 The Contractor shall not be entitled to compensation to the extent that the Employer's interests are
adversely affected by the Contractor not having given early warning or not having cooperated with the
Employer.
39. Tax
39.1 The rates quoted by the Contractor shall be deemed to be inclusive of the sales and other taxes that
the Contractor will have to pay for the performance of this Contract. The Employer will perform such
duties in regard to the deduction of such taxes at source as per applicable law.
40. Price Adjustment:
40.1 Contract price shall be adjusted for increase or decrease in rates and prices of labour, materials,
fuels and lubricants in accordance with the following principles and procedures and as per formulae
given in the Contract Data.
A. The price Adjustment shall apply for the work done from the date of commencement up to the end of
original period of completion or extensions granted by the Employer and shall not apply to work carried
out beyond the stipulated period of completion for reasons attributable to the Contractor;
B. Price Adjustment shall be admissible from the date of opening of tenders (original or extended)
C. The price adjustment shall be determined during each quarter from the formulae given in Contract
Data.
Following expressions and meanings are assigned to the work done during the quarter:
R = Total value of work done during the quarter. It will exclude value for works executed
Under variations for which price adjustment (if any) will be worked out separately based on the terms
mutually agreed.
40.2 To the extent that full compensation for any rise or fall in costs to the contractor is not covered by
the provisions of this or other Clauses in the Contract, the unit rates included in the contract shall be
deemed to include amounts to cover the contingency of such other rise or fall in costs.
41. Liquidated damages
41.1 The Contractor shall pay liquidated damages to the Employer at the rate per day stated in the
Contract Data for each day that the Completion Date is later than the Intended Completion Date (for the
whole of the works or the milestone as stated in the Contract Data). The total amount of liquidated
damages shall not exceed the amount defined in the Contract Data. The Employer may deduct
liquidated damages from payments due to the Contractor. Payment of liquidated damages does not
affect the Contractor's liabilities.
41.2 If the Intended Completion Date is extended after liquidated damages have been paid, the
Employer shall correct any overpayment of liquidated damages by the Contractor by adjusting the next
payment of bill.
42. Advance Payments
42.1 The Employer shall make payment to the Contractor of the amounts stated in the Contract Data by
the date stated in the Contract Data, against provision by the Contractor of an unconditional bank
guarantee in a form acceptable to the Employer issued by a Nationalized/Scheduled Bank in amounts
equal to the advance payment. The guarantee shall remain effective until the advance payment has been
repaid, but the amount of the guarantee shall be progressively reduced by the amounts repaid by the
Contractor. Interest will not be charged on the advance payment.
42.2 The Contractor is to use the advance payment only to pay for Mobilization expenses required
specifically for execution of the Works. The Contractor shall demonstrate that advance payment has
been used in this way by supplying copies of invoices or other documents to the Employer.
42.3 The advance payment shall be repaid by deducting proportionate amounts from payments
otherwise due to the Contractor, following the schedule of completed percentages of the Works on a
payment basis. No account shall be taken of the advance payment or its repayment in assessing
valuation of the work done, variations, price adjustments, compensation events or liquidated damages.
43. Securities
43.1 The Security deposit (including additional security for unbalanced tenders) shall be provided to the
Employer no later than the date specified in the Letter of Acceptance and shall be issued in an - amount
and form and type of instrument acceptable to the Employer. The security deposit shall be valid until a
date 30 days from the date of expiry of Defects Liability Period and the additional security for
unbalanced tenders shall be valid until a date 30 days from the date of issue of the certificate of
completion.
44. Cost of Repairs44.1 Loss or damage to the Works or Materials to be incorporated in the Works between the Start Date
and the end of the Defects Correction periods shall be remedied by the Contractor at the Contractor's
cost if the loss or damage arises from the Contractor's acts or omissions.
E. Finishing the Contract
45. Completion
45.1 The Contractor shall request the Employer to issue a Certificate of Completion of the Works and
the Employer will do so upon deciding that the Work is completed.
46. Taking over
46.1 The Employer shall take over the Site and the Works within seven days of issuing a, certificate of
Completion.
47. Final account
47.1 The Contractor shall supply to the Employer a detailed account of the total amount that the
Contractor considers payable under the Contract before the end of the Defects Liability Period. The
Employer shall issue a, Defect Liability Certificate and certify any final payment that is due to the
Contractor within 90 days of receiving the Contractor's account if it is correct and complete. If it is not,
the Employer shall issue within 90 days a schedule that states the scope of the corrections or additions
that are necessary. If the Final Account is still unsatisfactory, after it has been resubmitted, the
Employer shall decide on the amount payable to the Contractor and make payment within 60 days of
receiving the Contractor's revised account.
48. As built drawings and /or Operating and Maintenance Manuals
If as built" Drawings and/or operating and maintenance manuals are required, the Contractor Shall;
48.1 supply them by the dates stated in the Contract Data.
48.2 If the Contractor does not supply the Drawings within 30 days of completion of the project, or they
do not receive the Employer's approval, the Employer shall withhold the amount stated in the Contract
Data from payments due to the Contractor.
49. Termination
49.1 The Employer may terminate the Contract if the Contractor causes a fundamental breach of the
Contract.
49.2 Fundamental breaches of Contract include, but shall not be limited to the following:
a. The Contractor stops work for 45 days when no stoppage of work is shown on the current
Program and the stoppage has not been authorized by the Employer;
b. The Contractor becomes bankrupt or goes into liquidation other than for a reconstruction or
amalgamation;
c. The Employer gives Notice that failure to correct a particular Defect is a fundamental breach of
Contract and the Contractor fails to correct it within a reasonable period of time determined by
the Employer; the Contractor does not maintain a security which is required;
d. The Contractor has delayed the completion of works by the number of days for which the
maximum amount of liquidated damages can be paid as defined in the Contract data; and
e. If the Contractor, in the judgment of the Employer has engaged in corrupt or fraudulent
practices in competing for or in the executing the Contract.
For the purpose of this paragraph: "corrupt practice" means the offering, giving, receiving or soliciting
of anything of value to influence the action of a public official in the procurement process or in contract
execution. "Fraudulent practice" means a misrepresentation of facts in order to influence a procurement
process or the execution of a contract to the detriment of the Borrower, and includes collusive practice
among Tenderers (prior to or after Tender submission) designed to establish Tender prices at artificial
non-competitive levels and to deprive the Borrower of the benefits of free and open competition."
49.3 When either party to the Contract gives notice of a breach of contract to the Employer for a cause
other than those listed under Sub Clause 49.2 above, the Employer shall decide whether the breach is
fundamental or not.
49.4 Notwithstanding the above, the Employer may terminate the Contract for convenience.
49.5 If the Contract is terminated the Contractor shall stop work immediately, make the Site safe and
secure and leave the Site as soon as reasonably possible.
49.6 Committee for evaluation, monitoring and certification of the construction work finds any
deviations of work as in the contract terms and conditions.
50. Payment upon termination
50.1 If the Contract is terminated because of a fundamental breach of Contract by the Contractor, the
Employer shall prepare bill for the value of the work done less advance payments received up to the
date of the bill, less other recoveries due in terms of the contract, less taxes due to be deducted at source
as per applicable law and less the percentage to 'apply to the work not completed as indicated in the
Contract Data. Additional Liquidated Damages shall not apply. If the total amount due to the Employer
exceeds any payment due to the Contractor the difference shall be a debt payable to the Employer.
50.2 If the Contract is terminated at the Employer's convenience or because of a fundamental breach of
Contract by the Employer, the Employer shall prepare bill for the value of the work done, the
reasonable cost of removal of Equipment, repatriation of the Contractor's personnel employed solely on
the Works, and the Contractor's costs of protecting and securing the Works and less advance payments
received up to the date of the certificate, less other recoveries due in terms of the contract, and less
taxes due to be deducted at source as per applicable law and make payment accordingly.
51. Property
51.1 All materials on the Site, Plant, Equipment, Temporary Works and Works are deemed to be the
property of the Employer, if the Contract is terminated because of a Contractor's default.
52. Release from performance52.1 If the Contract is frustrated by any event entirely outside the control of either the Employer or the
Contractor the Employer shall certify that the Contract has been frustrated. The Contractor shall make
the Site safe and stop work as quickly as possible after receiving this certificate and shall be paid for all
work carried out before receiving it and for any work carried out afterwards to which commitment was
made.
F. Special Conditions of Contract
1. Labour:
The Contractor shall, unless otherwise provided in the Contract, make his own arrangements for the
engagement of all staff and labour, local or other, and for their payment, housing, feeding and transport.
The Contractor shall, if required by the Employer, deliver to the Employer a return in detail, in such
form and at such intervals as the Employer may prescribe, showing the staff and the numbers of the
several classes of labour from time to time employed by the Contractor on the Site and such other
information as the Employer may require.
2. Compliance with labour regulations:
During continuance of the contract, the Contractor shall abide at all times by all existing labour
enactments and rules made there under, regulations, notifications and bye laws of the State or Central
Government or local authority and any other labour law (including rules), regulations, bye laws that
may be passed or notification that may be issued under any labour law in future either by the State or
the Central Government or the local authority. The Contractor shall keep the Employer indemnified in
case any action is taken against the Employer by the competent authority on account of contravention of
any of the provisions of any Act or rules made there under, regulations or notifications including
amendments. If the Employer is caused to pay or reimburse, such amounts as may be necessary to cause
or observe, or for non-observance of the provisions stipulated in the notifications/bye
laws/Acts/Rules/regulations • including amendments, if any, on the part of the Contractor, Employer
shall have the right to deduct any money due to the Contractor including his amount of security deposit.
The Employer shall also have right to recover from the Contractor any sum required or estimated to be
required for making good the loss or damage suffered by the Employer. The employees of the
Contractor in no case shall be treated as the employees of the Employer at any point of time.
3. Protection of Environment:
The contractor shall take all reasonable steps to protect the environment on and off the Site and to avoid
damage or nuisance to persons or to property of the public or others resulting from pollution, noise or
other causes arising as a consequence of his methods of operation. During continuance of the contract,
the contractor shall abide at all times by all existing enactments on environmental protection and rules
made there under, regulations, notifications and bye-laws of the State or Central Government, or local
authorities and any other law, bye-law, regulations that may be passed or notification that may be issued
in this respect in future by the State or Central Government or the local authority.
4. Arbitration (Clause 24)
4.1 The procedure for arbitration shall be as follows:
A. In case of dispute or difference arising between the Employer and the Contractor relating to any
matter arising out of or connected with this agreement it shall be settled in accordance with the
Arbitration and Conciliation Act 1996. The disputes or differences shall be referred to a Sole Arbitrator.
The Sole Arbitrator shall be appointed by agreement between the parties; failing such agreement, by the
Appointing Authority (any one of the Organizations as per list enclosed in Annexure)
B. Arbitration proceedings shall be held at Bangalore, Karnataka, India
C. The cost and expenses of arbitration proceedings will be paid as determined by the Arbitrator.
However the expenses incurred by each party in connection with - the preparation, presentation, etc.,
shall be borne by each party itself.
D. Performance under the contract shall continue during the arbitration proceedings and payments due
the Contractor by the Employer shall not be withheld, unless they are the subject matter of the
arbitration proceedings.
5. Conditional tenders will not be accepted.
6. Materials like Steel, Cement, polythene, aluminum etc., required for the work shall be
procured by the contractors themselves & should be got tested and certified by the quality control
authority, before use on the work and the same shall be produced to the Employer before any
payments
7. Department will not supply any material.
8. 1% of the bill amount would be deducted towards Labour welfare funds.
9. All royalties and taxes will be deducted as notified by the Government from time to time.
10. Committee for evaluation, monitoring and certification shall visit the construction site and
certify the works at regular interval to confirm the work undergoing is as per the
standards/technical specifications only after which the payment shall be made for a particular
bill.

the propagation and other cultivation aspects of greenhouse technology to grow the commercial crops

(one for the vegetables and one for the flowers) The flow control of the UV machine is based on the actual transparency of the water. This transparency will be measured at two different points. (For safety reasons). The maximum flow through the sand filters will be 10m/h to get a filtration of 10 Micron. This machine is necessary to kill all diseases in the drain water and with low maintenance because the lamps should last for 12.00
hours under normal usage.ROOF COOLING SYSTEM
Roof cooling provides an extra possibility to lower the temperature in the greenhouse. Rooftop sprinklers create a thin film of water on the folio, which will be evaporated by the sun. This evaporation-process cools down the folio and causes a "cold layer" in top of the greenhouse. The sprinklers should be fixed on the ridge of the roof by a aluminium ridge clamp, length ± 12 cm. The feeding tubes should be inserted into the greenhouse through the aluminium profile of the vent. All feeding tubes should be connected to a PE supply line 25 mm, which is located along the posts on the ground. This supply lines should be fed by PVC underground sub main lines, which are connected by means of electric valves to the underground PVC main line. Sprinklers need to be provided every 9.60 m row and with spacing of 9.00 mPump unit

Greenhouse panels all with switchgear for ventilation, fans, screens e.g. is centralized in this panels, every component can be controlled by a switch, off/manual/automatic, so it is easy to handle and better for maintenance.Ventilation and screen motors controlled by integrated PCB controllers which should be included with emergency stop and protection switches to prevent high opening/closing frequencies. This also protects the screening and ventilation installations.Horizontal recirculation fans of 400 volt will be necessary to get a good climate distribution one homogeneous temperature and RH throughout the greenhouse. The fans must have a very efficient performance and high throw, including speed controllers with 5 different steps for optimal control.
Vertical fans which create an air flow from the bottom till the top of the greenhouse in order to get a good climate distribution and homogeneous temperature and RH throughout the greenhouse with this fans it offers the growers the opportunity to reduce the negative impacts, due to humidity, in a simple and energy efficient way. The vertical and horizontal airflows result into an active microclimate. The recirculation fans include OSHA-compliant steel guards with white powder-coated finish and pass UL 507, so they can withstand high temperatures.All climate computer components should be integrated in the panels and the rest of the electrical installation. All necessary mounting materials for the electrical installation mentioned above should be provided. All necessary electrical detail drawings in E-plan should be included.Time line scheduled – 30 Days from the completion of Milestone 3.
Milestone 55. Automation:Extent: For cultivation of 5 mandate crops under 10,000 m2 area hitech polyhouse as per the provided technical specifications.The project has to have one integrated system that provides optimal control and reliability. 1 CPC process controller is included in this system. This provides with highly reliable and unique solution with guaranteed accuracy for each part of installation. This is also the best solution for service and maintenance. This complete integrated system has to be controlled through Office Direct. It's possible to navigate through the complete system by using the geographical overviews.For this project for each of the five compartments (incl. nursery), a de-central Connext substation has to be included. As a result, the cabling distance is limited and al sensors can be connected locally. Future sensors can be easily added to these substations. The substations communicate through a fiber optic cable. This is proven technology and is also reliable in case of lightening with the use of fibre optic cable the substations are galvanic separated. In this drawing you can see the location of the Connext substations. The main cabinet with CPC should be installed in the irrigation room, which could be determined on a later stage. From this main cabinet there should be an I/O network installed to the irrigation room where the water units EC and pH measurement1 are connected to the substations

Local mechanics should be able to operate the same at the times of system malfunctioning and replacement (in case of imported items, specify separately). The tenderer has to include in his bidding the necessary spare parts which are immediately needed for replacement when the original break down.

Milestone 88. Project support and management.For the 5 sections for successively roses, peppers, tomatoes, cucumber and gerberas an external independent engineer shall be called, who will:
1. Check and adjust all quotations, contract proposals and descriptions in relation to accuracy, quality, efficiency and completeness.
2. Set up and suggest planning and transport (incoterms).3. Checkjoints of and with other project parts.4. Suggest changes and improvements when possible.5. Training Characteristics and conditions:1. Start of training with trainee level definitions, joint-definition of requested theory and
skills development and refreshment of plant physiological and greenhouse management and cultivation knowledge.
2. Realizing maximum geared tailor-made CoE staff training program to bridge the gap between current available knowledge capacity and needed capacity to enable continuously increasing performance of CoE within the specific socio, economic and climatic conditions of the CoE.
3. CoE Staff tailor-made training program should contain intensive transfer of theory and applied knowledge and skills development of principles on farm management and cultivation strategies for the proposed crops tomato, sweet pepper, cucumber, rose and gerbera or any other if requested.
4. Training should use the framework of competence based learning (CBL) which should realize optimal theory and skills capacity building of CoE Staff to secure sound CoE operations.
5. Training might be realized in so-called Greenhouse Rich-Learning-Environments (GRLE) as for example being provided by Dutch Applied Agro Universities or by the Dutch Horticulture Expertise groups like Green Q, which are training settings similar to professional Dutch greenhouse production situations. The training also can be realized in several professional Dutch greenhouse production farms with the High tech automation provisions etc. as mentioned in the DPR.
6. Important is that trainees are exposed as maximum as possible to all different phases of a crop cultivation cycle for above mentioned crops such as cultivation preparation, sowing, propagation, transplanting, production, post-harvest and crop removal and greenhouse cleaning.
7. Acquaintance and using high-tech (Dutch) greenhouses as GRLE should realize enable realize enable trainees to define new integrated solutions and future Indian innovations on the line of current low-tech Indian greenhouse sector and high-tech Dutch greenhouse sector.
8. Training should fully familiarize trainees with professional production and post-harvest phases of selected crops by field visits to horticultural production and supplier companies in which up scaling/conversion from GRLE to full professional environments is secured.
9. Sound skills training on principle understanding and operational management of all supplied technical installations of CoE.
10. Training should contain elements that trainees understand principles of horticultural supply and value chain development to realize that future CoE innovations are based on market driven factors.
11. Training should contain skills development of applied research, data collection and information dissemination towards CoE extension staff and Indian growers.
12. Training should contain principles of grower study groups, farmer field schools and vertical chain field schools to enable optimal information dissemination.
13. Training should create, besides farm managerial and greenhouse cultivation elements, also entrepreneurial spirit and awareness that running and realizing potential performance of CoE is not a 9 to 5 job, but a 24/7 business management approach.

1.2 SCREENING INSTALLATION
One screen motor 24 VDC supply and IP65 per compartment necessary tb safely and automatically control the screening installation.The climate in Hassan is characterized by:
- Average max temp between 27 and 33 °C
- Absolute max temp in the last 18 years: 37 °C
- Average minimum temperature between 15 and 21 °C
- Absolute minimum temperature in the last 18 years 11 °C
In view of the above screens are only needed to reduce air and crop temperature, there is no need for extra insulation during night time. Based on this we recommend open screen fabrics that allow the air to pass through. Thus will keep air exchange, essential for a good temperature control at the right level.
The amount of shading depends on the type of crop that will be grown. In general we can recommend: 30 to 40% shading for vegetable crops and 50% shading for cut flowers.
In recent years there has been much research into the effect of diffuse light on plant growth. It has become clear that plants grow better under diffuse light conditions. Shade screens are now also available in light diffusing versions.

The unit have to fulfill various functions: Dosing and mixing fertilizers with supply water to form homogeneous irrigation water; correcting the pH
value of the irrigation water; Pumping irrigation water to the crop.
The Nutrifit can be connected to the following irrigation systems: overhead irrigation systems; dripper systems; ebb and flow systems (only with PrivaConnext process computer).
The Nutrifit should fill tanks or silos with day stocks. From these silos the irrigation water will be distributed to the crop sections/units using separate pumps and irrigation valves.Drain collection system with a drain pit with pump and all necessary piping. 1.4 ROOF COOLING SYSTEM
Roof cooling provides an extra possibility to lower the temperature in the greenhouse. Rooftop sprinklers create a thin film of water on the folio, which will be evaporated by the sun. This evaporation-process cools down the folio and causes a "cold layer" in top of the greenhouse. The sprinklers should be fixed on the ridge of the roof by a aluminium ridge clamp, length ± 12 cm. The feeding tubes should be inserted into the greenhouse through the aluminium profile of the vent. All feeding tubes should be connected to a PE supply line 25 mm, which is located along the posts on the ground. This supply lines should be fed by PVC underground sub main lines, which are connected by means of electric valves to the underground PVC main line. Sprinklers need to be provided every 9.60 m row and with spacing of 9.00 m

Ventilation and screen motors controlled by integrated PCB controllers which should be included with emergency stop and protection switches to prevent high opening/closing frequencies. This also protects the screening and ventilation installations.Horizontal recirculation fans of 400 volt will be necessary to get a good climate distribution one homogeneous temperature and RH throughout the greenhouse. The fans must have a very efficient performance and high throw, including speed controllers with 5 different steps for optimal control.Vertical fans which create an air flow from the bottom till the top of the greenhouse in order to get a good climate distribution and homogeneous temperature and RH throughout the greenhouse with this fans it offers the growers the opportunity to reduce the negative impacts, due to humidity, in a simple and energy efficient way. The vertical and horizontal airflows result into an active microclimate. The recirculation fans include OSHA-compliant steel guards with white powder-coated finish and pass UL 507, so they can withstand high temperatures.
All climate computer components should be integrated in the panels and the rest of the electrical installation. All necessary mounting materials for the electrical installation mentioned above should be provided. All necessary electrical detail drawings in E-plan should be included.
1.6 AUTOMATION
1.6.1 System set up of the networkThe project has to have one integrated system that provides optimal control and reliability. 1 CPC process controller is included in this system. This provides with highly reliable and unique solution with guaranteed accuracy for each part of installation. This is also the best solution for service and maintenance. This complete integrated system has to be controlled through Office Direct. It's possible to navigate through the complete system by using the geographical overviews.For this project for each of the five compartments (incl. nursery), a de-central Connext substation has to be included. As a result, the cabling distance is limited and al sensors can be connected locally. Future sensors can be easily added to these substations. The substations communicate through a fiber optic cable. This is proven technology and is also reliable in case of lightening with the use of fibre optic cable the substations are galvanic separated. In this drawing you can see the location of the Connext substations. The main cabinet with CPC should be installed in the irrigation room, which could be determined on a later stage. From this main cabinet there should be an I/O network installed to the irrigation room where the water units EC and pH measurement1 are connected to the substations
Configuration of the sensorsAll the necessary equipment to control the complete climate and irrigation will be described in a drawing. Due to the flexible system set up it is always possible to make changes in the configuration when needed.For each compartment there will be a short description of the controls which will be used.

1.6.2 Climate computer system Setup with industrial network:The computer system consisting of 1 CPC module which should be located in the boiler room or irrigation room. All modules and devices should be reliably interconnected by an industrial Ethernet network. A fiber optics network should be used for this network. This industrial network will be the backbone in the installation which will be used for controlling the equipment through an I/O protocol and for communication concerning the control of the Connext.It is possible to connect to this backbone pc's for running Office.
1.6.3 Managing and optimizing climate controlsA climate for optimum growing conditions

With the climate computer, optimum growing conditions can be created for the crop. The climate controls are equipped by default with a large number of options, based on clever computational models that significantly improve the performance of the control.Some important climate controls of the climate computer include: Complete climate control by measured crop temperature, temperature monitoring,
registration, ventilation control, humidity influence. One can connect controls to various measuring instruments, including to the vents on the basis of
rain quantity and/or wind speed. In addition, for each period, all P bands and light sum adjustments, for example, can be set per day (6 periods) for all the available controls.
Adjustable ventilation control based on temperature, relative humidity or humidity deficit. Fans: can be controlled and adjusted in a modulating manner based on temperature,
temperature difference, humidity, humidity difference, vent, curtain position and/or hot water temperature.
Curtain controls: with the curtain control, a distinction is made between 6 different curtain functions - shading, energy, black out, humidity, slave/side and curtain combination.
In general
The most up to date and optimum controls have to be guaranteed.Every year new software controls for the process computer needs to be developed and optimised. The inspiration for these new controls comes from client and other users. This means that every year the software is enhanced with controls that helps for instance to save energy, improve user friendliness or optimize the quality of the products.
A selection of the controls and possibilities for crop
Air circulation
By creating a movement of air in the greenhouse, excessively large differences in temperature and air humidity can be prevented. This ensures a more uniform crop growth and reduces the risk of condensation. The air circulation control switches on the appropriate fans as soon as climate differences are likely to occur. The fans can be operated in response to all the measurements present in the greenhouse, which also makes it possible to prevent climate differences between the compartments. A report has also been added that gives an insight into the conditions used as the basis for operating the fans. In short, more extensive capabilities and more insight, resulting in a more uniform greenhouse climate and improved crop quality.
Curtain controlsWith the curtain control, a distinction is made between different curtain functions:
Shading curtain, Protecting the crop against too much radiation.The shading curtain program has six periods, in which the start and end time, a radiation limit and/or a temperature limit and a maximum curtain position can be set for each period. The PAR measurement can also be used to control the shading curtain (see below-curtain PAR control). In combination with the irradiation sensor control, the curtain can be closed or opened based on irradiation. The possibility exists for closing the shading curtain in a modulating fashion based on radiation. The shading curtain can also close in response to a multiple day radiation sum. As soon as the plant sees a lot of light on the first day, it will quickly be shaded, after a few days the plant will become used to this and can be shaded later.
Humidity curtain: with which the removal of moisture is limited if it becomes too dry. The humidity curtain program has six periods, in which a humidity limit and a maximum curtain position are set for each

period. Slave curtain, with which a curtain is closed based on the position of another curtain in the compartment.
The slave curtain program has six periods.
Side curtain, with which a side curtain is closed based on radiation and/or outside temperature. The side curtain program has six periods.
In combination with the blackout curtain a step control can also be set for opening and closing. If a curtain control is designed with multiple curtain functions, only one curtain function can be active at any time. The above sequence also indicates the mutual priority; black out therefore has the highest priority.The curtain functions are available in various combinations:With the exception of the slave/side curtain, every combination is equipped with a humidity and temperature gap control. The curtain gap control can also be configured for six periods. The curtain controls function only in combination with one or more curtain motor failures with a maximum of 3 curtain motor failures per curtain control.
1.6.4 Managing and optimizing water managementWise with water
In the field of water management, the climate computer offers plenty of options and start programs. Water management is left entirely to the process computer and keep the water flows separate from each other.

Valves can be controlled individually or by valve group, manually or with a start program.
Various start settings possible for the start program (e.g. humidity measurement, radiation, radiation sum, crop ageing recipe or a combination of more conditions).

Brief description of the irrigation possibilities
1.6.5 Valves Rotation of the valves over the course of the day, so that not every cycle has to be started with the
same valve. Optimum control of pollution of sand filters and filters per valve section:
o Because the capacity can be set for each valve, the computer knows exactly how long the water dosage must last for a specific size of cycle.
o The deviation from the desired time is displayed for each valve.o A negative deviation tells you that the filters are becoming polluted and you can take proactive
measures.o A positive deviation may, for example, be the result of a drip hose coming loose; as a result,
the water dosage is finished earlier, but you might not see a flow alarm. Prioritizing per valve; this enables you to supply water to specific valve sections as a priority, if

required. The decision to supply water simultaneously with multiple valves can be made automatically based
on radiation. To prevent water hammer, the computer can take the end of water dosage into account.
1.6.6 The flushing out of the drip hoses is fully integrated within the climate computer A separate flush valve can be configured for each dripper valve or each group of dripper valves. Choice of flushing out valves before the first cycle or after the last cycle (or even in between the
cycles) is freely adjustable. Choice of a number of valves with which flushing out can take place simultaneously.Water dosage is completely different from what it is like during a normal drip cycle. Flow monitoring even during flushing out.
1.6.7 Start program Can be set according to transpiration pressure or transpiration sum. Cycle size can be set over the day, possibly with a different recipe choice. Combination of starting conditions; this gives one the possibility of dosing water at the end of the
day only if, for example, the radiation sum condition and the radiation condition are met. Radiation-dependent reduction in minimum and maximum rest times. Monitoring and, if desired, triggering of an alarm if only a start is made at maximum rest time. Radiation-dependent adjustment of drop size and time.
1.6.8 RecipesThe following settings can be made for each nutrient recipe: The desired values for EC, pH, EC supply, UV dosage. The alarm limits for EC, pH, EC supply. The nutrient recipe values for EC, pH and EC supply and the quantities per dosing channel on which
the nutrient recipe values are based. The desired mixing ratio of the water stocks. Alarm limits can be set relative to setpoint. Absolute alarm limits can be set. Radiation-dependent adjustment of EC and EC supply. Modulating reduction or increase in EC supply setpoint, based on the level measurement in the
disinfected/drain tank. Choice of fertilizer stocks can be set for each nutrient recipe.
1.6.9 Mixing control The climate computer offers one the possibility of selecting the optimum water composition for
each nutrient recipe by means of mixing steps. This composition is supply water, which will be used by your water system.
1.6.10 Dosing selection On sunny days it is very important that the continuity of your water dosage should be guaranteed. A
"malfunction" in the water dosage is something one prefer not to happen on these days. Especially if circumstances mean one is not immediately available on site to rectify the problem. For these days, one can make a setting in the nutrient recipe which, in the event of a malfunction in EC and/or pH, will stop the dosing and switch off the dosage valves/pumps, trigger an alarm, but continue with fresh water during the cycle.o Obviously, this is not an ideal situation, but it does prevent crop damage.o The alarm is automatically cancelled when a new start takes place.

o If the same alarm occurs again, it is perhaps more than a one-off malfunction; a new alarm will be triggered and the water system will be switched off.
o This gives one greater security under these circumstances.
1.6.11 Office
The visual overviews, as shown for example in the picture, can also be used to navigate in the climate computerTo ensure the optimum performance of the applications (programs), it is recommend to install the software on a dedicated server. The dedicated server is a server on which only climate control programs may be installed.The dedicated base server is a server with monitor, keyboard/mouse combination and preinstalled Windows software. This system is suitable for the use of a single application. It is not possible to install third-party applications on it. This solution has been selected, because too many errors are caused by third party software impacting on the operation of the applications. This has an adverse effect on quality, and results in unnecessary costs.

Clear use of colors makes it immediately clear which module one is in. Particular to Office Direct is the ease, for example, with which one can set the greenhouse temperature. With one mouse movement, one can drag the points within a graph to the desired temperature curve, and the settings are automatically adjusted for all the desired ventilation and heating controls.
1.6.13 Report Generator ModuleOne can easily present historical data in a well-organized manner with the Report Generator module. This module replaces many manual registrations.The reports generated by the Report Generator module are immediately suitable to be used in study groups for comparison purposes. The data also provides information about the operating processes in the

climate, energy and water areas.1.6.14 Settings Manager
Saving and restoring climate settings is possible with the Settings Manager module in Office Direct.One can save settings on the Office server and restore them when required back into the climate computer.With this feature one can save settings if one do not want to loose and use them on another moment. It is now also possible to view saved settings before restoring them and also copy them to other compartments.In addition, the differences between the current and previously saved settings can easily be viewed. This enables experiences from the past to be put to even better use, errors to be prevented and time to be saved.

General: for comparisons with the most important aspects of outside conditions, climate, energy and water for the selected compartment.

1.6.16 Report types
The Report Generator module can generate the following types of reports: Weekly report, with the days of the week per column and a weekly total column; Period report, with the four weeks of the period per column and a period total column; Quarterly report, with the three months of the quarter per column and a Quarterly total
column. Annual report, with the four quarters of the year per column and an annual total column.
One can choose which week, period, quarter and year one want to retrieve. The data presented in the reports can be retrieved from the date on which the Report Generator was installed.

Local mechanics should be able to operate the same at the times of system malfunctioning and replacement (in case of imported items, specify separately). The tenderer has to include in his bidding the necessary spare parts which are immediately needed for replacement when the original break down.
2.6GROUND COVER
Groundcover of white colour 100g/m2 gauge, should be used so that the ground can be profiled locally to make sure it can be able to collect all the drain water. Details for the profiling shall be provided.
2.7 PROJECT SUPPORT AND MANAGEMENTFor the 5 sections for successively roses, peppers, tomatoes, cucumber and gerberas we will call in an external independent engineer, shall be called who will:
Check and adjust all quotations, contract proposals and descriptions in relation to accuracy, quality, efficiency and completeness.

1.0 TRAINING AT THE CENTRE OF EXCELLENCEObjective of the training of the “operational” CoE staff is have a staff which independently can realiz an optimal functioning of the CoE as well in terms of facility management, crop culture management as in human resource management, thus maximize the use of the potential capacity of the high tech Dutch greenhosuses in terms of crop yield and quality. Simultaneously reduce wastage of input materials such as water, and fertilizers, maintain a hygienic crop cultivation conditions in order to minimize the use of plant protection materials thus producing healthier products and guarantying a safe labor environment of the personnel. Create a database which will serve as a learning platform for continuous improvement.

3.1 Framework CoE Capacity Building ProgrammeTraining objective phase One: The training should secure that actual management, technical and greenhouse cultivation performance is increasingly meeting the full potential performance of the CoE greenhouses.Proposed trainees: CoE staff trainess will consist well-qualified persons who have Indian Agro University level degree with at least basic experience in horticultural production. This level is required to enable high – knowledge transfer via a knowledge intensive training program. The focus of this training is 2 persons more general 2 persons technical orientated like construction and equipments and for each crop 2 persons means 8 to 10.Furthermore, to enable sound capacity building in a relative short time frame, to understand the underlying theory and applied principles of farm managerial, plant physiological and greenhouse climate control, an adequate educational level of trainees is required.
Training Characteristics and conditions:1. Start of training with trainee level definitions, joint-definition of requested theory and skills
development and refreshment of plant physiological and greenhouse management and cultivation knowledge.
2. Realizing maximum geared tailor-made CoE staff training program to bridge the gap between current available knowledge capacity and needed capacity to enable continuously increasing performance of CoE within the specific socio, economic and climatic conditions of the CoE.
3. CoE Staff tailor-made training program should contain intensive transfer of theory and applied knowledge and skills development of principles on farm management and cultivation strategies for the proposed crops tomato, sweet pepper, cucumber, rose and gerbera or any other if requested.
4. Training should use the framework of competence based learning (CBL) which should realize optimal theory and skills capacity building of CoE Staff to secure sound CoE operations.
5. Training might be realized in so-called Greenhouse Rich-Learning-Environments (GRLE) as for example being provided by Dutch Applied Agro Universities or by the Dutch Horticulture Expertise groups like Green Q, which are training settings similar to professional Dutch greenhouse production situations. The training also can be realized in several professional Dutch greenhouse production farms with the High tech automation provisions etc. as mentioned in the DPR.
6. Important is that trainees are exposed as maximum as possible to all different phases of a crop cultivation cycle for above mentioned crops such as cultivation preparation, sowing, propagation, transplanting, production, post-harvest and crop removal and greenhouse cleaning.
7. Acquaintance and using high-tech (Dutch) greenhouses as GRLE should realize enable realize enable trainees to define new integrated solutions and future Indian innovations on the line of current low-tech Indian greenhouse sector and high-tech Dutch greenhouse sector.
8. Training should fully familiarize trainees with professional production and post-harvest phases of selected crops by field visits to horticultural production and supplier companies in which up scaling/conversion from GRLE to full professional environments is secured.
9. Sound skills training on principle understanding and operational management of all supplied technical installations of CoE.
10. Training should contain elements that trainees understand principles of horticultural supply and value chain development to realize that future CoE innovations are based on market driven factors.
11. Training should contain skills development of applied research, data collection and information dissemination towards CoE extension staff and Indian growers.
12. Training should contain principles of grower study groups, farmer field schools and vertical chain field schools to enable optimal information dissemination.
13. Training should create, besides farm managerial and greenhouse cultivation elements, also entrepreneurial spirit and awareness that running and realizing potential performance of CoE is not a 9 to 5 job, but a 24/7 business management approach.
14. Greenhouse constructions: basic information about trends & developments in global horticulture, construction site criteria, greenhouse and installation types, greenhouse mechanization options, greenhouse maintenance, irrigation and fertigation systems.
Training location and planning: Training start-up/needs assessment in India. Multi-week tailor-made training, preferable in the Netherlands, before CoE is operational Follow up CoE on-site training/additional training/support needs assessment on moment of CoE start

Data registration in Dutch horticulture climate computerThe data of all calculated values and all the measured values are automatically stored with a 5-minute interval. All data will be saved for two years. The climate computer can present all the stored data in clear graphs. This means that you can compare your actual data with last year's data. This feature is available for graphs of climate control, irrigation control and energy management. Every graph can contain up to 10 lines, with 10 different colors.All data from the 5 minute graphs can be exported in a .txt file on the climate computer. This makes it possible to store the data from 2 years in a file. This file can be uploaded in Microsoft Excel or other spreadsheet programs. You can make macros to calculate new values. It is also possible to compare data from previous years.
Remote controlThe climate computer is provided with software for remote control. This allows you to operate your climate computer remotely via any PC. It is also possible to use your smart phone or tablet as a remote control device. It is very easy to change your settings and you can see all the reports and graphs from anywhere in the world. This means that you always have insight into the current situation in your greenhouse at any time. It allows you to share data with your crop consultant at any given moment.
Online training (webinar)A webinar is an online seminar or interactive training that we offer to all our customers. The webinar has been specially developed for customers who require customized training about specific subjects within their own cultivation process from their own work place. A webinar is custom-made, so you can indicate which subjects you which to focus on during the training. During this online training, the computer expert can answer all your questions about production-related subjects such as plant physiology, software settings, cultivation methods and more. Furthermore, if your climate computer is connected to the Internet and with your permission only, your own climate computer can be used as a medium for the webinar by taking over the computer screen. By doing so the user experiences a hands on training. To participate in a webinar, you need a good internet connection, a headset and if possible a webcam.

General: Nursery greenhouse6 meter under gutter (big air buffer which will help to control the climate more equal inside the greenhouse.) 9.60 meter bays (less posts which will result in more growing surface and better light distribution.)
A complete porch consisting in a reinforced arch directly connected to the posts by a forged head postshould be used. This architecture is extremely powerful: the mechanical stress of the bays is directly supported by all post/telescopic leg. The temperature differences imply no substantial modification of the geometry of structures or any particular maintenance: No dilatation from front to front or side to side. The cultures are suspended with outstanding stability, and a very good report of charges, every three meters.The connection of the anchorage should be done by telescopic feet tube 70 x 70 mm, 2.5 mm thick which is recessed from the posts on the feet.
Reinforcement of the structure at base of the posts by the double pole/fool thick steel: 4.5mm. Simplicity and quality of implementation.

Top Ventilation
Side ventilation for optimal ventilation in combination with the top vents. Screening installationOne screen motor 24 VDC supply and IP65 (per compartment) necessary to safely and automatically control the screening installation.The climate in Hassan is characterized by:
- Average max temp between 27°C and 33 °C- Absolute max temp in the last 18 years: 37°C- Average minimum temperature between 15°C and 21°C- Absolute minimum temperature in the last 18 years 11°C
In view of the above screens are only needed to reduce air and crop temperature, there is no need for extra insulation during night time. Based on this we request open screen fabrics that allow the air to pass through. Thus will keep air exchange, essential for a good temperature control, at the right levelThe amount of shading depends on the type of crop that will be grown. In general 30 to 40% shading for vegetable crops and 50% shading for cut flowers is recommended. The screen types for this project:

Note: The complete irrigation system for the production greenhouse and the nursery must be calculated in accordance with the ISSO 87 guidelines to make sure it functions properly.The rainwater should be collected from the roof of the greenhouse and brought till the corner of each greenhouse.Roof cooling systemRoof cooling which provides an extra possibility to lower the temperature in the greenhouse should be provided with Rooftop sprinklers; Rooftop sprinklers which create a thin film of water on the folio, which will be evaporated by the sun light. This evaporation-process cools down the roof and causes a "cold layer" in top of the greenhouse.The sprinklers should be fixed on the ridge of the roof by an aluminium ridge clamp.The feeding tube should be inserted into the greenhouse through the aluminium profile of the vent.All feeding tubes should be connected to a PE supply line 25 mm, which is located along the posts on the ground. This supply lines should be fed by PVC underground sub main lines, which are connected by means of electric valves to the underground PVC main line. Sprinklers should be provided every 9.60 m a row and with spacing of 9.00 m.
