448, R. S. Dag No.455 appertaining C. S. Khatian No. 133,
R. S. Khatian No. 189 to the Collector of 24 patganas under
Collectorate's, Touzi No. 2998, Re. Sa No. 212, J.1,. No. 12,
within Police Station formerly Kasba at present Tilja_la nol\.
wilhin municipal Iimit of the Kolkata Municipal Corporation
(Jadarpur Unit) under Ward No. 1O8 in the Distdct of 24
Parganas. {hereinafter referred to as t}re said lalded
Property).
B. The said Satish Chandra paramanik died intestate leaving
behind him surviving his widow namely Ekadashi Dasi and
two daughters namely llechubala Dasi (par.amanik) and
Monmohini Dasi (I,ra_manik) as his only lcgal hcirs and
successors arrd in accordance with the Hindu Succession
Act, 1956, the said EkadasHi Dasi, Bechubala Dasi and
Monmohini Dasi jointly succeeded and inherited the said

thereirx. The said Dee<l was duly registered at the officc of
the Additional District Sub Registrar at Alipore in Rook
No. I, tseing No. 1391 for t-I:e year 1980.
ln the said land Sudhir Malik, Bishtu Haldar and Nirmal
Halder is also making cultivation in about one tiird area.
The said Sudhir Malik, Bishtu Haldar and Nirmal Halder
by a registered Deed of Sa-lc duly sold their respective right
of cultivation on t]:e said portion of land to the said
Shyamal Kumar Das. The said Deed was duly regrstered at
the offrce of the Additional District Sub Registrar at
Alipore in Book No. l, being No. 5760 for the year 1980.
One Purna Chandra l)arik alias Das was also making
cultivation in a portion of the said lald. By a rcgistcrcd
Deed of Sa.le the said Purna Chandra Darik atias Das duly

granted, sold, conveyed, transferred, assigned and
assured or expressed or ifiEnded so to be or any
portion thereof is not affected by any attachmcnt
including the attachnent under any certificate
case or any proceedings started at thi instance of
the Income Tax Authorities or otlter Government
Authorities under the Public Demands RecoverY
Act or any otlaer Acts or otherwise whatsoever ard

part of the Vendor to grant, sell' convey' transfer'

premises neither had or has sold nor had entered
into any Agreement for Sale and/or Memoraldum
of Undertaking, nor executed aIIy Memorandum of
Deposit of Title Dceds, nor deposited the title deeds

defect is found in the title of tie Vendor herein. in

portion thereof and the Vendor herein shall remain/:'

Relying on the aforesaid assurances, representation,
undertakings and warralties of the Vendor herein and
believing the same to be tlue and correct and acting on
the faith thereof, tJle purchasers, herein has agreed to
purchase ald acqute the said premise s, as morefully
described in the First Schedule hereunder wdtten and
on the terms arld conditions as mentioned herein.
a. It is expressly clarified, understood and confirmed that it
is only on the basis of the aforesaid assurances,
repres€ntations, und€,rtakings, warranties and
indemnities of tl.e Vendor that tlle Purchasers herein

would not have otherwise agrced to furchase the said
premises nor would has agreed to pay t}re amount as
