The following standards have been adopted for the determination of ESY services with the exception of:

1. The Nature or Severity of the disability.2. A serious potential for regression of skills

beyond a reasonable period of recoupment.

3. Student presents with a severe disability. 4. Consideration of the Critical Stages or

Areas of Learning.

Specifically, a student may be determined eligible for ESY service(s) due to:

1. a serious potential for regression of skills beyond a reasonable period of recoupment; or

2. the nature or severity of the disability; or3. critical stages or areas of learning.

If there is no goal area(s) of concern, service(s)is/are not needed for a FAPE.

Regression & Recoupment - Definition

• Regression: inability of a student to maintain acquired skill in an identified goal area of concern.

• Recoupment: capacity to recover those skills that have regressed to a level demonstrated prior to the break in instruction.

• Determination for ESY services starts with data to substantiate concern for serious regression of skills beyond a reasonable period of recoupment.

• This regression / recoupment concern must be aligned to existing IEP goal(s).

Students who can recoup those skills with re-teaching in a reasonable amount of time,

are not eligible for ESY service(s).

A student with a disability who requires a highly structured environment or consistent programming without substantial breaks in service(s) in order to make progress in the identified goal area(s) of concern.

Determination for ESY services starts with data to substantiate the need to provide service(s) in the identified goal area(s) of concern during breaks in the school year.

• Critical stage in learning: learning must occur without delay and that learning the skill(s) in the identified goal area(s) of concern will enhance the student’s ability to function independently.

• Critical area of learning: an area of instruction that is essential to the student’s development in achieving self-sufficiency and independence.

Determination for ESY services starts with data to indicate that failure to provide service(s) in the identified goal area(s) of concern beyond the normal school year will severely limit the student’s capacity to acquire essential skills.

• ESY service(s) are only for those annual goals identified as areas of concern.

• New annual goals are not developed for ESY service(s).

• Consideration of ESY services occurs at an IEP Team meeting.

• ESY services are to be offered with sufficient time to make plans for delivery and to provide an opportunity for IEP team members to resolve disputes (gather additional information, convene a new IEP, pursue mediation, file a state complaint, file a due process hearing complaint) prior to the break in service(s).
