Setting Goals and Requirements

The Right Role of Government

• Establish effective law that will meet needs of residents and their communities and protect the environment.

• Review stewardship plans, monitor programs, enforce the law.

• Ensure a level playing field by holding all responsible parties to the law.

• Otherwise, stay out of way and let private sector establish effective efficient services while meeting their obligations.

• WARNING: if government gets into role of setting or approving fees, much higher level of government oversight, auditing and fiscal review is needed – and this can be problematic.

Call2Recycle, Inc. Overview

• Founded in 1994 by industry to address the emergence of EPR legislation.

• In the U.S., funded primarily by rechargeable battery stewards and, more recently, fee-based services.

• In the U.S., we’re primarily a voluntary program except in certain states (e.g., Vermont, Minnesota, New York) where collections of some (but not always all) chemistries is mandated.

• In Canada, Call2Recycle® is primarily a mandatory program financed via Environmental Handling Fees (EHFs) applied at point of sale. (NOTE: Call2Recycle Canada was spun off from Call2Recycle, Inc., in January 2017.)

Industry’s Perspective• EPR Momentum has SLOWED – Interest has slowed dramatically of the over the last few

years. States are re-examining their existing laws, and industry, in some cases, is pushing back.

• Shared Responsibility – The intent of these laws is a shared responsibility across the life-cycle of the product. Many manufacturers feel they are 1) shouldering the ENTIRE burden of the law, and 2) simply subsidizing municipal recycling programs.

• No Law > Bad Law – Even if industry is in concept of favor, they still may oppose a proposed law because the resulting program could adversely impact them.

• Uniqueness of a Product – Certain products are unique in how they enter the marketplace which can make it difficult to create good policy. e.g. Batteries are sold separate and as a component of a product – who is obligated?

• Desired Components of EPR – Pillars of EPR for a manufacturer - level playing field, enforcement, flexibility, ability to work together and requirements in a stewardship plan.

What Can Industry Offer Through EPR?

• Product & Market Expertise – No one knows their products or industry better than the manufacturers. They can provide detailed, first hand knowledge of the “landscape”, including, existing recycling opportunities, industry guidance and obligated manufacturers.

• Best Practices – Industry has been dealing with EPR throughout the world for years, they can easily “tap” into what is happening and what has worked in other corners of the globe.

• Cost Relief – Whether they agree with it or not, these laws switch the cost for proper recycling of the product from the traditional tax-base funded system to one funded by the industry or obligated parties.

• Stewardship Organization – For the most part, industry wants to focus on what they do best – making and selling their product. They do not want to be involved in the day to day operations of product recovery.

The Role of a Stewardship Organization (SO) • NOT Always Industry – Some formed and operated by industry, while others are formed by

industry, but independently operated. This could result in actions differing from industry policy.

• Plan Development & Approval – Create a stewardship plan which covers all requirements of the law. “Usher” this plan through public review, final approval by the State and implementation.

• Administer Program – Establish budget and fee schedules (developed with & approved by obligated manufacturers), create & operate a network to collect covered products and implement a public outreach campaign.

• Reporting – Provide annual analysis and reporting on collection program on behalf of obligated manufacturers to the state authority.

• Relationship “Triangle” – Balance the interests of key stakeholders – industry, collection sites and the State - while ensuring compliance with the law.

• Staffing “Enforcement” – Act as the State’s “eyes and ears” in the marketplace to ensure all obligated parties are compliant with the regulation.

How Can Government Enable EPR? • Catalyst – Industry, local and state officials will not typically come together on their own,

government can bring ALL stakeholders together to begin the dialogue.

• Framework – Look beyond a single product, and adopt a strategy to move forward. Propose a common set of structured rules for product stewardship to be successful.

• “Borrow” from Others – Don’t re-invent the wheel! Contact state, local & industry officials where these laws exist to see what has and hasn’t worked for them. What would they do differently?

• Mechanisms for Funding – Do not dictate how these programs are funding. Allow industry to develop and fund a program that works for ALL – a “one-size fits all” solution may limit results.

• E-Commerce – The way we “shop” has shifted dramatically in the last decade – laws MUST include e-commerce companies as obligated producers and mechanism to enforce.

• Enforcement – The state must be able and willing to enforce these laws – if NOT, don’t bother. Consider a “private right of action” which supplements the state’s enforcement efforts.
