RULES & REGULATIONS

The following entities will be referred to in this Rules and Regulations: the National Association of County Engineers (NACE), the Duke Energy Convention Center Cincinnati, and the vendor signing contract for exhibit space.

1. Contract for Exhibit and Equipment Space: Contractsforexhibitandequipmentspacemustbemadeonformsprovidedforthispurpose(paperoronlineregistration).ThisformisinthisbrochureorontheNACEwebsiteatwww.countyengineers.org.

2. Assignment of Exhibit and Equipment Space: Spacewillbeassignedonthefollowingbasis:ForApplicationsreceivedwithdeposit,exhibitorswillhavepriorityaccordingtothedatereceivedwithNACECorporateMembersreceivingfirstpriorityintheavailabilityandselectionofboothspace.Forthoseexhibitapplicationsreceivedwithoutadeposit,boothspacewillbeheldatthediscretionofNACEandarenotsecureuntilthedepositorfullpaymentisreceived.Forboothselectionswhenallchoicesarealreadytaken,NACEwillmakeanefforttocontactyoutomakeanotherselection;otherwise,itwillbemadeatthediscretionofNACE.Dependinguponthetotalspacessoldandtheirlocations,NACEreservestherighttochangespaceassignmentsasneededtoconsolidateandimprovetheoverallexhibitflow,includingchangingboothstoequipmentspacesorvice-versa.NACEwilltrytokeepthepositioningofyourspaceassignment;how-ever,spaceassignmentsarenotguaranteed.Youwillbenotifiedinadvanceoftheshowifyourexhibitspaceischangedforanyreason.

3. Exhibit Rental Fees: RefertoExhibitSpacefeesonpage4ofthisbrochureorcontactNACE.

4. Rental Fees Include:For10’x10’booth:8’backwalls,3’sidewalls,6’table,2chairsand2exhibitrepresentativeregistrations.For10’x20’island:26’tables,4chairsand4exhibitrepresentativeregistrations.Theboothfloorsarenotcarpeted.For20'x50'equipmentspace:thespaceallottedand2complimentaryexhibitrep-resentativeregistrationsplusthefullstandard10'x10'boothpackage(spaceavailablebasis).Thespacefloorisnotcarpeted.

5. Expo Services & Shipping:TheofficialNACE2017exposervicesproviderisFern.Fernwillprovideanexhibitorkitforshipping,specialitemsorservices.Elec-tricitywillbeorderedwiththeDukeEnergyConventionCenter.Yourfreightmustbereceivedbythedeadlinessetintheexhibitorkit.

6. Set-up / Removal: NACEreservestherighttosetthetimeforthesetupofbooth/equipmentspacepriortotheshowandremovalaftertheconclusion.Anyexhibitspaceundercontractthatisnotsetupbythesedead-linesmaybeconfiscatedbyNACEandresoldtoanyotherparty,withoutcompensationtotheexhibitor.

7. Exhibit Times: NACEwillpublishthefinalexhibitshowtimesatleast2monthspriortotheopeningdateoftheexhibitshow.Atspecifiedtimesduringexhibithours,NACEwillservefoodandbeveragesintheexhibitareasfordelegates,exhibitors,andregisteredguests.Duringhoursthattheexhibitsareclosedovernight,securitywillbeprovided.

8. Removal of Exhibits:Exhibitsmustnotbedisturbed,dismantledorremovedbeforesethourasestablishedbyNACE.Allboothsmustbefullyremovedby10p.m.onMonday,April10,2017.Forexhibitsnotremovedbythattime,managementwillremoveexhibitsandchargeexpensestotheexhibitor.Equipmentspaceswillbenotifiedoftheirremovaldeadline.

9. Exhibitor Registration / Additional Representatives:Eachexhibitorisentitledto2complimentaryexhibitregistrationsforeach10'x10'boothspacecontracted,or4complimentaryregistrations(includes2fortheboothpackage)foreach10'x20'islandor20'x50'equipmentspacecontracted.Additionalexhibitorpersonnelmayregisterfortheshowfor$125each.TheexhibitshowregistrationentitlesthebearertoattendallconferencefunctionsheldonSundayandMonday.NoonewillbeallowedontheexhibitflooratanytimewithoutaproperNACEbadge.Extraexhibitregistrationmaybepur-chasedonsiteattheNACERegistrationDesk.

10. Entertainment of Delegates: Thehostingbyexhibitorsofprivatefunctions,cocktailparties,specialevents,etc.whentheexhibitshowisopen,ortheperiodofofficialNACEeducationalorsocialfunctions,isprohibited.Obscene,distastefulorlewdbehaviororattireisstrictlyprohibitedintheexhibitareas.Exhibitpersonnelmustwearappropriateattire(businessorbusinesscasual).Bathingsuits,robes,orotherrevealingclothingareconsideredinappropriateattire.Inappropriatelydressedexhibitpersonnelwillbeaskedtoleave.Norefundswillbemadetoexhibitorswhomustleaveforreasonsofinappropriateattireorbehavior.

11. Fire Regulations:Allmaterialsusedforboothdeco-rationmustbeofnonflammablenature.Electricsignsandequipmentmustbewiredtomeetspecificationsoflocalfireauthorities.Firehoses/extinguishersonwallsoronthefloororelsewheremustnotberemovedorobstructedinanymanner.

12. Insurance and Liability: Exhibitorassumestheentireresponsibilityandliabilityforlosses,damagesandclaimsarisingoutofinjurytopersonsordamagetoexhibitor’sdisplays,equipmentorotherpropertybroughtuponthepremisesoftheCenter,andagreestoindemnify,defendandholdharmlessNACE,theDukeEnergyConventionCenteranditsmembers,officers,representatives,owners,servants,agentsandemployeesagainstallclaimsorexpenseforsuchlosses,includingreasonableattorneyfeesarisingoutoftheuseoftheCenterpremisesexcludinganyliabilitycausedbythenegligenceofNACEortheCenter.TheExhibitorunder-standsthatneitherNACEnortheCentermaintainsinsur-ancecoveringtheExhibitor’spropertyorlostrevenue,anditisthesoleresponsibilityoftheExhibitortoobtainsuchinsurance.

13. Space Limitations: Exhibitorpersonnelandequipmentmustremainwithintheconfinesoftheirexhibitspace(widthandheight)andarenotpermit-tedtooccupyaislespaceorfirelanes.Fireregulationsrequirethataislesandfirelanesmustremainclear.Exhibitorswhoviolatethisregulationaresubjecttoimmediateclosingoftheirexhibitspace,asviolationscouldresultintheclosureoftheentireshowbythe

firemarshal.Alsoexhibitdisplaymustnotblocktheviewofotherexhibitbooths.Exhibitset-upissubjecttoNACEapproval.

14. Selling of Products for Show Delivery is Strictly Prohibited:NACEprovidesdisplayspacetomanufactur-ers,consultantsandvendorstoexhibitanddemonstrateproductsonthebasisoftheirpotentialinformationandeducationalvalueandnotforthepurposeofdirectsalesontheexhibitfloor.

15. Payment and Provision in Case of Default: Ifanyexhibitorfailstopay,whendue,anysumrequiredbytheApplication/ContractforExhibitSpace,orfailstoobserveorabidebytheseRulesandRegulations,NACEreservestherighttoterminatethiscontractimmediatelywithoutrefundofanymoniespreviouslypaid.A50%depositisrequiredatthetimethecontractissignedandspaceisreserved.Finalpaymentisdueby5:00pmESTonFebruary24,2017.

16. Cancellation/Refund: ArequestforcancellationofanexhibitspacecontractmustbemadeinwritingtoNACE(faxoremailacceptable).Alldepositsincludeanonrefundableprocessingfeeof$150.Cancellation/RefundrequestsreceivedpriortoDecember31,2016,maybegrantedatthediscretionofNACE.RequestsreceivedafterDecember31,2016,willnotbeconsid-ereduntilallexhibitspacehasbeensold,includingthecancelledspace.Anyrefundsowedwillbemadeaftertheconference.SpacenotfullypaidforbyFebruary24,2017,issubjecttocancellationorreassignmentattheoptionofNACE,withoutobligationforrefundofexhibi-tor’sdeposit.Norefundshallbemadeforno-shows.

17. Amendments:NACEreservestherighttointerpret,amendandenforcetheseRulesandRegulations.Writ-tennoticeofanyamendmentsorinterpretationswillbeprovidedtoeachexhibitor.
