Report of the Chief Officer for Highways, Infrastructure Development and Waste

Recommendation: It is recommended that:

(a) work on the annual waiting restrictions programme process for 2018/2019 is noted; and

(b) the recommendations contained in Section 4 of this report and detailed in Appendices I and II to this report are agreed.

1. Background

Proposals for the Exeter HATOC Annual Waiting Restriction Review for 2018 were presented to this Committee on 30 July 2018.

2. Proposal

Agreed proposals have since been advertised with significant objections having been received to 15 of the proposals.

Details of these proposals and the objections received are shown in Appendix I to this report.

3. Consultations

Following advertisement:

Proposals which did not attract objections will be implemented without the need to report back to Committee.

Proposals attracting significant objections are detailed in Appendices I & II to this report.

4. Specific Proposals and Recommendations

RECOMMENDATION - that the recommendations individually listed in Appendix I are agreed.

5. Financial Considerations

The total costs of the scheme are contained within a countywide budget of £100,000 which has been allocated from the On--Street Parking Account.

There will be a cost to the Council in advertising a new Traffic Order for each Committee Area, this will be approximately £1,500. In addition, the costs of any changes to signing or lining will be attributed to that Order.

Please note that the following recommendations are subject to consideration and determination by the Committee before taking effect.

6. Environmental Impact Considerations

The proposals are intended to rationalise on-street parking and improve mobility and access within the district and are designed to:

Encourage turnover of on-street parking to benefit residents and businesses. Enable enforcement to be undertaken efficiently. Encourage longer term visitors to use off street car parks. Encourage commuters to make more sustainable travel choices eg Car Share, Public

Transport, Walking and Cycling. Assist pedestrians and other vulnerable road users in crossing the highway.

The Environmental effects of the scheme are therefore positive.

7. Equality Considerations

There are not considered to be any equality issues associated with the proposals. The impact will therefore be neutral.

8. Legal Considerations

The lawful implications and consequences of the proposal have been considered and taken into account in the preparation of this report.

When making a Traffic Regulation Order it is the County Council’s responsibility to ensure that all relevant legislation is complied with. This includes Section 122 of the Road Traffic Regulation Act 1984 that states that it is the duty of a local authority, so far as practicable, secures the expeditious, convenient and safe movement of traffic and provision of parking facilities. It is considered that the proposals comply with Section 122 of the Act as they practically secure the safe and expeditious movement of traffic in the Exeter area.

9. Risk Management Considerations

There are thought to be no major safety issues arising from the proposals.

10. Public Health Impact

There is not considered to be any public health impact.

11. Reasons for Recommendations

The proposals rationalise existing parking arrangements within the Exeter area by:

Encouraging turnover of on-street parking to benefit residents and businesses. Enabling enforcement to be undertaken efficiently. Encouraging longer term visitors to use off street car parks. Encouraging those working in the town make more sustainable travel choices eg Car

Share, Public Transport, Walking and Cycling.

The proposals contribute to the safe and expeditious movement of traffic in the Exeter area and therefore comply with S122 of the Road Traffic Regulation Act 1984.

They do not believe the proposals will reduce “inappropriate and obstructive parking” because the gate is never used and it would remove three parking spaces in an area already under pressure from on-street parking.

Reason for proposalIntroduce No Waiting At Any Time across the Barton Road side of the emergency access gate to prevent inappropriate and obstructive parking.

Officer commentsThe gate is unlikely to have been used due to current parking habits however the restrictions are proposed to remove parking and allow the gate to be used in cases of emergency.

Reason for proposalIntroduce No Waiting At Any Time at the junction with Peterborough Road to prevent inappropriate and obstructive parking.

Officer commentsThe proposal is for restrictions to protect the junction where parking should not take place as per the highway code.

It is considered that extending the restrictions further is unlikely to impact the parking of school parents on pavements along this length of road and emergency service vehicles will still be able to access properties.

Plan ENV5667-015(A) Southbrook & Tollards Road, Exeter9 respondents – Residents of Bishops Westall Road, Southbrook Road, Tollards Road & Wendover WayObjections1 respondent does not want any restrictions at all.

Respondents object to the proposals for No Waiting At Any Time around the inside of the bend of Tollards Road and along Southbrook Road. They do not think the restrictions will solve the parking plight on the corner of Tollards Road.

1 respondent feels the proposals are fair for Southbrook Road but additional No Waiting At Any Time on the opposite side, as well as leaving a length for parking, will reduce issues around the bend and keep speeds down.

SuggestionsRespondents suggest that No Waiting At Any Time should be introduced on both sides of the corners to keep vehicles in their respective lanes. Also the restrictions should be extended further up Tollards and Southbrook Road.

Reason for proposalIntroduce No Waiting At Any Time around the corners to prevent inappropriate and obstructive parking.

Officer commentsThe proposed restrictions prevent parking on the inside of the bend to improve visibility of traffic driving around the corner in the 20mph zone.

It is proposed that the restrictions are implemented as proposed and the situation is monitored. Further restrictions can be considered, if necessary, as part of a future review.

Suggestion1 respondent would like to see No Waiting At Any Time or parking restrictions on the entire length of Albatross Road & Hook Drive to prevent IKEA/Matchday parking.

1 respondent suggests the restrictions should extend further into the side roads to better protect the junction.

Reason for proposalIntroducing No Waiting At Any Time along Newcourt Way & Riverplate Road and junctions to prevent inappropriate and obstructive parking.

Officer commentsThe proposal is for restrictions to protect the junctions where parking should not take place as per the highway code.

Residents are to be consulted about a residents parking scheme which may further tackle IKEA and matchday parking.

It is considered that the restrictions are appropriate for the route but will be monitored and can be reconsidered as part of a future review if problems arise.

Plan ENV5667-020(A) Digby Drive, Exeter4 respondents – Residents of Digby Drive, Etonhurst Close & North Grange, ExeterObjections2 respondents object to the proposals for No Waiting At Any Time along the current unrestricted, bar match days, length of Digby Drive. They feel removing on-street parking will drastically increase speeds along this road and there is too much pressure already in the off-street, private parking areas due to multiple vehicles per property. Two respondents feel the removal of on-street parking will shift vehicles into Etonhurst Close and increase parking pressures there.

1 respondent supports the proposals for No Waiting At Any Time but adds that they would be concerned if the speeds increased along here. Suggests a dedicated pedestrian crossing would help pedestrians.

1 respondent fully supports the proposals for No Waiting At Any Time and believes this should ease congestion at peak times.

Reason for proposalExtend No Waiting At Any Time to remove parking between Russell Way and Royal Crescent to prevent inappropriate and obstructive parking that causes traffic to queue.

Officer commentsTraffic calming along this section of road will ensure speeds remain low.

A controlled pedestrian crossing would not be installed on Digby Drive as there is insufficient demand for pedestrians to cross (outside of school times) to justify the expense. An uncontrolled crossing point has been provided across the top of the road hump.

Due to the road being used as a bus route and access to the park & ride / railway station, it is considered appropriate to remove obstructive parking that adds to congestion in the area.

Reason for proposalIntroduce No Waiting At Any Time opposite the junction with the north-western spur to ensure access is maintained for larger vehicles.

Plan ENV5667-025(A) Lyndhurst Road, Exeter1 respondent – Resident of Lyndhurst Road, ExeterObjectionsRespondent objects to the proposals for a new Pay & Display with resident permit holders exemption bay outside Marlborough Court. Resident wants the road to be resurfaced before any new proposals are implemented. They would want the new bay to be just for residents too, not for visitors.

SuggestionsResident would like to see the road resurfaced and the waiting restrictions of the bay to be changed to residents only.

Reason for proposalIntroduce a new pay & display parking bay outside Marlborough Court to provide additional on-street parking for local residents.

Officer commentsThe proposal is for restrictions to increase the quota of on-street parking for residents and visitors alike as the majority of residents have off-street parking.

The request for resurfacing will be passed to the appropriate department.

Plan ENV5667-035(A) Bonville Close, Exeter11 respondents – Residents of Bonville Close, Exeter (including a petition signed by 30 signatures [See Appendix III])Comments1 respondent seeks clarification on the consultation process as they are unhappy with the process and the website was not working.

ObjectionsAll respondents no not support the proposals because they feel they will only shift parking to other areas of the road. They want additional parking bays created along the road for properties that do not have driveways and/or multiple vehicles. They do not want parking restrictions introduced without providing an alternative means of parking in the road. They do not want to have to park out of the road and feel these restrictions would impact property prices as well as create neighbourly unrest.

SuggestionsRespondents would like to see additional parking spaces created, such as echelon bays similar to those on the opposite side of the road outside numbers 1-9 and making use of the verges.

Reason for proposalIntroduce No Waiting At Any Time around the circular traffic island to prevent inappropriate and obstructive parking

Officer commentsThe consultation ran from 13 September until 4 October and was advertised in the local press and on the streets affected in line with the councils process. The website was operational throughout the consultation period evidenced by the submissions received throughout this period.

Any further off-street areas would need to be considered by Exeter City Council who own the land as it is not public highway.

The proposal was to protect the traffic island and prevent obstructive parking on and adjacent to it. However due to the level of opposition, and as the resident requesting restrictions has signed the petition against this proposal, it is recommended that this request is not progressed.

RecommendationThat the proposals are not progressed.

The absence of any restrictions on the bend outside numbers 21-25 is seen as “an accident waiting to happen” and vehicles parking here are causing larger vehicles issue when passing and damaging the respondent’s hedge.

Officer commentsThe proposal is for restrictions to protect certain lengths of this road from obstructive parking.

The respondents hedge is overhanging the public highway which is likely to be the reason that vehicles are driving into it.

Plan ENV5667-042(B) Summerway, Exeter1 respondent – Resident of Summer Lane, ExeterObjectionRespondent objects to the proposals because they feel the implementation of no waiting at any time along the length of their garden is excessive. It would take up valuable parking spaces in an already busy road and would prevent their second vehicle and friends/family from parking close by. They feel the buses are the main traffic contributor issue and thinks a one-way system for them would work better than reducing on-street parking further.

Reason for proposalIntroduce No Waiting At Any Time at its junction with Summer Lane to prevent inappropriate and obstructive parking.

Officer commentsThe proposal is for restrictions to prevent obstructive parking to allow buses to pass freely around the junction.

The introduction of a one-way system on this road would be inappropriate for the residential street due to the number of properties affecting and the increase in vehicle speeds that would occur.

One respondent states this is because vehicles only park on one side of the road. The second respondent says implementing these restrictions will push more vehicles further up the road, amplifying existing parking pressures due to on-street parking disrupting passage in and out of residents’ driveways.
