Resolution ЕВ19.Й74 1 adopted by the Executive Board in this connexion is as follows: "The Executive Board, Further considering that the fixing of the coiiunencarnent and of the end of the period of tiiree yaars for wiiicii Members are elected to designate persons to serve on the Board is a matter which relates to “rticle 25 of the Uonstitutionj and Considering that the interpretation of this Article is a function to be exercised by the Health Assembly, 1 2. 1._ The Executive Board, at its nineteenth session, considered suggsstions to

amend Rules 92 and 99 of the Eules of Procedure of the World Health Assembly-

relating to the period for which ilembers are elected to designate persons to

serve on tho Executive Board.

3. The Tenth World Health Assembly examined among other proposals for the

revision of the iCules of Procedure of the iîealth Assembly^ draft amendinsnts to

Rules 92 and 99 concerning the coimiiGncera&nt of the period of office of persons

designated to serve on the Executive Board. In view of certain constitutional aspects

arising out of the amendments proposed, the Health Assembly, in resolution WHA10.44

(operative section 11)1 ad

ed the following:

"Considering the Rules of Procedure of the Assembly relating to the

period for which Members are elected to nominate a person to serve on the

Executive Board; and

Considering that the procedural provisions applicable should be

reconciled with a strict interpretation of the relevant provisions of the

Constitution;

1. DECIDES to maintain provisionally the existing texts of Rules 92 and 99;

2. INVITES the Executive Board, in consultation with the Director-General

to review the text of Rule 92 so as to introduce a fixed date on which

the period for which Members are elected to designate persons to serve on

the Board would commence and end^ selecting the date best meeting the

requirements of the work of the Organization; and

3. FURTHER INVITES the Executive Board to report to the Eleventh World

Health .Assembly."

4, In order to give effect to this proposal, it is necessary to seek a method which

would permit the establishment of a date on which both the appointment by election

of the Members entitled to designate persons to serve on the Board would take effect

and at the same time the persons designated to serve would take office.

5. The Board in its study of the question will wish to refer to the discussions at

the Tenth World Health Assembly in the Legal Sub-Committee of the Committee on 2 3

Administration,Finance and Legal Matters, and to the report of this Sub-Committee.
