The Free Flow of Non-personal Data Regulation
Aims to:
• Increase intra-EU data mobility
• Increase trust in data processing services
• Increase legal certainty regarding data processing
• Counter vendor lock-in
The Free Flow of Non-personal Data Regulation
• Principles-based, not detailed (Better Regulation):
• The free flow of non-personal data principle
• The principle of data availability for regulatory control purposes
• Actions to make sure cloud service providers and users develop self-regulatory codes of conduct for easier switching of provider and/or porting data back to in-house servers
• Actions to increase cloud computing security.
• Governance by single points of contact per Member State, forming an expert group.
Self-regulatory approach to facilitate the switching of cloud service providers (Article 6):
• Codes of conduct on switching & porting data between different cloud service providers and in-house systems;
• Work already started: "SWIPO" working group
• Deadline for implementation: 2 years from now
• Commission review of codes of conduct: 4 years from now
• Open & inclusive process: new participants are welcome!
• Initially 2 codes: Infrastructure (IaaS) / Software (SaaS)

Proposal for a EU Cybersecurity Act, including the reform of ENISA and towards a European Cyber Security Certifications Framework
Cloud security is a prerequisite for enabling the Free Flow of Data in the EU and promoting Cloud uptake
WG on Cloud Security Certification is exploring the possibility of developing a candidate European Cloud Security Certification Scheme European Cloud Security Certification Scheme will promote scale- up of EU CSPs
• 6 billion devices will be connected to the internet by 2020 in the EU and threats are increasing!

• For Cloud data centres: Code of Conduct for Energy Efficiency in Data Centres (https://ec.europa.eu/jrc/en/energy-efficiency/code-conduct/datacentres )
• Edge and Fog computing should be taken into consideration as part of the wider distributed cloud continuum cater for developments such as: • IoT, 5G, AI, autonomous cars and smart cities, connected things, micro-
datacenters …
• Energy consumption of edge and fog is estimated at 40-80% of data centre energy consumption already – and rising.
