ASSISTANT DISTRICT ATTORNEY JOB DESCRIPTION

Position: Full-Time Assistant District Attorney

Department: Luzerne County District Attorney’s Office

Employment Status: Regular, Full-Time, Union, Non-Exempt

Salary: $43,000 (non-negotiable)

Summary:An Assistant District Attorney (ADA) is responsible for rep-resenting the Commonwealth’s position and interest when individuals are charged with committing a criminal act. In-volvement in the cases assigned to the ADA begins with the initial stages of the investigation and continues through all stages of the investigation and prosecution, up to and includ-ing the sentencing and any post-sentence motions.

Minimum Qualifications:Minimum requirements include being in good standing and admitted to practice before the Bar of the Commonwealth of Pennsylvania. The applicant must also be willing to un-dergo PA and FBI Criminal History Background Checks and PA Child Abuse History Clearance.

Essential Functions:

1. The Assistant District Attorney may be responsible for specific types of crime prosecution such as domestic disputes, child abuse, narcotics, sexual assaults, major crimes, elder abuse and DUI.

2. The Assistant District Attorney must formulate trial strat- egy, determine sentence to be sought, conduct plea negotiations and research applicable case law.

3. The Assistant District Attorney is responsible for ascer- taining the facts of the case, work closely with law enforce- ment, secure expert testimony and prepare witnesses for trial.

4. The Assistant District Attorney will act as a resource for law enforcement, other Assistant District Attorneys, Detectives and lawyers, and attend community outreach programs when asked by the District Attorney.

5. The Assistant District Attorney must advise police on matters of filing complaints when asked, attend write-ups and/or preliminary hearings, and secure additional infor- mation from law enforcement personnel when required.

6. The Assistant District Attorney must communicate infor- mation on case status to all involved parties such as de- fense attorneys, law enforcement and victims.

7. The Assistant District Attorney must be proficient at legal research, provide necessary training in his/her desig- nated specialty, and be able to communicate effectively and work closely with all support staff and detectives within the office.

No application will be accepted in instances where the ap-plicant has any pending criminal charges filed against him/her, other than minor traffic violations, in this or any other jurisdiction. No applicant shall have any pending disciplinary complaints or proceedings brought against him/her by the Disciplinary Board of the Supreme Court of Pennsylvania or the Disciplinary Board of any other jurisdiction. Meeting of President Judge Vough, District Attorney’s Office and

Criminal Defense BarCourtroom 1—July 10, 2020

President Judge Vough called the informal meeting to discuss the proposed procedures for criminal trials in light of the pandemic. Beginning on September 14, 2020, President Judge Vough will call 3 lists of criminal cases. The list of cases with the defendants currently in prison will be addressed first. There will be 2 judges available to immediately process any pleas. The defendants who are not currently in prison will then be called. President Judge Vough will call approxi-mately 10 calls every half hour for approximately 13 hours on September 14th and 15th.

Prospective jurors will be in groups of 50—26 socially distanced in the jury lounge and 24 socially distanced in the Rotunda. Voir dire will be in panels of 25 jurors. Once a juror is dismissed, he or she will be sent home. Jurors will not be kept for the week. Jurors will be seated 4 in the jury box and 8 socially distanced in the gallery (side closest to the jury box) with the 2 alternates in chairs directly behind the jurors in the gallery. This will leave 8 spectator seats in the gallery on the opposite side.

As a witness testifies in the witness box, he or she will be on camera with a 65” screen for the jurors in the gallery and the alternates to view. The screen will also be available to the attorneys to display exhibits. Jury deliberation will take place in the courtroom with only the jurors permitted to be present, and with each of them in their assigned socially distanced seats. If both parties agree, the judges will allow a trial to proceed with only 6 jurors. The judges will not currently seek to limit the number of challenges from either party.

The witness will not wear a mask, but, in accordance with Governor Wolf ’s current Executive Order, everyone else in the courtroom, including the attorneys will wear a mask at

all times. Masks with clear front panels are being investi-gated by the President Judge. An attorney for the prosecutor and for the defendant will have a mobile microphone which he or she can turn off and on. The large tables in the court-rooms will be removed and there will be matching smaller tables for each side.

Larger cases such as homicides, cases with multiple victims, or cases having a large media presence expected will be con-ducted from jury selection to conclusion of the trial at the JCC Center in Kingston in its large banquet room. An at-torney can present a motion for consideration for a case to be tried at the JCC location if the Court has not scheduled the matter at that location, and it will be in the judge’s sole discretion as to any relocation.

Prospective jurors will be sent a special questionnaire re-garding the effect of the pandemic on his or her ability to serve. Voir dire of the prospective jurors can include questions concerning the pandemic. If a juror tests positive during the trial, it will be the trial judge’s discretion how to proceed.

Prisoners will only be transported to the courthouse for suppression hearings, jury selection and trial. All pleas will be by video. For defendants in the prison, attorneys can meet in person with his or her client if he or she signs a waiver and brings PPE for his or her own person and for the defendant. Attorney/client meetings are currently, and will be permitted to continue, taking place by phone with the defendant in the phone booth at the prison.

Any case resolutions prior to September 14th can be pro-cessed immediately. This was strongly recommended by the Bench. Probation is by appointment, and it is the responsibil-ity of the defendant to call the Probation Office. Two weeks in December of 2020 are being added for the criminal list. Rule 600 continues to be suspended until September 14, 2020.

▪ Partnered with Pizza Bella and have been collecting donations to send pizza to essential workers in the area

▪ So far, have donated $955.00 and have sent lunch to employees at:
