    O R D I N A N C E

    WHEREAS,individualswithmental illnesswho do not receive appropriate treatment and support can

    become entangled inthecriminaljusticesystem, and even beinvolved in

    violent

    incidents,resulting in

    the need fo rpolice intervention,and

    WHEREAS,an analysis done byWBEZradio revealed thatsome of the policedistrictswhichreceive the

    most mental health911 calls are also the

    districts

    withthe fewest mental health services, and

    WHEREAS,the Chicago Departmento f

    Public

    Health

    (CDPH)operates

    sixcommunitymental health

    clinics,the

    majority

    o fwhichare locatedinunderservedareasthat have ahighrate ofmentalhealth 911

    calls,

    and

    WHEREAS,

    CDPH

    has indicated thatthese

    clinics

    have the capacity toservemore

    clients,

    but are

    underutilizeddue in largemeasureto managementissuesincludinginadequatestaffing, inabilityto bill

    fo rMedicaidreimbursement, and

    insufficient

    community outreach, and

    WHEREAS,

    due to inadequate numbers o fpsychiatrists,in the

    past

    two

    years

    the numbero fpsychiatrist

    hourso fcareinCDPHmental healthclinicshas dropped by more thanhalf,compromisingcareand

    halting

    the intakeo fnew clientsinsomeclinics,and

    WHEREAS,when theIllinoisDepartment of

    Human

    Services signaled plans toshift

    Medicaid

    recipients

    tomanagedcareplans,CDPHfailedto take actionto jo inany managedcarenetwork,resulting in a

    disruption o fcarefor

    some

    Medicaidrecipients who have been turned away

    f r o m

    theclinicsand along

    termloss of sorely-needed revenue, and

    WHEREAS,

    CDPH

    has recently executed atwo year contract toimprovethe department's billing

    services andreviewoptionsfo rcontractswithmanagedcareentities,thetwo yeartimelineposes

    significantconcerns due to the urgent need fo radequatebilling

    processes

    and reimbursement fo rservices

    currently

    being

    provided

    at mental health centers, and

    WHEREAS,addressingthese

    ongoing

    management problems

    could

    increase the numbero fclientsserved

    at theCDPH clinics

    within

    the currentCDPHbudgetframework,therefore

    Section 1.Section 2-112-150 of the MunicipalCodeo fChicago is hereby amended byinsertingthe

    language underscored asfollows:

    2-112-150 Grants and other agreements.

    a) The commissioner shall have the powerto i)applyfo rgiftsand grants o fservices, equipment,

    supplies, materials, or funds

    f r o m

    the

    United

    States,

    the

    State

    of

    Illino is,

    other government entities, their

    agenciesorofficers,orf r o many person,foundation,association,not-for-profitcorporation,f i rmor

    corporation,

    and ii )to enterintocontracts andagreementsresultingingiftsor grants f r o mtheseand other

    sources. The commissionershalln o t ifythe mayor, the budget

    director,

    and thecomptrollero feach such

    action. The commissioner shall have the power to expend such receipts on projects that implement the

    policies of the department o fhealth,providedthatallexpenditureso fgrant and/or contract funds shall be

    subject to thesamepolicies and practices as the expenditureo fcorporate

    funds,

    includingthe provisions

    of

    career

    service rules.

    (b)

    The commissioner shallhavethe power to i)make grants orsubgrantso fdulyappropriated funds,

    ii )make grants orsubgrantso fpersonal propertyincluding,but notlimitedto,vaccines,

    testing kits

    and condoms,

    iii)

    execute or amend grant or subgrant

    agreements

    to effectuate the

    purposeso f

    this

    subsection b) ,and iv )execute such documents and provide any

    information,assurances

    orcertifications

    necessaryor appropriate to effectuate thepurposeso f

    this

    subsection (b).

    (c)

    The commissioner shall

    encourage

    and conduct such studies, investigations and

    research

    as

    in

    his

    judgment

    will

    promote and

    improve public

    health. Such

    activity

    may be carried out

    join tly with

    public or

    private entities. In furtherance thereof the commissioner shallhavethe power to enter

    intoagreements

    with

    public and private entities

    for

    the sharing and other use

    o fpublic

    health-related data.

    An y

    such

    agreements

    shallcomplywithapplicable law governingprivacy. Inorder to effectuate suchagreements,

    the commissioner is authorized: i)subject to the

    availability

    of

    duly

    appropriated funds, to pay

    application,processing, and otherfees,and ii )to executeancillarydocuments and provideancillary

    information,assurances

    or

    certifications.

    (d) The commissioner shallhavethe power to enter

    into

    contracts withhealth plans, insurance

    companies, and managed

    care

    entities

    for

    reimbursement

    for

    health

    care

    services

    provided

    by the

    department,includingclinical,planning,dataanalysis,

    care

    coordination,

    quality

    improvement, anddata

    sharing.

    (e) The Commissioner shall enter

    into

    contracts withatleastthree

    (3 )

    managed

    care

    entities for

    reimbursement

    for

    health

    care

    servicesprovidedtoindividualswithMedicaidhealth planswithinsix(6)

    months

    o fthe

    passageof this ordinance.

    f )The Commissioner shall take whateverstepsarenecessarytoensure adequatestaffingo fpsychiatrists

    at thecitvmental health

    centerswithinfour (4)

    monthso f

    the

    passageo fthis ordinance.

    (g)

    The Commissioner shall conduct such

    activities

    asnecessaryto

    increase

    awarenessof mental health

    issuesand of services available at thecitymental health centers,

    including

    conducting mental health

    workshops in communities disproportionately impacted by violence.

    (h)

    The Commissioner shall provide amonthlyreport toCity

    Council

    whichshall be posted on the

    CDPH

    website regarding the numbero fexecuted contractswithmanagedcareentities and thestatusofany

    contracting

    process,

    the

    level

    of

    staffing

    o fpsychiatrists at thecitymental health

    centers

    and the

    steps

    taken toensure adequatepsychiatricstaffing,and theactivitiescompleted toincreaseawarenessof

    mental

    healthissuesand of services available at thecitvmental health centers.
