Hal R. Lieberman is a past partner-in-charge of the New York office of Hinshaw& Culbertson LLP. He is an experienced trial lawyer who concentrates hispractice on the representation of lawyers and law firms in matters related tolegal ethics, professional discipline, malpractice, disqualification motions,sanctions and partnership issues.

For nearly three decades, Mr. Lieberman has focused his practice on lawyers'professional liability and ethics matters, and has helped shape the lawgoverning lawyers. Prior to representing lawyers and law firms in privatepractice, he was an Assistant Bar Counsel in the Massachusetts Office of theBar Counsel (1983–1987), and then served for more than 13 years as PrincipalTrial Attorney (1987–1989) and Chief Counsel (1989–1998) to theDepartmental Disciplinary Committee of the New York Supreme Court, FirstDepartment.

In addition to representing lawyers and law firms, Mr. Lieberman has providedexpert testimony or opinions in more than 40 civil and criminal litigationsinvolving legal ethics or legal malpractice. He was the subject of an interview inthe March 25, 2011 issue of the New York Law Journal. The article, entitled"Q&A With Hal R. Lieberman," focused primarily on Mr. Lieberman’s longexperience handling legal ethics and professional liability matters, and his viewson attorney discipline from the perspective of the former Chief Counsel to thedisciplinary committee in New York's First Judicial Department.

Professional BackgroundMr. Lieberman joined Hinshaw & Culbertson LLP in March 2004, served aspartner-in-charge from 2004 to 2012, and is a past member of the firm'sExecutive Committee. Previously, he was a partner in the New York office ofEdwards & Angell, LLP.

Mr. Lieberman has taught at a number of law schools, and was appointed to theadjunct faculty at Columbia Law School in 2007. For 13 years he taught legalethics at Brooklyn Law School, and has served as a visiting lecturer on thetopics of legal ethics and professional discipline at Harvard Law School,Fordham Law School, Hofstra Law School, Cardozo Law School and New YorkLaw School.

Mr. Lieberman is actively involved in alternative dispute forums. From 1989 to 1998, he served as a coordinator and trainerfor the Complaint Mediation Panels of the Departmental Disciplinary Committee. This program, which he founded, was thefirst lawyer-client dispute resolution program in the United States serving as an adjunct to the professional disciplinarysystem. Since 1999, he has served as a Special Mediator on the Complaint Mediation Panel of the New York City BarAssociation.

In the early years of his career, Mr. Lieberman held various positions involving legal services to the poor, includingExecutive Director of Central Massachusetts Legal Services, Inc. from 1977 to 1982 and Associate Appellate Counsel inthe New York Legal Aid Society's Criminal Appeals Bureau from 1974 to 1977.

In 1996, Mr. Lieberman was elected to membership in the American Law Institute, and served on the members'consultative group for the Restatement of the Law Governing Lawyers. He is the former Chair of the Committee onProfessional Discipline of the New York City Bar; is a long time member of the Committee on Professional Discipline of theNew York State Bar Association; a past member of the Committee on Professional Responsibility of the New York City BarAssociation; a past member of the Boston Bar Association Ethics Committee; and a past member of the Committee onProfessional and Judicial Ethics of the New York City Bar Association where he was the principal author of N.Y.C. FormalOp. 2000-1. His professional affiliations also include membership in the New York County Lawyers' Association; theFederal Bar Council; the U.S. District Court, E.D.N.Y (Grievance Panel); and the Association of Professional ResponsibilityAttorneys.

PersonalMr. Lieberman is a long time competitive middle distance runner, and participates in numerous national and local trackmeets as a member of the Central Park Track Club. In 2013, Hal and three other CTPC runners broke the world indoorrecord for the men's 4 x 800 meter relay in the 70+ age group, when they finished 22 seconds faster than the previouslyheld record.

Sherry K. Cohen has many years of experience in the ethics and disciplinary field, having served as First Deputy Counsel for the Departmental Disciplinary Committee, First Judicial Department.

In November 2001, Martin was named “Litigator of the Month” by the National Law Journal for

having obtained a $248 million judgment on behalf of the Cayuga Indian Nation of New York

against the State of New York for the state’s wrongful acquisition of the Cayuga’s land in 1795.

Martin has taught evidence and trial practice as an adjunct professor of law at Benjamin N.

Cardozo School of Law, Yeshiva University. Between 1962 and 1965, Martin served as an

Martin Gold's litigation practice concentrates on large and complex matters.

His vast experience over many years in a wide range of matters includes general civil and

criminal matters, trials and appeals, entertainment, intellectual property, securities, computer,

technology, antitrust, corporate and real estate law.

He has tried many cases in state and federal courts, and has argued numerous appeals in

various courts, including the U.S. Supreme Court.

Martin has extensive experience in many substantive areas, including antitrust, securities,

international disputes, class actions, civil rights, contract issues, intellectual property, legal and

accounting malpractice, white-collar criminal defense and entertainment industry-related

matters.

Martin is a senior member of the Departmental Disciplinary Committee, First Judicial

Department, appointed by, and responsible to, the Appellate Division, First Judicial

Department, for the discipline of attorneys.

In connection with the prosecution of a major conspiracy, he received a special commendation

from Attorney General Robert F. Kennedy.

SARAH JO HAMILTON

Sarah Jo Hamilton is a partner in the firm SCALISE & HAMILTON, LLP in Scarsdale, New York. The Firm focuses its practice on the representation of professionals (lawyers, judges, accountants, doctors, dentists, pharmacists, social workers, and government employees) in professional responsibility and ethics matters, and white-collar criminal matters. Before entering private practice in 2007, Ms. Hamilton was the Secretary to the Committee on Character and Fitness for the First Judicial Department, where she supervised applications and litigated hearings for lawyers seeking admission to the bar. Prior to that, for thirteen years Ms. Hamilton was employed at the Departmental Disciplinary Committee for the First Judicial Department. She served as Special Trial Counsel from 1989 to 2000 and First Deputy Chief Counsel from 2000 to 2003. Myron Kirschbaum has been litigating in the federal and state courts in New

York and throughout the country for over 30 years with an emphasis on

securities, derivatives, antitrust, corporate, bankruptcy, tax and insurance-

related litigation. Myron has represented issuers, officers, directors, and major

shareholders in securities fraud, shareholder derivative, and RICO actions; has

represented major corporations in a variety of commercial disputes, including

contested takeovers and actions under the antitrust laws; and has represented

He joined Kronish Lieb Weiner & Hellman LLP in 1980, which was merged into Cooley Godward Kronish LLP in 2006. He is resident in the New York office.

For nearly 40 years, Mr. Levine has represented individuals and companies in complex civil, criminal and regulatory matters. Mr. Levine has successfully tried numerous civil and criminal cases and appeared in federal and state courts throughout the country. Public companies, private companies and individuals in sensitive situations - some leading to litigation, some not - have retained Mr. Levine to analyze, solve, settle or litigate matters to resolution.

Recognized by the New York Law Journal for his prominence and experience in litigating cases involving complex financial transactions, Mr. Levine has handled trials and arbitrations involving derivative trading practices and structured transactions for institutions such as Allied Irish Bank, Goldman Sachs, the former Republic National Bank of New York, as well as all kinds of governance and transactional disputes for hedge funds, private equity firms and venture capital funds.

In the aftermath of the Enron bankruptcy, St. Paul Fire and Marine Company and Travelers Indemnity Company turned to Mr. Levine to defend them against claims made by JPMorgan Chase on surety bonds issued with respect to Enron's structured commodities business. Ultimately, JPMorgan Chase's claims totaling $1 billion were tried against nine of the nation's largest insurance companies with Mr. Levine as lead trial counsel. The case was settled following Mr. Levine's summation on terms favorable to his clients. In another standout representation, Mr. Levine represented Sumitomo Corporation for five years in the well-publicized derivative copper trading scandal, commencing and successfully resolving multi-million dollar fraud claims against major financial institutions, and defending antitrust claims arising out of the scandal.

Some of the nation's largest law firms have retained Mr. Levine to handle professional malpractice actions and to represent the firms in partnership disputes, insurance coverage disputes and other matters arising out of the business of law firms.

In addition, Mr. Levine has extensive experience representing clients in major government investigations conducted by federal and state grand juries, the SEC, and other regulatory agencies.

Over the last several years, Mr. Levine has also served as special counsel to Audit Committees directing investigations of accounting and transactional issues in conjunction with public accounting firms.

Mr. Levine served for six years on the Management and Compensation Committees of the firm and for the prior eight years (1998-2006) as Managing Partner of Kronish Lieb Weiner & Hellman LLP, a premier, 110-lawyer firm in Manhattan. Prior to joining Kronish Lieb, Mr. Levine served as an Assistant United States Attorney in the Southern District of New York, where he played a key role in the investigation and prosecution of union corruption on the New York City waterfront.

He graduated from New York University School of Law, where he was a member of the Law Review. Mr. Levine earned his BS from University of Pennsylvania.

A Fellow of the American College of Trial Lawyers, Mr. Levine has repeatedly been recognized by his peers, having been asked to assume leadership roles over his career in the American College of Trial Lawyers, The Legal Aid Society, the American Bar Association and the New York State Bar Association. From 2007 through 2010, Mr. Levine served as Chairman of the Board of The Legal Aid Society, the largest public law firm in the United States. In 2003, he was called upon to represent the Legal Services Corporation in a landmark case involving federal legal services funding, which he argued before the United States Supreme Court.

In 2012, the Honorable Jonathan Lippman, Chief Judge of the New York Court of Appeals, appointed Mr. Levine as Co-Chair of the Advisory Committee on the New York State Pro Bono Bar Admission Requirements. In 2013, he was appointed to New York Commercial Division Advisory Council.

Mr. Levine has long been active in civic and community affairs. He was named by former Governor George Pataki to serve as a member of the New York State Commission on Public Authority Reform. He is also Vice Chairman of the Board of Trustees of the Jewish Theological Seminary. He serves on the New York State Courts Appellate Division, First Department Disciplinary Policy Committee.

Mr. Levine has received numerous awards for his contributions including The Pro Bono Award from The Legal Aid Society, The Torch of Learning Award from American Friends of the Hebrew University and The Human Relations Award from the Anti-Defamation League. In 2006, the Police Athletic League honored Mr. Levine with The Robert M. Morgenthau Award for being "a tireless advocate for the community."

In May 2011, Mr. Levine received the Servant of Justice Award from The Legal Aid Society.

Michael S. Ross is the principal of the Law Offices of Michael S. Ross, where he

concentrates his practice in attorney ethics and criminal law. He is a former

Assistant United States Attorney in the Criminal Division of the Southern District of

New York and also served as an Assistant District Attorney in Kings County. Mr.

Ross has been an Adjunct Professor at Benjamin N. Cardozo Law School since

1980 (where he teaches Fall and Spring Semester courses in Litigation Ethics).

Mr. Ross has also taught a variety of trial practice and judicial administration courses as an Adjunct

Associate Professor at Brooklyn Law School since 2005 (where he teaches a Fall course in Professional

Responsibility, and has taught Spring and Summer courses over the years as well). In addition, in three and

a half decades of teaching at Cardozo Law School, he has taught a variety of ethics, trial practice and

judicial administration courses.

Mr. Ross is a frequent lecturer and author on topics involving ethics, trial practice and criminal law for such

organizations as the Practicing Law Institute, the Appellate Divisions, First and Second Departments, the

Association of the Bar of the City of New York, the New York State Judicial Institute, the National Institute of

Mr. Ross currently serves as a member of the New York State Bar Association’s Committee on Professional

Discipline; the New York County Lawyers’ Association Committee on Professional Discipline; the New York

State Bar Association’s Special Committee on the Unlawful Practice of Law; and the New York State Bar

Association’s Committee on Mass Disasters. He previously served for a number of terms on the Association

of the Bar of the City Of New York’s Committee on Professional Discipline, the New York State Bar

Association Special Committee on Procedures for Judicial Discipline, and the New York State Bar

Association’s Task Force On Lawyer Advertising.

Mr. Ross completed a five-year tenure as an appointed member of the New York State Continuing Legal

Education Board, which, among other things, formulates CLE guidelines in the State. Mr. Ross has chaired

the American Bar Association (“ABA”) Grand Jury Committee and the City Bar Association’s Committee on

Criminal Advocacy. He previously served as the ABA Criminal Justice Section’s liaison to the ABA Standing

Committee on Ethics and Professional Responsibility and was an appointed member of the ABA’s Special

Criminal Justice In Crisis Committee.

Among his writings, Mr. Ross has co-authored a chapter on “Client and Witness Perjury,” for the ABA’s

Section of Litigation ethics training course book entitled “Litigation Ethics: Course Materials For Continuing

Legal Education.” The course book was developed for use nationally by law firms, bar associations and

other groups which provide ethics training.
