According to Centers for Disease Control and Prevention (CDC), Kentucky was ranked as having the fifth highest rate of drug overdose deaths in the nation in 2017 (37.2 per 100,000, 1,566 deaths).1 This rate of overdose deaths represented an 11% increase as compared to 2016 (33.5 per 100,000, 1,419 deaths). Synthetic opioids other than methadone have been identified by the CDC as the main driver of drug overdose deaths. While the overall rate of opioid prescribing in Kentucky has decreased significantly since of the passage of House Bill 1 in 2012, the rate of overdose deaths has increased during the same period. The National Institute on Drug Abuse reports that close to one third of the drug overdose deaths in Kentucky in 2017 involved opioid prescriptions (10.2 deaths per 100,000).2 These statistics are proof of a continuing opioid epidemic in Kentucky.

Beginning in January of this year, the Inspector General of the Kentucky Cabinet for Health and Family Services (CHFS-OIG) began issuing overdose death notices to controlled substance prescribers. These notices are issued only where a Kentucky death has been attributed to drug poisoning, and only to the prescribers who authorized issuance of an opiate prescription to the deceased person within a sixty (60) days period preceding the person’s death.

Each time a Kentucky prescriber is sent a CHFS-OIG overdose death notice, a copy of the notice is mailed to the professional licensing board that licensed the prescriber, which is typically the Kentucky Board of Nursing (KBN) or the Kentucky Medical Licensure Board. KBN does not regard an overdose death notice as a complaint; rather, such notices are treated as preliminary information sufficient to warrant a review of both patient and prescriber KASPER data. Review of KASPER data sometimes results in further investigation such as a review of a medical examiner’s report or the deceased person’s medical records. If evidence indicates that improper, inappropriate or illegal prescribing has occurred, KBN staff will prepare an agency-initiated complaint requesting that the prescriber respond and provide relevant documents and information. The public

is informed of the filing of agency-initiated complaints via the license validation tool on the KBN website.3 When investigation and litigation is concluded in such cases, the complaint document and the disposition document are regarded as public records pursuant to the Kentucky Open Records Act; however, patient identifying information is redacted prior to the release of such records.4
