  • THE WATER ENVIRONMENT (OIL STORAGE)(SCOTLAND) REGULATIONS 2006

    DO THE REGULATIONS APPLY TO ME? YES if you store any of the following kinds of oil: Petrol Diesel Mineral oil Heating oil Lubricating oil Waste oil Vegetable and plant oil

    The regulations apply to any kind of container which is used and stored onpremises above ground, whether inside or outside a building. This includesfixed tanks, intermediate bulk containers, drums (oil drums or similarcontainers used for storing oil) or mobile bowsers.

    The container must be situated within a secondary containment systemwhich satisfies the following requirements: It must have a capacity of not lessthan 110% of the container's storage capacity or, if there was more than onecontainer within the system, of not less than 110% of the largest container'sstorage capacity, or 25% of the aggregate storage capacity, whichever isgreater.

    KEY REQUIREMENTS OF THEREGULATIONS The regulations set design standards for new and existing above-ground oilstorage facilities:

    Where oil is stored in any portable container with a storage capacity of lessthan 200ltr, the container must be of sufficient strength and structuralintegrity to ensure that it is unlikely to burst or leak in its ordinary use.

    Where the container has a storage capacity of 200ltr or more, theregulations require provision of a secondary containment (a bund or drip-tray) to ensure that any leaking or spilt oil cannot enter the waterenvironment.

    IS STORAGE WITHIN BUILDINGSCOVERED BY THE REGULATIONS? YES Oil storage within buildings must comply with the regulations.

    DO THE REGULATIONS COVER MOBILEBOWSERS USED AT LICENSED WASTESITES? YES Mobile bowsers used at all licensed waste sites must comply with the

    regulations.

    DO THE REGULATIONS COVER THEVOLUME OF OIL STORED OR THE SIZE OFTHE CONTAINER? The regulations cover the size of the container. For example, sites with an oil

    tank of 1000ltr which only ever have 150ltr of oil stored would still have tocomply.

    WHERE DO THE REGULATIONS APPLY? ONLY in England

    WHAT TYPES OF OIL CONTAINERS ARECOVERED BY THE REGULATIONS?The regulations apply to: Tanks (can be permanent or temporary) Drums greater than 200ltr capacity Intermediate bulk containers (IBCs) Mobile bowsers Oil storage containers can be made from a variety of materials, for example

    polyethylene or metal, but all should be designed and manufactured to holdoil and must be fit for purpose while they are being used. The EnvironmentAgency regard an Intermediate Bulk Container (IBC) as being permanent oilstorage and the requirements for fixed tanks apply.

    WHICH TYPES OF OIL ARE COVERED? The regulations cover all types of oil, except waste mineral oil. This includes

    petrol, diesel, bio-fuels, vegetable oils, synthetic, mineral oils and oils used assolvents. Biodegradable oils are also covered.

    ARE CROWN SITES EXEMPT? NO they must comply with the regulations, although the Environment Agency

    can't prosecute for non-compliance, they can ask the court to serve a noticewhich would require improvements to be put in place.

    DO THE REGULATIONS COVER THEVOLUME OF OIL STORED OR THE SIZE OFTHE CONTAINER? The regulations cover the size of the container. For example, sites with an oil

    tank of 1000ltr which only ever have 150ltr of oil stored would still have tocomply.

    ARE THERE DIFFERENCES BETWEENTHE SCOTTISH AND ENGLISHREGULATIONS?

    YES they differ slightly, here are 3 key differences:

    Regulations in Scotland apply to storage of waste oil. Thestorage of waste mineral oils is exempt under the Englishregulations because it is covered by The WasteManagement Licensing Regulations 1994

    Regulations in Scotland apply to storage of oil in buildingswhile the English regulations exempt the storage of oilwithin a building

    The Scottish regulations require that if oil is stored in aportable container of

  • ASSESSMENT By understanding what happens on your site you will be better

    placed to respond in the event of an emergency. Let us carry out your assessment, an outside pair of eyes often sees things that have become commonplace to you.

    KNOW WHAT LIQUIDS YOU HAVE You need to know which liquids you have on site, what risks they pose

    (check Material Safety Data Sheets) what volumes, in what sizes of container and how many of each you have.

    WHERE YOUR LIQUIDS ARESTORED AND USED Check how liquids are delivered to site, how they are unloaded and

    moved around the site, where they are stored and in which applications they are used.

    WHICH TYPE(S) OF ABSORBENT(S) ARE BEST FOR YOU Once you understand your site, and where and how liquids are transported,

    stored and used, you will be better placed to select the correct products to best suit you.

    DEALING WITH DAY TO DAYHOUSEKEEPING AND RESPONDINGTO EMERGENCIES Choosing the right absorbents and spill kits is only the start of the process,
