What do the

Minutes show?Now, you know that the person at Sl. No. 5 in the Select List had been selected for the post of Assistant Professor, “subject to completion of Ph.D”.

It proves that selection was made in spite of the fact that person did not have the Ph. D. qualification even on the date of interview, let alone the date of application.

This is contrary to the terms communicated in the advertisement.

The Minutes

also shows

That one of the Members. Prof. Apte, present in the Committee, had not approved the decision and had not signed.

Whether his opinion was got recorded in the Dissent Note and examined is not known.

What does the Hon’ble

Supreme Court say?“It must further be realized by all concerned that when an advertisement mentions a particular qualification and an appointment is made in disregard of the same, it is not a matter only between the appointing authority and the appointee concerned.

The aggrieved are all those who had similar or better qualifications than the appointee or appointees but who had not applied for the post because they did not possess the qualification mentioned in the advertisement.

It amounts to a fraud on public to appoint a person with inferior qualifications in such circumstances unless it is clearly stated that the qualifications are relaxable. No court should be a party to the perpetuation of the fraudulent practice.” (Emphasis added)

1990 Vs. 2010

The judgment of the Hon’ble Supreme Court had been delivered in the year 1990.

But, the appointments in the Indian Institute of Technoloygy Madras at Chennai even after twenty years of the said judgment continue to be made in deviation of the terms communicated to the Indian Nationals through the Advertisement.

Hon’ble President of India is the Visitor of the IITs. The Ministry of Human Resources and Development is the controlling body.

Yet, things go this way in the IIT Madras at Chennai.

The authorities of IIT Madras do not bother about the Supreme Court judgments.

They do whatever they please.

The Ministry of HRD, Government of India is either indifferent or abetting the violation of law and procedure in the matter of appointment in the IIT Madras at Chennai.

Be aware of these facts when or whether you choose to apply or choose not to apply for the post of Assistant Professor in the IIT Madras at Chennai.
