1.0 GENERAL

1.1 The Empanelment of Electrical Agencies/Firms shall be initially valid for One (1) year. However, NPCC reserve the right to curtail or extend this period at its sole discretion. With this empanelment process the existing empanelment of contractors is cancelled.

1.2 Application should be submitted on E- Tendering Portal i.e. https://npcc.eproc.in/ and Processing Fee, Hard Copy of Complete Tender Document Should Be reached to Zonal Manager-EZO Kolkata 3A Dr. SN Roy Road, Kolkata-700029 033-2466-7371/2463-4965. Incomplete application shall be summarily rejected.

1.3 NPCC reserve the right to call for clarification if needed at its own discretion and applicant will not have any claim on this ground of any nature.

1.4 NPCC reserve the right to reject any or all the application or limit the shortlist

to any number of annul this process without assigning any reasons whatsoever.

1.5 One agency can submit one bid for work.

1.7 The process open-ended however easily applications are invited up to date

2.0 INFORMATION AND INSTRUCTION FOR APPLICANTS

2.1 The categories of empanelment and definition of similar works for the categories are as under:

2.2 Eligibility Criteria

i. Turnover: Average Annual Financial Turnover on Electr ica l construction works during the last three years, ending 31s t March of the previous financial year i.e. 2017-18, should be at least 50% of the estimated cost. Audited annual report to be attached. In case Balance Sheet with profit & loss is not prepared for 2017-18, Provisional Balance sheet along with profit & loss duly certified by chartered accountant is to be enclosed.

ii. Experience: Applicant should have the experience of completion of similar works during last 7 years ending last day of month previous to the one in which tenders are invited should be either of the following.

a. Three similar completed works each costing not less than the amount equal to 40% of the estimated cost,

or

b. Two similar completed works each costing not less than the amount equal to 60% of the estimated cost,

or

c. One similar completed work costing not less than the amount equal to 80% of the estimated cost.

iii. Similar works mean: Similar work as defined in Table 2.1, only from Central / State Govt. Departments / PSUs /autonomous organizations etc. Bidders need to attach the credential with tender documents.

iv. Profitability: The applicant should be a profit (net) making firm and Should not have incurred any loss in the last 2 (two) financial years and have not

incurred losses for more than two years out of last five years ending 31st March, 2018 duly certified by Chartered Accountant.

v. EPF Registration: Preferably agency should have EPF registration, in case EPF registration is not there. The agency should obtain EPF registration on allotment of work. In case of failure NPCC will deduct EPF & deposit as per EPF norms.

vi. Joint Venture: Joint Ventures are not permitted.

vii. The applicant must have adequate organizational setup as well as having sufficient number of experienced personnel, technical know-how, and infrastructure to complete the project well within time frame.

viii. The applicant must have minimum three years o f experience working with public sector enterprises / government / semi government / autonomous organizations as per clause (iii) above

ix. NPCC is free to get documents verified and agency shall have no objection to it. In case, if it is found at any stage that the agency has made any false information will be disqualified and kept on holiday list.

x. Policy for Micro and Small Enterprises (MSEs):

a) Small scale Industries registered with the National Small Scale Industries Corporation shall be exempted from payment of tender cost/earnest Money Deposit as per eligibility limits.

b) Tenderers seeking exemption should enclose a photocopy of Valid Registration Certificate giving details such as product/services and Monetary limits, failing which they run the risk of their tenders being passed over as ineligible for this concession.

c) NPCC may consider award of work to MSEs as per provision of Public Procurement Policy for Micro and Small Enterprises (MSEs) order, 2012 with special provision for Public Procurement Policy for Micro & Small enterprises owned by the Scheduled Caste or the scheduled Tribe entrepreneurs.

2. 3 No joint venture or Consortium of firms shall be allowed and the contractors / agencies / firms should meet the above criteria by themselves.

2.4 The value of free issues material (if any) shall be taken while evaluating completion cost of project. The value of such materials incorporated in the project should be certified by chartered accountant.

2.5 Desired Agencies / contractors should apply on the prescribed documents along with documentary evidence meeting the above qualification criteria to be attested by authorized signatory such as:

1. Audited balance sheet for the last three years.

2. Bank solvency certificate issued within three months from the BID submission date.

3. Completion certificates from clients / owners.

4. Details of pending litigation etc.

5. EPF registration certificate.

6. Professional Tax challan latest copy.

7. Details of board of directors / partners/proprietor.

8. Copy of updated Electrical contractor license .

9. Power of attorney authorizing for signing of the documents and correspondence.

10. Memorandum and articles of association in case of company /registered partnership deed in case of partnership firm.

2. 6 The past experience in similar nature of work should be supported by certificate issued by an officer not below the rank of Executive Engineer or equivalent.

2. 7 The gross annual turnover, profit and loss and the net worth should be certified by the chartered accountant. Year in which no turnover is shown would also be considered for working out the average.

2.8 The applicant should own sufficient construction equipment for the proper and timely execution of the work. The applicant should submit details of same with empanelment application.

2.9 The applicant should have sufficient number of Technical and administrative employees for the proper execution of the contract. The applicant should submit details of same with empanelment application.

2.10 All the application received, will be evaluated on the basis of Information and documents provided by the applicant. In case the applicant is not found suitable for the group / category, his application shall be considered for the empanelment in other group / category (if found suitable)

2.11 Letter of transmittals and forms for giving details for empanelment are given in section 3.

2.12 All information called for in the enclosed forms should be furnished against the relevant columns, if for any reason information is furnished on a separate

sheet this fact should be mentioned against relevant column. Even if no information is to be provided in a column, a “NIL” or “NO SUCH CASE” entry should be made in that column. If any particulars! query is not applicable in case of the applicants, it should be stated as “not applicable”. The applicants are cautioned that not giving complete information called for in the application form or not giving it in clear terms or making any change in the prescribed forms or deliberately suppressing the information may result in the applicant being rejected. Applications made by telegram or telex, email and those received late will not be entertained.

2.13 Application should be typed written. The applicant should sign and stamp each page of the application.

2.14 Overwriting should be avoided correction if any should be made by neatly crossing out initialing, dating and rewriting. pages of the pre qualification documents are numbered additional seats , if any added by the contractor, should also be numbered by him they should be submitted as a package with signed letter of transmittal.

2.15 References information and certificates from the respective clients certifying suitability , technical knowhow or capability of the applicant should be signed by an officer not below the rank of Executive Engineer or equivalent.

2.16 The applicant may furnish any additional information which he things is necessary to establish his capabilities to successfully complete the works. the applicants are however ,advised not to furnish superfluous information. no information shall be entertained after submission of pre-qualification documents unless it is called for by the NPCC.

2.17 Any information furnished by the applicant found to be incorrect either immediately or at a later date, would render him liable to be debarred from pre-qualification/ tendering / taking up of work in NPCC. If such applicant happens to be empanelled / enlisted contractors in more than one Group /Category his name shall be removed from all the groups /Category of the empanelled list of contractors.

2.18 Prospective applicant may request clarification on the empanelment document within ten days of publication of this Notice for Empanelment No request for clarification will be considered after that date.

DEFINITIONS

2.20 In this document the following works and expression have the meaning hereby assigned to them;

(1) “EMOPLOYER “ Means Chittaranjan National Cancer Institute, Kolkata

(2) “NPCC” Means NATIONAL PROJECTS CONSTRUCTION CORPORATION LIMITED.

(3) ”APPLICANT” Means the individual proprietary firm in partnership, limited company private or public or corporation.

(4) ”YEAR” Means “Financial year” unless stated otherwise.

2.21 METHOD OF APPLICATION

(1) If applicant is an individual, the application shall be signed by him above his full typewritten name and current address.

(2) If the applicant is a proprietary firm, the application shall be signed by the proprietor above his full typewritten name and the full name of his firm with its current address.

(3) If the applicant is a firm in partnership, the application shall be signed by all the partners of the firm above their full typewritten names and current address or alternatively by a partner holding power of attorney for the firm. In the latter case a certified copy of the power of attorney should accompany the application. In both cases a certified copy of the partnership deed and current address of all the partners of the firm should accompany the application.

(4) If the applicant is a limited company or a corporation, the application shall be signed by a duly authorized person holding power of attorney for signing the application accompanied by a copy of the power of attorney. The applicant should also furnish a copy of the Memorandum of Articles of Association duly attested by a Public Notary.

2.22 FINAL DECISION MAKING AUTHORITY

NPCC reserve the right to modify the eligibility criteria, to decide on cutoff date of implementation, to accept or reject any application, to annul the EMPANELMENT process to reject all application or accept new applications at any time, without assigning any reason or incurring any liability to the applicants.

2.23 EVALUATION CRITERIA FOR EMPANELMENT

2.23.1 For the purpose of empanelment applicants will be evaluated on the basis of past experience criteria. The details of plant & machinery holding, Manpower employed, pending litigation shall also be evaluated for empanelment of the firms.

2.2 3.2 Even though an applicant may satisfy above requirements, he would be liable to disqualification if he has:

(a) record of poor performance such as abandoning work ,not properly completing the

contract, delay in completion of works ,or financial / weakness etc. (b) Made misleading or false representation or deliberately suppressed the information in

the forms statements and enclosures required in the pre-qualification documents. 2.24 Financial information

Applicant should furnish the follow financial information. (a) Annual financial statement for the last 3 years (in FORM- C). This should be supported

by audited balance sheet and profit and loss accounts ( with all schedules attached) along- with details required for assessing the net worth duly certified by a Chartered Accountant, as submitted by the applicant to the Income Tax Department.

(b ) Name & Address of the bankers, name of persons familiar with the applicants financial

Standing and a bankers statement on availability of unutilized cash credit and bank guarantee limits.

2.25 EXPERIENCE IN WORKS HIGHLIGHTING EXPERIENCES IN SIMILAR WORKS 2.25.1 Applicant should furnish the following;

(a) List of all similar works successfully completed during the last seven years (in form” E”)

2.26 ORGANIZATION INFORMATION 2.2 6.1 Applicant is required to submit the following information in respect of which organization.

(a) Name and Postal Address including Mobile No., Telephone, Fax numbers , and Email address etc.

(b) Copies of original documents defining the legal status, place of Registration and principal places of business.

(c) Name of Directors and Officers concerned with the work, with designation of individuals authorized to act for the organization.

(d) Information on any litigation in which the applicant was involved during the last 5 years, including any current litigation.

(e) Authorization for NPCC to seek detailed references.

2.27 Letter of transmittals The applicant should submit the letter of transmittal attached with prequalification document for duly signed by him.

2.28 Any effort on the part of the applicant or his agent to exercise influence or to pressurize

the employer would result in rejection of his application. Canvassing of any kind is prohibited.

2.29 CANCELLATION OF EMPANELMENT The empanelment of contractor shall be cancelled by NPCC in case of their poor performance, abandoning of the allotted work, and abnormal delay in completion of work, bankruptcy and for activities detrimental to the interest of NPCC the decision of NPCC in this regard shall be final and binding on the contractor.

2.30 The contractor / firm shall not effect any change in the constitution of the firm or in its name without the prior approval of NPCC. Such proposal, if any shall be submitted in advance furnishing full details of the proposed change along with all supporting documents. Any change in the constitution or name of the firm/ company without the prior approval of NPCC will render the contractor / firm liable for removal from the approved list of contractors. The discretion to allow / disallow the proposed change shall vest solely with NPCC. In case, the original partners / constitution changed by more
