I. Introduction The request is for Development Review Board (DRB) approval for seven (7) single-family residential homesites on an approximately 8.48-acre site located at the southwest corner Gold Dust Avenue and 124th Street. The site is zoned R1-43 ESL. This application includes a request for amended development standards in accordance with ESL guidelines. These amended development standards will allow for the entirety of the Site’s Natural Area Open Space (NAOS) area to be provided within tracts and for an additional 0.75-acres of NAOS to be provided above the minimum NAOS requirement, an increase of 60%. Historically used as an equestrian facility, this Site is unique in that 100% of the Site was disturbed prior to 1991 leaving no remaining undisturbed natural desert. To account for this, this application also includes a request for a NAOS waiver to reduce the NAOS required for the Site to 15% of the Site’s gross area.

II. Site Context The Site has historically been used as an equestrian facility. This use has resulted in 100% disturbance of the Site. The Site consists of a single parcel, APN # 217-32-625. Located at the southwest corner of Gold Dust Avenue and 124th Street, the Site is bounded to the west and south by the Central Arizona Project Canal. See Figure 1: Context Aerial, below.

The Site is currently zoned R1-43 ESL and has a General Plan Land Use designation of Rural Neighborhoods. See Table 1: Surrounding Context for a summary of neighboring land uses and entitlements

III. Description of Request The Emerald Hills community consists of seven (7) lots fronting to Gold Dust Avenue for an overall density of 0.82 dwelling units per acre. Lots are approximately 34,970 square feet in size with typical dimensions of 130-feet by 269-feet. All non-lot area within the community will be dedicated as tract NAOS with the exception of small carveouts for drainage improvements and the community mailbox location. No community signage or monumentation is proposed as a part of this request. See Figure 2: Conceptual Development Plan.

Gold Dust Avenue is classified as a “Local Residential – Rural/ESL Character” street and the southern half of the roadway will be improved per City standards as a part of this application. Due to the lack of sewer infrastructure at this Site, each residence will utilize an on-lot septic system. Approvals for septic will be processed through Maricopa County. A mapped FEMA floodplain currently extends across a portion of the western portion of the property. The construction of a regional detention basin to the north of the Site has resulted in a change to the drainage patterns on this site that has reduced or eliminated historic off-site flows from impacting the property. A CLOMR will the processed along with the preliminary plat application request to address existing drainage conditions and removing the site from the mapped floodplain.

IV. NAOS Waiver The ESL district contains specific requirements for preservation of the Site’s natural features and the provision of NAOS Area. Typically, the amount of required NAOS for a Site is determined by a Slope Analysis. The Emerald Hills Site however, is a unique case. Despite being located within the ESL overlay, 100% of the Site was scraped of its natural features prior to the implementation of the ESL ordinance in 1991. This means that there are nearly no natural features left to preserve on the Site. Under typical circumstances, properties located within the ESL overlay would have natural open space to be preserved in place. This site is not subject to these conditions due to extensive historic disturbance. In an effort to mitigate these impacts, the applicant seeks to comprehensively revegetate areas designated as Natural Area Open Space which is a different methodology than is typically applied to ESL properties. To account for unique situations such as this, Section 6.1060.B of the City of Scottsdale Zoning Ordinance outlines criteria for situations where the Zoning Administrator may approve reductions in the required NAOS area to a minimum of 15% of the Site’s gross area. The criteria for this NAOS reduction are provided within Table 3: NAOS Reduction Standards and Conformance. As shown within Table 3, the Emerald Hills Site meets all five (5) NAOS reduction standards and therefore is a prime candidate for the NAOS requirement reduction.

Given that the Site meets the above standards for NAOS reduction, we request that the Zoning Administrator approve our request to reduce the Site’s NAOS requirement to the minimum requirement of 15% of the Site’s gross area which, per the equation shown below, would result in a minimum NAOS requirement of 1.27 acres.

Required NAOS = 15% of the Site’s gross area (8.48 acres) = 1.27 acres Typically, 70% of the provided NAOS area is to remain undisturbed. Given the unique situation of this Site where 100% of the Site has been disturbed and no natural native desert areas remain, the applicant is designating 100% of of the provided NAOS area as revegetated NAOS with the intent of restoring and enhancing this scarred area to a more natural ultimate condition. The Landscape Plan provided with this application includes a revegetation plan depicting the locations, species, and methodology for revegetating the Site in conformance with ESLO guidelines and methodologies.

V. Amended Development Standards The City of Scottsdale’s ESL ordinance allows for development standard reduction of up to 25% in ESL areas to provide greater protection for the natural environment. The applicant is requesting amended development standards for the Emerald Hills community. These have been identified in Table 2: Amended Development Standards, below. The amended development standards as requested will translate into a development plan in which 100% of the provided NAOS is off-lot within protective tract.. Additionally, these Amended development standards allow for the provision of 0.75-acres of NAOS over the 1.27-acres required to be provided for a total of 2.02 acres of NAOS on

the Site. This represents a 60% increase over the NAOS requirement. This amended development standards request will result in greater protection for the natural areas planned for the Site.

VI. Conclusion The Emerald Hills Preliminary Plat represents an appropriate use for the Site that is consistent with surrounding development patterns, and is in conformance with the current General Plan Land Use and zoning designations on the property. The Development Team looks forward to working with the City of Scottsdale and adjacent residents to bring this project to fruition.
