NOW THEREFORE, it is hereby agreed by and between the parties hereto as follows:

l. In this Agreement, words and expressions shall have the same meanings as arerespectively assigned to them in the Contract documents hereinafter referred to.

2. The Contractor should execute and cornplete the Works and the rernedyingdefects therein, namely :

ln accordance with this Agreement and the Conhact Document as hereinafter defined.The time for completion from the Commencement Date shall be Seven HundredThirly (730) calendar days, and Defects Notification Period shall be Three HundredSixty Five (365) calendar days.

3. The following Documents shall be deemed to form and be read as part of thisAgreement and for the purposes of interpretation the priority of the documents shallbe in accordance with the following sequence:

In consideration of the payments to be made by the Employer to the Conhactor asindicated in this Agreement, the Contractor hereby covenants with the Employer toexecute the Works and to remedy defects therein in conformify in all respects with theprovisions of the Contract.

The Employer hereby covenants to pay Contractor in consideration of the executionand completion of the Works and remedying of defects therein, the Contract Price orsuch other sum as may become payable under the provisions of the Contract at thetimes and in the manner prescribed by the Contract.

The Contract Price inclutling the Value Added Tax (VAT) obtained from the priceand the estimated quantities of work as indicated in the Bill of Quantities, subjecttosuch additions thereto or deductions therefrom as may be made under the provisionsof the Contract is Rp 85,315,392,000.00 (Eighty five billion three hundred fifteenmillion three hundred ninety hvo thousand rupiahs)
