AUCTIONEERS NOTEVoyce Pullin have recently conducted the Property Sale of Heneage Court through the kind instructions of the owner, Mr Geoff Durston. We are also very pleased to have instructions todayto conduct this very genuine dispersal sale alongside Mr Phillip Taubenheim and his team atWotton Auction Rooms who will offer immediately following our sale the contents of HeneageCourt. Today’s sale is a bit out of the ordinary as, with respect to all others the setting for the saleis probably one of the best we have ever experienced. Today’s sale contains 4 tractors, mainly vintage including the Case L Roadless T36 Lifeboat Tractor which was acquired through Geoff andhis father’s former business, Durston Plant Hire who were once main dealers for Case ConstructionEquipment. Very few were ever made and it is the highlight of our part of the sale, but there aremany other excellent quality lots throughout the sale.

METHOD AND ORDER OF SALEAll items in the catalogue will be sold in pounds. The catalogue has been fully pre-lotted althoughprecise details of numbering may change but an update will be available on the afternoon prior tosale. It is our usual practise to end the sale with the higher value items namely vehicles and tractors however, please contact the auctioneers to discuss precise lot numbering as required. Allentered lots will be sold near the end of the sale.

Two separate firms of Auctioneers will be operating sales at today’s location. The Voyce Pullin element of the sale will commence at 10.30 am and the sale conducted by Wotton Auction Roomswill commence immediately after. Should you only be wishing to purchase from the second saleplease contact the Joint Auctioneers with regard to timing. It is however the responsibility of anypurchaser to allow themselves sufficient time to be on site prior to the commencement of either sale.

Today’s catalogue has been pre-lotted but we reserve the right to alter, amend, remove or re-lot anyitem at our own discretion and the auctioneers cannot be held liable for any losses due as a resultof alterations to sale lotting.

Special Note: The conditions of sale noted herein are specific to the lots sold by Voyce Pullin. Anylots purchased in the sale conducted by Wotton Auction Rooms Ltd may be subject to different orother Conditions. Purchasers should make themselves fully aware of all other conditions of saleapplicable in the second sale.

CONDITIONS OF SALEThe sale is held subject to the Auctioneer's General terms and Conditions of Sale (printed in theback of the catalogue) and to the Auction Conditions of Sale recommended for use by the LivestockAuctioneers Association (LAA), the latter Conditions will be displayed in full at the Sale Premisesand available to those purchasers who wish to view them. All lots are sold as seen and without warranty of any type unless specifically stated.

Please note that at the fall of the hammer all lots become the responsibility of the purchaser however legal title to ownership does not pass until payment in full is received and accounted.

VATVAT at the current standard rate will be charged on all items, if applicable.

BUYERS PREMIUMBuyers Premium will be charged at 10% on all items in the sale plus VAT except on the CaseLifeboat and Field Marshall Tractors where it will be reduced to 5%. A different rate applies to alllots being sold by Wotton Auction Rooms Ltd.

BIDDING NUMBERAll sale attendees must aquire a bidding number from the sale office prior to bidding. One biddingnumber can be used for both sales.

CATALOGUE ENTRIESWhilst every effort has been made to ensure that the descriptions are accurate no guarantee is givenor implied. Buyers should note that lots may be withdrawn and other lots added prior to the saleday. Buyers are advised to contact the Auctioneers prior to the sale to confirm a particular lotsinclusion since neither the Vendor nor the Auctioneers will be responsible for abortive expenses inrespect of withdrawn lots.

COMMISSION BIDSThe Auctioneers will be pleased to execute written commission bids prior to the sale on the understanding that the Purchaser has inspected the items. Forms are available on request. Pleasecontact the Auctioneers prior to sale.

ENGINE HOURSNeither the vendors nor the auctioneers make any warranty regarding engine hours or vehiclemileages. Any quoted hours in the catalogue were recorded in May 2015, but vehicles may continue to be used up until sale day. The Auctioneers will update clock readings and announce atthe point of sale.

ELECTRICAL ITEMSAll electrical items will be PAT tested prior to the date of sale as appropriate. PAT testing indicatesthe electrical safety of an item but does not guarantee it is in working order.

FIXED ITEMS SOLD IN SITUAny item sold in situ that is fixed to the ground will be given additional time to be removed unlessstated otherwise at point of sale. Any removal of items after the day of sale will be strictly byarrangement of an appointment with the owner. Purchasers are reminded that a completion of theproperty sale is imminently due and failure to comply with the above may mean the loss of the itemwithout recompense for cost.

Due to the requirements of the Money Laundering Regulation 2007 we regret that we are unableto accept payments for goods in cash where the total transaction (including VAT) exceeds £8,000.

SETTLEMENT AND CLEARANCE OF ITEMSSettlement in full is due to the Auctioneers immediately at the conclusion of the sale, no machineryor asset may leave from the Sale Premises without an official PASS obtainable only from theAuctioneers upon settlement and all stock should be cleared from the sale premises on the day ofthe sale, except where additional time to remove has been specified. 294. Case Roadless L RNLI Lifeboat Tractor T36 Registration No FYM 853 believed 1940 (see photograph on front cover)

History: Case Manufactured over 31,000 L Tractors between 1929 and 1940 with a further 2,000 industrial and other limited versions. However, there were only 11 Roadless Case L RNLI Tractors ever built between 1937 and 1940 numbered T27-T37. The one in today’s sale being one of the last of this type ever made.

Her service began at Filey Lifeboat Station, North Yorkshire in March 1940 until 1957. Between 1958 and 1962 she had a spell of work at Criccieth Lifeboat Station in Wales and after a period as a spare tractor she served at Blackpool Station between 1964 and 1965.

The Durston family acquired the tractor through their connections as Case Main Dealers for Construction Machinery and she has been stored at Heneage Court for most of the period since. The Tractor has been standing and covered for many years.

CONDITIONS OF SALE

1 The Auctioneers sell as agents for the Vendor (except where they are stated wholly or partly to own any lot as principal) and as such are not personally responsible for any default by the Vendor or Purchaser.

2 Subject to the reserve price (if any) being reached, the highest bidder for any lots shall be the Purchaser, and if any dispute arises, the Auctioneers may determine the same, or the lot may be put up again and resold at their discretion.

3 The bidding at all times to be at the discretion of the Auctioneers, who reserve the right to refuse any bidding or to withdraw any lot or lots from the sale, and to sell in such order and combine lots as they think fit. No bidding shall be retracted.

4 At the fall of the hammer, each Purchaser shall upon request give to the Auctioneers his or her name and address, and pay for any lots purchased at the close of the sale.

5 No lot or lots shall be removed from the premises until paid for, but each and every lot shall, at the fall of the hammer, be considered as delivered and at the risk of the Purchaser and shall be removed from the sale field at the Purchaser’s expense and taken with all faults and errors, save as hereinafter provided.

6 The Auctioneers describe each lot with care from information supplied by the Vendor or from their inspection when cataloguing but no allowance will be made for errors of description or misstatement contained in advertisements, catalogues or given verbally at or before the sale. Buyers should satisfy themselves prior to the sale of the condition of each lot.

7 Purchasers paying by cheque must be prepared, if required, to produce a letter of credit from their bankers.

8 The Auctioneers will, at the Purchaser’s request, transfer lots to another Purchaser, but the original Purchaser shall not cease to be responsible for the purchase money and, in the event of default may be sued for the same.

9 No lot of any description is sold with a ‘warranty’ or ‘condition’, unless specifically mentioned at the time of sale.

10 If a Purchaser shall fail to comply with any or all of these conditions any money deposited will be forfeited and any lot which remain uncleared after the times and date specified in the General Remarks will be sold by public auction or private sale, without notice to the Purchaser, and the deficiency (if any) arising upon the resale together with interest thereon (at a rate of 15% per annum) and all costs, charges and expenses incurred shall be due as a debt by the Purchaser in default upon the first sale and be recoverable as for liquidated damages.

11 Accidents – Every person attending the sale shall be deemed to be there at their own risk and neither the Vendor nor Auctioneers will be responsible for any damage to life or limb or property, prior to or during the progress of the sale, or at any time during the removal of lots. Cars are parked entirely at the Owner’s risk.

12 We hope that you do not have cause to complain about the services we provide, however we

are now legally obliged to provide you with the following information: We regard client care

and the standard of service delivered as a top priority. If, however, you do have cause for

concern, please initially contact of one of the Directors, either Jon Pullin or Chris Voyce FLAA.

The complaints handling procedure of the Royal Institution of Chartered Surveyors is

complied with and a copy of the firm’s procedure is available for inspection at any Office.13 These conditions and all transactions shall be governed by and construed in accordance with

English law.
