Most of my work has been associated with environmental permitting for fossil fuel and

biomass fired power plants, specializing in air quality engineering and permitting. I have

provided environmental siting and permitting services for over 40 fossil fuel fired power

projects proposed by electric utilities and independent power producers throughout the

United States. These projects have included more than 20 natural gas fired power plants,

several of which have been combined-cycle or cogeneration power plants in

Massachusetts. I was the environmental project manager for most of these projects.

A copy of my resume is attached hereto as Attachment A.

Please identify any regulatory proceedings in which you have previously testified.

I have appeared as an expert witness before the Massachusetts Energy Facilities Siting

Board ("EFSB") on several occasions. I testified in EFSB 91-101A (Cabot Power

Corporation), and EFSB 99-3 (Nickel Hill Energy). I also have testified before the

Missouri Public Service Commission in EC 95-28 (Empire District Electric Company's

Missouri 2000 Project), and the Vermont Public Service Commission relative to

Certificates of Public Good for the following power plant projects: Bonneville

Springfield Associates, Bonneville Pacific Corporation's Sheldon Springs Gas Plant,

Bonneville Ryegate Associates, and Burlington Electric Company's McNeil Station. I

also have provided environmental testimony to the Rhode Island Energy Facility Siting

Board regarding the Indeck-North Smithfield Combined Cycle Power Plant, and to the

Pennsylvania Environmental Hearing Board in New Jersey DEP v. Commonwealth of

I received my Bachelor of Science degree in Environmental Engineering from Rensselaer

Polytechnic Institute in 1974 and my Master of Engineering in Environmental

Engineering from Rensselaer Polytechnic Institute in 1975. I am a Registered

Professional Engineer in Massachusetts, Maine, New York, and Florida in the discipline

of Environmental Engineering. I have extensive experience in project management and

project engineering for permitting efforts for power generation projects, and project

management of permitting and compliance engineering for a wide range of industrial

facilities.

A copy of my resume is attached hereto as Attachment B.

I have appeared as an expeli witness before the EFSB on a number of occasions. I

testified with respect to proposals to construct generating facilities in EFSB 91-102

On August 3, 2012, Footprint Power filed with the Siting Board a Petition for Approval

to Construct a nominal 630-megawatt ("MW") natural gas-fired, quick-start combined-

cycle generating facility at the Salem Harbor Power Station site in Salem, Massachusetts.

Together, we are responsible for analyzing and evaluating issues peliaining to air quality,

Experience Summary Mr. Kennedy has been an environmental consultant to the energy industry for more than 35 years. I-Ie has extensive experience in conducting air quality impact analyses and air permitting for a variety of energy projects with an emphasis on fossil fuel and biomass fIred power plants. Mr. Kennedy assisted with the Massachusetts Environmental Policy Act process consisting of comprehensive Environmental Impact Reports, the Energy Facility Siting Board process, and other water and waste permits.

Deputy Project Manager, August 2011 - October 2011 Confidential Client, PJM Siting Study for Gas Fired Combined Cycle Plant Provided a siting study for an approximate 1500 to 2250 MW gas fIred combined cycle power plant in the PJM Region. Summarized the electric transmission systems and natural gas distribution systems as well as the siting and permitting processes in four states of interest to the major utility: Ohio, New Jersey, Maryland, and Delaware. The status of the PJM interconnection queue was also summarized for each state. Using extensive GIS mapping tools, potential site regions were identifIed within each state based on proximity to major natural gas transmission lines, electric transmission lines and potential interconnect points, load pockets, and potential signifIcant sources of water including major publicly owned treatment works, POTW s. In the next phase, the project team identifIed and evaluated up to 25 potential specifIc sites, including existing generation and brownfIelds sites, in each state. For these sites, more detailed GIS constraint mapping was performed and the potential benefIts and liabilities of each site were presented.

Island End Cogeneration Plant Project Manager responsible for all environmental permitting services associated with a 350 MW gas­fIred combined cycle power plant in Everett, Massachusetts for Tractebel and Cabot Powcr Corporation. The permitting included Massachusctts Environmental Policy Act (MEPA) environmental impact documents, Energy Facility Siting Board (EFSB) petition materials and tcstimony, and extensive air permitting.

Ontario Hydro, Fossil Division Responsible for an environmental and economic assessment of Ontario Hydro's position relative to current and future environmental regulations in the U.S. and Canada.

Orion Power/Reliant Energy, Ceredo and Grane Creek Stations Mr. Kennedy was the Project Manager for a major siting, feasibility analysis, and permitting project for two 500 MW combined cycle peaking generating stations in West Virginia and Kentucky. Both plants were successfully permitted within nine months. Acceptance and compliance emissions and noise testing were planned and supervised.

GM·Linden Cogeneration Project Mr. Kennedy was the Project Managcr for all environmental permitting of a 20 MW combined cycle cogeneration plant at General Motors Linden, New Jersey SUV Assembly Plant. Approximately 10 environmental permits were obtained on a fast-track schedule. The success of this streamlined permitting process for three Solar combined cycle turbines and a hot water boiler was vety instrumental in allowing this GM plant to remain competitive and therefore not shutdown as had been planned.

Mon Valley Cogeneration Project Mr. Kennedy was the Project Manager responsible for obtaining all environmental permits for an 80-megawatt pulverized coal-fIred cogeneration plant proposed in Southwestern Pennsylvania by CMS Generation Company. The permits included PSD, NPDES, Water Quality Management Part II (Design Engineer's Report), Corps of Engineers/Stream Encroachment, Solid \Vaste Management Module One, and Soil Erosion and Sedimentation Control Plan Approval. \Vetlands and archeological studies were also conducted.

Orion Power/Reliant Energy Avon Lake Plant Retrofit Mr. Kennedy was the Project Manager on a project to assist Orion/Reliant in evaluating the viability of various innovative NO x control strategies for the coal fIred No.9 boiler at the Avon Lake, Ohio Plant. In particular, he led a team providing technical and economic due diligence on SCR or SCR hybrid retrofIts as part of this DOE-sponsored study.

Genetics Institute (now Wyeth Pharmaceuticals) Energy Plant Mr. Kennedy was the Project Manager responsible for preparation of the Non-Major Comprehensive Plan Approval Applications for this 10 MW (two Solar Taurus gas turbine engines) distributed generation and combined heat and power plant at Wyeth's campus in Andover, Massachusetts. Permitting included dispersion modeling, noise analyses, and extensive air pollution control technology analysis.

Confidential Client, Guayanilla, Puerto Rico Mr. Kennedy was the Project Manager responsible for obtaining environmental permits and for preparing a comprehensive environmental impact statement for a 460 MW combustion turbine/ combined cycle power plant.

Scranton Energy Project Mr. Kennedy was the Project Manager for air permitting of a 100 M\V culm-fired fluidized bed cogeneration plant proposed for Scranton, Pennsylvania by Ahlstrom Development Corporation. This project included extensive complex terrain dispersion modeling, on-site meteorological data usage, and assistance with community relations.

Southbridge Distributed Generation Plant Yeseo Power and Southbridge Power & Thermal developed and operate (as Nations Energy) a 7 M\V distributed generation and cogeneration plant at the former American Optical campus in Southbridge, Massachusetts. Mr. Kennedy was the Project Manager responsible for all permitting for this project. Permitting included water quality approvals, noise analysis and extensive air permitting analyses.

Bonneville Pacific Sheldon Springs Cogeneration Project Mr. Kennedy was responsible for the preparation of the PSD permit application for a 55-megawatt gas turbine combined cycle power plant in Sheldon Springs, Vermont. Prepared and delivered testimony at Public Service Commission hearings.

Panther Creek Energy Facility Mr. Kennedy was responsible for air and water permitting of an 80 MW culm-fired fluidized bed power plant located in Nesquehoning, Pennsylvania for Ahlstrom Development Corporation.

Everett Power Project Mr. Kennedy was the Project Manager responsible for all environmental permitting for a proposed 80 megawatt coal-fired, fluidized bed cogeneration project in Everett, Massachusetts. Assessments for draft and final environmental impact reports included air, noise, land use, traffic, aesthetics, ecology, health risks and public safety. Responsibilities also included scoping, application preparation, and regulat01Y negotiation for all environmental permits and approvals including PSD, NPDES, sewer use, and coastal Zone management. He prepared testimony for DPU hearings and managed the site contamination investigations for property transfer. He also prepared a project change notice and new air and water permits after the project was reconfigured to a 90-megawatt gas turbine/combined cycle plant.

Green Mountain Power Peaking Plants Mr. Kennedy managed the preparation of air quality Operating Permits for four oil-fired reciprocating engine and turbine peaking plants in Vermont. Permit renewals and required modifications were subsequendy prepared.

Air Products and Chemicals Cambria Cogen Project He was the Project Manager responsible for PSD permitting for an 80-megawatt coal-waste-fired fluidized bed cogeneration project near Ebensburg, Pennsylvania. The project included fast track siting and field mobilization for a 4-month meteorological and ambient air quality-monitoring program.

Massachusetts Bay Transportation Authority Mr. Kennedy was responsible for a comprehensive environmental impact statement for a 30 MW simple cycle combustion peaking turbine proposed for an industrially Zone site in South Boston. Assessments included air quality, noise, traffic, aesthetics, land use and zoning, and infrastructure.

Central Maine Power Company Coal Gasification Project Mr. Kennedy was responsible for all air quality activities associated with an environmental, economic, and engineering feasibility study for a 600 MW integrated coal gasification combined cycle power plant proposed for Sears Island, Maine.

Boston Generating, Charlestown and Weymouth MA Mr. Lipka is currently Project Manager responsible for environmental support for two power generation facilities in metropolitan Boston, MA. Major project milestones have included a PSD Permit modification for Fore River Station, preparing and certifying an Air Plan ApprovallPSDINSR Application for 1550 MW of new gas turbine combined cycle redevelopment of the Mystic Generating Station in Everett, MA. The four new gas turbine combined cycle generating units are currently in operation. Other activities include preparation of Title V Air Operating Permit Application updates and preparation of Air Plans filings for auxiliary boiler upgrades for Mystic Station, and review of stack testing results and compliance support for Mystic and Fore River Stations.

Malden Mills. Lawrence, MA Mr. Lipka was Project Manager for environmental SUppOlt for the Lawrence MA textile manufacturing facility. Dighton Power Associates, Dighton, MA Mr. Lipka was Project Manager for comprehensive environmental permitting of Energy Management's 170 MW gas turbine combined cycle project in Dighton MA. The project required Air Plans Approval, Massachusetts EFSB Approval , MEPA Approval, and other preconstruction permits. The facility completed construction in the second quarter of 1999 and is presently in operation.

Westchester RESCO Retrofit Pl'Oject, Peel{skill, NY Mr. Lipka was Project Air Quality Engineer responsible for air quality engineering and Professional Engineer' s certification for the retrofit of air pollution control equipment at the 2,250 ton-per-day Charles Point Resource Recovery facility in Peekskill NY. The retrofit project involved the addition of a spray dryer absorber, fabric filter, selective non-catalytic reduction system and carbon injection to each of the three units at the facility.
