TENNESSEE

The U.S. EPA and the U.S. Geological Survey have evaluated the radon potential in the U.S. and have developed this map to assist National, State, and local organizations to target their resources and to assist building code officials in deciding whether radon-resistant features are applicable in new construction. This map is not intended to be used to determine if a home in a given zone should be tested for radon. Homes with elevated levels of radon have been found in all three zones. All homes should be tested regardless of geographic location. The map assigns each of the 3,141 counties in the U.S. to one of three zones based on radon potential. Each zone designation reflects the average short-term radon measurement that can be expected to be measured in a building without the implementation of radon control methods. The radon zone designation of the highest priority is Zone 1.

Purpose The purpose of these guidelines is to help with the understanding of mold basics, the clean up of mold in a safe manner, and if necessary, selecting a remediation plan. These guidelines are intended for residential buildings. The US Environmental Protec-tion Agency (US EPA) has guidance for commercial and school buildings availa-ble at http://www/epa.gov/mold/pdfs/moldremediation.pdf

Definition of Mold Molds are fungi which occur naturally in the environment. Many different species of mold exist. Molds help break down dead materials and convert it back to organic matter which can be used by living organisms.

How Molds Grow Molds grow by digesting and destroying the material they grow on. They can be found almost anywhere and can grow on just about any material as long as conditions are favorable. For favorable growing conditions, mold needs nutrients (oxygen and moisture) and a material to grow on. Molds reproduce by making spores. These spores become air-borne, both outside and inside of buildings. If spores land on suitable material and conditions are favorable, the mold will begin to grow.

Appearance of Mold Molds grow in colonies and growth may take on different shapes and col-ors. Some molds may appear circular in growth while others may grow and spread to cover an area. Molds may appear brown in color. The ap-pearance depends on the species of mold present.

Understanding Molds Even though molds are everywhere, they may become a prob-lem when they begin to grow inside homes and buildings. Many building materials such as drywall, ceiling tiles and wood fram-ing contain cellulose, which is a material on which molds can grow. As molds grow on building materials they may become de-structive. Molds may grow un-noticed, above ceilings, behind walls, in attics and basements or in crawl spaces. Molds can cause staining of walls and ceilings and can begin to break down the studs and joists of buildings causing extensive proper-ty damage. Excessive moisture is an key ingredient which causes molds to grow. Sources of excess moisture may be plumbing leaks, leaking roofs or windows, high humidity, flooding or condensa-tion inside walls due to poor insulation.

Health Concerns It is important to remember, that individuals should consult their physician if they suspect they are experiencing health ef-fects resulting from mold exposure.

Individuals at the highest risk:

Those who have a pre-existing health condition (allergies; lung conditions such as asthma or emphysema)

Infants

The elderly

Molds emit spores and chemicals as part of their normal life cycle and some individuals may exhibit reactions when exposed to these materials. Mold spores are microscopic and, once airborne, can easily be inhaled. Spores may contain allergens that can cause irrita-tion to the nose, throat and respiratory tract.

In addition to allergens, molds may emit microbiological vola-tile organic compounds (MVOC’s). These chemicals usually have a strong and unpleasant odor and are associated with the musty smell that individuals equate to mold being present. These chemicals, when released into the air, can be inhaled, ingested or absorbed through the skin. MVOC’s can act as irri-tants and have been linked to headaches, nausea, dizziness and fatigue.

Assessing Risks There are factors that can be used to assess whether an in-creased health risk may be present.

These factors include:

Evaluating individuals for sensitivity to mold (children, el-derly and those with previously compromised health, are potentially more sensitive)

The extent of mold growth

The condition of mold growth

Identifying Mold Identifying mold in your home should always begin with a thor-ough visual inspection. An inspection can be done by a mainte-nance or management representative or a qualified environ-mental consultant. Excess moisture is always a key ingredient in mold growth. Examine the structure for water leaks and other sources of excess moisture. This is the first area to look for mold growth. Mold grows well on building materials that contain cellulose. Therefore, all building materials that contain cellulose (i.e., ceiling tiles, gypsum board, studs, wood products, etc.) should be inspected closely for signs of mold growth.

Why is a Thorough Visual Inspection and Assessment Necessary? A thorough visual inspection and assessment is the single most important procedure in obtaining information on the presence of a mold problem. A visual inspection and assessment will examine areas that may be impacted by water infiltration/leakage or excessive moisture and identify areas of mold growth.

Correcting a Water Intrusion Problem and Developing a Mold Remediation Plan If a mold problem is identified during the visual inspection, a plan to correct the water/moisture problem (s), along with a plan to clean up the mold, will need to be developed and im-plemented. Information obtained from a visual inspection can be used to help a professional consultant in the following ways:

Identifies the source of moisture so that it can be fixed prior to attempting to eliminate the old problem.

Assists in determining the extent of the mold growth.

If necessary, helps to formulate a mold sampling strategy (see section entitled “When is Mold Sampling/Testing Necessary?” to determine if further tests are advisable or necessary).

Helps in the development of an action plan to abate any mold contamination.

If the water that caused the mold, contained sewage or other hazardous substances, additional steps would be required in or-der to assess, clean and decontaminate the area.

When is Mold Sampling Necessary? Please note: If a visual inspection reveals the presence of mold, ad-ditional testing is not necessary.

Once a mold problem is identified, resources would be better used to correct any moisture problems and clean up mold contamination, ra-ther than for testing. However, if mold is not found during a visual inspection and is still suspected as being present testing may be nec-

essary. The cost of doing the sampling should be considered when deciding whether or not to conduct mold sampling. Test-ing should always be performed by a qualified person. The Local Health Department may be able to assist.

If mold sampling is necessary, samples may be collected from building materials, dust or from the air and will help determine the extent of the mold contamination. Collecting mold samples helps a consultant determine the mold species present concen-trations and if mold is actively growing.

Sampling Plans When sampling is necessary, it needs to be conducted in conjunc-tion with an investigation. This pro-vides as accurate assessment of ex-isting conditions in the building. To accomplish this, a specific plan for sampling should be developed.

The best sampling plans are those which are designed to sample in ar-eas of suspected mold growth and

should include information on why an area is sampled. Typical samples that may be collected by the consultant include: Bulk, Surface, Dust, and Air Samples.

Additional testing may include an evaluation of the relative humidity in the home and taking moisture readings of building materials in suspected areas. Testing of suspected surfaces and bulk samples of building materials may also be performed.

Information Which Should Be Provided as a Result of a Mold Inspection and Assessment The results of the mold inspection and assessment should be clearly communicated in a final report. The final report should have three components: A summary of the inspection that was conducted; a summary of the mold conditions; and a sum-mary of the moisture conditions identified.

Each report component is described below:

Inspection Summary Summarizes the scope of the inspection performed and specifies the areas which were inspected.

Details the techniques which were used to conduct the in-spection and assessment.

Moisture Information Summary Identifies the source(s) of water and/or moisture intrusion.

Specifies actions that need to be taken to correct any wa-ter and/or moisture intrusion problems.

Mold Information Summary Summation of the mold growth identified, including the specific locations, estimated size of the areas impacted and substrates affected by the growth.

The size of the areas affected by mold growth should be categorized into levels. This will help in developing a re-mediation work plan.

Information on other contaminants that could be present.

Corrective Actions If a mold problem is found, steps need to be taken to address such conditions. Remediation is necessary to prevent further property damage and further exposures. Specifics steps have been outlined by the United States Environmental Protection Agency (USEPA) to remediate mold contamination. These include:

Identifying and correcting the source of moisture.

Removing and/or cleaning mold contaminated materials.

Removing the mold and ensuring the area is completely dry before performing any renovation or construction work.

The USEPA also notes that it is important not only to kill the mold but to also clean it up since even dead mold remains al-lergenic. See the references section for information on how to contact the USEPA.

Who Should Clean up Mold? Deciding “who” should perform mold remediation work is not al-ways easy. For small areas affected by mold growth (i.e., less than 10 square feet), building maintenance staff may be capable of performing the work. For larger areas (i.e., greater than 100 square feet), a qualified contractor who has expe-rience in mold or environmental

contamination clean up should be hired. A professional opin-ion should be sought for affected areas that fall between 10 square feet and 100 square feet.

Inspection Services Checklist The Inspection

Get quotes from a few different consultants/contractors.

Develop a contract for the work to be done.

Areas to be inspected for the source of excess moisture.

Areas to be assessed for signs of mold, excess humidity or excess moisture.

Will sampling be done? If so, an explanation of why sampling will be done and a sampling plan should be developed by the consult-ants/contractors.

If mold is found and finances allow, a remediation plan should be developed to repair damage that caused water intrusion, remove damaged items and building materials, remediate mold, and de-termine what pre-contamination levels the remediation contrac-tor should meet for final testing after remediation is complete.

Make sure a thorough visual inspection is conducted before any sampling or remediation is done.

As a result of the visual inspection: Determine the sources of excess moisture and what needs to be done to repair the home and correct the problem.

Determine if sampling/testing needs to be conducted, if it does, what type of sampling, how many samples, cost, etc.

Once inspection, testing and sampling are complete: Ask for the consultant to explain the report and interpret the results.

The consultant should develop a plan to remediate the mold.

Begin the process of hiring a mold remediation company.

Remediation Working with mold can be hazardous, so regardless of who performs the work, work practices that protect the workers as well as the occupants need to be employed.

Workers need to be protected with gloves, a respirator, pro-tective clothing and goggles or some type of eye protection. Also, the work area may need to be contained to prevent the spread of mold to other areas.

Mold Remediation Checklist Get quotes from a few different contractors.

Select a contractor

Develop a contract for the work to be done.

Make sure you are aware of what will be done.

Make sure all porous items (i.e. Carpeting, paper items, upholstered furniture, etc.) that have mold growth should be removed and disposed of.

Remediation of contaminated structural components should be done (the items to be remediated should be specified in the remediation plan which was prepared by the consultant/contractor).

Once mold remediation is complete, further testing should be done to ensure that mold levels within the home are within normal ranges. Speak to your consultant/contractor prior to abatement regarding what levels will be consid-ered safe for re-occupancy.

EXECUTIVE SUMMARY

Partner Engineering and Science, Inc. (Partner) has performed a Phase I Environmental Site Assessment (ESA) in general accordance with the scope of work and limitations of ASTM Standard Practice E1527-05, the Environmental Protection Agency Standards and Practices for All Appropriate Inquiries (AAI) (40 CFR Part 312), the Fannie Mae DUS Guide, and set forth by MMA Financial for the Hampton Ridge Apartments property located at 300 McMeen Circle, within the incorporated City of Columbia, County of Maury, Tennessee (the “subject property”). The Phase I Environmental Site Assessment is designed to provide MMA Financial with an assessment concerning environmental conditions (limited to those issues identified in the report) as they exist at the subject property.

The subject property is located around McMeen Circle, east of Theta Pike, in an area of the City of Columbia, Tennessee that is characterized by single- and multi-family residential land uses. Please refer to the table below for further description of the subject property.

The subject property is known as Hampton Ridge Apartments and is located at 300 McMeen Circle, within the incorporated City of Columbia, County of Maury, Tennessee. The subject property consists of an irregular-shaped parcel of land that totals approximately 12.52 acres. The subject property is currently developed for multi-family residential use with fourteen (14) two-story apartment buildings that contain 140 units and total approximately 146,384 square feet of rentable space. The subject property also includes a one-story clubhouse/ leasing office building, with a fitness center and laundry area, outdoor pool, and uncovered asphalt-paved parking areas,

and landscaped areas. The subject property is designated for multi-family residential development by the City of Columbia and is considered a legal use in its current configuration. Available information indicates that the subject buildings were constructed in 1997. The subject property is currently utilized as a multi-family residential property known as the Hampton Ridge Apartments.

The properties located adjacent to the south and west of the subject property are developed for single and multi-family residential use. The properties located adjacent to the north and east of the subject property consist of undeveloped wooded land areas.

According to historical sources, the subject property was formerly undeveloped and covered with natural vegetation. City directories dated 1991 and 1996 had no listing for the subject roadway (McMeen Circle). Aerial photographs dated 1974 and 1996 depict the subject property as undeveloped land. City directories dated 1999 and 2003 indicate that the subject property has been utilized for multi-family residential purposes since its initial development in 1997. Aerial photographs dated 2006 depict the current multi-family residential buildings on the subject property.

According to information obtained from Maury County, depth to the high groundwater table is anticipated to be greater than 100 feet below ground surface. Based on local topography, groundwater in the general vicinity of the subject property is inferred to flow in a northeasterly direction.

Findings

A recognized environmental condition (REC) refers to the presence or likely presence of any hazardous substance or petroleum product on a property under conditions that indicate an existing release, a past release, or a material threat of a release of any hazardous substances or petroleum products into structures on the property or into the ground, groundwater, or surface water of the property. The term REC includes hazardous substances and petroleum products even under conditions that might be in compliance with laws. The term is not intended to include "de minimis" conditions that do not present a threat to human health and/or the environment and that would not be subject to an enforcement action if brought to the attention of appropriate governmental agencies. The following was identified during the course of this investigation.

An environmental issue refers to environmental concerns identified by Partner that do not qualify as RECs, but warrant discussion.

Five Radon samples revealed analytical results at levels exceeding the EPA Action Level of 4.0pCi/L.

Partner has performed a Phase I Environmental Site Assessment in conformance with the scope and limitations of ASTM Practice E1527-05 of the Hampton Ridge Apartments property located at 300 McMeen Circle, in the City of Columbia, County of Maury, Tennessee (the “subject property”). Any exceptions to or deletions from this practice are described in Section 1.4 of this report.

Based on the presence of radon within multiple samples at levels exceeding the EPA Action Level and the location of the Property within EPA Radon Zone 1, long term testing for Radon for a period of six months is recommended.

1.0 INTRODUCTION

Partner has performed a Phase I Environmental Site Assessment in general conformance with the scope and limitations of ASTM Standard Practice E1527-05 and AAI for the Hampton Ridge Apartments property located at 300 McMeen Circle, the City of Columbia, County of Maury, Tennessee 38401. Any exceptions to, or deletions from, this scope of work are described in the report.

1.1 Purpose

The purpose of this Phase I Environmental Site Assessment (“ESA”) is to identify existing or potential Recognized Environmental Conditions (as defined by ASTM Standard E-1527-05) affecting the subject property that: 1) constitute or result in a material violation or a potential material violation of any applicable environmental law; 2) impose any material constraints on the operation of the subject property or require a material change in the use thereof; 3) require clean-up, remedial action or other response with respect to Hazardous Substances or Petroleum Products on or affecting the subject property under any applicable environmental law; 4) may affect the value of the subject property, and; 5) may require specific actions to be performed with regard to such conditions and circumstances. The information contained in the ESA Report will be used by Client to: 1) evaluate its legal and financial liabilities for transactions related to foreclosure, purchase, sale, loan origination, loan workout or seller financing, 2) evaluate the subject property’s overall development potential, the associated market value and the impact of applicable laws that restrict financial and other types of assistance for the future development of the subject property, and/or; 3) determine whether specific actions are required to be performed prior to the foreclosure, purchase, sale, loan origination, loan workout or seller financing of the subject property.

This ESA was performed to permit the User to satisfy one of the requirements to qualify for the innocent landowner, contiguous property owner, or bona fide prospective purchaser limitations on scope of Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) (42 U.S.C. §9601) liability (hereinafter, the “landowner liability protections,” or “LLPs”). ASTM Standard E-1527-05 constitutes “all appropriate inquiry into the previous ownership and uses of the property consistent with good commercial or customary practice” as defined at 42 U.S.C. §9601(35)(B).

1.2 Scope of Work

The scope of work for this ESA is in general accordance with the requirements of ASTM Standard E 1527-05. This assessment included: 1) a property and adjacent site reconnaissance; 2) interviews with key personnel; 3) a review of historical sources; 4) a review of regulatory agency records; and 5) a review of a regulatory database report provided by a third-party vendor.

1.3 Limitations

Partner warrants that the findings and conclusions contained herein were accomplished in accordance with the methodologies set forth in the Scope of Work. These methodologies are described as representing good commercial and customary practice for conducting an ESA of a property for the purpose of identifying recognized environmental conditions. There is a possibility that even with the proper application of these methodologies there may exist on the subject property conditions that could not be identified within the scope of the assessment or which were not reasonably identifiable from the available information. Partner believes that the information obtained from the record review and the interviews concerning the subject property is reliable. However, Partner cannot and does not warrant or guarantee that the information provided by these other sources is accurate or complete. The conclusions and findings set forth in this report are strictly limited in time and scope to the date of the evaluations. The conclusions presented in the report are based solely on the services described therein, and not on scientific tasks or procedures beyond the scope of agreed-upon services or the time and budgeting restraints imposed by the Client. No other warranties are implied or expressed.

Some of the information provided in this report is based upon personal interviews, and research of available documents, records, and maps held by the appropriate government and private agencies. This report is subject to the limitations of historical documentation, availability, and accuracy of pertinent records, and the personal recollections of those persons contacted.

This practice does not address requirements of any state or local laws or of any federal laws other than the all appropriate inquiry provisions of the LLPs. Further, this report does not intend to address all of the safety concerns, if any, associated with the subject property.

Environmental concerns, which are beyond the scope of a Phase I ESA as defined by ASTM include the following: asbestos-containing materials, lead-based paint, radon, and lead in drinking water. These issues may affect environmental risk at the subject property and may warrant discussion and/or assessment; however, are considered non-scope issues. If specifically requested by the Client, these non-scope issues are discussed in Section 6.3.

1.4 User Reliance

MMA Financial, its employees, agents, successors and assigns may rely upon this report in evaluating a request for an extension of credit to be secured by the property (the "Mortgage Loan"). This report may also be used and relied upon by any actual or prospective purchaser, transferee, assignee, or servicer of the Mortgage Loan (or any portion thereof), any actual or prospective investor (including agent or advisor) in any securities evidencing a beneficial interest in or backed by the Mortgage Loan (or any portion thereof), any rating agency actually or prospectively rating any such securities, any indenture trustee, and any institutional provider(s) from time to time of any liquidity facility or credit support for such financing. 1.5 Limiting Conditions

The findings and conclusions contain all of the limitations inherent in these methodologies that are referred to in ASTM E1527-05.

Specific limitations and exceptions to this ESA are more specifically set forth below.

Partner requested information relative to deed restrictions and environmental liens, a title search, and completion of a pre-survey questionnaire from the Report User. This information was not provided at the time of the assessment.

Partner was not able to document the historical use of the subject property prior to 1974, since city directories had no listings for the site roadway prior to 1997, aerial photographs prior to 1974 were not reasonably ascertainable from local agencies and other historical sources such as Sanborn fire insurance maps or topographic maps did not provide coverage of the subject property. This data failure is not considered critical and does not change the conclusions of this report, as the 1974 and 1996 aerial photographs revealed the subject property to be undeveloped land. In addition, the adjacent and surrounding areas are also shown mostly as undeveloped land or land with small residential development to the east and south of the subject property.

The performance of this Phase I ESA was not limited in any other way. Partner was granted full and complete access to the subject property.

2.0 SITE DESCRIPTION

2.1 Site Location and Legal Description

The address of the subject property is 300 McMeen Circle, Columbia, Tennessee 38401. The subject property is located around McMeen Circle, east of Theta Pike, in an area of the City of Columbia, Tennessee that is characterized by single- and multi-family residential land uses. Please refer to the table below for further description of the subject property.

According to the Maury County Assessor, the subject property is identified as Real Property Map 075 Control Map 075 Parcel 044.02

According to the Maury County Assessor, ownership of the subject property is currently vested in Great Atlantic Management Company.

2.2 General Property Description

The subject property is known as Hampton Ridge Apartments and is located at 300 McMeen Circle, within the incorporated City of Columbia, County of Maury, Tennessee. The subject property consists of an irregular-shaped parcel of land that totals approximately 12.52 acres. The subject property is currently developed for multi-family residential use with fourteen (14) two-story apartment buildings that contain 140 units and total approximately 146,384 square feet of rentable space. The subject property also includes a one-story clubhouse/ leasing office building, with a fitness center and laundry area, outdoor pool, and uncovered asphalt-paved parking areas, and landscaped areas.

The subject buildings are rectangular structures that are oriented in various directions throughout the subject property. The subject buildings are of wood-frame construction with reinforced concrete foundations. The three-story building include common, open breezeways and entrances, while the two-story units include walkup, ground level entrances along the building front elevations. The building exteriors are finished with horizontal lap vinyl siding with areas of brick veneer, painted wood or vinyl trim. The roofs of the subject buildings are pitched and covered with composition roofing materials. The apartment entry doors are insulated metal doors in painted wood frames. Interior doors are hollow core wood in wood frames. Windows throughout the development are single-paned and aluminum-framed. The interior walls and ceilings are comprised of textured material and painted wallboard/drywall. Floors are covered with resilient flooring materials and carpet.

Vehicular access to the subject property is provided from Theta Pike by means of a paved roadway extending to the eastern perimeter of the subject property. McMeen Circle traverses the property in a circular pattern with buildings fronting along the roadway. The subject property provides asphalt-paved parking for approximately 223 automobiles, based on a physical count conducted at the time of the assessment. Landscaped areas are provided along the perimeters of the subject property and between the subject buildings; curbs are of raised concrete construction. Wheel stops on the subject property, where provided, are constructed of six-inch raised concrete curbs.

Columbia Power System provides electricity to the subject property. Natural gas is not provided to the subject property. The City of Columbia provides utilities to the subject property for sanitary sewer and domestic drinking water. Storm water is managed by a series of on-site storm drains that are interconnected and attached to a storm water system maintained by the City of Columbia. Sanitary wastewater discharged from the subject property is treated by the City of Columbia. Solid waste is disposed of by an independent solid waste disposal contractor.

Interior appliances provided in each apartment unit at the subject property consist of refrigerator, electric range and range vent hood, dishwasher, and garbage disposal. The mechanical system at the subject property is comprised of a split system for each apartment unit with one central unit and an exterior pad-mounted condenser located outside of each apartment unit. Hot water is supplied to each apartment unit by a 30-gallon electric water heater. Electrical service is 120/240 volt, single-phase service and appears to be adequate for the subject buildings and their current electrical loads. Electrical distribution wiring was reported and observed to be copper..

Fire suppression and life safety systems are provided as required by the City of Columbia Fire Department and the code in place at the time the subject buildings were constructed. The subject buildings are equipped with a hydraulically designed automatic fire sprinkler system. The sprinkler system is connected to a fire alarm panel that has communication abilities and is monitored by an outside contractor. The automatic fire suppression sprinkler system was last inspected by Bohn & Bohn Fire Protection in February 2008. Fire extinguishers and smoke detectors are provided throughout the subject buildings as required. The fire extinguishers throughout the common areas are maintained annually and were last inspected by ACME Fire & Safety in October 2008

2.3 Current Property Use

The subject property is designated for multi-family residential development by the City of Columbia and is considered a legal use in its current configuration. Available information indicates that the subject buildings were constructed in 1997. The subject property is currently utilized as a multi-family residential property known as the Hampton Ridge Apartments.

2.4 Current Use of Adjoining Properties

The subject property is located in an area of the City of Columbia, Tennessee that is characterized by residential and recreational land uses. Partner observed the following land uses on properties located in the immediate vicinity of the subject property at the time of the assessment.

North The property located adjacent to the north of the subject property consists of undeveloped, wooded lands.

South The property located to the south of the subject property is occupied by multi-family residential properties.

East The property located adjacent to the east of the subject property is occupied by a single-family residential property and open field areas followed by several small (fourplex) multi-family residential units.

West The property located adjacent to the north of the subject property consists of undeveloped, wooded lands.

None of the adjacent properties are listed in the regulatory database. Off-site properties within the search radii prescribed by ASTM E1527-05 are discussed in Section 4.2.

2.5 Physical Setting Sources

2.5.1 Topography

The United States Geological Survey (USGS) Godwin, Tennessee Quadrangle 7.5-Minute series topographic map was reviewed for this assessment. This map was published by the USGS in 1990. According to the contour lines on the topographic map, the subject property is located at approximately elevation range of 640 to 680 feet above mean sea level (MSL). The subject property is located along a ridgeline and west slope in an area of rolling hills. The contour lines in the area of the subject property indicate the area moderately slopes to the west. No structures are depicted on the subject property. Rutherford Creek is located approximately one-half of a mile to the west of the subject property. No significant surface features are depicted on or adjacent to the subject property. The topographic map is provided as Figure 3 of this report.

2.5.2 Hydrology

The site is located within the Valley and Ridge Aquifers in the Appalachian Highlands Province. These aquifers mostly consist of carbonate rock type aquifers. The nearest surface water in the vicinity of the Property is Rutherford Creek located approximately 1/2 mile west of the Property. No settling ponds, lagoons, surface impoundments, wetlands or natural catch basins were observed at the Property during this investigation.

Information specific to the subject property regarding the depth to groundwater and direction of groundwater flow was not available for the subject area. However, according to information obtained from Maury County, depth to the high water table is anticipated to be in excess of 100 feet below surface level. Based on local topography, groundwater in the general area is inferred to flow in a westerly direction toward….

2.5.3 Soils/Geology

Based on the soil survey maps published by the USDA Soil Conservation Service (1978) for Masaury County, Tennessee, the Property is mapped as Maury silt loam. These soils are described as well drained, strongly acidic soils on the hillsides of the Central Basin. Slope and slowly permeable subsoils (sticky plastic clay) cause rapid runoff and erosion hazard. The estimated depth to bedrock at the Property is approximately 5 to 8 feet below the ground surface.

The Property is situated within the Tennessee Section of the Valley and Ridge Province of the Appalachian Highlands. This province is comprised of unconsolidated, coarse-grained deposits of Quaternary age (primarily of glacial origin) compose principal aquifers that cover the Paleozoic rocks throughout most of the Appalachian Highlands Physiographic Province.

2.4.4 Flood Zone Information

Partner performed a review of the Flood Insurance Rate Map, published by the Federal Emergency Management Agency. According to Community Panel Number 475423 0170E, dated April 6, 2007, the subject property appears to be located in Zone X, an area located outside of the 100-year and 500-year flood plains.

3.2 Sanborn Fire Insurance Maps

Sanborn maps were originally created in the late 1800s and early 1900s for assessing fire insurance liability in urbanized areas of the United States. These maps include detailed town and building information.

Partner searched for Sanborn fire insurance maps at the Maury County Public Library in Columbia, Tennessee. No historic map coverage was found for the subject property or vicinity at the time of the assessment.

Partner requested Sanborn fire insurance maps from Environmental Data Resources, Inc. No Sanborn fire insurance maps were available at the time of the assessment. A statement from FirstSearch is included in Appendix D-3.

3.3 City Directories

City directories have been produced for most urban and some rural areas since the late 1800s. The directories are generally not comprehensive and may contain gaps in time periods.

Partner contacted local agencies, such as environmental health departments, fire departments and building departments in order to determine any current and/or historic hazardous materials usage, storage and/or releases of hazardous substances on the subject property. Additionally, Partner researched information on the presence of activity and use limitations (AULs) at these agencies. As defined by ASTM E1527-05, AULs are the legal or physical restrictions or limitations on the use of, or access to, a site or facility: 1) to reduce or eliminate potential exposure to hazardous substances or petroleum products in the soil or groundwater on the subject property; or 2) to prevent activities that could interfere with the effectiveness of a response action, in order to ensure maintenance of a condition of no significant risk to public health or the environment. These legal or physical restrictions, which may include institutional and/or engineering controls (IC/ECs), are intended to prevent adverse impacts to individuals or populations that may be exposed to hazardous substances and petroleum products in the soil or groundwater on the property.

4.1.1 Health Department

Partner requested records for the subject property from the Maury County Public Health and Environmental Services Department. These records may contain evidence indicating current and/or historical hazardous materials usage, storage or releases as well as the presence of underground storage tanks.

No records regarding hazardous materials use or the presence of AULs on the subject property were found on file with the County of Maury at the time of the assessment.

4.1.2 Fire Department

4.2 Mapped Database Records Search

Information from standard federal, state, county, and city environmental record sources was provided by Environmental Data Resources, Inc. Data from governmental agency lists are updated and integrated into one database, which is updated as these data are released. The information contained in this report was compiled from publicly available sources and the locations of the sites are plotted utilizing a geographic information system, which geocodes the site addresses. The accuracy of the geocoded locations is approximately +/-300 feet. Please refer to the radius map for a complete listing (Appendix E).

In some cases, location information supplied by the regulatory agencies is insufficient to allow the database companies to geocode facility locations. These facilities are listed under the non geocoded section within the EDR report.

In order to qualify for one of the Landowner Liability Protections (LLPs) offered by the Small Business Liability Relief and Brownfields Revitalization Act of 2001 (the Brownfields Amendments), the user must provide the following information (if available) to the environmental professional. 6.0 SITE RECONNAISSANCE

The subject property was inspected by Don W. Davidson on December 4, 2008. The weather at the time of the site visit was overcast with rain and in the 30s (degrees Fahrenheit). The Property Manager was identified as Ms. Susan Rathbun, 931-380-5262. The Maintenance Supervisor was not onsite at the time of the site inspection. Ms. Rathbun accompanied Partner during field reconnaissance activities and provided information pertaining to the current operations and maintenance of the subject property.

All areas of the subject property were accessible at the time of the site inspection. There were no physical or visual obstructions of the subject property. Partner inspected 100% of the exterior areas of the subject property, 100% of the common areas at the subject property, and over 10% of the apartment units at the subject property as listed below.

The subject property is currently occupied by multi-family residential buildings. No potential environmental concerns were identified during the onsite reconnaissance. Non-ASTM issues are discussed in Section 6.3.

6.1 General Site Characteristics

6.1.1 Solid Waste Disposal

Solid waste generated at the subject property is disposed of in commercial solid waste dumpsters located throughout the subject property. An independent solid waste disposal contractor removes solid waste from the subject property. According to Property personnel, only household trash is collected in the on-site solid waste dumpsters.

6.1.2 Sewage Discharge and Disposal

Sanitary discharges are discharged from the subject property into the municipal sanitary sewer system. The Columbia Water System services the subject area. No wastewater treatment facilities or septic systems are located on the subject property.

6.1.3 Surface Water Drainage

Storm water is removed from the subject property primarily by sheet flow action across the paved surfaces towards storm water drains located throughout the subject property and in the public right of way. Site storm water from the roofs of the subject buildings, landscaped areas, and paved areas is directed to on-site concrete swales, which drain to the public right of way, and to on-site storm water drains. The subject property is connected to a municipal owned and maintained sewer system.

The subject property does not appear to be a designated wetland area, based on information obtained from the United States Department of Agriculture; however, a comprehensive wetlands survey would be required in order to formally determine actual wetlands on the subject property. Partner did not observe any surface impoundments, wetlands, natural catch basins, settling ponds, or lagoons on the subject property. Partner did not observe any drywells on the subject property.

6.1.4 Source of Heating and Cooling

Heating and cooling systems as well as domestic hot water equipment are fueled by electricity and natural gas provided by Columbia Power System. The mechanical system within the apartment units is comprised of a split system with a central unit and interior air-handler located within each apartment unit and an exterior condenser located outside of each apartment. Hot water is provided by central natural gas boiler units.

6.1.5 Wells and Cisterns

No aboveground evidence of wells or cisterns was observed during the site reconnaissance.

Domestic wastewater generated at the subject property is disposed by means of the municipal sanitary sewer system. No industrial process is currently performed at the subject property.

6.1.7 Septic Systems

No septic systems were observed or reported on the subject property.

6.1.8 Additional Site Observations

No additional relevant general site characteristics were observed on the subject property at the time of the assessment.

6.2 Potential Environmental Hazards

6.2.1 Hazardous Materials and Petroleum Products Used or Stored at the Site

No hazardous materials or petroleum products were observed on the subject property. No evidence of the use of reportable quantities of hazardous materials or wastes was observed on the subject property. Small quantities of general maintenance supplies and pool maintenance supplies were found to be properly labeled and stored at the time of the assessment with no signs of leaks, stains, or spills. The storage and use of maintenance supplies does not appear to pose a significant threat to the environmental integrity of the subject property at this time.

6.2.2 Aboveground & Underground Hazardous Substance or Petroleum Product Storage Tanks (ASTs/USTs)

No evidence of ASTs or USTs was observed on the subject property at the time of the assessment.

6.2.3 Evidence of Releases

No spills, stains, or other indications that a surficial release has occurred at the subject property were observed or reported at the time of the assessment.

6.2.4 Polychlorinated Biphenyls (PCBs)

Older transformers and other electrical equipment could contain polychlorinated biphenyls (PCBs) at a level that subjects them to regulation by the U.S. EPA. PCBs in electrical equipment are controlled by United States Environmental Protection Agency regulations 40 CFR, Part 761. Under the regulations, there are three categories into which electrical equipment can be classified:

Greater than 500 ppm – “PCB-Containing”

The manufacture, process, or distribution in commerce or use of any PCB in any manner other than in a totally enclosed manner was prohibited after January 1, 1977.

The on-site reconnaissance addressed indoor and outdoor transformers that may contain PCBs. Partner observed pad-mounted electrical distribution transformers located throughout the subject property.

The units were not labeled as to their PCB status or ownership. No indication of staining, leaks, or fire damage was observed on or around the base of these units. Partner contacted a customer service representative of Columbia Power System (telephone conversation of December 8, 2008), who confirmed that Columbia Power System maintains ownership and operational responsibility for the transformers and that the units do not contain PCBs.

No elevators, capacitors, or other suspect equipment were observed on the subject property. Partner observed fluorescent light fixtures located throughout the subject buildings. Fluorescent fixtures, if manufactured prior to 1978, may contain PCBs; however, based on the construction date of the subject buildings, it is unlikely that the fixtures contain this material.

No other potential PCB-containing equipment (interior transformers, oil-filled switches, hoists, lifts, dock levelers, hydraulic elevators, etc.) was observed on the subject property during field reconnaissance activities.

6.2.5 Strong, Pungent or Noxious Odors

No strong, pungent, or noxious odors were evident during the site reconnaissance.

6.2.6 Pools of Liquid

No pools of liquid were observed on the subject property at the time of the assessment.

6.2.7 Drains, Sumps and Clarifiers

No drains, sumps, or clarifiers, other than those associated with storm water removal, were observed on the subject property at the time of the assessment.

No radiological substances or equipment was observed or reported stored on the subject property at the time of the assessment.

No additional potential environmental hazards were observed.

6.3 Non-ASTM Services

6.3.1 Asbestos-Containing Materials (ACMs)

Asbestos is the name given to a number of naturally occurring, fibrous silicate minerals mined for their useful properties such as thermal insulation, chemical and thermal stability, and high tensile strength. Asbestos is commonly used as an acoustic insulator, thermal insulation, fire proofing and in other building materials. Exposure to airborne friable asbestos may result in a potential health risk because persons breathing the air may breathe in asbestos fibers. Continued exposure can increase the amount of fibers that remain in the lung. Fibers embedded in lung tissue over time may cause serious lung diseases including: asbestosis, lung cancer, or mesothelioma.

The subject buildings were constructed in 1997. As such, an asbestos evaluation was not required by the scope of services; however, please refer to the table below for observed materials that would be considered suspect ACMs in the event of a thorough survey.

6.3.2 Lead-Based Paint

Lead is a highly toxic metal that affects virtually every system of the body. While adults can suffer from excessive lead exposures, the groups most at risk are fetuses, infants and children under 6. Congress passed the Residential Lead-Based Paint Hazard Reduction Act of 1992, also known as Title X, to protect families from exposure to lead from paint, dust, and soil. Section 1018 of this law directed the Housing and Urban Development (HUD) and EPA to require the disclosure of known information on lead-based paint and lead-based paint hazards before the sale or lease of most housing built before 1978. Sellers, landlords, and their agents are responsible for providing this information to the buyer or renter before sale or lease.

According to Section 1017 of Title X, “lead-based paint hazard is any condition that causes exposure to lead from lead-contaminated dust; bare, lead-contaminated soil; or lead-based paint that is deteriorated or intact lead-based paint present on accessible surfaces, friction surfaces, or impact surfaces that would result in adverse human health effects.” Therefore, under Title X intact lead-based paint on most walls and ceilings is not considered a “hazard,” although the

condition of the paint should be monitored and maintained to ensure that it does not become deteriorated. Lead-based paint is defined as any paint, varnish, stain, or other applied coating that has 1 mg/cm2 (or 5,000 ug/g by weight) or more of lead.

Based on the construction date of the subject buildings (1997), it is unlikely that lead-based paint is present at the subject property. Furthermore, Partner observed painted surfaces throughout the subject property to be in good condition at the time of the assessment with no signs of peeling, flaking, or chipping.

6.3.3 Radon

Radon is a colorless, odorless, naturally occurring, radioactive, inert, gaseous element formed by radioactive decay of radium (Ra) atoms. The US EPA has prepared a map to assist National, State, and local organizations to target their resources and to implement radon-resistant building codes. The map divides the country into three Radon Zones, Zone 1 being those areas with the average predicted indoor radon concentration in residential dwellings exceeding the EPA Action limit of 4.0 picoCuries per Liter (pCi/L). It is important to note that the EPA has found homes with elevated levels of radon in all three zones, and the EPA recommends site specific testing in order to determine radon levels at a specific location. However, the map does give a valuable indication of the propensity of radon gas accumulation in structures.

Review of the EPA Map of Radon Zones places the subject property in Zone 1, where average predicted radon levels are greater than 4.0 pCi/L.

In accordance with Fannie Mae guidelines, Partner facilitated sampling at the subject property in order to ascertain general levels of radon concentrations at the subject property. Sampling activities were commenced by Don W. Davidson on December 4, 2008 and completed by on-site personnel on December 6, 2008. A total of ten (10) charcoal canisters were placed throughout the subject buildings and subsequently retrieved and forwarded to AccuStar Laboratories for radon analysis.

6.3.4 Lead in Drinking Water

According to available information, a public water system operated by the Columbia Water System serves the subject vicinity. According to a representative of the Columbia Water System, shallow groundwater directly beneath the subject property is not utilized for domestic purposes. The sources of public water for the Columbia Water System are surface water from the Duck River. According to the City of Columbia and the 2007 Annual Water Quality Report, water supplied to the subject property is in compliance with all state and federal regulations pertaining to drinking water standards, including lead and copper.

6.3.5 Mold

Molds are microscopic organisms found virtually everywhere, indoors and outdoors. Mold will grow and multiply under the right conditions, needing only sufficient moisture (e.g., in the form of very high humidity, condensation, or water from a leaking pipe, etc.) and organic material (e.g., ceiling tile, drywall, paper, or natural fiber carpet padding). Mold growths often appear as discoloration, staining, or fuzzy growth on building materials or furnishings and are varied colors of white, gray, brow, black, yellow, and green. In large quantities, molds can cause allergic symptoms when inhaled or through the toxins the molds emit.

Partner observed accessible, interior areas for the subject buildings for significant evidence of mold growth; however, this ESA should not be used as a mold survey or inspection. Additionally, this inspection was not designed to assess all areas of potential mold growth that may be affected by mold growth on the subject site. Rather, it is intended to give the client an indication as to whether or not conspicuous (based on observed areas) mold growth is present at the subject property. This evaluation did not include a review of pipe chases, mechanical systems, or areas behind enclosed walls and ceilings.

During the unit observations, numerous units were observed with areas of mold accumulation around interior edges of the window units. The mold accumulation appeared to be caused by water condensation along the window edge and casing surfaces. According to the property manager, tenants are responsible for periodic cleaning or window surfaces and adjacent areas. This is reportedly a common occurrence and tenants are notified in writing about necessary cleaning practices to prevent mold accumulation.

6.4 Adjacent Property Reconnaissance

The adjacent property reconnaissance consisted of observation of the adjacent properties from the subject property premises. No items of environmental concern were identified on any of the adjacent properties during the site inspection, including hazardous materials, petroleum products, ASTs, USTs, evidence of releases, PCBs, strong or noxious odors, pools of liquids, sumps or clarifiers, pits or lagoons, stressed vegetation, or any other potential environmental hazards. The properties located adjacent to the north, south, and west are occupied by undeveloped wooded lands or residential properties.

7.0 FINDINGS AND CONCLUSIONS

Findings

A recognized environmental condition (REC) refers to the presence or likely presence of any hazardous substance or petroleum product on a property under conditions that indicate an existing release, a past release, or a material threat of a release of any hazardous substances or petroleum products into structures on the property or into the ground, groundwater, or surface water of the property. The term REC includes hazardous substances and petroleum products even under conditions that might be in compliance with laws. The term is not intended to include "de minimis" conditions that do not present a threat to human health and/or the environment and that would not be subject to an enforcement action if brought to the attention of appropriate governmental agencies. The following was identified during the course of this investigation.

Partner has performed a Phase I Environmental Site Assessment in conformance with the scope and limitations of ASTM Practice E1527-05 of the Hampton Ridge Apartments property located at 300 McMeen Circle, in the City of Columbia, County of Maury, Tennessee (the “subject property”). Any exceptions to or deletions from this practice are described in Section 1.4 of this report.
