explicit for information of our all members.

"It is my pleasure to apprise my other

comrades/members of our beloved Association

about those stalwarts who founded this

Pensioner's Association about 30 years back.

There were many prominent leaders who served

this Association but few of our prominent leaders

served this Association with much endeavour,

untiring, selfless, devotion and their sacrifices.

They should ever be remembered by all of us,

among those are our former General Secretaries

of the Chandigarh Circle Pensioners Association.

Sh. M.M. Singh and Sh. N.S. Dhamoon were

very dutiful and learned persons, who have

since expired. Sh. Jai Ram Gupta, our previous

appreciate the sincere efforts, endeavors of Hon'ble

Editor of the Circle Pensioners Mail i.e. Sh. T.R.

Gupta, our existing General Secretary and his

advisory Board in linking the generation and

releasing the SBI Pensioners' Mail, our monthly

magazine, blow life in it and inculcate the latest

developments/information, help, guidance and

other welfare matters taken by our Federation with

the management, which relates to our members

cause. It also covers the activities done by the

different centres (units) and most important thing

is that it provides the latest information regarding

our court case. The pensioners are very curious

to know the developments on various dates at its

Delhi High Court. All the credit goes to the Editor

and its advisory board.

On the appeal of the General Secretary,

on behalf of the Federation, who has requested

to donate Rs.100/- per member and we have

donated Rs.3700/- towards Legal Fund account

as requested in the pensioners mail.

We have also sorted out many small to big

issues of those retirees, whose cases were

pending from their working days. It has benefitted

to few of our members to the tune of few

thousands of rupees on our taking the matter with

the managements at the RBO level and zonal

office level. I am thankful to Sh. T.R. Gupta, our

General Secretary, who from time to time share

his views with us which gives us moral support.

Widow, not dead man’s mom, will get pension: SCTIMES OF INDIA - 30th Sep 2016

Deciding a long and bitter ‘saas-bahu’ fight over a dead man’spension, the Supreme Court stood behind the daughter-in-law and ruledthat a widow alone was entitled to pension after death of an employeeand not his mother.

A bench of Justices A,R, Dave and L. Nageshwar Rao faced atricky question while deciding this dispute between the mother and wifeof deceased Haryana government employee Yash Pal. while the widowlaid claim to her late husband’s pension, the mother cited the HinduSuccession Act to stake her claim.

Writing the judgment for the bench, Justice Dave said so far asprovisions of Hindu Succession Act, 1956 were concerned, theproperties of a Hindu who dies intestate (without writing a wilt) wouldfirst of all go to persons categorised as class-l heirs.

“Therefore, so far as the properties of late Yash Pal are concerned, they would be divided among the mother and widow, provided no otherfamily member of Yash Pal “is alive who would fall within class-l heirs,”Justice Dave said.

But the position on pension was different, the SC said. Citing anearlier judgment, the court said family pension did not form part of thedeceased employee’s property to be divided among his family memberscategorised as class-l heirs.

“Even the employee has no right to dispose of family pension “inhis will by giving direction that someone other than the one entitled to itshould be given the same,” the bench said and set aside Punjab andHaryana High

Court’s order entitling the mother to 50% of family pension. Onthe fight between the daughter-in-law and the mother-in-law over YashPal’s pension, the bench said, “Under the family pension scheme, widowis the only family member entitled to the pension and, therefore, themother of the deceased would not get any right in the pension, of course,it cannot be disputed that “if there are other assets left by late Yash Pal,his mother would get 50% share, if he had not prepared any Will and itappears that late Yash Pal had died intestate and no Will had beenexecuted by him.”
