TERMS AND CONDITIONS:Buyer Acknowledges: -.

That before Buyer signed this contract, Seller submitted the contract to the Buyer with all applicable spaces completed,and Buyer had a reasonable opportunity to examine it and accept as legible, executed and completed copy thereof wasdelivered to Buyer. Buyer has held and understands this contract and agrees to the terms and conditions as set forth herein.

This proposal when accepted by Mid-Atlantic Deck & Fence Co., Inc. becomes a contract between two parties.This contract embodies the entire understanding between the parties as there are no verbal agreements or additionalrepresentations in connection therewith.

All materials remain the property of Mid-Atlantic Deck & Fence Co., Inc. until payment of this contract is made in full andany recovery costs including the reasonable cost ofattomey's fees or collection fees incurred by Mid-Atlantic Deck & FenceCo., Inc. Will be borne by the customer in the event an attorney or collection service is needed to collect the balance duefrom customer at a rate of 25% of the outstanding balance due together with all costs of service including private processservice. In the event that this contract is turned over to attorneys for collection the Buyer agrees to have all court casesheard at District Court in Anne Arundel County, Maryland. .

Warranty is honored only. if contract is paid in full.In case payment is not made as specified in (TERMS OF PAYMENT) the Company reserves the right to repossess all

materials used on this job without recourse. Finance charges will be added at 1.8% per month of the uncollected balance.The parties hereto specifically agree that the Seller retains a security interest in the materials until such time as paid in full.

The Buyer is responsible for advising contractor of any obstruction underground such as pipes, sprinklersystems, cables, septic tanks, drain field, etc. and will pay damages to same If not properly Identified. Mid-AtlanticDeck & Fence Co., Inc. is responsible for calling Miss Utility to mark public lines prior to commencement of work.

The Buyer is responsible for obtaining all Homeowner Association approvals unless otherwise stated on thiscontract. Please advise Mid-Atlantic of H.O.A. status.

Mid-Atlantic Deck & Fence Co., Inc. cannot be held responsible for unavoidable delays such as weather, soil conditions,seasonal business conditions, late shipments of materials, or any other conditions beyond Seller's direct control. However,all efforts will be made to complete your project on time.

The contracted price only includes items stated herein described in this agreement. Any additional work requestedby the Buyer shall be charged in addition to original contract price. Mid-Atlantic Deck & Fence Co., Inc. shall provideBuyer the Additional Work Change Order and the cost of additional work prior to the commencement of any additionalwork. Any modifications to the original agreement which change the cost, material or work to be performed must be inwriting and signed by Mid-Atlantic Deck & Fence Co., Inc. and the Buyer. Any additional work will be paid in full prior to thecommencement of the additional work order.

Mid-Atlantic Deck & Fence Co., Inc. shall be governed by the laws of the State of Maryland and parties consent tojurisdiction being in Anne Arundel County, Maryland. In the event of final punch list items to be performed by Mid-AtlanticDeck & Fence Co., Inc. hereunder, Buyer may withhold no more than 10% of the unpaid contract price until such time asMid-Atlantic Deck & Fence Co., Inc. shall correct the final punch list item(s).

Completed fence projects might require re-measurements of the fence lines and gate openings, and will be done oncompletion as any overages or underages will be debited or credited accordingly.

Fencing will be placed as near as possible to the property lines in accordance with the Buyer's instructions. We do notassume any responsibility for any infraction whatsoever of property lines, disputes or accuracy. If you do not know the exact

. locations of your property, it is advisable to have your lot surveyed and marked prior to the start of work. At your request wewill have a survey completed for you, for an additional and separate fee.

Please be aware that your project is a construction site, therefore disturbance created by the project to grass, trees,shrubs, and other landscaping adjacent to project could possibly occur. Buyer agrees to indemnify and hold Mid-AtlanticDeck & Fence Co., Inc. harmless for damages to the above stated disturbance issues. Sodding or seeding is not includedin this contract. All spoils left over from the installation of your new fence will be left on the job site, If the spoils are to beremoved from the job site there will be an additional charge for this service unless otherwise noted on the front of thiscontract. .

Insurance is carried by this company to cover the workmen and equipment. We recommend that all children orunauthorized personnel be kept away from the job site to avoid unnecessary injury. We.do not assume liability for injuryoccurring to any unauthorized person on the job site at any time during the construction process. . .

The Buyer may cancel this transaction at any time prior to midnight of the third business day after the date of thistransaction, in writing and/or faxed/delivered to Mid-Atlantic Deck & Fence Co., Inc. 's office. Cancellations after the thirdbusiness day will be subject to 20% of original contract to cover administrative costs. Deposits will be returned and allrecourse released in accordance with Maryland State Law.

Mid-Atlantic Deck & Fence Co., Inc. shall have the right at any time prior to actually starting constructiori work, tocancel this contract and return any deposit monies, with both parties thereupon being fully released from each other, upontwo (2) days written notice to Buyer.

LIMITED WARRANTY:Mid-Atlantic Deck and Fence Co., Inc. warrants workmanship for this project to the original buyer that the workmanship

and labor will be free from defects as long as the original buyer owns their deck/fence. Gates are covered under this.warranty for one (1).year from the date of completion of installation.

All pressure treated southern yellow pine lumber carries a limited lifetime guarantee against rot and termite infestation.Ask your estimator for more information.

Buyer acknowledges: that wood materials used in the installation of your project are a product of nature and are subjectto cracking, splitting, warping, shrinking and bowing. Such changes in the wood are part of the wood's natural dryingprocess and do not harm the structural integrity of the wood, and therefore not warranted.

Buyer acknowledges: all plastic lumber and vinyl building materials are susceptible to thermal expansion, contraction,·and may generate static electricity which should dissipate over time and is not considered a warranty item. SeeManufacturer's Warranty for details.

At completion of your project you will be sent a "Completion Certificate", which must be signed and retumed to Mid-Atlantic Deck & Fence Co., Inc. to validate your warranty. .

This warranty does not cover equipment or materials warranted by the manufacturer's separate warranty, nor does itcover damage caused by floods, strikes, high winds, acts of God or damage caused by negligence or abuse by partiesother than Mid-Atlantic Deck and Fence Co., Inc.
