RE: Equivest 160 acres/FM 969 Development Permit Analysis

Dear Mr. Carpenter: We are pleased to submit this evaluation of the development permitting process for the 160-acre parcel located at the northwest corner of FM 969 and Burleson-Manor Road in eastern Travis County. The subject property is located in Austin’s 5-mile Extra-territorial-jurisdiction (ETJ) and outside the corporate limits of Austin. The ETJ is a jurisdictional boundary measured from the existing city limits and reserved for future annexation. Development within the ETJ is subject only to subdivision, environmental, and drainage controls and not land use regulations, resulting in a much simpler development permitting process without the subjective zoning and other land use restrictions including parking, landscaping, building heights and densities, and building permits. Development of the subject property will only require a civil engineering plan demonstrating compliance with grading and drainage requirements of the City and County’s Land Development Code. Building footprints, parking, and driveway access are shown as well as detention and water quality infrastructure improvements. A detention pond and water quality control system will be required to capture and filter the stormwater run-off collected from the site before it is released, at the predeveloped rate, into the off-site drainage system. The site development permit process is administrative and not subject to the political process. The site development permit process takes approximately 3-6 months to complete, depending on the size and complexity of the project. Developments comprised of at least 10 acres of land area with frontage on existing public roadways are not subject to the City or County’s subdivision ordinances and regulations. Instead, they are allowed to be platted by simply filing a survey drawing in the County property records. No building permits are required for the development within the ETJ. However, all buildings are subject to local Fire Department review for compliance with fire code regulations.

In summary, development of the subject property requires minimal review and is only subject to the technical grading and drainage regulations. This is the least restrictive process available in Austin’s jurisdiction and the shortest path to the permits necessary to start construction. Development within the city limits of Austin are subject to the complex, and often political, process of zoning which restricts development through the implementation of building heights and densities, landscaping, parking, and the onerous building permit process. More importantly, these extra layers of code requirements add a significant amount of time to the development permit process, often 2 or 3 times the length for properties outside of the city limits. In the case of the subject property, a surveyor and civil engineer should be able to complete the site development process within a 3-6-month timeframe.
