if you’re a regular reader of Renters Guide, you know we offer a variety of information for those looking for a new place to call home. But did you know it is your responsibility as a tenant to know your rights and

responsibilities prior to signing a lease agreement?

By knowing your rights and responsibilities ahead of time, you will be well informed and able to determine if the location is right for you. Once you choose your location, make sure you understand your lease – and all the provisions in it

– before you sign. Over the course of your tenancy a landlord should give you adequate written notice, in accordance with the timelines set out in The Landlord and Tenant Act, when rent or landlord services will be adjusted. You should be able to discuss any clarifications or adjustments before they take effect or a new lease is signed. Many landlords and property management companies do their jobs well and care about the property they own as well as the people who live there. It is in their best interest to keep good tenants. Many go above and beyond. Do you know a terrific landlord or property management team? What makes him or her so great? Let us know. We’d love to hear from you!

I feel it’s extremely important to love where you live. Your home needs to be that haven, that place where you be yourself, enjoy yourself and

indulge yourself. My view of it is, if you can’t be comfortable in the nest you’ve make for yourself and your family, then where in the world can you be comfortable?

Home doesn’t have to be a palace or a five-star hotel, or even your dream home to be comfortable. It doesn’t have to be perfect to be comfortable. It just has to be that place you can enjoy, that space you’ve created to respond to your needs.

I’ve lived in a lot of places (actually, 13 places! but several of them were during university and shortly thereafter, when I moved to different cities), and I can honestly say I’ve loved each and every apartment I’ve chosen. It was always a priority when I was apartment hunting. I’d have my list of needs and wants – and I’d only visit places that fit my budget. (It’s awful to fall for a place beyond your budget, that makes life difficult and is best avoided.) I’d try to picture where my furniture would go; what colours I would paint the rooms and exactly where my favourite reading nook would be. I’d ask the current tenants why they were moving and whether there were any surprises I should know about, like noise, landlord issues, temperature control – anything that came to mind.

But the truth is, I always had an instinctual feeling when I walked into what would be my new apartment. I just felt at home, fell in love with the space at first sight.

Love at first sight is grand, make sure you fall for an apartment for the right reasons. Find that place that you will love living in for a long time to come. AT THE FEDERATION OF RENTAL-HOUSING PROVIDERS OF ONTARIO, we continually look for ways to enhance the quality of life for tenants across the province. In 2008, we developed and implemented the Certified Rental Building Program (CRBP) to provide a “quality assurance” benefit that rental-housing consumers can count on when shopping for their rental apartment home.

Apartment buildings and complexes accepted into the program must comply with more than 50 Standards of Practice and are audited regularly by J.D. Power & Associates to track compliance. Once an apartment building has been granted official “certification,” it is considered a well-run, well-managed property where the property manager and their staff care about providing good quality of service to their residents. To date, more than 260,000 rental residents reside in over 950 “certified” apartment buildings across the province. In 2014, we took the CRBP to a new level by introducing 10 new Environmental Operating Standards as part of our exciting new Living Green Together groundbreaking initiative.

Basically, the 10 new Environmental Operating Standards are in line with current Canadian trends toward sustainability.

AT THE FEDERATION OF RENTAL-HOUSING PROVIDERS OF ONTARIO, we continually look for ways to enhance the quality of life for tenants across the province. In 2008, we developed and implemented the Certified Rental Building Program (CRBP) to provide a “quality assurance” benefit that rental-housing consumers can count on when shopping for their rental apartment home.

Apartment buildings and complexes accepted into the program must comply with more than 50 Standards of Practice and are audited regularly by J.D. Power & Associates to track compliance. Once an apartment building has been granted official “certification,” it is considered a well-run, well-managed property where the property manager and their staff care about providing good quality of service to their residents. To date, more than 260,000 rental residents reside in over 950 “certified” apartment buildings across the province. In 2014, we took the CRBP to a new level by introducing 10 new Environmental Operating Standards as part of our exciting new Living Green Together groundbreaking initiative.

Basically, the 10 new Environmental Operating Standards are in line with current Canadian trends toward sustainability.

PAINT. If you really can’t stand the neutral wall colour, try asking your landlord if you can paint, even if it’s only one feature wall (if you promise paint it back when you leave it may help). If they say no, there are still plenty of options when it comes to adding personality into your space.

A VARIETY OF STORES. Mix and match your furniture pieces, don’t purchase everything at once. My general rule of thumb is to shop at a minimum of three different stores when furnishing your home. You don’t have to buy everything at the same time, shop around and turn your place into a story.

ART. If your landlord doesn’t want holes in the walls, you’ve got a few options when it comes to artwork and wall-hung accessories. You can purchase pieces that are free standing, such as my personal favourite, large floor-standing mirrors. Mirrors are a great way to make a room look larger and feel more upscale. Your second option is using stick-on hooks (you can find these at any home improvement store) that are guaranteed not to create surface damage and can hold quite a lot of weight. There is a wide range of sizes and styles available that will suit your undressed-wall’s needs!

VISUAL INTEREST. Create some visual interest in your rental unit by placing a large, floor-to-ceiling, free standing book shelf to cover one of your empty walls and to make use of your vertical space. This can easily be a feature wall, and a great way to show off your belongings. Make sure whatever you place on the shelves are at varying heights. Book shelves aren’t only for books anymore- you can dedicate a shelf for your glassware including vases of different colours and sizes, and you can also purchase baskets to place on a couple shelves that serve as great storage and a great place to hide clutter.

COLOURS, PATTERNS AND TEXTURES. Liven up the space with different colours, patterns and textures. When mixing patterns, make sure the scales differ, for example, match a large-scale floral with a small-scale stripe. You can bring in these elements in varying ways. Throw cushions, area rugs, bedding and upholstery are just a few options. Be creative and let your style shine through.

You may feel frustrated at first when it comes to decorating your rental unit. No paint, no holes and no major changes doesn’t mean no style. Weather you are staying for the short-term or the long run; you can still make your rental an inviting, warm and cozy place to call home.

MOVING IS RIGHT AT THE TOP OF THE LIST of most people’s stressful situations. But a little organization goes a long way in alleviating the stress and making the move go smoothly. I’m happy to share some simple steps that will help you de-clutter your current home so you can enjoy your new home with a clean slate:

1. Start now: Our tendency is to put it off until packing time, but most people are in a time crunch at that point, and will often put things in a box to deal with ‘later’. Remember that you are paying for each item you move, not only in the time it takes to pack and unpack it, but also by the space it takes up in the moving truck. Why pay to move something you don’t really need? You’ll be busy when you move into your new home, and will probably put off going through those ‘deal with them later’ boxes indefinitely; believe me, when I work with clients, I come across unpacked boxes that have been sitting in the basement or garage for several years after a move.

2. Pictures: Take pictures of all the large items you know will not work or fit in your next home and post them on one of the resale sites online, like Kijiji, Craigslist or Ebay. You can put the extra money you earn towards your moving expenses and perhaps some pieces that fit the new place much better than your old stuff. And the nice thing about photographing them in the first place is that, if you have any sentimental attachment to the items you are selling, you can always use the pictures to trigger the memories.

3. The no-brainers: Go through your house one room at a time and get rid of the no-brainers first. No-brainers are items you don’t have to think twice about letting go of, like torn towels, chipped plates and broken electronics (if you haven’t fixed them by now, trust me, you probably never will). Do this every day, even if it’s just for just 15 minutes, until the task is complete. This is a great way to warm up your de-cluttering muscles and will give you an immediate sense of accomplishment and motivate you to tackle the tougher stuff.

4. Research: Do some research ahead of time and decide where you will take your discarded items. Although some things will be garbage, most items can be donated or recycled. You will be motivated to let go of more things if you know they will be going to a cause that you believe in or disposed of in a way that doesn’t hurt the environment.

Could a local women’s shelter make better use of the clothes you never wear? Find the closest drop-off location where your unused electronics can be reused or recycled safely (do an online search – there are hundreds of locations).

5. Fight the ‘what if I need it someday’ fear: If you haven’t used it in a year, chances are you never will. For example, we wear only 20 per cent of our clothes 80 per cent of the time. If in doubt, toss it out (or donate/sell it). On the off-chance you do need it months from now, you can always replace it, but chances are you’ll never look back. If you keep everything because of this fear, it will probably cost you much more in time, money and stress than it would to replace it.

6. Be prepared: Set up your supplies in advance. For the de-cluttering process, you will need bins, sticky notes (for labeling) and garbage bags. Use bins to do the initial sort; label them ‘donate’, ‘sell’, ‘recycle,’ ‘toss’ and ‘keep’. When the bins get full, transfer the contents into bags. Use clear bags for items that will be donated and opaque bags for garbage, so there’s no confusion. Arrange for a charity to come and pick up the donations or drop them off yourself before the end of the week (you can always go back again as you accumulate more items to donate). Give yourself a deadline on the ‘sell’ items and have a plan for the items that don’t sell (i.e. donate). Transfer the ‘keep’ items directly into the moving boxes.

7. Get the whole family involved: Everyone should make decisions on their own things, when it comes to determining what to keep and what to let go of. But a little competition never hurt, so make a game of the de-cluttering process. Set a timer, give everyone a bin, and put some up-beat music on to make it fun. Choose a token prize for the winner who got rid of the most items and a reward for the entire family for the effort each member put in.

MOVING IS NEVER EASY OR EFFORTLESS, BUT THERE ARE WAYS TO SIMPLIFY. I recommend the following 15-point checklist to help you complete your move in a stress free way:

1 Double-check all closets, drawers and shelves, in addition to the attic,

garage and any storage spaces to ensure they are empty.

2 Carry important documents, money and jewelry with you.

3 Pack toys, games or special items for the kids to keep them busy during the move.

4 Remember to pack a box of basics that you may need on move-in day (tools, paper products, all-purpose household cleaners, etc.). Be sure to have it loaded last so that it will be first off at your new home.

5 Don’t pack paint, bottles of bleach, gas cans or other inflammables. It is against federal law for movers to transport flammable and combustible materials.

6 Use strong boxes and containers that can be secured tightly. Purchase special boxes for dishes, wardrobes and other special items.

7 Pack audio-video equipment in their original boxes. Label cables and tighten transit screws. Before removing cables, take pictures of the back of the unit so you can hook everything back up the same way. If removing screws, tape them to the objects they are removed from.

8 Avoid loading more than 50 pounds into one box.

9 Label each box and indicate: which room it should go in; whether it is fragile; and if it should be loaded last so it will be unloaded first.

10 Cushion contents with packing materials such as bubble wrap, newspaper or tissue. Save room by using towels and blankets to wrap fragile items.

11 Pack books tightly on end in small boxes. If they are musty smelling, sprinkle talcum powder between the pages and wrap the books before packing. Leave them stored for a couple of months to eliminate the smell.

12 Have rugs and draperies cleaned before moving and leave them in wrappings for the move.

13 Pack medicines in a plastic re-sealable zipper storage bag or leak-proof container.

14 Check the weather forecast for your move day. If it’s going to be hot, be sure to have a cooler with lots of bottled water and sports drinks on ice.

15 Call your moving company the day before your move to get a contact number for the crew in case you need to contact them en route. Give your mover your cell phone number and be sure to fully charge your cell phone the night before your moving day.

OCCASIONALLY AN OPPORTUNITY ARISES THAT REQUIRES A TENANT TO BE AWAY FROM THEIR APARTMENTS FOR AN EXTENDED PERIOD OF TIME. Often it’s short enough that a tenant doesn’t want to give up their apartment, store their belongings and then have to fi nd another upon their return – but long enough that the fi nancial obligation of rent while away can make the option prohibitive. Subletting can be a great solution, but how does this impact on the lease and responsibilities as a tenant? Subletting means that a tenant moves out of his or her unit for a speci� c period of time, but plans to move back into the unit before the end of the tenancy. The person who moves into the unit is known as a “subtenant.” The subtenant is responsible for paying the rent to the original tenant who continues to pay rent directly to the landlord, and is responsible for complying with everything in the lease.

When planning to leave a unit for an extended period of time but want to return to it, a tenant must ask for the landlord’s permission to sublet the unit. The landlord must be informed when the tenant will be leaving and returning.

The landlord cannot refuse to allow a tenant to sublet a unit, but they can refuse a speci� c person if they believe

the person is unsuitable. If a tenant needs to sublet an apartment, the tenant, and not the landlord, are responsible for fi nding someone to pay rent while occupying the apartment. It’s best to advise the landlord of the intent to sublet, and provide all necessary details such as the subtenant’s name, phone number, place of employment, etc. The landlord may need to contact them for maintenance or to enter the apartment in case of an emergency. They may even want to run a reference check to ensure their suitability.

Assigning a Unit means that the tenant moves out of the unit permanently and transfers their tenancy to another person. Subletting is often confused with “Assigning a Unit.” Assignment might happen if a tenant suddenly has to terminate the lease early. If such circumstances do arise, it would be best to notify the landlord as soon as possible. The landlord may have a waiting list or a suitable applicant interested in an apartment in the building and would be able to take over the apartment right away. If not, the situation is similar to a sublet: the tenant would have to get the landlord’s permission to Assign the tenancy, and it would be the tenant’s responsibility to try to fi nd someone to take over the apartment permanently.

The landlord has the right to refuse to let a specifi c person become a new tenant, but must have a good reason for doing so. The landlord does have the right to do a reference and credit check to qualify the potential Assignee tenant just as they would investigate any new tenant since Assignee will become entirely fi nancially and otherwise responsible to the landlord for the apartment.

It’s possible that the landlord might refuse the idea of the Assignment or might not respond to requests to do so. This may mean either honouring the signed lease or there may be the opportunity to end the tenancy early.
