INTRODUCTION:
This document is an incorporated document in the Schedule to Clause 52.03 and theSchedule to Clause 81.01 of the East Gippsland Planning Scheme (the Scheme). Despiteany provision to the contrary in the Scheme, pursuant to Clause 52.03 of the Scheme, theland identified in this incorporated document may be used and developed in accordance withthe specific controls contained in this document.
In the event of any inconsistency between the specific controls contained in this documentand any provision of the Scheme, the specific controls contained in this document willprevail.

THIS DOCUMENT ALLOWS:
Despite any provisions of the East Gippsland Planning Scheme, no permit is required for useand development of the land known as ‘870 Princes Highway, Hillside, for the purpose of fora newspaper production and printing facility, generally in accordance with following‘Incorporated Plans’ by Tim Hall & Associates Pty. Ltd. including any amendment of the plansas required under the conditions of this Incorporated Document. Once approved, these planswill be the endorsed plans, and may be amended from time to time by the responsibleauthority.

THE FOLLOWING CONDITIONS APPLY TO THIS DOCUMENT:
1. Prior to the commencement of development, excluding demolition, bulk excavation, sitepreparation, soil removal, site remediation, retention works, piling, footings, groundbeams and ground slab, detailed plans to the satisfaction of the Responsible Authoritymust be submitted to and be approved by the Responsible Authority. When approved,the plans will be endorsed and form part of this Incorporated Document. The plansmust be drawn to scale with dimensions and three copies must be provided. The plansmust be generally in accordance with the Incorporated Plans but modified to show:a. The use of muted colours and non-reflective finishes for the exterior walls and
roofs of all buildings;b. Limited on-site non-illuminated business identification and directional signage to
the satisfaction of the responsible authority;c. Landscaping of the site in accordance with Condition 3; andd. Any works or modifications to the development required to meet the other
conditions of this incorporated document.
2. Prior to the commencement of any buildings and works, a Construction ManagementPlan to the satisfaction of the responsible authority must be submitted to and approvedby the responsible authority. When approved the Construction Management Plan willbe endorsed and will form part of this incorporated document. The constructionactivities must at all times accord with the endorsed plan. The ConstructionManagement Plan must include:a. Construction timeframe;b. Details of hours of construction;c. Actions to be taken to prevent the discharge of dust, sediment and litter during
construction activities at the site; andd. Routes of all construction vehicles, including the provision for construction
access to the Princes Highway having regard to the comments of VicRoads.
3. Prior to the commencement of any buildings and works, a detailed landscaping plan tothe satisfaction of the responsible authority must be submitted to and approved by theresponsible authority. The landscaping plan must be consistent with the approvedLandscape Concept Plan (Condition 4), be prepared by a qualified landscape architect,and must include:a. A unified landscape 'theme' across the site;b. Screening of any external storage or utility areas;c. A planting schedule, which details plant species, including height and spread at
maturity;d. Landscaping to screen the views from adjoining properties to north, west and
east. The landscaping must be sited and comprise species chosen so as tominimise fire risks, and to provide effective screening within a short time frame;
e. Any design features such as lighting, paving, lawn and mulch; andf. Irrigation methods.
4. Landscaping in accordance with the approved landscaping plans must be completed tothe satisfaction of the responsible authority within 6 months of the completion of thedevelopment. Thereafter the landscaping must be maintained to the satisfaction of theresponsible authority.
5. Prior to the commencement of any buildings and works, stormwater design plans to thesatisfaction of the responsible authority must be submitted to and approved by theresponsible authority.
6. Once approved the plans will form part of the incorporated document. The plan shouldbe based upon the preliminary investigations undertaken by Crossco Consulting Pty

Ltd for infrastructure (September 2008), be prepared by a suitably qualified engineer,and must include:a. All proposed stormwater drainage infrastructure, including piping/drains and pits
and culverts (particularly associated with works affecting the Princes Highway);and
b. Methods to capture the additional stormwater runoff on the site including suitablysized and located water tanks to catch rainwater from the roofs of all buildings.
7. Prior to the commencement of any buildings and works, a Traffic Management Plan tothe satisfaction of the responsible authority must be prepared and submitted to thesatisfaction of the responsible authority and VicRoads. When approved, the plan will beendorsed and will then form part of the permit. The plan must include:a. A dimensioned layout plan of the new road access to the Princes Highway, which
must be prepared by a pre-qualified or approved consultant to the satisfaction ofVicRoads and approved in writing by the Regional Manager;
b. Details of any new lighting;c. Surface treatments for all roadworks including for the proposed access to the
Princes Highway; andd. Stormwater drainage discharge (specifically affecting the Princes Highway).
8. All approved roadworks and access points must be constructed in line with theapproved Traffic Management Plan and approved in writing by the Regional ManagerVicRoads.
Use and Development
9. The use and development must be carried out generally in accordance with theendorsed plans that may be approved from time to time by the Responsible Authority.
Lighting
10. External lighting must be designed, baffled and located to prevent adverse effect toadjoining land or to the Princes Highway, to the satisfaction of the responsibleauthority.
Plant and equipment
11. All external plant and machinery must be screened so as not to be highly visible fromthe Princes Highway to the satisfaction of the responsible authority.
Amenity
12. The amenity of the area must not be detrimentally affected by the use or developmentthrough the emission of noise (including from plant and equipment) or odour.
Water and sewerage
13. The development must be connected to East Gippsland Water’s supply and seweragecollection system, to the satisfaction of East Gippsland Water and the responsibleauthority.
Car parking and Access
14. Prior to occupation of the building(s), areas set aside for parked vehicles and accesslanes, as shown on plan(s) and be submitted to and approved by the responsibleauthority. The plan(s) must be:a. Constructed to the satisfaction of the responsible authority;b. Properly formed to appropriate levels;c. Surfaced with an all-weather sealcoat to satisfaction of the responsible authority;d. Drained and maintained to the satisfaction of the responsible authority; and

e. Line-marked to indicate each car space and all access lanes to the satisfaction ofthe responsible authority, in line with requirements set out in AS 2890.1 ParkingFacilities Part 1: Off-street car parking.
15. Parking areas and access lanes must be kept available for these purposes at all times.
Roadworks and Access
16. As general conditions for roadworks on declared roads, contractors must:a. Provide evidence of public liability insurance policy for at least $10,000,000 that
will be effective for the duration of the works;b. Provide traffic control in accordance with VicRoads - Worksite Traffic
Management (Roadworks Signing) Code of Practice;c. Provide a Worksite Traffic Management Plan for approval at least seven days
prior to any works commencing within the declared road reserve;d. Carry out works in accordance with VicRoads Standard Specifications for
roadworks;e. Cover all works with a defects liability period of twelve months for all works.f. Prior to commencing work within the road reserve, the applicant must provide a
security deposit of either $5,000 or 10% of the estimated cost of roadworks,whichever is greater, to VicRoads. On practical completion of the worksVicRoads will refund 50% of the deposit and will return the balance after theduration of the defects liability maintenance period (twelve months).
17. All works associated with the construction of this access are to be completed at no costto VicRoads, and the declared road reserve must be left in a neat and tidy condition.
18. The proponent must meet the requirements of the Road Management Act 2004 withrespect to notifying and/or seeking consent from VicRoads to undertake works in thePrinces Highway road reserve.
Fire fighting (CFA) requirements
19. To meet the needs of fire fighting, the site is to be serviced by an AS 2419.1 compliantsystem. As a guide, fire fighting water storage in the order of 288 kL will be required.Although not mandatory, if an AS 2118.4 sprinkler system is proposed additional waterstorage over and above fire fighting storage would be required.
20. Prior to the commencement of the construction of car park and water main, a fireservices design and emergency vehicle movement plan shall be submitted andapproved by County Fire Authority.
Expiry
21. Notwithstanding other provisions of these conditions, the development permitted by thisIncorporated Document will expire if any of the following circumstances applies:a. The development is not started within two (2) years of the date of the gazettal of
the approved amendment;b. The development is not completed within six (6) years of the date of the gazettal
of the approved amendment.The Responsible Authority may extend the periods referred to if a request is made inwriting before these controls expire or within three months afterwards.
