RANDY AGNETTI RETURNS TO RESURRECT PIPE PROS Former long-time EBCA advocate and past-president, Randy Agnetti, is back! After investing years building his successful Concord-based leak detection business, Pipe Pros, Inc., Randy sold the business several years ago, and moved back to his home state of Florida.

As that deal ultimately fell apart, Randy decided to reboot his California busi-ness, effectively starting over, twenty years after he first founded it in 1994.

As Owner and President of Pipe Pros, Inc., Randy was very active in the East Bay Adjusters Association, and the Mt. Diablo Property Association through most of the ‘90s. In fact, he was at the forefront of the movement that ultimately merged those two organizations back into one, in 2001. A veteran of the industry, Randy explained to us how he got involved. “I started as a plumber, and realized that what the industry needed was a no-conflict-of-interest reporting service to provide professional and accurate causation services to customers dealing with plumbing leaks,” he said.“I have 30 years in the plumbing industry. I served as president of the East Bay Claims Association for four years during which time the membership doubled,” he added. “Further, I was on the Board of Directors for the Underground Utility and Leak Locators Association (UULLA) for nine years, and on the Board for the Plumbing Heating Cooling Contractors Association (PHCC).”Pipe Pros provides the latest in video inspection, leak detection, utility location, ground penetrating radar services, and smoke and odor detection wherever needed throughout Northern California. Randy worked smart, and he worked hard, to build up Pipe Pros back in the day. “My biggest accomplishment has been the building of Pipe Pros from a one truck operation to a six vehicle fleet with eight employees and sales that grew 25% per year,” he shared. “I am looking forward to re-starting Pipe Pros after a five year absence. I expect to make it bigger and better than it was before. “In his "spare" time, Randy lives his passion. “I love umpiring base-ball games, for a variety of leagues,” he stated with his infectious grin. “I was recently selected as an umpire for the Roy Hobbs World Series to be held later this month in Ft. Myers, FL”Randy Agnetti, owner/president of Pipe Pros, Inc., maybe be reached at: (925) 969-9182, or [email protected].

2015 Early-Bird Membership Deal! Join or Renew Now & SaveOn the success of a similar offer last year, the East Bay Claims Association Board of Directors has elected to offer-up a bit of a reward for returning members for the coming year, as well as an enticement for new members. “We really appreciate all the support this organization has enjoyed the past several years,” stated EBCA President Joe Baughman. Overall membership and meeting attendance has been consistent and substantial. Still, the sense that there aren’t many adjusters at any given function remains pervasive. “As with all our sister groups, we continue to encourage the carrier claims people and independent adjusters participate, and to be-come more involved,” Joe added. “East Bay Claims Association is always committed to maintaining a high degree of professional courtesy within our ranks.” The organization has been actively taking measures to continue to raise its standing within the community, as well.

As an established charitable 501c(3) non-profit organization, EBCA has added the status of the Continuing Education Provider credential to the reasons to be more involved. There seems to be a bit of a revival of carriers supporting their claims people joining and supporting their local associations. The EBCA Board has opted to continue to offer annual FREE Member-ships to insurance claims adjusters. Completion and submission of a simple membership application now allows all such claims people the benefits of membership.

The Early-Bird discount amounts to a 10% savings off the normal annual membership dues. Beginning October 1, 2014, and running through the end of the year, current members may renew for just $45 for individuals, or $90 for Corporate membership (three people per corporate membership). New members joining for the first time pay the regular $50 or $110 respective dues, but receive the balance of the current year and all of 2015.

The East Bay Claims Association enjoyed a busy day on October 8, 2004 with a Continuing Edu-cation Class, including California DOI CE Credits, that started at 9:30 a.m. The morning session was then followed by the regularly scheduled Luncheon Meeting.“Construction Defect Law” was the topic for the CE Class presentation, conducted by Richard Arneal, Esq. of Van de Poel, Levy, Allen & Arneal, LLP. Included for attendees was a very comprehensive 30 page presentation guide of the content of his two hour class. His presentation covered construction defect laws on new residential construction, repair work, and what happens at trial. He stated that the average cost of going to trial is about $275,000. As a result, there are many times when law suits never make it to trial, settling out of court.“Actionable defects in residential construction” may be found in Civil Code #896 outlines standards that must be met for residential con-struction (including condominiums). This code relates to “any” action seeking recovery of damages related to residential construction. He said the exception is a case known as “Liberty Mutual vs Brookfield”. He discussed an opposite ruling in KB Homes vs Superior Court

CC895, that held an exclusive remedy. The Plaintiff was able to recover damages for “violation of standards” as opposed to “actual damages”Mr. Arneal’s presentation was most informative, covering a lot of ground in a relatively short period of time. The Speaker for the Luncheon was Ryan Ayers from the American Foundation for Suicide Prevention which. His organization was one of the many Charitable benficiaries the East Bay Claims board chose for this year. The ability to support such worthy causes comes as a direct result of the EBCA Luncheons and Golf Tournament fund-raisers. Half of all 50/50 Raffle donations (the half that goes to the association) is earmarked for this purpose. President Joe Baughman thanked all the Members and friends of East Bay Claims for their support. The association was able to donate $2500 to this cause. The AFSP Mission Statement is : “Ninety percent of all people who die by suicide have a diagnosable psychiatric disorder at the time of their death. We believe scientific research, better treatments and effective education of professionals and the public will best prevent this tragic loss of life”. AFSP’s Survivor Outreach Program has trained local volunteers to visit newly-bereaved survivors and treat families upon request. log on to:[email protected] you or someone you know is in crisis please call the National Sui-cide Prevention Lifeline at 800-273-8255. Mr. Ayers presentation was heartfelt and inspiring.

Understanding your risks and mitigation needs offers the best protection

Californians Urged to Prepare Before The Next Big One Hits

SACRAMENTO, Calif. - More than 10 million Californians par-ticipated in the largest disaster preparedness event ever October 16th, when they practiced “The Great ShakeOut” drop, cover and hold-on drill. Insurance Commissioner Dave Jones reminded Californians to prepare before the next earthquake hits with a few simple steps that can save your life and help you recover from disaster."You have the opportunity to prepare for the next disaster today, and make recovering easier," said Commissioner Jones. "In ob-servance of the Great ShakeOut I urge all Californians to make a preparedness plan and practice it. Before the next big one hits, make sure you take a few simple steps to mitigate your risk of injury and loss."Californians know it's not if but when the next earthquake will hit. Even a small or moderate temblor can cause significant damage. The magnitude 6.0 quake that struck Napa on August 24 is a good reminder that residents need to take steps to protect themselves, their loved ones and their belongings by making sure they have the coverage they need and they take simple, inexpensive miti-gation steps.Standard homeowners insurance does not provide coverage for earthquake damage. Earthquake insurance must be purchased sep-arately and is typically designed as a catastrophic policy to cover tens of thousands of dollars in structural damage. The majority of quakes are moderate and cause damage and injury when furniture and belongings tumble and break. For about $100, the average person can protect themselves and their family by using Velcro appliance and furniture straps, cabinet latches and quake putty to secure those items that fall and break during a quake.Adding an earthquake strap to a flat screen TV helps prevent injuries from the appliance falling on small children and has the added benefit serving as a theft deterrent. continued page 10
