Earth Hour 2013 Band Contest Terms and Conditions

WHO IS ELIGIBLE: The Earth Hour 2013 Band Contest is open to three-person to six-person bands, comprising members who are Malaysian citizens at least 16 years of age, who are all not signed with any record label.

HOW TO ENTER: Each band may submit ONE video of themselves performing either an original or cover version of a song about environmental conservation or love for nature. Each participating individual can only participate as a member of one band, not as a member of two or more bands. The video must be submitted via the platform on www.facebook.com/wwfmy from 9:00am Monday 3 December 2012 to 5:00pm Monday 22 January 2013. Entrants must not include video footage that infringes on the rights of any other person in their video submission. WWF-Malaysia reserves the right to disqualify any submissions that are vulgar, offensive, racist, sexist, personal attacks, and off-topic or are inflammatory or derogatory in nature. WWF-Malaysia is not responsible for lost, damaged, late or misdirected video submissions, or for uploading connections, garbled transmissions, unauthorised intervention or technical malfunctions. WWF-Malaysia and Universal Music Malaysia reserve the right to select original songs submitted for the Earth Hour 2013 Band Contest for inclusion in the Earth Hour 2013 music CD. 50% of the sales proceeds of this music CD will be channelled to WWF-Malaysia’s conservation work. Voting is open to the public and will commence from 9:00am Monday 4 February 2013 until 5:00pm Friday 1 March 2013 via the platform on www.facebook.com/wwfmy The five bands with the most votes will be invited to participate in the Finals on Earth Hour 23 March 2013 at Sunway Pyramid Shopping Mall, Selangor. Finalist bands will have to bear their own transport costs to the venue. In the event that a band cannot be contacted via the email address provided with their video submission or declines to attend the finals, WWF-Malaysia reserves the right to invite the band with the next highest number of votes, up to a maximum of five bands to perform at the Finals. JUDGING: Each finalist band will perform the song in their video submission live. The winner will be picked by a panel of judges comprising representatives from: WWF-Malaysia, an established local band, Earth Hour 2013 Band Contest corporate sponsor DiGi Telecommunications Sdn Bhd, Earth Hour 2013 Band

Contest supporter Universal Music Malaysia, and Earth Hour 2013 venue sponsor Sunway Pyramid Shopping Mall. The judges’ decision is final. PRIZES: First Prize: The band will win

RM2,500 cash prize*,

An invitation to participate in the Earth Hour 2013 media conference on 23 March 2013,

Performance slot on the Earth Hour stage just before the grand finalé when the established local band performs at the end of the Earth Hour 2013 ground event at Sunway Pyramid on Saturday 23 March 2013, and

A feature on Universal Music Malaysia and WWF-Malaysia digital channels.

Second Prize: The band will receive RM1,500 cash prize* and be featured on WWF-Malaysia digital channels. Third Prize: The band will receive RM1,000 cash prize* and be featured on WWF-Malaysia digital channels. The remaining two bands will receive the consolation prize of WWF-Malaysia Earth Hour merchandise and be featured on WWF-Malaysia digital channels. **Cash prizes sponsored by DiGi Telecommunications Sdn Bhd. YOUR RIGHTS: By entering the contest, you hereby grant to WWF-Malaysia the right to use your band name, name, city, state, country of residence, your video submission as well as footage of your performance(s) in promotions and other publications. LEGAL CONDITIONS: By entering this competition, you agree to these entry rules and the following legal conditions: By entering, participants warrant that his or her video submission is original, does not include video footage/snippets from other musician’s videos and does not infringe on any third party’s rights, and that participant has obtained any and all necessary permissions from any third party if a third party or third party’s property appears in the video submission. WWF-Malaysia reserves the right to disqualify any entry if it finds in its sole discretion that any of the foregoing warranties are not true. Decisions of WWF-Malaysia shall be final and binding. By entering, participants release and hold harmless WWF-Malaysia, its affiliated organisations, and each of their directors, officers, employees, attorneys, agents

and representatives (collectively, the "Companies") from any and all liability for any injuries, loss, claim, action, demand or damage of any kind arising from or related to the Earth Hour 2013 Band Contest, any prize won, any use of the entry materials by WWF-Malaysia, the warranties participants make, any misuse or malfunction of any prize awarded, participation in any Earth Hour 2013 Band Contest-related activity, or participation in the Earth Hour 2013 Band Contest. Participant agrees that any and all disputes that cannot be resolved with the Companies, and causes of action arising out of or connected with the Earth Hour 2013 Band Contest, shall be resolved individually. In any such dispute, participant shall, under no circumstances, be entitled to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than participant’s actual out-of-pocket expenses (if any) associated with participating in the Earth Hour 2013 Band Contest. Participant hereby waives all rights to have damages multiplied or increased. Any attempt by an entrant or other individual to deliberately damage any website or undermine the legitimate operation of the Earth Hour 2013 Band Contest is a violation of criminal and civil laws, and should such an attempt be made, the Companies reserve the right to seek damages to the fullest extent permitted by law. The Companies are not responsible for any incorrect or inaccurate information, whether caused by website users or by any equipment or programming associated with or utilised in the Earth Hour 2013 Band Contest, or by any technical or human error that may occur in the processing of submissions to the Earth Hour 2013 Band Contest, including but not limited to any misprints or typographical errors. The Companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, video submissions. The Companies are not responsible for any problems or technical malfunction of any telephone network or lines, computer equipment, servers, providers, computer on-line systems, software, or failure of email on account of technical problems or traffic congestion on the Internet or at any website, including injury or damage to participant’s or to any other person’s computer related to or resulting from participating or uploading videos or information in the Earth Hour 2013 Band Contest. Winners may be required to return a Prize Acceptance Form. Return of any prize and/or prize notification as undeliverable or failure of any entrant to comply with any Official Rules may result in disqualification. If, for any reason, the Earth Hour 2013 Band Contest is not capable of completion as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Companies that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Earth Hour

2013 Band Contest, the Companies reserve the right at their sole discretion to cancel, terminate, modify or suspend the Earth Hour 2013 Band Contest. In no event will the Companies, their advertising and promotional agencies, or their directors, officers, employees, attorneys, agents and representatives be responsible or liable for any damages or losses of any kind, including direct indirect, incidental, consequential or punitive damages arising out of participant’s access to and use of the Companies’ websites, or the downloading or uploading and/or printing of material from said sites. Without limiting the foregoing, everything on the Companies’ sites is provided "as is" without warranty of any kind, either express or implied. By participating in this Earth Hour 2013 Band Contest, WWF-Malaysia may share your information with other WWF affiliated offices. *End
