OVER THE EDITOR'S DESK

Now that Labor Day is over and schools are back in session, many of us are able to resume our lives on a more regular schedule . . . or so we suppose. Then there are others of us (and I'm one of these) who say "Where has the sununer gone? I'm only on July schedule." We have so many opportunities to further our research, and we fully intend to pursue them, but somehow we never seem to get caught up . . . or am I the only one in this condition? Perhaps one of the opportunities below will fit your schedule or offer another source of information. Personally speaking, I need a course on time-stretching!

The second annual Genealogy Conference, co-sponsored by the Family History Centers of Memphis, TN (Walnut Grove) and Memphis, TN North, will be held on Saturday, October 29, 1994 at the facilities of the Memphis North group at 4195 Kirby mitten Rd., Bartlett, TN. This free conference to assist the amateur genealogist at every level, also offers a free syllabus of all classes and a complimentary lunch, if you register before September 30th. Late registration will be honored to the best ability of the hosts. You may call them weekday evenings at (901) 388-9974 or (901) 754-2545.

Another chance for learning comes from our state capital, Nashville, TN. The Middle Tennessee Genealogical Society will be sponsoring a seminar on Saturday, 19 November 1994 in Nashville. The speaker will be Elizabeth Shown Mills, CG, CGL, FASG, editor of the National Genealogical Society Quarterly. The Newsletter of the Southeastern Jurisdiction Historical Society of The United Methodist Church is edited by the Rev. Joseph W. Lasley, 423 Crum Dr., Lake Junaluska, NC 28745. His June issue carried an article titled "How-To For Genealogists" quoted from Action Memo, Spring 1994. It concerns the availability of United Methodist records, as follows:

"The genealogist is the bane and blessing of most archives! The General Commission (of the United Methodist Church) has prepared a flyer that answers some frequently-asked questions by family researchers, along with definitions of distinctively United Methodist terms. The flyer is adapted from a booklet written by Dr. John Simms, historian of the North Central Jurisdiction and a member of the General Commission on Archives & History.

We are happy to make this flyer available to you. Please send a stamped, self-addressed envelope, legal-size, to Susan Eltscher at the General Commission, P.O. Box 127, Madison, NJ 07940. You may duplicate the flyer as needed. You may adapt the information to suit your archives' circumstances, but we ask that you acknowledge the original authors on copies you distribute."

GIBSON COUNTY, TENNESSEE 1830 L I S T OF INHABITANTS

Gibson County is one of several counties formed from the Western District in 1823. This handwritten list had been bound and was in the Trenton Library. In a different handwriting from the list, 1830 was written on the frontpiece. An effort was made to verify the date by comparing the list of names with Mrs. Emily B. Walker's books of tax lists (see Book Reviews). The names were compared to the 1828 and 1832 tax list, the 1830 census index, the 1836 tax list (printed in "Ansearchin'" News 1978), and the 1840 census index ("Ansearchin'" News 1970). This comparison of names was surprising in that there were many names on each list which were not on the one below. There are names listed below that were not on any of the lists checked. Normally, men between the ages of 21-50 pay a poll tax, and the lack of female names on the list may indicate this is a poll tax, or perhaps a Jury Pool. Could it possibly be the list made prior to Gibson becoming a County in 1823 showing a sufficient number of inhabitants?

Mrs. MELLEN found the Bible while clearing her mother's house following Mrs. Bettie McCRACKEN 's death. The Holy Bible, Old and New Testaments, was printed in 1852 in New York by the American Bible Society. According to an entry on the fly leaf it originally belonged to Nancy Darthula (HAMPTON) McCRACKEN, daughter of Nancy Jane LONGWITH. John Longwith, probably Nancy Longwith's brother, is entered on a fly page with the placename Dare given (a Bradley Co, TN community). The entries are difficult to read because of aging. Each page is entitled "Family Record". We have attempted to organize this record by family groupings as given in an accompanying letter by Mrs. Mellen.

William Hampton, the father of James M. Hampton Sr, was a Revolutionary War veteran and survivor of the Valley Forge winter. At the time of his death in 1837 he was a member of the Hiwassee Baptist Church in McMinn County. However, there is no present marker for his grave. Undoubtedly, he is buried in the graveyard near the church. Many graves are marked with stones but have no readable inscriptions on them at the present time, if indeed they ever had any. William Hampton's identity as a Continental Army veteran was well known to his neighbors in McMinn County. Any local information concerning the location of William Hampton's grave would be greatly appreciated. Mrs. Diana Mellen is in possession of William Hampton's army pension papers.

James M. HAMPTON, Jr., was in the 36th Regiment, Tennessee Volunteers of the Confederate Army. He died at Knoxville, Tennessee, on March 26, 1862. The story of this unit is a reflection of the divided state of Tennessee allegiances in the Civil War period. Organized in February 1862, this regiment was raised from men in Knox, Bradley, Hamilton, and Marion Counties of East Tennessee. However, when it was posted at the Cumberland Gap, substantial numbers of the men deserted to the Union lines rather than fight against their fellow East Tennesseans who joined

the Union forces in Kentucky. The regiment, by April 1862, was regarded by the Confederate command as "disloyal", and in May 1862 was ordered to Savannah, Georgia - a more "loyal" environment. However, by June 1862 the regiment was disbanded and the "loyal" men assigned to other regiments.

Another member of this family group who saw Civil War service was John B. McCRACKEN, the father of Jackson L. McCracken. He, it seems, was in the Union Army, and died in its service during the war. Tennessee, like Kentucky, Missouri, and Virginia [whose western part became a Union state in 18631, contributed men to both sides of the bitter struggle we call the American Civil War, and some of them died in the military service of their respective armies. The Union authorities raised a number of regiments from East Tennessee who fought bravely and well. On several occasions the Confederate and Union regiments from Tennessee met in battle, and the fighting was fiercer between them than it would have been under normal circumstances. All too often fathers and sons, brothers and cousins were in opposing uniforms. [Tennesseans in the Civil War, vol 1 (Nashville: Civil War Centennial Commission, 1964), pp. 251-2.1

CAPTAIN WILLIAM THOMSON--The Man Who Founded " Eveni ng Shade" Contributed by Mary Twitty Clements, 2303 E . 131st St, Bixby, OK 74008

Captain William THOMSON served in the War of 1812 and commanded a company of soldiers from Smith County in Middle Tennessee. His mother was a cousin of President James Knox POLK. After the war, Captain Thomson brought his family west by flatboat and went to Arkansas, settling 25 miles north of Batesville. First he built a log cabin to shelter his family and then a grist mill and sawmill. As the Thomsons prospered, the log cabin was replaced by a better house. In the 1840s, the settlers who had joined Captain Thomson in this area, petitioned the Federal Government for a post office. The mail for the area had to go to Batesville, and was delivered only every two or three months from Wild Haws in Izard County. Postage at the time was charged according to the distance the mail had to be sent. Naturally, anyone writing to the settlers north of Batesville had to pay more than if they sent a letter to a nearer recipient. It was a surprise to many at the small settlement that the petition for a post office was granted. Perhaps Captain Thomson's kinship to the President had something to do with it. In any case, when the papers arrived it was necessary to fill in a name for the settlement. Captain Thomson then realized that the settlement had never had a formal name. The Captain looked at the tall pine trees, which grow in the area; as they threw a shadow over his mill as the sun set, bringing darkness prematurely. In a flash of inspiration Captain Thomson wrote "Evening Shade" in the blank for the settlement name. This is the town which inspired the television series of the same name.

The value of printing the 1837 tax list immediately after the 1836 list (see Vol 41, {/2) lies in comparison of the two. Some names have disappeared from the second list; did he/she die or move away? In the case of a woman who had paid tax on a slave e, the slave could have died, been freed or sold, and the woman would not appear on the list, yet still be 1 iving .

New names may appear on the 1837 list. Did a young man just attain majority at age 21, or did a new resident move into the district? If he paid only poll tax, either or both suppositions might be true.

Sometimes changes are noted in the name, a different spelling (a different enumerator also?) or the addition of an initial or second name. Sometimes the acreage changes; did he buy or sell, or did some of us read the figures incorrectly? A change in poll tax payment to non-payment could mean that a man had turned 50 and is no longer charged poll tax, however if he paid tax on anything else, his name would be included.

A lively imagination may help us establish the truth during these non-census years.

p. 198 - March term 1804: Bazel DAVIS vs Rece GUZLICK: Debt under ten dollars. Isham COX, J.P., had returned a warrant to court at Dec 1803 term, summoning Brittain Davis, Elizabeth Gullick and Richard LAM as witnesses for Bazel Davis. Cox decided in favor of Davis, and Gullick appealed to court giving John HANKINS & William BLACK as securities.

p. 199 - Patrick BURNS vs Daniel McPHAIL: T.A.B. On 12 Dec 1803 the sheriff was ordered to arrest McPhail, but returned the order marked "Not found" to court on the third Monday in Dec, 1803. Another order was issued 2 Jan 1804, which Sheriff John BROWN marked "Executed & committed to Jail 30th January 1804." At the March 1804 term, Burns and McPhail both appeared in court. McPhail agreed to pay the costs, and Burns dropped the suit.

p. 200 - Robert PROFFITT vs Stockley DONELSON and Elizabeth Donelson, his wife: Trespass with force and arms. The papers were served 30 Jan 1804, and Edward SCOTT, attorney for the Donelsons, appeared at March Court, but Proffitt did not come and did not pursue his suit.

p. 201 - John FORMWALT vs Nicholas PASCHAL: T.A.B. Edward SCOTT, attorney for Formwalt and Paschal appeared in court. Paschal assumed the costs and Formwalt dropped the suit.

p. 202 - Robert WHYTE vs John STONE: Covenant broken. Court decided in favor of the plaintiff.

Judah OLIVER vs Daniel McPHAIL: T.A.B. Sheriff BROWN returned the warrant marked "Executed 30 January 1804 & committed to Jail". At court held in March 1804, McPhail assumed the cost of this suit, "& the Plaintiff not further prosecuting b suit is dismissed."

John DEN vs Daniel RATHER: Breaking and Entering. John Den claims that "with force & arms he broke and entered the close of the said plaintiff and ejected him . . . " Den's attorney, Edward SCOTT, "brought here into court his Certain Declaration in Ejectment against Richard FEN with the Note thereunder written . . . ( see file for Declarations etc)." Daniel RATHER came into court and agreed to pay the costs and the suit was dismissed.

p. 203 - Aran COB vs Moses WINTERS: John L O W , attorney for Cob, claims that the plaintiff had obtained a judgment before George McPHERSON, Esq. for forty dollars with costs "the said Moses Winters having obtained Writs of Certeorari & Supersidas to remove the same to Court, Butthe said George McPherson . . . having failed to bring up the Warrants & proceedings had before him, The said Plaintiff Dismisses his Suit . . . "

p. 204 - John McDONALD vs Daniel RATHER: Debt. Jacob JONES, J.P., brought into court a warrant which was marked "Executed by me Patrick BURNS, February 11, 1804". Rather's attorney was Thomas H. PAINE and his security was Milton CENTER.

p. 205 - Thurs. 22 Mar 1804. Court met. Present, Jesse BOYD, James PRESTON & Samuel MILLER, Justices.

p. 205 - "Joseph McPHERSON on application to the court Who having entered into Bond With his Securities Conditioned as the Law directs was qualified accordingly"

State vs James LUSTER: (see file for Indictment) At September Court 1802, a grand jury returned a True Bill against James Luster, and the sheriff was ordered to summons him to court. The paper was returned marked "Not found". Orders were given on 5 Oct 1802, 1 Jan 1803, 29 Apr, 15 Aug, and 19 Dec 1803, all returned "not found". On 23 Jan 1804 another Plurias Capias ad respondendurn was issued and returned marked "Executed 25 Jan'y 1804". Andrew WHITE prosecuted for the state, and Luster pleaded guilty. He was fined six cents and the cost of this indictment.

p. 206 - State vs Zachariah CASH: (see file for Indictment) In December 1802, Cash was indicted; Sheriff BROWN served the paper and returned it marked llExecuted 21st Dec'r 1802". Cash pleaded not guilty, the plea was continued, and at March court 1804 the suit was dropped.

p. 207 - State vs Richard OLIVER: (see file for Indictment) In December 1803 the sheriff was ordered to serve papers on Oliver, and bring him to court. The sheriff returned "not found". A similar paper was served on 2 Jan 1804 & returned "not found in my county". Andrew WHITE, for the state, did not prosecute further.

p. 208 - State vs Richard ALLEN: (see file for Indictment) Sheriff BROWN, ordered to summons Allen to court in December 1803, returned the summons marked "Not found". On 2 Jan 1804 another summons was issued and returned marked "Executed 30th January 1804". Allen appeared in March court 1804 and, not contesting the charge, was fined $5.00 and costs.

p. 209 - State vs Thomas MORRIS: (see file for Indictment) a summons dated December 1803 was returned "Not found"; another dated 2 Jan 1804 was marked "Executed 26 Jan 1804". Morris appeared in March 1804, pleaded guilty, and was fined twenty-five cents plus cost.

p. 210 - John DEN vs John NEEL: Breaking and entering. This suit was begun 31 Aug 1802 and contested and continued until March 1804. It seems to involve a land dispute rather than burglary. Other persons mentioned are Sheriff John BROWN, John Den's attornies, Edward SCOTT and Pleasant M. MILLER, Richard FEN, John SMITH T, Thomas GRAY, Esq., Jacob GARDENHIRE.

p . 211 - State vs Daniel RATHER, Francis LEE & Samuel McCULLY (No.17) State vs Joseph BRADLEY, Daniel Rather & Francis Lee (No.18) State vs Samuel McCully, Daniel Rather & Francis Lee (No.19), and State vs Jacob GARDENHIRE, Daniel Rather and Joseph Bradley (No.20): (see file for Sci Fac). The defendants came to court on the 3rd Monday in March 1804 "and for reasons appearing to the Court, the forfeitures heretofore entered against them are Set Aside on their paying Costs, and Daniel Rather Assumes the costs."

p. 223 - Isham COX vs Little Page SIMS: T.A.B. Both parties appeared in court in June 1804 and the suit was settled by Sims paying Cox $10.00 plus costs.

James WILLLT vs Isaac SHINALT: Trespass. Sheriff BROWN returned the summons marked "Executed 1st March 1804". Both parties came to court in June and Shinalt agreed to pay all costs except Willet's attorney fees, "to which the Plaintiff agrees and Dismissed his Suit".

William LAMPKIN vs John STONE: Debt. A summons was served on Stone 10 Mar 1804. Andrew WHITE was attorney for Lampkin at June court and the jury was made up of John JONES, Adam CARSON, Ephraim WALKER, Hugh FRANCE, Amos MARNEY, Isaac SHINALT, Edmond WALLER, James GORDON, Thomas M. McMULLIN, William BYRN, Isaac BROCK, & Alexander HOPKINS. They decided in favor of Lampkin and ordered Stone to pay the debt plus damages of $2.56.

BARNETT, J.P. & Adkinson "refused to deny "a note of "Thirty-six Dollars and five Shillings & three pence" . . . Judgment was in favor of Johnson, and Adkinson appealed, giving David MOORE/MOON as his Security. The plaintiff "came not, nor is his suit further prosecuted".

Thomas HUME vs Adam CARSON - Edmund WALLER was security for Carson. James MONTGOMERY & Little P. SINS also came into court, apparently in support of Carson.

p. 237 - State vs Peter BOWMAN: (see file for Indictment) Sheriff John BROWN was issued papers to bring Bowman to court on 26 Sept 1803, 28 Feb 1804 and 1 June 1804, all of which were returned marked "not found". The suit was dismissed.

State vs Daniel McPHAIL: ('see file for Indictment) A capias was issued in Dec 1803 for Sheriff BROWN to bring McPhail to Court. The paper was returned "not found". An alias capias was issued on 2 Jan 1804 and marked "Executed & committed to Jail this 30th January 1804". In June 1804, Andrew WHITE (for the state) & Daniel McPhail appear in court where McPhail "will not contend" and "saith he is guilty ...p uts himself upon the Grace & Mercy of the Court". His fine is $2.50.

p. 238 - State vs Allen SNEED: (see file for Indictment) In March a capias was issued & returned "not found", but an alias capias was marked "Executed 28 May 1804". At June court Allen Sneed pled "guilty" & was fined $1.50 & costs.

p. 239 - State vs James WILLITT: (see file for Indictment) Willitt pled "Not guilty" and a jury composed of Adam CARSON, Ephraim WALKER, Hugh FRANCE, Amos MARNESS, Isaac SHINALL, Edmond WALLER, Alexander HOPKINS, Joseph BRADLEY, Robert SHADDEN, Joseph Hopkins, Harden EVANS, & Thomas REED found him "not guilty".

p. 240 - State vs Zachariah CASH: "Wm McNUTT who hath been summoned a Garneshee saith he owes the Defendant Fifty Dollars is/in Store Goods or thereabouts & Edward SCOTT, Esq agrees to release the Lot for which William McNutt became indebted to Cash the Store Goods and the said Store goods are condemned in his hands etc" .

Nicholas PASCHALL, constable, returned to court an Execution issued by Jesse BYRD in favor of Thomas HUMES plaintiff vs Adam CARSON for $50.50 debt and $1.00 costs, "Levied on a Lot he now lives on in the Town of Kingston". The sheriff is ordered to proceed with the sale.

OBITUARIES FROM THE ARKADELPHIA, ARKANSAS Contributed by Allen B. Syler, 712 South 22nd, Arkadelphia, AR 71923

JUDGE EAKIN died on Thursday night at the residence of his sister-in-law in Marshall, MO where he had gone only a few days before he was taken ill. Judge Eakin moved from Tennessee to Washington, in this state in 1857. He was recognized as an able lawyer, and was elected chancelor in 1874 in which position he served two terms. In 1878 he was elected associate justice of the supreme court, and his term would have expired next year. His remains were taken to Washington, where he was buried by the Knights Templar . 12 Sept 1885

It is with regret that we chronicle the death of one of our oldest and most highly esteemed citizens, Judge N. H. LOCK. He has been rather feeble for some months, but he was thought to be in his usual health, on last Tuesday when he suddenly fell forward from his chair, dead. It was most likely of the nature of a heart trouble. Judge Locke was esteemed and respected of all his neighbors and acquaintances-- a man though of peculiar disposition, scrupulously upright and straight-forward in all his transactions of life, and the embodiment of affection and tenderness in his domestic relations. Judge Locke was born in Tennessee in 1812 and at his death was 73 years of age. He immigrated to this state and county in 1860 and settled in the Terre Noir section of this county; he moved to Arkadelphia just after the war, and has since lived here. 12 Sept 1885

The Wayne County Old Records Project began in 1990 as a part of a state-wide effort to make available to the public many old records which were usually stored in courthouses. The originals of these chancery court records are stored in the County Historian's Office in the Waynesboro Courthouse, but they have been microfilmed for public use and may be purchased from the Tennessee State Library and Archives. Lawsuits, depositions, and estate settlements abstracted for this volume reveal names of persons and their residences, often piecing together entire families. Names are printed in capital letters making them stand out on the page, and the large, clear print is a pleasure to read.

The first chapter is a 75 page essay on writing family history by Sir James Balfour Paul.

This computer-printed transcription is an attempt to identify McNairy County residents of the 1890rs, and to compensate for the missing 1890 census. The original tax record was found in the McNairy County courthouse basement, and the information copied was selected as that being most useful to genealogical researchers. MS Garrett has dedicated this series to "all our ancestors that lost their home in the forced removal, also known as the Trail of Tears". In this volume she continues to link the Drennen ~ 0 1 1 of 1851 and the Guion Miller Applications taken from 1906 to 1910. The two lists are briefly explained and illustrated with maps. Family relationships are identified if possible. Other volumes are planned, and Volume 3 will give Saline District and the 1880 Cherokee Orphanage census.

Created in 1792 from part of Lincoln County, Logan County became the parent of twelve present day counties. The greatest number of settlers came from Virginia, but many came from the Atlantic coast and the mid-west Territories. The Deed Records were filmed by courthouse personnel in Russellville, with help from the Kentucky Archives. From that film, Mrs. Murray has abstracted transfers of property, powers of attorney, bills of sale, Kentucky citizenship papers, relinquishments of dower, deeds of gift, and emancipation certificates. The Index of Places and the Slave Index should be very useful.

VITAL STATISTICS covers marriages from May 12, 1881 to March 3, 1883. Information includes number of the license, date of marriage, place of marriage, full name of both parties (widow's maiden name), color of both parties, ages, birth place of both bride and groom, residence at time of marriage, groom's occupation, name and official station of person performing the marriage, name and residences of at least two witnesses and the date recorded. Births are covered from April 1, 1881 to September 30, 1881. From these records the information given is: number of the record, date of birth, full name of child, sex of child, color, place of birth, full name of both parents, nativity of both parents, father's occupation, parentsr residence, any kinship, and the date recorded. This is an unusual. amount of information for records of that period.

The names of many residents of the county appear as they carry out the business of the county in such duties as jury service and road maintenance. A map of Trenton completes the volume.

NEWSPAPER EXTRACTS contains material of historical and genealogical interest from THE MILAN EXCHANGE for the period from January 7 to December 23, 1875. Marriages, deaths, property sales, church news, and items from other newspapers are included. A picture of the rural community is gained from the variety of material presented, from fines for disorderly conduct to the timing of the first cotton blossom.

LAND GRANTS is an attempt to supply information not available in census records, which are missing for the Western District for the years 1790 and 1800. These grants name owners are settlers, particularly in Gibson County. Items included are the grant number, date of grant, number of acres, name of owner, survey date, warrant number, warrant date, location of grant, and volume letter and page number of original records. Adjoining owners are also mentioned. A map of West Tennessee is included.

This "master index" of case files of the Southern Claims Commission has consolidated information from existing works. Three were published by the Unided States government in the ninefeenth century. The fourth, published in 1980 by the present writer, was entitled Civil War Claims in the South, The Union invasion of the South caused suffering for Union sympathizers, just as it did for Confederate supporters. In 1871 Congress created a claims commission through which southern Unionists could apply for reimbursement for some of their losses. Southerners filed 22,298 cases. The adjudication of these cases created a vast store of data that is now maintained by the National Archives in Washington. These records are located in five separate record groups. All records can be accessed by using the four-step process flow chart which prefaces this book.

Include your name and address; put the current date a t the top right corner of each card: please list names and birth dates of subject's children on the back of the index card. Please use the sample card format shown below. You may want to keep a list of Index Cards you have submitted; and if there is a change in your address or information on any of your Surname Cards, you may send new cards with instructions to replace old cards. Index Cards are filed by ancestor surname.

Subscribers may request a search of the Surname Index File for ancestors and persons who could be researching the same name--only one family name for each request, please, and no more than one search request per month. A long SASE is essential for return of information in the file.

Each request must: 1. include surname and given name 2. give a t least one date and one location (even if they are estimated) 3. have a legal size SASE
