Welcome from the Conference Host

Dear All,

I welcome you all to the 3rd annual East Africa International Arbitration Conference 2015 hosted by the East Africa Business Network (EABN).

International arbitration has become the preferred method of resolving disputes

between parties of different nationalities. As further investment continues to pour into

East Africa and the governments of East Africa and private sector continue to invest

in more infrastructure projects, we will continue to see a rise in the use of international

arbitration as the mode of resolving disputes.

The theme for this year´s edition is “Improving capacity and highlighting dispute resolution capabilities in the region”, and will highlight the increasing importance

of international arbitration as a tool for promoting foreign investment in East Africa and

in particular Tanzania. Our focus on the oil & gas sector is informed by the increasing

development of energy, and oil & gas in the Eastern African region.

The Programme Committee has prepared a detailed program for the next two days

covering key topics on international arbitration in Eastern Africa. I am confident that

the Conference will create a platform whereby East Africa legal professionals can

network, share expertise and exchange ideas amongst us and also with peers from

other jurisdiction.

Of course, this conference would not have been possible without the support of our

of their representative speakers, are set out in detail in this Brochure. I am also thankful

to my Tanzania partners who have been instrumental in the conference organisation,

We are now in our third year of the East African International Arbitration Conference. The Program Committee is proud of this milestone, and welcomes you to experience yet another insightful forum in Dar es Salaam, Tanzania.

This year’s conference follows on from the EAIAC 2014 which was hosted last July in Nairobi. East Africa is at the cusp

of development. Development needs a fuel. East Africa has viable oil reserves, and Tanzania in particular, has extensive

off-shore gas deposits. We therefore decided to gear this years’ international arbitration conference towards a focus on

the oil & gas sector.

We have an inclusive and interactive 2-day program which includes: the development of international arbitration in

Tanzania; the process of international arbitration; drafting effective international arbitration clauses and drafting dos

and donts; anatomy of international arbitration and the role of arbitration institutions; the role of the courts in the arbitral

process; recognition and enforcement of awards and challenges to awards; investment arbitration; achieving efficiency

and reduced costs in international arbitration; and the highlight – a focus on international arbitration on the oil & gas

sector .

Our speakers include: the Judiciary; distinguished regional arbitrators; experienced international and regional arbitration

practitioners (solicitors from top international firms, top barristers including Queens Counsel, and practitioners from

leading East African firms); and the private sector.

Aisha is a Partner in Anjarwalla & Khanna’s Litigation and Arbitration

Department.

Her practice focuses on all aspects of commercial litigation, and she has extensive specialist experience in a wide range of commercial and property disputes, including contractual claims, competition issues, insolvency issues, joint venture agreements, professional negligence, mortgage fraud and defective securities and rectification of title issues.

She is also experienced in alternative dispute resolution.

Andrew specialises in international arbitration and public international law. He has extensive experience of advising states, state-owned entities and major companies on all aspects of public international law.

He has acted in ad hoc and institutional arbitrations across multiple jurisdictions and under a range of governing laws, and before the rules of major arbitral institutions. He has particular experience in the energy sector, including advising major multinational energy companies on structuring investments and the availability of relief under the Energy Charter Treaty and bilateral investment treaties.

Arthur Igeria is a meticulous and highly experienced Advocate of the High Court of Kenya. He trained at the University of Nairobi, graduating in 1989 with a Bachelor of Laws degree.

He also holds a post graduate Diploma in Law from Kenya School of Law. He was admitted to practice as an Advocate of the High Court of Kenya in 1991. Resulting from his passion in alternative dispute resolution, Arthur was recently appointed the Chairman of the Nairobi Centre for International Arbitration. He is a Member of the Chartered Institute of Arbitrators (Kenya), the Mediation Training Institute, and the Institute of Directors of Kenya. He is also on the list of counsel entitled to practice at International Criminal Court (ICC) at The Hague, and the International Criminal Tribunal for Rwanda (ICTR, and a Certified Public Secretary and a member of the Institute of Certified Public Secretaries of Kenya.

Arthur Igeria, Chairman, Nairobi Centre for International Arbitration (NCIA)

Bernadette UWICYEZA is the Secretary General of Kigali International

Arbitration Centre (KIAC) since the starting in 2012. She Holds a French Law

degree and a DEA in European Law (Honors) from the University of Rennes I

in France. The special field for Bernadette is business law, management and

policy formulation. She is also an Accredited Mediator CEDR.

Prior to joining KIAC, Mrs. UWICYEZA was a Legal Advisor to the Ministry of East African Affairs

under Trade Mark East Africa Project (2011) assisting the Ministry in legal and judicial matters of

the EAC integration process. She serves also as Legal consultant to the Ministry of Justice under

the Competitiveness and Enterprise Development Project/World Bank (2006- 2011), coordinating

the business law reform program engaged by the government for easy doing business in Rwanda.

She worked earlier to that as Managing Director in different companies in Rwanda and served as

lecturer in different Schools of law in Rwanda.

Charles is the current president of the Tanganyika Law Society.

He is the founder and Managing Partner of CRB AFRICA LEGAL. He is an experienced consultant in the fields of mining, corporate, banking and financial law and is held in high regard by clients and peers. Chambers Global Guide to the World’s Leading Lawyers describes market observers as “praising Charles Rwechungura’s ‘hands-on approach’ to an array of work, including mining, banking and finance activities.”

Charles advises mining exploration and extraction companies on corporate and commercial issues, the national and foreign banks operating in Tanzania as well as equity IPOs and bonds listing at Dar es Salaam Stock Market. In recognition of his industry knowledge and legal expertise he is often appointed to act as arbitrator on complex commercial disputes.

Craig Tevendale is a partner in the international arbitration group at Herbert

Smith Freehills.

He has extensive experience of multi-jurisdictional work subject to a wide range of governing laws, and across a wide range of industries and sectors. Craig has acted in arbitrations as counsel and advocate in ad hoc proceedings and before all of the leading arbitral institutions. He also accepts appointment as arbitrator.

Craig speaks Arabic and French, and is often involved in disputes in North Africa and the Middle East.

He is recognised as a leading practitioner in energy disputes.

Duncan Bagshaw is a barrister, called to the Bar of England and Wales in 2003.

He studied English law in Birmingham and London and French law at the University of Limoges, France. Duncan practised in the fields of commercial and company litigation and arbitration.

He acted in a range of substantial court matters, including cases in the English High Court and Court of Appeal. He also acted in arbitrations, both domestic and international, with particular emphasis on disputes arising out of the supply of IT and technical equipment.

Elizabeth has a strong background in corporate and commercial law particularly in the areas of energy and natural resources, private equity and M&A.

Dr. Kariuki Muigua, Chairman, Chartered Institute of Arbitrators (CIArb),

Nairobi

Dr. Kariuki Muigua is a distinguished law scholar, an accomplished mediator

and arbitrator with a Ph.D in law from the University of Nairobi and with

widespread training and experience in both international and national

commercial arbitration and mediation.

He has on several occasions been appointed by the Chartered Institute of Arbitrators (CIArb)-Kenya and other institutions as a sole arbitrator in arbitrations involving commercial disputes.

Dr. Muigua is a Fellow of Chartered Institute of Arbitrators (CIArb)-Kenya chapter. He is also a Chartered Arbitrator. He is a member of the International Bar Association, the International Commission of Jurists, Human Rights Institute of the International Bar Association, the London Court of International Arbitration (LCIA), Chartered Institute of Arbitrators (UK) and Kenya Branch, Young International Arbitration Group, Member of Commonwealth Lawyers Association and the Institute of Certified Public Secretaries of Kenya. He has served as the Branch Chairman from 2012 to 2015.

He is an Advocate of the High Court of Kenya of over 20 years standing and practising at Kariuki Muigua & Co. Advocates, a firm that specialises in environmental and commercial law litigation and Alternative Dispute Resolution. The firm is also listed as a leading Kenyan commercial law firm in the distinguished Martindale Hubbell Directory.

He has undertaken specialised courses specifically on Environmental Impact Assessment (EIA) and Environmental Audit (EA) which earned him the EIA/EA lead expert accreditation by the National Environmental Management Authority of Kenya (NEMA). He is a Lead Consultant and Expert at Pristine Consultants, an Environmental Law and Policy Consultancy drawing its clientele from Kenya and elsewhere around the world.

His research interests include environmental and natural resources law, governance, access to justice, human rights and constitutionalism, conflict resolution, international commercial arbitration, the nexus between environmental law and human rights, land and natural resource rights, economic law and policy of governments with regard to environmental law and economics.

Dr. Muigua has also worked closely with various environmental advocacy groups in Kenya and regionally. He works closely with professionals from National Environmental Management Authority (NEMA) especially in the areas of Environmental Resources and their management through Environmental Impact Assessment (EIA), Mediation and Public Participation. He advocates the setting up of effective policy, legislative and institutional frameworks for the resolution of environmental conflicts. He is an ardent commentator and contributor to debates on the constitutional review, governance and has worked closely with stakeholders in the areas of constitutionalism and Access to justice.

He is also a lead auditor/implementer of BSI ISO/IEC 27001:2005 (Information Security Management Systems) and consults on the same.

Dr. Muigua teaches law at the Centre for Advanced Studies in Environmental Law and Policy (CASELAP) and the School of Law, University of Nairobi.

Ms. Dulac is a Partner in King & Spalding’s Singapore office and a member of

the firm’s International Arbitration Group.

Ms. Dulac has practiced international arbitration in Paris, Singapore and Washington, D.C.

She has represented clients in commercial and investment arbitrations around the world. She has worked on international arbitrations under the rules of the ICC, ICSID, SCC, SIAC, and UNCITRAL. In addition to her work as counsel, Ms. Dulac has been appointed as an arbitrator in ICC, SIAC and ad hoc arbitrations.

She is the co-chair of the Asia-Pacific Forum for International Arbitration. Ms. Dulac is a frequent speaker and writer on international arbitration and international investment law. She is also a visiting lecturer on international arbitration at the University of Addis Ababa and the University Of Bahir Dar Ethiopia. She is admitted to practice in England & Wales and Paris, France. She holds a DEA (J.D. equivalent) from the University of Paris I (La Sorbonne) and an LL.M from King’s College, University of London. Elodie Dulac, Partner, King & Spalding LLP, Singapore

Mr. Godfrey Simbeye is currently the Executive Director of Tanzania Private

Sector Foundation (TPSF) since 9th March 2012.

He has a general background in business management possessing solid managerial and supervisory experience, detailed understanding and knowledge of the business policies and processes, excellent decision making skills, excellent leadership skills, business planning and budgeting competences, ability to conduct and direct work on projects, interpersonal and negotiation skills, excellent communication in a clear and concise manner, ability to analyse private sector advocacy issues and private sector development.

Mr. Simbeye has a strong background in Business and Financial Management and has experience of more that seventeen (17) years in consultancy and management of finance functions. He is a qualified accountant (ACCA) and has master degree in Information Management and Technology from University of Strathclyde in the UK. Prior to his appointment as Executive Director, Mr. Simbeye was the Director of Finance and Human Resource development of TPSF and was responsible for managing World Bank Funds and grants from development partners of more USD 60million.

Godfrey Simbeye, Executive Director, Tanzania Private Sector Foundation

Harry Matovu is a QC with a wide-ranging practice, including energy and

natural resources disputes, civil fraud and banking and finance.

He has detailed knowledge of oil and gas exploration, LNG trading and shipping, and the financing and valuation of oil and gas and mining assets. Harry has been instructed in a number of very high-profile cases over the years, including a US$1.6 billion claim over oil rights in Iraqi Kurdistan, which was one of the longest-running trials in the English Commercial Court in recent times. • LCIA dispute and trial (London seat) to defend a US Engineering group against a $40m claim

by Indian distributors of fastenings who had distributed the products throughout India for 37
