The Supreme Court on Tuesday ordered the dismissal of Gilani as prime minister after convicting him of contempt in April for refusing to reopen Swiss corruption cases against Zardari. The move was the culmination of a stand-off between the judiciary and the government, and forced the Pakistan People’s Party to hastily elect Raja Pervez Ashraf as the new PM on Friday in a bid to end the crisis. The presidential ordinance aims to prevent actions taken and orders passed by Gilani between April 26 – when he was convicted of contempt—and his dismissal on June 19 from being challenged in any Pakistani court. The ordinance said, “This ordinance has been introduced in light of aftermath of the notification regarding disqualification of Syed Yousaf Raza Gilani as Prime Minister, and short verdict of Supreme Court (circa-19 Jun 2012), over various constitutional petitions”. “The functions including parliamentary functions performed, actions taken, orders passed, directions issued, instruments made, MOUs executed, national and international commitments made, process of communication issued, advice given to the President in any matter, including in respect of Acts and Ordinances, SROs and other legal instruments issued, powers confirmed, assumed or exercised, or appointments made, by Syed Yousaf Raza Gilani, Prime Minister of Pakistan from 26-04-2012 to 19-06-2012 (both days inclusive), shall be deemed to have been validly done, performed, taken, passed issued, made, given, confirmed, assumed, executed, exercised and provisions of this ordinance shall have, and shall be deemed to always to have had, effect accordingly,” the ordinance said. Talking to reporters after visiting the mausoleums of Quaid, Zulfikar Ali Bhutto and Benazir Bhutto, Ashraf vowed to hold elections in a free, fair and transparent manner so that no one could raise a finger at the government. Ashraf said the PPP leadership was well aware of the hardships faced by countrymen due to the energy crisis and solid steps were being taken to bring betterment in the power supply situation. He said anti-democracy elements thought democracy would derail after Yousaf Raza Gilani was disqualified, but another PPP activist replaced him which disappointed the opponents. The prime minister was of the view that democracy could not be wrecked and it would continue as his party would continue struggle for the purpose with same commitment and sincerity. He said he belonged to the middle class and his appointment as prime minister had proved that the PPP was a party of poor and it worked for their welfare. Ashraf said the PPP was desirous of strengthening national institutions, including judiciary, as it was in the larger interest of the country and its people. He said the country would progress if everyone followed the principles of unity, faith and discipline. He said the PPP and allied parties were committed to promoting politics of reconciliation in line with the vision of Benazir Bhutto. Asked about law and order in Karachi, the prime minister said the city was the jugular vein of Pakistani economy and his priority was to restore peace to the city along with dealing with the energy crisis. He said he had spoken to the governor and chief minister and they were committed to controlling crimes and taking action against those indulging in crimes. About the restoration of NATO supplies, he said the government wanted to have good relations with all countries, including the US, on an equal basis and dignity. He said decision about the restoration of supplies would be taken in line with the recommendations of parliament. While addressing a meeting of PPP leaders in Karachi, the prime minister said that their destination was not achieving power but to implement the philosophy of Zulfikar Ali Bhutto. “People are well aware of every conspiracy being hatched against the Pakistan People’s Party,” Ashraf said, adding that his government would be paying special attention to the energy crisis and the law and order situation. The new prime minister said he would decide on writing the letter to Swiss government in the light of the constitution. He said he did not want any clash between different institutions and the matter of writing letter to the Swiss government would be decided according to the law of the land. Three cops gunned down on duty in Quetta QUETTA: Unidentified armed men killed three police constables in Quetta on Sunday. Officials said a police party of four consta- bles was on patrolling duty in eastern bypass area of Quetta when unidentified armed men opened indiscriminate fire on them and fled. As a result, two of the constables died on spot, while the third succumbed to his in- juries at a hospital. They said the police party was on patrol and came under a sud- den attack, so none of them could retaliate. No one has claimed responsibility far the killing so far. Superintendent of Police Sariab Sikandar Tareen told reporters that the fourth constable remained unhurt in the attack. The bodies were moved to Combined Military Hospital (CMH) for autopsy. They were identified as Abdullah Mengal, Shahjhan and Abdullah Pirkani, while the fourth official was named Mumtaz Sarpara. Police said an investigation was underway into the incident to unearth the real motive behind the killing, however, preliminary in- vestigation showed that they had been tar- geted. Police have registered a case against unidentified men and an investigation is un- derway. Shahzada zulfiqar Afghan militants ambush army convoy in Upper Dir, 21 killed PESHAWAR Online Afghan militants on Sunday attacked a military convoy in Upper Dir, an area bordering Afghanistan, resulting in the killing of at least 21 people, including militants and soldiers. According to reports, Afghan militants attacked a military convoy in Upper Dir, killing at least 10 military personnel, while several others were left missing. The sources further said that the security forces retaliated to attack and killed almost 11 militants. Militants from Afghanistan have attacked checkposts in Upper Dir several times, causing a number of causalities to security forces in the area. Two women, child drownin Quetta sewerQUETTA: A seven-year-old boy, his mother andgrandmother, died due to suffocation in a sewer on Sunday.Rescue workers said that Abdul Rauf, 7, fell into an openmanhole while playing outside his house near Burma hotel onSariab area in the outskirts of Quetta. After knowing about theincident, the boy’s mother identified as Bibi Mariam went outof the house and climbed down the manhole to save her son.Later Bibi Zura, the boy’s grandmother, saw her daughterclimbing down the manhole also jumped into the gutter afterher. The boy had already died of suffocation due to poisonousgas, but unfortunately his mother and grandmother also died.Rescue workers say that the bodies had been retrieved fromthe main hole and were shift to hospital. The deceased wereAfghan refugees and living in a refugee camp in Sariablocality. House to review the power situ-ation in the country.

The meeting was a follow-upof Saturday’s meeting held at thePrime Minister’s House in Is-lamabad, in which important de-cisions were taken to reduce loadshedding on the war footing.

The prime minister was ap-prised by Sindh Chief MinisterQaim Ali Shah and Sindh Gover-nor Dr Ishratul Ebad Khan thatthey would hold negotiationswith all the stakeholders todayand tomorrow to get their coop-eration for increasing powergeneration in the province.

ernor assured the prime minis-ter that it would be their topconsideration to extend all pos-sible support to the federalgovernment in reducing loadshedding in the country assoon as possible.

Federal Minister for Petro-leum Dr Asim Hussain informedthe PM that the Faisalabadpower plant has started its oper-ation per decision taken in Sat-urday’s meeting at the PMHouse. It would produce 65MWelectricity each day, he added.

India will soon deploy its anti-missile de-fence shield in the national capital and inMumbai in the first phase, defensesources said on Sunday.

“The shield will be able to interceptand destroy mid-air any incoming enemymissiles up to a range of 2,000 km. TheIndian capital and Mumbai will get theshield in the first phase as the DefenseResearch and Development Organistionchose the two cities considering their vul-nerability to outside missile attack,” theysaid. India’s Cabinet Committee on Secu-rity will soon give its final approval beforethe shield is deployed in the two cities, thesources said. The second phase will seeother cities like eastern India’s Kolkata

and southern India’s Bangalore andChennai get the shield, the sourcesadded. India had tested its anti-missiledefense shield earlier and plans to in-crease its range up to 5,000 km by 2016.

The system was first test-fired in No-vember 2006, making India one of thefew countries to have successfully devel-oped an anti-ballistic missile systemafter the US, Russia and Israel.

They said the lawyerstook decisions through theirelected bodies and they wereaware of their duties andrights. They said some de-feated elements could notmake the lawyers leave theirmission.

They said the meeting ofdefeated elements was un-constitutional and any callannounced by them was inviolation of the Pakistan BarCouncil Act and rules.

They said such ele-ments were not only scan-dalising the judiciary butalso wanted to make it aparty. The lawyers con-demned such negative ef-forts at all levels.

Pakistan’s interior ministry onSunday issued new guidelines forthe foreigners traveling to Pe-shawar and the tribal areas of Pak-istan.

According to a notification is-sued by the interior ministry, theforeigners, traveling to Peshawar,should submit their requests atleast 12 working days in advancefor security clearance.

“The guidelines will be imple-mented on all NGO and aid workerstraveling to Peshawar and tribalareas,” the statement said.

“The foreigners will not be al-lowed to enter the tribal areas ofPakistan nor they would be permit-ted to contact or take an interviewwith the tribal elders,” it stated.

The notification further saidthat the foreigners would not be al-lowed to carry any weapons or pro-hibited material during theirjourney.

Australian Foreign MinisterBob Carr Sunday said therewas “no hint” of a plan to extra-dite WikiLeaks founder JulianAssange to the United Statesshould he be sent to Sweden.

“When I have raised it...I’ve received no hint that

But he has concededthere is no current US indict-ment against him.

Carr said he had no indica-tion this was going to happen.

“There’s not the remotestevidence that that is the case.No US figure has confirmedthat to us,” he said.

“But I can say, when I’vesaid to a senior US official,‘Assange is an Australian cit-izen, we’ve got an interest inthis. Have you got plans toextradite him?’, they haven’tsaid they have got plans to ex-tradite him.

According to details, the not releas-ing of funds has put the future of half amillion students, 95,000 employees and

thousands of students who are studyingabroad on scholarships at stake. Foreignprofessors at the universities have notbeen paid for the last two months. Thesources quoting the Higher EducationCommission officials said the FinanceMinistry had held back 37 percent of thefunds allocated for the universities whichaccounted for Rs 12 billion.

The HEC said the funds werenot being released sinceApril and scholar-ships of 10,000students withinthe countryand abroadhad beenstopped. Ina d d i t i o n ,600 stu-d e n t swhose schol-

munities stand united today, said Mut-tahida Qaumi Movement (MQM) ChiefAltaf Hussain on Sunday.

Altaf said this during his telephonicaddress to the MQM’s ‘Paigham-e-Mo-habbat’ rally in Karachi here at JinnahGround, Azizabad. The gathering’s aimwas to promote love and harmonyamong different communities living inthe provincial capital.

The MQM chief demanded of theSindh government to resolve the prob-lems of the Pakhtuns and Hazara peo-ple’s populated areas of the metropolis.MQM is not only the party of downtrod-den Punjabis, Sindhis, Balochis, Gilgit-Balistanis and Kashmiris but also of thePushto and Hindko speaking people, headded. “Pushto and Hindko speakingpeople are also our brothers,” he said.

He said MQM would foil conspira-cies aimed at creating hatred amongpeople and pitting them against one an-other. Altaf Hussain held feudals andlandlords responsible for hatching con-spiracies on the basis of divide and ruleformula. The MQM chief called upon the

Asurplus Rs 817 millionbudget of Sir Syed Uni-versity of Engineeringand Technology (SSUET)for the fiscal 2012-2013

was passed at a meeting of the institu-tion’s board of governors held hereunder the chairmanship of Vice-Chan-cellor Prof Dr Jawaid Hasan Rizvi.

A spokesman of the University saidon Sunday that in the budget the Uni-versity announced a 20 percent increasein the salaries of its employees while itshowed Rs 815 million as current ex-penditure for the next fiscal. He saidthat the budget shows Rs 816.89 millionas current income and Rs 814.27 millionas current expenditure thus making itsurplus by Rs 2.63 million.

According to the salient features, theuniversity will spend Rs 100.52 millionon development, Rs 37.6 million on thepurchase of additional equipment forlaboratories in all the Faculties includ-ing newly established Telecom Faculty.

Besides, Rs 16.5 million have beenearmarked for financial help to deserv-ing students and staff. The help willcome out of profits on EndowmentFund, while Rs 23.45 million would bespent on construction of new academicblock and Rs 9 million for developmentof New Campus/IT Park at its 200 acresof land in the upcoming Education City.

The University has earmarked Rs1.5 million for research projects, Rs 6million for research by faculty, Rs 1.6million for Ph.D. Graduate Programmewhile Rs 3 million set aside for pur-chase of new books, research journalsand equipment for its library.

As per budget documents some10,818 students had been awarded de-grees in six different engineering disci-plines since 1998 to date. This year, theUniversity allocated Rs 16.5 million fordevelopment fund and the accumulatedFund now stands at Rs 88.1 million.

The Endowment Fund which wasestablished with an amount of Rs 250million in 2006 has now soared to Rs310 million. The Board approved theproposition of Academic Council ac-cording to which syllabus has beenamended with respect to the presentdemands and modern trends.

The board meeting was attended,among others, by Lt Gen (r) MoinuddinHaider, Dr Abdul Qadeer Khan, Prof DrMD Shami, Justice Fazl-e-Ghani Khan,Engr Muhammad Adil Usman, Cdre (r)Salim A Siddiqui and Provincial Secre-tary Education.

The parliament cannot make laws that arerepugnant to the constitution. This was the chiefjustice the other day, speaking at a students’function in Islamabad. Not a problematic

statement, if taken out of context. If simply any law wereto be kosher, it would lead to majoritarianism, which is ananathema to the spirit of democracy. And even if a lawwere to be repugnant to the constitution, before it were tobe struck down, the constitution will usually takeprecedence over it. The way simple acts of parliament takeprecedence over regulations.

But it is not that simple. No statement is made in avacuum. The clash between the parliament and thejudiciary is very real and any and all statements made bythe leaders of either side are going to be mined for thesignificance therein. One cannot help but interpret theadversarial tone in the statement.

The fact of the matter is that if the parliament cannotdraft any law on account of it clashing with theconstitution, it can go ahead and amend the latter.Determining whether an act of parliament actually clasheswith the constitution in the first place is subject to theinterpretation of the Supreme Court.

The interpretative powers of the courts are large. Yes,it would do the parliament a whole lot of good to realisethat the sharper, tighter and clearer the legislation, thelesser that interpretative power is going to be but the courtcan still get away with a lot.

The idea is to take one’s work seriously but never totake oneself seriously. All institutions form the patchwork,the magical mix, that goes on to make countries smoothlyfunctioning democracies. No institution, not the judiciary,not the armed forces nor the political government, shouldnurture a messiah complex; that is usually the start of asob story. But, it is still important to realise that there is apecking order here. One that places the parliament at thetop. Some institutions may derive their bravado from theguns they wield, others from their right to decree. But it isonly the parliament and political government that derivesits power from the people themselves.

Cyberspace: the new battleground

he media debacle that unfoldedduring the last couple of weeks isnot unique to Pakistan; it has al-

ready rocked the West. Rupert Murdochand his media empire are under the gunin UK for the phone hacking scandal andreporting practices. During the secondIraq war, the credibility of the Americanmedia was questioned for not asking theright questions. Then came the Wik-iLeaks phenomena, the repercussions ofwhich are still being felt. As the reputa-tion of mainstream media got hit, alter-native sources of information gained instatus.

The connection between powerful in-dividuals and media is nothing new. In-ternational actors spent huge sums toprotect their image and influence themessages that reflect on them. The bot-tom line is, in the information age, media

has become a tactical and strategicweapon. It is used to shape perceptionsthat ultimately are instrumental in devel-oping pubic opinion.

For example, consider this reportthat indicates nearly one third ofAfghanistan’s media is either backed byIran financially or through providingcontent. Afghanistan’s National Direc-torate of Security had earlier alleged Iranwas funding weekly Ensaf, as well asTamadon and Noor TV channels. It wasfurther suspected that Iran might alsohave Afghan MPs on it pay roll, with 40of the 249 members receiving fundingfrom Iran. "What Iran wants, what theyare striving at, is a power base inAfghanistan that can counter Americaninfluence," said a senior government of-ficial.

What constitutes media has changedover times as well, and it’s no longer justthe print and the traditional electronicmedia. Modern communication technolo-gies and social media such as Facebook,Twitter and YouTube have been added tothe list and are playing a key role.

For instance, in the Arab awakening,WikiLeaks acted as a catalyst in ignitingthe resentment and discontent that ex-isted within the Arab society. The leakeddocuments reinforced the perceptionswidely held by the public about their du-plicitous rulers and elite. On the otherhand, with tools like Facebook and Twit-ter, people were able to vent their anger,organise and maintain the much-neededmomentum, as seen in Tahrir Square.

They empowered the otherwise power-less citizens of these countries to becomevoluntary reporters and spies in thismodern day information warfare. The vi-tality of social media has increased tosuch an extent that UN wants to classifyaccess to the internet as a basic humanright.

However, these modern tools havenot been able to generate leadership totake charge of the movement it has in-spired. Thus, while the social media hashad a galvanising influence and in pro-viding the initial momentum, it has adangerous side effect of not preparingpeople for the day after. Despite theselimitations, the social media tools ap-peared to be tremendously successful inbringing about regime change but consti-tute a threat to the forces of status quo.

With increasing dependence on In-ternet, protecting the infrastructure andnetworks that facilitates these informa-tion-based transactions to occur in thecyber space, has emerged as the most im-portant arena of the future warfare. TheUS and the West are spending big buckstowards beefing up cyber security, to pre-vent not only the extremists from exploit-ing the vulnerabilities, but to also protectagainst industrial espionage from coun-tries like China.

In June 2011, Defense SecretaryPanetta had commented, “The next PearlHarbor we confront could very well be acyber attack that cripples our power sys-tems, our grid, our security systems, ourfinancial systems, our governmental sys-

tems.”With cyber attacks becoming increas-

ingly frequent against government net-works, last year President Barack Obamaapproved guidelines that determine theparameters of the military responseagainst the perpetrators of a cyber attackor espionage. According to this strategy,US will consider the use of conventionalweapons.

Meanwhile, Li Shuiseng, a researcherat the leading military science academyof the People’s Liberation Army, stated inan interview at the time the new strategywas “fundamentally an attempt of the USto maintain its unparalleled global mili-tary superiority."

The allegations by the analysts cameafter Google accused Chinese officials ofattempting to hack Google email ac-counts relating to US officials, govern-ment offices, politicians, journalists andactivists - a claim denied by China. In-stead, Beijing asserts that America isusing online tactics to bring about regimechange in Arab nations and claims it hasevidence that the cyber assaults origi-nated in the US.

Some recent examples of cyber war-fare have come in the form of ‘Stuxnet’and ‘Flame’ viruses that were deployed byUS and Israel against Iran. While Stuxnetimpeded Iran’s progress towards acquir-ing nuclear capability, Flame reportedlywas used to map and monitor Iran’s com-puter networks. Flame virus has an ex-traordinary data snatching capability andcan eavesdrop on unsuspecting computer

users by manipulating its audio systemand listen to office conversations andSkype calls.

One can discern the following pat-terns from the above discussion. Withthe control of local governments, inter-national actors and powerful individualson the mainstream media, it is increas-ingly seen as preserving the status quo.On the other hand, social media is sup-porting the cause of those seekingchange. In this atmosphere, alternativesources are increasingly bringing out theshocking truth. And, as they do, it fur-ther erodes trust in the traditionalsources of news and information. Mean-while, the reporting business itself ischanging when Twitter provides 24hours coverage of the raw ground realityin different languages, to whom it mayconcern. While the forces of change maywant to keep the Internet switch on, theforces of status quo will like to have theability to turn it off.

In this context, the Mediagate in Pak-istan is just a tip of the iceberg. Theglobal trends that are impacting the in-formation and cyber warfare will ulti-mately have an impact in Pakistan aswell. The struggle for access to informa-tion and knowledge, and being able tocontrol and influence it, continues on likenever before.

PPP’s human shieldsthe game hasn’t even begun yet

As far as human shields go, there isonly so much they can do. Keep-ing that in view, former PM Gi-lani did more than his part instanding by the president of Pak-

istan. Mr Gillani had to fall. From the PPP’sperspective, taking the hit was precisely thepoint. So no one in the PPP — or for that mat-ter no student of politics with enough realismand cynicism — was shocked when Mr Gilaniwas disqualified. The fact that the timing ofthis suits the PPP more than any other stake-holder or power broker is a no-brainer.

Now you can either be naively moralisticabout such things, which at some level I ad-mire, or you can be mature and skeptical.People often see their politics through amoral lens. This does not necessarily maketheir positions or justifications better — itjust makes people feel better about them-selves. The moral stance comes first and thereasoning is somehow tailored to accommo-date a more base approach. Some of us admitit and others don’t. If you don’t believe this,read The Righteous Mind: Why Good Peopleare Divided by Politics and Religion byJonathan Haidt.

Taking a moralistic approach to Gilani’sremoval will of course allow many to assumethe moral high ground. How could a PM floutthe orders of the highest court in the land?This was a fundamental issue of accountabil-ity for many. The higher the office, thegreater the power. The greater the power, thegreater the responsibility. Spiderman andOptimus Prime told us that and now so hasthe Supreme Court. Being a superhero has itsappeal.

Those at the other end of this debatemight argue that the contempt ruling neverreally, or at least meaningfully, engaged withthe question of the immunity of the presi-

dent. The Swiss prosecutor made statementssupporting the stance of Mr Gilani. Somemight argue that the SC cleverly skirted theissue of immunity by becoming hell bent onenforcement of one particular order.

Allegations of corruption against politi-cians in Pakistan are more effective when notproven. Lack of accountability and allega-tions to that effect go with it. The argumentcould go on: Supreme Court took on politi-cians and a party that is not popular with themedia or the army so forget about jurispru-dential advances — this is about appearances.This argument isn’t necessarily valid but de-serves contemplation.

The initial contempt ruling left the ques-tion of disqualification open but through anew petition the Court turned the office of theSpeaker of the National Assembly into a post-office and seemed to be saying, “disqualifica-tion was never really an open question.” Inthe SC’s defence, the bench that convicted MrGilani of contempt limited itself to the nar-row issue of contempt and left the issue ofdisqualification to be played out. But, ofcourse, others might argue that the SC knewthat the disqualification issue would comebefore it and it wasted no time in taking thatup. It made the most of the opportunity. Orhas it? Has the apex court, despite whatmedia frenzy indicates, handed the PPP whatit will cherish most close to an election, i.e. awound the party can show off to win greatsympathy? For the PPP, the battles and liveslost are opportunities—not catastrophes.

The PPP can now turn around and raisemany questions: why this obsession andfocus on the case of one man, i.e. Mr Zardari,when hardly anything has improved in the ju-dicial system that affects the common man.The SC is not the only court in this countryand without prejudice to the suo moto ac-tions it is not the court of first instance for anoverwhelming number of litigants in thiscountry. What do they gain from such focuson one case? Another question: has the armyand intelligence high command not beenguilty of contempt of court? Think aboutcases of missing persons or even Mush’sEmergency. Will corps commanders, armychiefs (past and present) and spy masters beremoved and punished? Or is our collectivedamnation limited to politicians? Are thewomen and minorities in this country anymore secure because of judicial activism? Isjustice more readily available to the ordinarylitigant who has spent crushing hours andhard earned money to pursue his claims be-

fore the lower courts? I am not, categorically not, endorsing the

PPP. I am trying to analyse where this debatemight lead and who might gain more. Thatdoesn’t mean I support the gains or losses.But these are issues we must think aboutsince they are often presented to us in waysfar too simplistic. They hardly ever are.

As the new PM enters his office, calcula-tions may already have been done. What willthe PPP gain by now writing the letter to theSwiss authorities? Nothing. So why not con-tinue to play hardball? Doesn’t mean I sup-port that position but it wouldn’t be anirrational call in politics. So they lost a PM inthe process but will they abandon the stance?They might gain huge sympathy especially ifthey use the right rhetoric. Losing one ormany PMs might be worth it if it means an-other five years in power. Will we now have aline of PMs being tried for contempt and thendisqualified? If that happens then it is notjust the PPP that might suffer embarrass-ment. In fact, just to mock the issue, what ifthe PPP says to the SC, “okay, let’s play hard-ball now. Let’s see how far you can go withfiring our prime ministers.” The commonman in constituency based politics is hardlylikely to view the PPP as corrupt and the SCas the messiah since justice has hardly im-proved at the grassroots level.

And how much more evidence will thencome forward regarding Dr Arsalan Iftikhar,and at what juncture, if the SC takes on thearmy and intel chiefs regarding the missingpersons and extra judicial killings? The lesseager the SC is in pursuing cases involvingthe army and intelligence agencies, thestronger the case for the PPP that it has beensingled out. In an election year, that is musicto the party’s ears.

Political cases are hardly ever only aboutthe rule of law. They relate to and reveal per-ceptions held by the actors involved — oftenof their own role in the present day and his-tory. “Rental Raja” is not a flattering choicebut why pick a strong man if he is only to bea human shield? If being the targets of vic-timisation is what has served the PPP histor-ically, then the scorecard might read like this.PPP Opponents: 1, the PPP: 0—but wehaven’t even arrived at the game yet. So be-ware.

The widespread criticism of Raja Pervaiz Ashraf'selection as the new prime minister, especially on socialmedia by the pseudo-intellectual advocates of democ-racy, is an inconsistency in itself. These self proclaimedexperts on politics blame all evil on the absence ofdemocracy, but fail to see the contradiction in their ownstance when they criticise Raja Pervaiz Ashraf’s appoint-ment on vacuous grounds. What is undemocratic aboutan elected member of parliament, qualified as such bythe constitution, being elected as the prime minister?

Political parties claiming to be frontrunners intheir own 'imaginary' struggle for restoration ofdemocracy are devoid of any trace of democratictrends within their parties. Office bearers are notelected but nominated, that too mostly from among

the family that 'owns' the party. Decisions are imposedupon the members and not discussed with them andwhen the party is in government, policies are madeoutside the parliament.

Then there is our esteemed lawyer fraternity. Theyproudly claim to have run a 'historic' movement tostrengthen the pillars of democracy: independence of ju-diciary and rule of law. And now they appear in agree-ment over the issue that anyone who brings a caseagainst a 'fraternity favourite' should not have the rightto be represented by council, and if a lawyer dares pro-vide them this fundamental right he should be banishedfrom their ranks. When it comes to the so-called heroesof the lawyer community, no adjudication is required -they can pronounce anyone guilty or not guilty on their

own. So this is the demented form of rule of law theystrived for?

We all have our own flawed concepts for notions ofdemocracy, rule of law and the like. It is likely that in aprocession of a 100 men all chanting for democracy,each one has a different picture of democracy in hishead. We want everything to be according to our ownindividual preferences; a prime minister that 'I' like, acourt decision that 'I' agree with and a law that suits myindividual needs. These trends are fundamentally dicta-torial and not, by any stretch of the imagination, demo-cratic. Are we a nation of wolves pretending to be lionsand asking to be governed like sheep?

I would like to ask him whatabout his own treatment as a PM waswhen his party coworkers attacked theSC and then the former CJ Sajjad AliShah had to leave unceremoniously.What about the role of a former judgewho was later awarded with the presi-dential post who took the chamak toBalochistan to divide the apex court?

It is a general perception that thePML(N) was more active in restoringthe judiciary to wash away its past sinalthough the PPP lost more workerswhile demanding the restoration andits leader Aitzaz Ahsan was one of theleaders of Lawyers Movement, (nowdiscredited by the section of lawyers).

A question that one is forced to askis why is the judiciary not prepared to

wait till President Zardari completeshis terms and then ask the governmentto write a letter to the Swiss Authori-ties to open cases against him as then aPM will not have to breach the consti-tution as was claimed by the formerPM Gilani because Article 248 clearlyprovides immunity to the presidentand governor. Why has the judiciarybeen so blatantly against PPP leaders?Shouldn’t they try not to be primarilyin the interest of justice but also par-ticularly because the sentencing of PPPfounder Zulfikar Ali Bhutto in 1979 isnow accepted by all to be a judicialmurder?

Why is an impression being createdby the judiciary itself that it is biased?Why did the CJ not show any restraintwhile taking a decision about the dis-qualification about Yousaf Raza Gilani?

How many PMs will be disqualifiedand how many will be elected by theparliament in the next eight months isthe question every thoughtful Pakistaniasks. Who will be the ultimate winneror loser? As they say, only time willtell.

The forth problem is computer gen-erated calls from help lines of mobilecompanies enticing you to subscribe fordifferent schemes. These calls not onlywaste time, but also leave most of peo-ple angry for disturbing them as thesecalls are being made without the per-mission of the subscribers.

Last but not least, bumper offers towin a car or similar luxurious prizes onusing certain amount of balance in stip-ulated period of time has given impetusto many con artists in society whobadger you through your phone and tryto wring you out of phone credit.

The above horrendous situationcalls for immediate remedial action onpart of PEMRA to save time and moneyof billions of Pakistanis.

tional Database and Registration Author-ity (NADRA) was introduced whichlaunched the Multi-Biometric NationalIdentity Card. However, it seems that theauthority has been incompetent in usingthis new technology.

I came to this conclusion recentlywhen two of my acquaintances, who aretwins, applied for their CNIC and theirapplication got rejected in the verifica-tion and clearance process, on the basisof a ridiculous objection which said: “Un-natural age difference between twotwins.”

I would request NADRA to pleaserectify such errors in their system imme-diately, as obtaining or renewing one’sCNIC is already a tedious task.

BoheMIA AnD ChAKWAL gRoUP: This is a

love song written by Aziz Lohar, a

contemporary of the Chakwalis who hailed

from village Shah Khushi near Kalar Kahar in

Chakwal. There is little information available as

to the date it was written and no written

records of the poet Aziz Lohar. A fusion

between contrasting tragedies of love; One

referring to spiritual love, sung by the

Chakwali's in a joyful manner and the other

relating to people who are lost in the material

realm, performed by Bohemia.

KANDYAARI DHOL gEET

hAMAyoon KhAn: This is a famous Pashto

folk song which was tied together with

another folk song with a similar theme. ‘Tora

Bahraam Khaana’ is a love song sung from a

woman to her beloved. Her beloved, Bahram

Khan, has a very dark complexion – and not

considered handsome by conventional ideals

of beauty, however, that is of very little

significance to the girl and she sings about

how much she cares and loves Bahram Khan.

This song was tied together with another folk

song in which a man is singing to his beloved

who is very dark but he doesn’t care and will

continue to love her. Like Larsha Pekhawar

Ta, Tora Baram Khanna includes Pashto

couplets known as tappas.

TORA BAHRAAM KHAANA

ATIF ASLAM: This song

was supposed to be on

one of Aslam’s albums

but he wanted to do it

for Coke Studio. The

song talks about Aslam’s

journey. He writes about

the idea of searching for

someone and turning to God in pain of separation

from his beloved. In the song Atif writes that the

beloved returns but the person doesn’t need them

anymore because he has found God and needs

nothing else. Aslam decided to include a section

from 'Shaana Uchiyan' the renowned qawali

performed by Nusrat Fateh Ali Khan. He felt the

qawali would help bring out the idea of searching for

God and add a higher spiritual dimension to his

music. A track created upon cyclic rhythm layers,

which evolve through shifting accents while the

underlying rhythm remains unchanged.

DHOLNA

UzAIR JASWAL: was

written in late 2011 and is

very different from Jaswal’s

other songs. Most of his

compositions are sad and

mellow and Jaswal wanted

to do something that would

appeal to people his own

age. ‘Bolay’ just came to him in a burst of creativity.

He was asked to send a few demos for Coke Studio

and wanted to include a faster track along with his

mellow ones. The song represents the freedom, love

and a carefree sense of life when you’re young –

one that Jaswal hopes will touch the youth at the

heart. A light-hearted track that inspired Coke

Studio to use a typical eastern folk-beat as its fusion

rhythm base.

RUNgFAReeD AyAz AnD ABU MUhAMMAD: This is a

Kalaam written by Amir Khusro in his early years.

Though there is no evidence to prove this, it is said

that Khusro was inspired to write the kalaam after he

met his pir Nizamuddin Auliya. This version of Rung is

considered to be the closest to the original rendition by

Amir Khusro. It has been featured this season along

with Hadiqa Kiyani's version to show the similarity and

contrast between two very different versions of the

same Qawali. One reason why traditional music

continues to survive today is because of its evolution in

time. By featuring two different versions of Rung in

one season, this point is highlighted and

experimentation with traditional music is encouraged -

provided the essence of the original is not sacrificed.

An earthquake hit a mountainous area of south-west China on Sunday, killing at least four peo-ple and injuring more than 100, state mediareported.

The US Geological Survey (USGS) said thequake had a magnitude of 5.5 and struck theborder between the provinces of Sichuan andYunnan just before 4:00 pm (0800 GMT), at ashallow depth of just 9.3 kilometres (5.8 miles).The Chinese government put the magnitude ofthe quake at 5.7. It was followed two minuteslater by an aftershock of 3.3, the China Earth-quake Network Centre said.

The quake toppled houses and cut off com-munications with parts of Ninglang county in

Yunnan, the official Xinhua news agency said.The tremor killed three people in Ninglang whileanother one was reported dead in neighbouringYanyuan county in Sichuan. A total of 104 wereinjured in the quake with 20 in serious condition,Xinhua said, quoting local authorities.

Yunnan provincial authorities had sent re-lief supplies to Ninglang, where the quake wasstrongly felt, including 1,100 tents and 3,000quilts, it said. The province had also sent ateam to the area. An official in the historic cityof Lijiang, which administers Ninglang, toldAFP it was too early to have detailed estimatesof casualties and damage. Separately, aYanyuan county government official wasquoted by Xinhua as saying that “many”houses in rural areas had collapsed, but hegave no figure.
