MINUTES OF THE August 22, 2018 CONSTRUCTION CONTRACTORS BOARD MEETING

The Construction Contractors Board (CCB) met on Wednesday, August 22, 2018, in the Hearings Room on the 1st floor at 201 High Street SE, Salem, Oregon.

Attendees: Board members appearing in person: Board Chair Jim Kitchin, Kurt Bolser, Jim Patrick, Susan Steward, Eric Olson, Patty Dorroh and Andrea Noble

A. MEETING CALLED TO ORDER:

Chair Kitchin called the meeting to order at 9:30 a.m.

B. APPROVAL OF AGENDA:

MOTION: Jim Patrick moved to approve the agenda. Patty Dorroh seconded the motion.Motion to approve the agenda carried unanimously.

C. APPROVAL OF MINUTES:

MOTION: Kurt Bolser moved to approve the June 27, 2018 minutes. Jim Patrick secondedthe motion. Motion to approve the minutes carried unanimously.

D. DATE OF NEXT REGULARLY SCHEDULED MEETING: The next meeting isscheduled for October 24, 2018 in the Hearings Room on the first floor at 201 High Street SE,Salem, Oregon.

F. AGENCY REPORTS:

Agency UpdateRemmal Nivens, Interim Administrator wanted to thank staff at the CCB for holding thingsdown while he was out of the office in July. The Agency Requested Budget (ARB) wassigned and submitted. This is the start of the budget process for the 2019-2021 biennium.

The House Business and Labor Committee put together a workgroup to discuss issues related to unpaid wages and contracting. Mr. Nivens will participate in the group, as will Bureau of Labor and Industries (BOLI).

Licensing Laurie Hall, Licensing Manager advised licensing statistics continue to slowly go up. We are closer to the peak that was reached before the recession in 2008.

Business Services and Information Technology Dana Zeimantz, Business Services Manager advised that revenues have exceeded expenses as has been the trend. The Agency Requested Budget (ARB) was submitted and is awaiting recommendations from the agency budget analyst. The budget was based on our revenue projections that keep licensing fees at $250, with a renewal rate of 83%. Projection of agency expenses will be covered in the ARB and no additional funds were requested. There is an open recruitment for Leslie’s Executive Assistant position.

Education Leslie Culpepper, Communication/Education Manager advised that agency outreach will be in 10 cities. The schedule includes all of the home shows attended last year. The fall schedule will be on the light side as Ms. Culpepper continues to transition into the Communication/Education Manger role but by spring the schedule should be full. NW Natural Gas will be attending some of the classes. The 2nd edition of the manual was released in Mid-August.

Enforcement Stan Jessup, Enforcement Manager advised that the board memo briefly discusses the Key Performance Measures (KPM’s). The enforcement section is responsible for 7 out of the 10 KPMS. There is continued improvement and significant progress on them. Sweep plans for the Field Investigators are planned through the end of the year. Also included in the packet are the Quarterly reports for all 3 sections; Dispute Resolution, Enforcement and Field Investigations. Board Member Steward had a question related to determinations. Mr. Jessup explained how the process works. Board Member Noble wanted to know about the staffing levels in enforcement and was advised that staffing is currently at 100%. In addition the board asked questions about a couple of outstanding cases the agency is involved in. Mr. Jessup provided updates on those as well.

G. OLD BUSINESS:

Administrative Rule Changes

MOTION: Jim Patrick made a motion to amend OAR 812.003.0100, 812.003.0200,812.003.0280 and 812.003.0320. Andrea Noble seconded the motion. The motion carriedunanimously.

MOTION: Andrea Noble made a motion to amend OAR 812.003.0152 and 812.003.0153.Kurt Bolser seconded the motion. The motion carried unanimously.

MOTION: Kurt Bolser made a motion to amend OAR 812.022.0025. Eric Olson seconded the motion. The motion carried unanimously.

AAG McCracken called for a recess to call the Secretary of State Rules Division for some clarification regarding the effective date of HB4144. Meeting adjourned at 10:13am and was back in session at 10:26am.

MOTION: Andrea Noble made a motion to amend OAR 812.003.0131, 812.003.0142, 812.003.0260, 812.006.0100, 812.006.0150, 812.006.0450 and to adopt OAR 812.006.0162 effective January 1, 2019. Jim Patrick seconded the motion. The motion carried unanimously.

Reciprocity with other states/NASCLA Residential Exam

Remmal Nivens Interim Administrator discussed a letter from the State of California requesting reciprocity. This letter was discussed at the last meeting and Mr. Nivens advised that there is no additional update at this time.

H. NEW BUSINESS:

Enforcement Consent Agenda June 9-August 6th, 2018

MOTION: Jim Patrick made a motion to approve the Notices of Intent minus file 119874.Kurt Bolser seconded the motion. The motion carried unanimously.

MOTION: Jim Patrick made a motion to approve Notice of Intent file 119874. Eric Olsonseconded the motion. The motion carried unanimously. Andrea Noble abstained.

MOTION: Jim Patrick made a motion to approve the Final Orders. Susan Steward secondedthe motion. The motion carried unanimously.

Key Performance Measures

Ms. Culpepper discussed the Key Performance Measures with the board. KPM 10 is the KPMthat pertains specifically to Boards and Commissions. The board must vote to approve KPM10, if they agree with the assessment outlined in the board packet.

MOTION: Kurt Bolser made a motion to approve Key Performance Measure items 1-15,Susan Steward seconded the motion. The motion carried unanimously.

Additional Question/Comment

The Board inquired about the recruitment process for the new Administrator. Mr. Nivensadvised that he would reach out to DCBS to find out how to move forward with the processon hiring a new administrator.

Cut back except for extreme cases you can't protect everybody [illegible] [illegible] good intentions

I did not realize that home inspectors do not need continuing ed thru CCB. My original renewal letter said that electricians, plumbers, engineers

and architects do not need CE. I finally saw the home insp exception after paying for 13 hrs of credit

The test for subcontractor should contain information pertinent to their specialties

I wish you could make changes and still renew online, that would be more convenient for when we will need to make changes in the future.

To: Construction Contractors Board From: Leslie Culpepper, Communications and Education Manager Date: October 9, 2018 Subject: Outreach and Education Program update

Communications/outreach: This is a busy time of year for the education section. With 5 outreach events in September and 6 events in October, plus a full schedule of live CCB classes, we’re connecting with contractors and homeowners at every opportunity.

In addition to the usual lineup of senior fairs, scam jams and home shows, we’ve signed up for several new events, including the Oregon Assocation of Realtors Fall Convention in Eugene.

Over time, we’d like to develop a partnership with realtors, because they have first contact with new homeowners and often help them navigate home repair issues that arise during real estate transactions. Through our connections with realtors, I’m hoping we can educate homeowners about the consumer protections offered by the Construction Contractors Board.

Continuing education: We’ve recently partnered with folks at 811 and Northwest Natural Gas to speak at our CCB courses. 811 and NW Natural Gas representatives will educate contractors about Call Before You Dig services.

CCB regularly partners with OSHA, local building officials and other government agencies to keep contractors aprised of issues relating to safety, current laws and issues related to running a small business.

Some contractors attend our in-person classes again and again, so we’re always on the lookout for new speakers. This helps us keep content fresh and useful for contractors.

The Enforcement section has had significant success with new application screening that is now a year old. There are two Compliance Officers assigned to reviewing applications for current construction debts, judgements, worker’s compensation verification and former license issues. A significant number of license applications have been found to have problems that have been resolved prior to issuing a license.

We have been cross training staff for several months in anticipation of the current and future changes. This allows for a smooth transition while also giving CCB the ability to implement process improvements at the same time with minimal disruption.

My philosophy has always been one of cross training, which I believe opens opportunities for staff to learn new things and as an added benefit staff is well positioned to fill openings when the opportunity presents itself.

The Field Investigation Section has completed three sweeps since August covering Eastern Oregon, Lane County and the southern Oregon coast. These sweeps involve several investigators canvassing targeted areas looking for unlicensed contractors and other violations of contracting laws and rules.

The proposed rules eliminate the use of the 1987 Standard Industrial Classification (SIC) codes to determine whether a contractor is a general contractor or a specialty contractor. Draft rule language is attached. The target effective date for these rules is January 1, 2019.

ISSUE: Historically, the Construction Contractors Board (CCB) was concerned that general contractors were licensing as specialty contractors (or residential limited contractors) to avoid the costs of larger bonds and insurance. Under ORS 701.005(7), a general contractor is a contractor who supervises or performs more than two unrelated building trades or crafts.1 A specialty contractor can perform no more than two unrelated building trades or crafts.

The CCB adopted a rule to define the phrase “building trades or crafts” using the 1987 Standard Industrial Classification (SIC) Manual.2 The CCB has not used the SIC codes in many years. The definition in OAR 812-002-0100 is not necessary to implement ORS 701.005(7). The phrase “building trades or crafts” contains common terms.

SOLUTION: Repeal rules that incorporate the SIC codes.

ACTION: Repeal OAR 812-002-0100; 812-003-0120(2)(h); 812-003-0260(1)(i). Renumber sections as necessary.

[812-002-0100 Building Trades or Crafts

“Building trades or crafts”, as used in ORS 701.005(7)(a) and these rules, means the following special trade contractors as defined by the four-digit codes in the 1987 Standard Industrial Classification Manual:

(1) Building trade contractors including:(a) 1711 – Plumbing, Heating and Air Conditioning.(b) 1721 – Painting and Paper Hanging.(c) 1731 – Electrical Work.(d) 1741 – Masonry, Stone Setting and Other Stone Work.(e) 1742 – Plastering, Drywall, Acoustical and Insulation Work.(f) 1743 – Terrazzo, Tile, Marble, and Mosaic Work.(g) 1751 – Carpentry Work.(h) 1752 – Floor Laying and Other Floor Work.(i) 1761 – Roofing, Siding and Sheet Metal Work.(j) 1771 – Concrete Work.(k) 1791 – Structural Steel Erection.(l) 1793 – Glass and Glazing Work.(m) 1794 – Excavation Work.(n) 1795 – Wrecking and Demolition Work.(o) 1796 – Installation or Erection of Building Equipment Not

Repeal rule.

This rule defines the phrase “building trades or crafts” as used in ORS 701.005(7)(a) to refer to certain trade contractors defined by the 1987 Standard Industrial Classification (SIC) Manual. While SIC codes are still widely used, the North American Industry Classification System (NAICS) was established in 1997 to replace the no longer sufficient SIC system. It was developed in coordination with statistical agencies of the United States, Canada and Mexico. NAICS establishes a North American Standard that allows for a high level of comparability in business statistics among the three countries. The most current version of the NAICS is contained in the 2017 NAICS manual.

The CCB has not used the SIC codes in many years. The definition in OAR 812-002-0100 is not necessary for ORS 701.005(7). That statute uses the words “building trades or crafts.” These words have commonly accepted meanings.

812-003-0120License Required to Advertise

(1) No person shall advertise or otherwise hold out to the publicthat person's services as a contractor unless that person holds a current, valid license, nor shall any person claim by advertising or by any other means to be licensed, bonded, or insured unless that person holds a current, valid license.

(2) License number in advertising and contracts:(a) All newsprint classified advertising and newsprint display

advertising for work subject to ORS chapter 701 prepared by a contractor or at the contractor's request or direction, shall show the contractor's license number.

(b) All written bids, written inspection reports and buildingcontracts subject to ORS chapter 701 shall show the contractor's license number.

(c) All telephone directory space ads and display ads shall showthe contractor's license number.

(d) All advertisements by audio-only media, such as radiocommercials, must contain an audible statement of the contractor’s license number.

(e) All advertisements by video media or video and audiocombined media, such as television commercials, must show visually the contractor’s license number.

(f) All advertising by internet media, including but not limited to,website advertising must show visually the contractor’s license number.

(g) All business cards, business letterhead, business signs atconstruction sites and all other written or visual advertising shall show the contractor's license number. Written or visual advertising does not include permanently affixed or attached signs at a contractor’s place, or places, of business that primarily and prominently display the contractor’s name.

[(h) This section does not apply to a company whose primary business is other than construction and has a Standard Industrial Classification (SIC) code from other than Major Groups 15, 16, and 17.]

[(i)] (h) This section does not apply to promotional gifts, including, but not limited to, pencils, pens, cups and items of clothing.

(d) Except for a public company, the date of birth and driverlicense number or number associated with United States government-issued identification of:

(A) The owner of a sole proprietorship;(B) All partners of a general partnership or limited liability

partnership; (C) All joint venturers of a joint venture;(D) All general partners of a limited partnership;(E) All corporate officers of a corporation;(F) All trustees of a trust;(G) The manager and all members of a manager-managed limited

(J) For purposes of this subsection, a “public company” means anybusiness entity that offers securities registered for sale by the federal Securities and Exchange Commission to the general public.

(e) Social security number of the owner of a sole proprietorship orpartners, if partners are human beings, in a general partnership;

(f) Class of independent contractor license and employer accountnumbers as required under OAR 812-003-0250;

(h) The driver license number or number associated with UnitedStates government-issued identification of the responsible managing individual who has completed the education and passed the examination required under ORS 701.122 or is otherwise exempt under division 6 of these rules; [(i) The Standard Industrial Classification (SIC) numbers of the main construction activities of the entity;] [(j)] (i) Names and certification numbers of all certified locksmiths if the entity is a Residential Locksmith Services Contractor or will do work providing locksmith services under ORS 701.475 to 701.490; [(k)] (j) Names and certification numbers of all certified home inspectors if the entity will do work as a home inspector under ORS 701.350; [(L)] (k) Names and certification numbers of all certified home energy assessors if the entity is a Home Energy Performance Score Contractor providing home energy performance scores under ORS 701.527 to 701.536 or will do work providing home energy performance scores. [(m)] (L) For each person described in subsection (1)(c) of this section, the following information if related to construction activities:

(A) If unsatisfied on the date of application, a copy of a finaljudgment by a court in any state entered within five years preceding the application date that requires the person to pay money to another person or to a public body;

(B) If unsatisfied on the date of application, a copy of a final orderby an administrative agency in any state issued within five years preceding the application date that requires the person to pay money to another person or public body;

(C) If pending on the date of application, a copy of a courtcomplaint filed in any state that alleges that the person owes money to another person or public body; or

(D) If pending on the date of application, a copy of anadministrative notice of action issued in any state that alleges that the person owes money to another person or public body. [(n)] (m) For each person described in subsection (1)(c) of this section, the following information if related to construction activities;

(A) A copy of a judgment of conviction for a crime listed in ORS701.098(1)(i), entered within five years preceding the application date; or

(B) A copy of an indictment for a crime listed in ORS701.098(1)(i), entered within five years preceding the application date.

(C) In addition to documents required in paragraphs (1)[(l)](m)(A)and (B) of this section, copies of police reports, parole or probation reports indicating parole or probation officer’s name and phone number, and letters of reference. [(o)] (n) Independent contractor certification statement and a signed acknowledgment that if the licensee qualifies as an independent contractor the licensee understands that the licensee and any heirs of the licensee will not qualify for workers' compensation or

unemployment compensation unless specific arrangements have been made for the licensee’s insurance coverage and that the licensee’s election to be an independent contractor is voluntary and is not a condition of any contract entered into by the licensee; [(p)] (o) Signature of owner, partner, joint venturer, corporate officer, member or trustee, signifying that the information provided in the application is true and correct; and [(q)] (p) For licenses obtained pursuant to Oregon Laws 2018, chapter 46, sections 1 and 2, and OAR 812-006-0162, forms prescribed by the agency that document and verify qualifying work experience.

(2) A complete license application includes but is not limited to:(a) A completed application form as provided in section (1) of this

rule; (b) Except as otherwise provided, the new application license fee

as required under OAR 812-003-0142; (c) A properly executed bond, letter of credit or assignment of

savings as required under OAR 812-003-0152, 812-003-0153, 812-003-0154 or 812-003-0155; and

(d) The certification of insurance coverage as required under OAR812-003-0200.

(3) The agency may return an incomplete license application to theapplicant with an explanation of the deficiencies.

(4) All entities listed in section (1) of this rule that are otherwiserequired to be registered with the Oregon Corporation Division must be registered with the Oregon Corporation Division and be active and in good standing. All assumed business names used by persons or entities listed in section (1) of this rule must be registered with the Oregon Corporation Division as the assumed business name of the person or entity using that name.
